Abstract

Abstract Data from the Directorate General of Intellectual Property at the Ministry of Law and Human Rights of the Republic of Indonesia, Lada Putih Muntok (Muntok White Pepper) is the only registered geographical indication of the Bangka Belitung Islands. In fact, when referring to the scope of protection and the potential possessed based on that scope, there are still many other products that have the potential to be registered as geographical indications, one of which is the Bikang Pineapple in Bikang Village, Toboali District, South Bangka Regency. In accordance with the provisions of Article 53 of the Law of the Republic of Indonesia Number 20 of 2016 concerning Marks and Geographical Indications, in addition to the provincial or district/city regional governments, applications may be submitted by institutions representing the people in certain geographical areas who cultivate an item and/or product in the form of a source. natural resources, handicrafts, or industrial products, one of which is the Geographical Indication Protection Society (MPIG). Interactive socialization, starting with a pre-test, condensing material, discussion, and ending with a post-test, is a method that can solve the problem of not registering Bikang pineapple as a geographical indication. From the results of the activities carried out, it was found that people who initially did not understand the legal protection of geographical indications, after the socialization were carried out, became more understanding. Abstrak Data di Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan HAM RI, Lada Putih Muntok (Muntok White Pepper) merupakan satu-satunya indikasi geografi terdaftar dari Kepulauan Bangka Belitung. Padahal, bila merujuk pada ruang lingkup perlindungan serta potensi yang dimiliki berdasarkan ruang lingkup itu, masih banyak produk lain yang berpotensi untuk didaftarkan sebagai indikasi geografis, salah satunya Nanas Bikang yang ada di Desa Bikang, Kecamatan Toboali, Kabupaten Bangka Selatan. Sesuai ketentuan Pasal 53 Undang-Undang Republik Indonesia Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, selain pemerintah daerah provinsi atau kabupaten/ kota, permohonan dapat diajukan oleh lembaga yang mewakili masyarakat di kawasan geografis tertentu yang mengusahakan suatu barang dan/atau produk berupa sumber daya alam, barang kerajinan tangan, atau hasil industri, salah satunya masyarakat perlindungan indikasi geografis (MPIG). Sosialisasi yang dilakukan secara interaktif, diawali pre test, pemapatan materi, diskusi, dan diakhiri dengan post test, merupakan metode yang dapat memecahkan masalah belum didaftarkannya nanas Bikang sebagai indikasi geografis. Dari hasil kegiatan yang dilakukan, didapati hasil masyarakat yang semula kurang memahami tentang perlindungan hukum terhadap indikasi geografis, setelah dilakukannya sosialiasi menjadi lebih memahami.

Abstract

Abstract The potential of the village in the form of the original results of the village must be developed with a touch of legal certainty based on the rules relating to the village. The classic problem that arises is in the process of establishing a draft village regulation that explores the potential of local wisdom-based villages and legal protection of the original products of villages that are not yet incorporated and are not recorded in household industrial food production permits. Methods used through direct socialization, discussion, and direct assistance to the village government in the process of making a draft village regulation based on local wisdom, this method can solve problems related to the structuring of village government administration. The result of devotion that the village government has not maximally understood the concept of making village regulations based on local wisdom to the maximum so that it needs continuous assistance in the draft aspirational village regulations is an integral part so that real action is needed from the village government to accommodate the aspirations of the community in the form of local wisdom-based regulations and real action is needed with regard to legal protection of the original product. Abstrak Potensi desa dalam bentuk hasil asli desa harus dikembangkan dengan sentuhan adanya kepastian hukum berdasarkan pada aturan yang berkaitan dengan desa. Permasalahan klasik yang muncul adalah dalam proses pembentukan rancangan peraturan desa yang menggali potensi desa berbasis local wisdom serta perlindungan hukum atas hasil produk asli desa yang belum berbadan hukum dan tidak tercatat dalam izin produksi pangan industri rumah tangga. Metode yang digunakan melalui sosialisasi secara langsung, diskusi, dan melakukan pendampingan langsung terhadap pemerintahan desa dalam proses pembuatan raperdes berbasis local wisdom, metode ini dapat memecahkan permasalahan terkait dengan penataan administrasi pemerintahan desa. Hasil pengabdian bahwa pemerintahan desa belum maksimal memahami konsep pembuatan peraturan desa yang berbasis kearifan lokal secara maksimal sehingga perlu pendampingan secara berkelanjutan dalam Rancangan peraturan desa aspiratif merupakan bagian yang tak terpisahkan sehingga diperlukan tindakan nyata dari pemerintahan desa untuk menampung aspirasi dari masyarakat dalam bentuk peraturan berbasis kearifan lokal serta diperlukan tindakan nyata berkaitan dengan perlindungan hukum atas produk asli desa

