Abstract

The COVID-19 pandemic, a globally unprecedented disease outbreak, has alarmed all governments to reconsider the importance of disaster management policies at the domestic level. At the same time, handling transboundary disasters was another challenge faced by regional organizations such as the Association of Southeast Asian Nations (ASEAN). This paper argues that this regional institution could play a strategic role but not responsively anticipate it, while further similar disasters may emerge. As a result of this pandemic, all member states tend to act more independently by closing their territories and isolating their citizens from cross-border migration. This paper aimed to examine ASEAN's existing measures to address the COVID-19 pandemic, following the importance of considering domestic policies taken by its member states to portray the possible action at the regional level. In practice, each ASEAN member state had various approaches, from strict lockdowns such as those implemented in Singapore to Indonesian policies that were far from being prepared. While COVID-19 is a non-natural disaster but has had a devastating impact on Southeast Asia, the future of regional integration is at stake. This paper shows that each member state's different social, economic, and political situations influence the absence of common practices at the domestic level to overcome this pandemic from the early outbreaks. Simultaneously, market stability in Southeast Asia was the key to regional development, whereas this pandemic harmed ASEAN's aim to meet economic integration. This paper suggested that ASEAN should establish guidelines regarding disaster management as experienced during the COVID-19 pandemic for member states' domestic policies to anticipate possible adverse episodes in the future that may hamper the integration progress.

Abstract

The Independent International Fact-Finding Mission on Myanmar (IIFFMM) released a report on August 27, 2018, documenting over 10,000 deaths and the displacement of more than 725,000 Rohingyas to Bangladesh due to "clearance operations" conducted by the Myanmar Military. These actions constitute severe violations of international human rights law, potentially amounting to crimes against humanity, for which perpetrators could face prosecution at the International Criminal Court (ICC). However, Myanmar's non-ratification of the Rome Statute presents a significant obstacle to effective enforcement. Therefore, a more robust approach is necessary to address the plight of the Rohingya ethnic group affected by these operations. This study adopts a normative research methodology employing both statutory analysis and case study approaches. The Tatmadaw's culpability in committing acts of genocide against the Rohingya ethnic group has been established. To address this, three key mechanisms are proposed: the application of the Responsibility to Protect (R2P) principle, the involvement of international governmental organizations (IGOs), and the pursuit of justice through ICC proceedings. Urgent action is required to ensure accountability for those responsible for genocide, particularly high-ranking Tatmadaw officials, thereby preventing impunity from perpetuating.

Abstract

Pembunuhan terhadap jurnalis Jamal Khashoggi di Istanbul Turkiye menimbulkan kompleksitas terhadap penerapan yurisdiksi. Menurut fakta, kasus itu muncul sebagai akibat dari pelanggaran HAM terhadap jurnalis, pelaku yang merupakan tangan kanan kerajaan Arab Saudi mencari impunitas dan kedaulatan hukum di hadapan keinginan untuk mendestabilisasi negara. Situasi saat ini menunjukkan bahwa kehadiran organisasi internasional dan pemerintah adalah faktor penting dalam penyelidikan yang sedang berlangsung atas kematian Jamal Khashoggi untuk mendapatkan keadilan melalui sistem peradilan sesuai dengan Draft Articles on Responsibility of States for Internationally Wrongful Act 2001. Penelitian ini mencoba mencari solusi yang solutif terkait perlindungan HAM jurnalistik di kancah internasional dengan menggunakan penelitian hukum yuridis normatif, penelitian ini menemukan permasalahan-permasalahan yang dihadapi di dalam hukum internasional. Permasalahan-permasalahan tersebut diantaranya, terkait penyelesaian kasus tersebut hingga saat ini dan mengetahui penerapan prinsip yurisdiksi negara dalam pembunuhan Khashoggi. Dengan menyelesaikan permasalahan tersebut, peneliti menawarkan bahwa penerapan prinsip yurisdiksi negara berdasarkan hukum internasional adalah prinsip yurisdiksi teritorial dan nasionalitas mengacu pada Arab Saudi. Namun tidak sepenuhnya dapat diberlakukan karena adanya suatu pelanggaran. Salah satu bentuk upaya tersebut mencakup investigasi secara rinci, pengusutan pelaku kejahatan, dan kerja sama internasional dengan melibatkan pihak netral atau mediator yang dapat dijadikan sebagai regulasi tambahan antara pihak-pihak yang terlibat.Kata Kunci: Tanggung Jawab Negara; Yurisdiksi; Perlindungan Hak Asasi Manusia Jurnalis.The murder of journalist Jamal Khashoggi in Istanbul Turkiye raises complexities regarding the application of jurisdiction. According to the facts, the case arose as a result of human rights violations against journalists, the perpetrators who are the right hand of the kingdom of Saudi Arabia seeking impunity and rule of law in the face of the desire to destabilize the country. The current situation shows that the presence of international organizations and governments is an important factor in the ongoing investigation into the death of Jamal Khashoggi to obtain justice through the justice system in accordance with the Draft Articles on Responsibility of States for Internationally Wrongful Act 2001. This research tries to find solutions related to this. protecting journalistic human rights in the international arena by using normative juridical legal research, this research finds the problems faced in international law. These problems include the resolution of the case to date and knowing the application of the principle of state jurisdiction in Khashoggi's murder. By resolving this problem, the researcher offers that the application of the principle of state jurisdiction based on international law is the principle of territorial jurisdiction and nationality referring to Saudi Arabia. However, it cannot be fully enforced because there is a violation. One form of this effort includes detailed investigations, prosecuting criminals, and international cooperation involving neutral parties or mediators who can serve as additional regulations between the parties involved.Keywords: State Responsibility; Jurisprudence; Protecting the Rights of Journalists.

