Abstract

The development of digital technology has reconstructed the pattern of social interactions among the younger generation, particularly Gen Z, who are increasingly influenced by identity representation through social media platforms such as TikTok. This platform no longer functions merely as a means of entertainment but has evolved into a space for identity production and social standardization, including in defining criteria for life partners. This study aims to examine how partner standards formed on TikTok are understood and negotiated by students of the 2022 cohort of the Islamic Family Law Study Program at UIN Raden Intan Lampung, from the perspective of Maslahah mursalah. Using a descriptive-analytical qualitative approach through questionnaires distributed to 91 respondents, the study finds that although TikTok provides an initial influence in constructing perceptions of the ideal partner, final decisions are filtered through religious values, morality, and the principles of maqasid al-shariah. TikTok serves only as a secondary reference, while religiosity, morality, and responsibility are positioned as primary criteria. The findings affirm that young Muslim generations possess digital literacy capacities grounded in Islamic values and are able to negotiate algorithmic standards with Sharia-based norms.

Abstract

Poligami dalam Islam sering menjadi topik perdebatan, terutama dalam konteks keadilan gender dan keharmonisan rumah tangga. M. Quraish Shihab memandang poligami sebagai rukhshah (keringanan) yang diperbolehkan dalam kondisi tertentu, dengan syarat utama adalah keadilan. Namun, dalam praktiknya, aspek keadilan ini sering kali sulit diwujudkan, terutama dalam aspek emosional dan psikologis. Penelitian ini bertujuan untuk mengkaji pandangan M. Quraish Shihab mengenai poligami serta relevansinya terhadap konsep keluarga sakinah, mawaddah, wa rahmah. Metode penelitian yang digunakan adalah studi pustaka dengan pendekatan kualitatif-deskriptif. Hasil penelitian menunjukkan bahwa relevansi keadilan poligami menurut M Qurais Shihab dengan mewujudkan keluarga yang sakinah mawadah warahmah adalah adalah apabila seorang laki-laki dapat memperlakukan istri-istrinya dengan adil sesuai kemampuannya, seperti berlaku adil dalam rasa suka yang berlandaskan akal, memperlakukan istri dengan baik, serta berlaku adil dalam hal material. Selain itu, keduanya harus menyadari peran masing-masing dalam keluarga, di mana laki-laki bertanggung jawab dalam kepemimpinan, sedangkan perempuan berperan dalam menciptakan ketenangan serta mendidik anak-anaknya. Dengan usaha ini, keluarga sakinah, mawaddah, wa rahmah diharapkan dapat terwujud, sebagaimana hasil penelitian yang dilakukan oleh Khoirul Abror (2016), yang menyatakan bahwa keharmonisan dapat tercipta salah satunya melalui faktor internal dalam keluarga itu sendiri.

Abstract

Standar Pelayanan Minimal Desa adalah ketentuan tentang jenis dan mutu pelayanan yang merupakan urusan desa yang berhak diperoleh setiap masyarakat desa secara minimal. Desa Wates masih banyak masalah yang menghambat penyelenggaraan Standar Pelayanan Minimal Desa secara optimal. Beberapa masalah tersebut antara lain adalah keterbatasan, informasi, anggaran, sarana, dan prasarana desa. Pelayanan publik memiliki peran penting dalam administrasi pemerintahan dan tata kelola yang baik. Hal ini terkait dengan implementasi Undang-Undang Nomor 30 Tahun 2014 dan Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 2 Tahun 2017 tentang Standar Pelayanan Minimal Desa. Kepala Desa, sebagai pelaksana Standar Pelayanan Minimal Desa, memiliki tanggung jawab utama dalam memastikan bahwa pelayanan yang diberikan kepada masyarakat sesuai dengan ketentuan peraturan. Rumusan Masalah : 1) Bagaimana Peran Kepala Desa  Berdasarkan Peraturan Menteri Dalam Negeri Republik Indonesia Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa Prespektif Fiqh Siyasah Tanfidziyah? 2)Bagaimana pandangan Fiqh Siyasah Tanfidziyah terhadap Peran Kepala Desa  Berdasarkan Peraturan Menteri Dalam Negeri Republik Indonesia Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa Prespektif Fiqh Siyasah Tanfidziyah? Metode penelitian yang digunakan adalah penelitian lapangan (field research) yang bersifat deskriptif kualitatif. Data yang digunakan adalah data primer yaitu data yang diambil secara langsung, dan data sekuder diambil dari Buku, Skripsi,Tesis, Disertasi, Jurnal, Berita atau artikel Online. Hasil Penelitian ini Kepala Desa Wates telah melaksanan Pasal 14(a) Nomor 2 Tahun 2017 Tentang Standar Pelayanan Minimal Desa dengan menyediakan kemudahan pelayanan administrasi untuk semua warga yang dapat diakses secara online maupun offline, dan memperbaiki dan merawat fasiltias yang ada di desa yaitu fasilitas Kesehatan, Fasilitias Digital, Serta Fasilitas umum desa lainnya. Kepala Desa Wates dalam pemenuhannya sejalan dengan tugas kepemimpinan sesuai dengan prinsip-prinsip siyasah tanfidziyah dengan memberi petunjuk dengan benar, menjalankan keadilan, dan bertanggung jawab terhadap masyarakat desa yang dipimpinnya, sesuai dengan ajaran Islam.        Kata Kunci  : Kepala Desa, Standar Pelayanan Minimal Desa, Siyasah Tanfidziyah