Abstract

Abstract In the Marriage Law in Indonesia, it is stated that one of the marriages is that a man and a woman who will become prospective husband and wife have matured and are physically and mentally ready to carry out the marriage, from this it can be concluded that mental, physical, and strong determination are needed to prepare for marriage. continue to live with a partner. The Province of the Bangka Belitung Islands is included in one of the provinces in Indonesia where the number of underage marriages is quite high. This is a separate legal problem for the lives of couples who carry out underage marriages. Due to this condition, the authors are interested in conducting community service with one of the existing problems, which is related to the importance of understanding the underage dispensation for the community in Serdang Village through the PKK Peduli Perempuan program. This paper aims to provide an understanding of the community regarding the dispensation of underage marriage, the method of implementing the service used is through counseling and socialization. The results based on the knowledge of understanding the dispensation of underage marriages are very important to be known by the public. Abstrak Dalam Undang-Undang Perkawinan di Indonesia menyebutkan salah satu asas perkawinan adalah laki-laki dan perempuan yang akan menjadi calon suami istri telah matang jiwa maupun raganya agar dapat melangsungkan perkawinan, dari hal tersebut dapat dipahami bahwa sangat dibutuhkan kesiapan mental, fisik, maupun tekad yang kuat untuk terus hidup bersama pasangan. Provinsi Kepualaun Bangka Belitung, masuk dalam salah satu provinsi di Indonesia yang angkat perkawinan dibawah umur cukup tinggi. Hal ini menjadi permasalahan hukum tersendiri bagi kelangsungan hidup pasangan yang melangsungkan perkawinan dibawah umur. Atas kondisi ini, maka penulis tertarik menyelenggarakan pengabdian kepada msyarakat dengan salah satu permasalahan yang ada, yaitu terkait pentingnya pemahaman dispensasi dibawah umur bagi masyarakat di Desa Serdang melalui program PKK Peduli Perempuan. Tulisan ini bertujuan memberikan pemahaman terhadap masyarakat terkait dispensasi perkawinan dibawah umur, metode pelaksanaan pengabdiaan yang digunakan adalah melalui penyuluhan dan sosialisasi. Berdasarkan hasil penelitian diketahui pemahaman dispensasi perkawinan dibawah umur sangat penting diketahui oleh masyarakat

Abstract

Sebagai daerah bercorak kepulauan, Kepulauan Bangka Belitung memiliki banyak sumber daya alam yang di antaranya berpotensi didaftarkan sebagai indikasi geografis, salah satunya adalah Nanas Bikang yang ada di Desa Bikang, Kecamatan Toboali, Kabupaten Bangka Selatan. Hanya saja, Nanas Bikang belum terdaftar sebagai indikasi geografis sampai saat ini. Nanas Bikang baru terdaftar sebagai varietas lokal, bukan indikasi geografis. Nanas Bikang terdaftar dengan Tanda Daftar Varietas Tanaman Nomor: 1557/PVL/2020 yang dikeluarkan oleh Pusat Perlindungan Varietas Tanaman dan Perizinan Pertanian Kementerian Pertanian Republik Indonesia tanggal 26 Oktober 2020. Oleh sebab itu, melalui kegiatan pengabdian kepada masyarakat, dilaksanakan Focus Group Discussion (FGD) sebagai upaya penguatan reputasi Nanas Bikang sebagai indikasi geografis. Dari kegiatan yang dilaksanakan, diketahui bahwa pada dasarnya Nanas Bikang memiliki karakter khas yang berpotensi diidaftarkan sebagai indikasi geografis. Oleh sebab itu, sejumlah langkah konkrit harus dilakukan, termasuk menjaga reputasi yang ada sekarang.

Abstract

Adherents trust, at first no protected by law positive in Indonesia, with birth Decision Court Constitution No. 97/PU-XIV/2016 related Constitution Administration population. This thing give positive impact for adherents trust namely, protection and recognition by Indonesian law to adherents devotee trust, one related with recording marriage. Valid something marriage from adherents trust implications for rights civil law on child status as well as problem inheritance later. Destination from study this for knowing validity from marriage devotee trust in Bangka Regency based on law positive as well as fulfillment rights civil for adherents trust.  Study this conducted with use method law juridical empirical through researching materials References as well as studies cases that develop in the community adherents trust. The results of the research produced in Bangka Regency are still there is marriage from devotee unreliable trust registered so that result in they no get rights civil law, such as right for get inheritance.  Study this is very important conducted because still there is adherents trust whose marriage not yet legitimate nationally so that no protected rights civil from the parties, so that study this is very important done.

Abstract

The transformation of mining law policy in Law No. 3 of 2020 concerning Minerals and Coal has broad implications for mining law, including illegal tin mining. The high dependence of the tin extractive economy in Bangka Belitung has changed the landscape of this archipelago province as an area with a high level of natural damage and social disasters. The ability of governments through regulatory instruments to tackle illegal mining is an important ideal goal. This research was conducted using socio-legal methods, to produce a comprehensive analysis related to the environmental and social impacts of illegal tin mining after the renewal of the mineral and coal law. This study found that the transition of mining authority from the central government to the regional government directly has an impact on the proliferation of illegal mining activities. Substantive changes in the mineral and coal law have not provided a strategic solution because the tug-of-war over authority ends with the continued delegation of authority to grant community mining permits to local governments. Meanwhile, the unpreparedness of local governments has resulted in the continued marginalization of mining communities and has an impact on widespread environmental damage. The lack of fair decision-making processes for people mining licences is indicative of an immature tin mining management in Bangka Belitung. The purpose of this study is to provide a comprehensive overview of the implications of the latest mineral and coal policies on illegal tin mining activities, as a reference and consideration in strategic policy making to create an ideal and sustainable tin mining ecosystem.