Abstract

Orang asing dapat memperoleh Kewarganegaraan Republik Indonesia melalui permohonan pewarganegaraan. Dalam melaksanakan praktek pewarganegaraan tersebut, pemerintah Republik Indonesia membentuk dan menugaskan Tim Evaluasi Terpadu Permohonan Kewarganegaraan berdasarkan Surat Edaran Menteri Hukum dan HAM No. M.HH.AH.10.01-23 tanggal 30 Maret 2011 tentang Permohonan Pewarganegaraan RI Pasal 8 dan Pasal 19 UU No. 12/2006. Namun demikian, kedudukan Tim Evaluasi Terpadu yang begitu sentral sampai saat ini masih menimbulkan permasalahan yang cukup kompleks yaitu:(1) tidak adanya standar baku bagi Tim Evaluasi Terpadu untuk melakukan pemeriksaan pewarganegaraan; (2) kedudukan institusi Tim Evaluasi Terpadu yang tidak permanen; serta (3) regulasi tentang proses pemeriksaan substantif pewarganegaraan yang hanya diatur dalam Surat Edaran Menteri Hukum dan HAM No. M.HH.AH.10.01-23 Tahun 2011. Menggunakan pendekatan perbandingan hukum dengan sistem hukum Belanda dan Amerika Serikat, tulisan ini mengusulkan perbaikan aspek regulasi dan non regulasi pemeriksaan substantif pewarganegaraan. Perbaikan regulasi dilakukan dengan membentuk Peraturan Presiden atau Peraturan Menteri Hukum dan HAM tentang pemeriksaan substantif pewarganegeraan. Sedangkan pendekatan non regulasi dapat ditempuh dengan perbaikan proses investigasi, merumuskan mekanisme hearing atau eksaminasi ulang, penyusunan standar uji Bahasa Indonesia serta standar uji kewarganegaraan, dan pelembagaan Tim Pemeriksa Permohonan Pewarganegaraan secara permanen.

Abstract

This article examines whether the structure of the 2008 ASEAN Charter is still well-suited and appropriate with the intergovernmental organisation of ASEAN. ASEAN has developed and turned into a rule-based organisation. The Charter as the legal basis of the Association is regarded as the constitution of ASEAN, and it has the constitutional character as if all ten ASEAN Member States (AMS) were united as one big country. The design and character of the Charter have placed it above the AMS’s constitutions.  While ASEAN basically stands firmly to state’ sovereignty and non-interference principles which were and will remain the important ASEAN principles, ASEAN has developed into a people-oriented organisation which accommodates the participations of the ASEAN people into the Association. By analysing the normative ASEAN and international legal instruments that are gathered from the official ASEAN website and other publicly available sources, combined with the conceptual and statute approaches, this article found that ASEAN has become a legalised organisation. ASEAN surely cannot be equated with the European Union (EU), considering that the TFEU provides a hierarchical arrangement and the binding effect upon its member countries. The article argues that the Charter has a supremacy at regional level as a part of the indirect aspects of the community law of ASEAN.