Abstract

This study examines the potential of zakat as an economic instrument that can enhance the welfare of the Muslim community if managed properly according to Sharia principles. In practice, zakat's collection, management, and distribution should comply with religious guidelines to be used productively as a community fund source. However, current zakat management faces challenges, such as the use of conventional banks for zakat collection, distribution that is more consumption-oriented, and a management process that is not yet effective. This research was conducted at BAZNAS in Bandar Lampung City using a descriptive qualitative approach. The results show that the use of conventional banks by BAZNAS is solely as a zakat collection medium, not as a manager, and is considered compliant with Sharia economic law, referencing Ibn Asyur's maqashid shari'ah, as it provides broad benefits. As an official zakat management institution in Bandar Lampung, BAZNAS strives to manage zakat by government regulations to improve community welfare through distribution models that include consumptive and productive empowerment approaches.

Abstract

The diversity of inheritance systems in Indonesia reflects the interaction between Islamic law, customary law, and national law. This study examines the inheritance distribution practices of the Kaur indigenous community in Bengkulu Province, which adopts a bilateral system through family deliberation. The main focus is to analyze the compatibility of these practices with the principles of Islamic inheritance law. This research employs a descriptive qualitative method based on library study, utilizing primary data from the Qur’an, Hadith, the Compilation of Islamic Law (KHI), and relevant legislation, alongside secondary data from academic literature. The findings reveal that the Kaur community distributes inheritance flexibly through consensus, granting rights to both sons and daughters without strict proportional distinctions. A contextual notion of justice is emphasized, as reflected in practices such as gilir sawah (rotational use of farmland) as a form of collective asset management. From the perspective of Islamic law, this system is not entirely aligned with the faraidh provisions, which are definitive (qath’i), particularly regarding the proportional shares between male and female heirs as prescribed in Surah An-Nisa. Nevertheless, the principles of deliberation and social balance inherent in Kaur customary practice can serve as an entry point for harmonization with Sharia. This study underscores the importance of constructive dialogue among religious scholars, customary leaders, and state institutions to formulate an inheritance model that is just, contextual, and consistent with both Islamic principles and the national legal framework.

Abstract

MUI Fatwa No. 1 of 2004 concerning Interest states that mu'amalah is not permitted using Conventional Banks because there is an Interest system in Conventional Financial Institutions and the practice of interest is haram. Fundraising zakat by BAZNAS Bandar Lampung City in practice is known to use Conventional Banks which are used in collecting zakat. This is contradictory and gives rise to speculation among the public because there is a discrepancy between the fundraising mechanism at BAZNAS Bandar Lampung City and the MUI fatwa No.1 of 2004. This research is field research with a descriptive qualitative approach. Data sources come from primary data and secondary data. The results obtained in this research are: First, the fundraising mechanism for zakat funds is carried out directly, namely muzaki go directly to the BAZNAS / UPZ office and indirectly, namely through transfers to bank accounts, including using conventional banks. This was done because of the existence of an MoU with the Bandar Lampung City Government in optimizing the collection of ASN zakat, the regulations of which are carried out by Regional Banks, and Commercial Banks are used to facilitate and target Muzakki who are not familiar with Sharia Banks, Commercial Banks are used only as a channel for zakat/UPZ (zakat collection unit), deposited and managed by Sharia Bank account. Second, the use of conventional banks in collecting zakat carried out by BAZNAS Bandar Lampung City from the perspective of sharia economic law based on findings and facts that occur in the field and based on maslahah murlah may be done because there are benefits and maslahah for many people (not problems for the interests of one group or certain individuals) and reject harm in order to maintain the goals of shara' (maqashid shari'ah)

Abstract

Pernikahan dalam Islam merupakan institusi sakral yang menuntut kesamaan aqidah sebagai dasar terbentuknya keluarga sakinah. Namun, fenomena perpindahan agama salah satu pasangan pasca pernikahan semakin sering terjadi dalam masyarakat modern yang pluralistik. Permasalahan akademik muncul ketika konversi agama tersebut tidak selalu lahir dari kesadaran spiritual, melainkan karena faktor eksternal seperti tuntutan administratif, tekanan keluarga, atau legitimasi sosial. Hal ini menimbulkan dilema, baik dari perspektif hukum Islam yang mayoritas ulama menyatakan murtad dapat membatalkan pernikahan, maupun hukum positif Indonesia yang menuntut penyelesaian perceraian hanya melalui pengadilan. Kekosongan norma inilah yang memunculkan persoalan status pernikahan, hak anak, dan keberlangsungan rumah tangga. Penelitian ini bertujuan untuk menganalisis perpindahan agama salah satu pasangan pasca pernikahan dalam perspektif hukum Islam, sekaligus mengkritisinya dengan teori Maqashid al-Syari‘ah. Dengan menggunakan metode kualitatif, jenis penelitian kepustakaan (library research), serta pendekatan undang-undang (statute approach), penelitian ini menelaah regulasi perundang-undangan, literatur fiqh klasik, dan kajian akademik kontemporer terkait konversi agama dalam pernikahan ,Namun, dalam konteks Indonesia, keputusan tersebut tidak otomatis berlaku karena harus diputuskan melalui pengadilan agama. Analisis dengan pendekatan maqashid al-syari‘ah menekankan bahwa fenomena konversi agama harus dilihat dari tujuan syariat, yaitu perlindungan agama (hifz al-din), jiwa (hifz al-nafs), keturunan (hifz al-nasl), kehormatan (hifz al-‘ird), dan harta (hifz al-mal Kesimpulan penelitian ini menegaskan pentingnya reformulasi regulasi hukum keluarga Islam di Indonesia agar lebih responsif terhadap fenomena konversi agama pasca pernikahan. Diperlukan aturan yang jelas, verifikasi motivasi yang adil, serta mekanisme mediasi berbasis maqashid untuk mencegah kerusakan sosial dan melindungi kemaslahatan keluarga.

Abstract

Normatively, there is no provision in granting a mandatory will for non-Muslims. This legal vacuum encourages the Supreme Court to grant inheritance to non-Muslims through a mandatory will. 3 (three) Supreme Court cassation decisions grant mandatory wills to non-Muslim heirs. This decision is inconsistent with Islamic law and positive law in Indonesia. The provisions of mandatory wills in KHI article 209 are only intended for adopted children and adoptive parents. Islamic law prohibits non-Muslim heirs from inheriting property from a Muslim testator. This study aims to reconstruct the mandatory will law in Indonesia. This study is a field and library research, using a qualitative approach. Data were collected through interviews with 3 (three) Supreme Court Judges who tried and decided the case. The data were supported by 3 (three) Supreme Court Decisions, namely No. 368 K/AG/1995, No. 51 K/AG/1999, No. 16K/AG/2010, and Compilation of Islamic Law (KHI), Civil Code (KUHPdt). Data analysis using Miles and Hubermen analysis. The results of the study indicate that there are no legal provisions for heirs for non-Muslims through mandatory wills in the KHI, KUHPdt or Islamic law. 3 (Three) Supreme Court Decisions that allow heirs for non-Muslims through mandatory wills are decisions that are responsive to social conditions, equality and justice in society. Therefore, it is necessary to reconstruct Article 209 Paragraph (3) of the KHI to be illegitimate children, stepchildren and children of different religions with the testator who do not receive a will are given a mandatory will of up to 1/3 of the testator's inheritance. This reconstruction can be a consideration for the government in renewing inheritance law in Indonesia