Abstract

Perkembangan ekonomi dan teknologi yang pesat pada era Industri 5.0 menuntut adanya lulusan hukum yang tidak hanya memahami hukum secara teknis tetapi juga memiliki keterampilan kewirausahaan dan teknologi. Program LawPreneur merupakan suatu langkah strategis untuk mencetak lulusan hukum yang memiliki keahlian tambahan dalam bidang bisnis berbasis hukum dan teknologi. Program ini bertujuan untuk menjembatani kesenjangan antara kemampuan lulusan hukum dan kebutuhan pasar akan profesional hukum yang siap bersaing, dan berinovasi di sektor legal-tech. Dalam beberapa tahun terakhir, lulusan hukum dihadapkan pada tantangan baru di pasar kerja. Selain peran tradisional seperti advokat, jaksa, atau hakim, muncul kebutuhan terhadap peran inovatif seperti konsultan hukum bagi bisnis teknologi, pengelola startup hukum, dan profesional hukum di perusahaan digital. Sebagai respons, Program LawPreneur menawarkan pendidikan yang mengintegrasikan hukum, kewirausahaan, dan teknologi, didukung oleh mitra-mitra bisnis, salah satunya HeyLaw. Melalui pelatihan dan magang, mahasiswa mendapatkan pengalaman praktis dalam mengelola bisnis hukum berbasis teknologi. Penelitian ini bertujuan untuk menganalisis konsep dan implementasi Program LawPreneur di fakultas hukum dalam membentuk profil lulusan yang kompeten dalam kewirausahaan hukum berbasis teknologi, serta mengidentifikasi arah pengembangan LawPreneur untuk meningkatkan daya saing lulusan di dunia kerja dan memenuhi kebutuhan industri 5.0.  Metode yang digunakan adalah penelitian kualitatif untuk memperoleh pemahaman menyeluruh tentang pelaksanaan program. Teknik pengumpulan data meliputi wawancara mendalam, observasi partisipatif, dan studi dokumentasi. Analisis dilakukan secara kualitatif interaktif, dengan memvalidasi data melalui triangulasi sumber. Luaran yang diharapkan dari penelitian ini mencakup rekomendasi strategis bagi pengembangan Program LawPreneur, peningkatan keterampilan lulusan, dan pemetaan kompetensi yang sesuai dengan kebutuhan industri 5.0. Penelitian ini selaras dengan roadmap Riset Unggulan UNEJ yang berfokus pada daya saing lulusan dan kesiapan menghadapi era digital.

Abstract

This study aims to examine the characteristics of the PBJP dispute settlement conducted by LKPP, as well as legal certainty and the ideal concept of PBJP dispute settlement by LKPP in the future. The method utilized by this study is a normative legal review using a legal regulatory approach that examines a rule of norms and a case approach that is linear with the issues to be resolved. The results of this study show that the characteristics of dispute resolution through mediation and arbitration by an independent and professional LKPP, as well as the adoption of technology in dispute resolution can increase efficiency and transparency in procurement in accordance with the culture of deliberation in Indonesia. The regulation of dispute resolution by LKPP has not provided legal certainty, because the provisions related to dispute resolution that are excluded are contrary to higher regulations and the principles of the agreement, thus not providing legal certainty for the parties. The ideal concept of PBJP dispute resolution in Indonesia can combine local wisdom with technological developments to provide more effective and credible solutions. This will improve the efficiency and transparency of the procurement process, ensure dispute resolution is in line with local culture and values, and provide the desired legal certainty.  ABSTRAK Penelitian ini mencoba untuk melihat karakteristik penyelesaian sengketa PBJP yang dilakukan oleh LKPP, serta kepastian hukum dan konsep ideal penyelesaian sengketa PBJP oleh LKPP kedepan. Metode yang dimanfaatkan oleh kajian ini berupa penelaahan hukum normatif dengan memakai pendekatan peraturan yang legal yang menelaah suatu aturan norma serta pendekatan kasus yang linier dengan isu yang akan dipecahkan. Hasil dari penelitian ini menunjukkan bahwa Karakteristik penyelesaian sengketa melalui mediasi dan arbitrase oleh LKPP yang independen dan profesional, serta adopsi teknologi dalam penyelesaian sengketa dapat meningkatkan efisiensi dan transparansi dalam pengadaan sesuai dengan budaya musyawarah di Indonesia. Pengaturan penyelesaian sengketa oleh LKPP belum memberikan kepastian hukum, karena ketentuan terkait penyelesaian sengketa yang dikecualikan kontrdiktif dengan peraturan di atasnya dan asas-asas perjanjian, sehingga tidak memberikan kepastian hukum bagi para pihak. Konsep ideal penyelesaian sengketa PBJP di Indonesia dapat mengkombinasikan kearifan lokal dengan perkembangan teknologi untuk memberikan solusi yang lebih efektif dan kredibel. Ini akan meningkatkan efisiensi dan transparansi proses pengadaan, memastikan penyelesaian sengketa sesuai dengan budaya dan nilai-nilai lokal, serta memberikan kepastian hukum yang diinginkan.  Kata Kunci: Karakteristik, penyelesaian sengketa; PBJP; LKPP