Abstract

Sampai saat ini, ada sekitar 92 indikasi geografis yang terdaftar di Direktorat Jenderal Hak Kekayaan Intelektual Kementerian Hukum dan Hak Asai Manusia Republik Indonesia. Salah satu di antaranya adalah Lada Putih Muntok (Muntok White Pepper) yang terdaftar oleh Badan Pengelola, Pengembangan dan Pemasaran Lada (BP3L) Provinsi Kepulauan Bangka Belitung dengan ID G 000000004 pada 28 April 2010. Sesuai dengan ketentuan Pasal 70 Ayat (1) Undang-Undang Republik Indonesia Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, pembinaan indikasi geografis dilakukan oleh pemerintah pusat dan/atau pemerintah daerah sesuai dengan kewenangannya, meliputi di antaranya inventarisasi potensi produk indikasi geografis. Hanya saja, bila merujuk pada Lada Putih Muntok yang menjadi satu-satunya indikasi geografis terdaftar dari Kepulauan Bangka Belitung di Direktorat Jenderal Hak Kekayaan Intelektual Kementerian Hukum dan Hak Asasi Manusia, timbul pertanyaan terkait pembinaan berupa inventarisasi potensi produk indikasi geografis, terutama yang dilakukan oleh pemerintah daerah di Kepulauan Bangka Belitung. Penelitian ini dilakukan berdasarkan metode penelitian yang sudah disusun sedemikian rupa, yakni bersifat yuridis empiris. Dari hasil penelitian yang dilakukan di seluruh pemerintah daerah kabupaten/ kota yang ada di Kepulauan Bangka Belitung, secara umum dapat dikatakan bahwa pemerintah daerah kabupaten/ kota belum melakukan upaya optimal terkait inventarisasi. Belum optimalnya upaya inventarisasi diakibatkan oleh banyak hal, di antaranya adalah tugas pokok dan fungsi yang dianggap tidak ada kaitanya dengan kekayaan intelektual terutama indikasi georafis, tidak ada program kerja yang berkaitan dengan kekayaan intelektual terutama indikasi geografis, secara kelembagaan terjadi miss-persepsi instansi mana yang dianggap berwenang.

Abstract

Abundant and diverse natural resources are an extraordinary gift for the Indonesian people. From the perspective of intellectual property rights, the product in question can be legally protected as a geographical indication, such as pepper in the Bangka Belitung Islands under the name Muntok White Pepper. One of the purposes of using a product as a geographical indication is for the price of the product to be high, or at least stable, and controlled by the manufacturer. In fact, this was not the case with Muntok White Pepper. This research was conducted empirically with an economic and business approach, aiming to study the marketing of Muntok White Pepper after being certified or registered as a geographical indication. Based on the results of the research, there are obligations that must be carried out by applicants as rights holders after a product is registered as a geographical indication, namely maintaining a reputation so that the product remains of high value. It's just that, the marketing that has been done so far has not been enough to control prices. Based on marketing management science, it can be done using several marketing strategies that are commonly used in marketing management. One strategy that can be used is market segmentation, namely dividing the market into smaller groups based on the same characteristics, such as age, gender, or product preference.

Abstract

Pesta demokrasi lima tahunan yang diselenggarakan tahun 2024 tinggal hitungan bulan. Generasi millenial yang sebagian merupakan pemilih pemula akan turut mencoblos. Namun berkaca dari alias tidak mencoblos atau berpartisipasi namun karena tidak memahami secara teknis pencoblosan sehingga surat suara menjadi tidak sah. Pada sisi yang lain masih ada yang pragmatis. Kegiatan pengabdian masyarakat ini bertujuan untuk membekali pemilih pemula di Belitung Timur yang sedang duduk dibangku SMA/SMK kemampuan teknis kepemiluan dan wawasan kepemiluan agar menjadi pemilih cerdas dan mencoblos dengan benar. Kegiatan dilakukan dengan simulasi pencoblosan sekaligus deklarasi sebagai pemilih cerdas dengan membubuhkan tanda tangan sebagai bentuk komitmen. Kegiatan dilaksanakan di KPU Belitung Timur pada Selasa 30 Mei 2023 dengan peserta 20 pelajar perwakilan dari SMA/SMK. Hasilnya dapat menambah wawasan kepemiluan dan dapat mencoblos dengan benar serta punya komitmen menjadi pemilih pemula yang cerdas.The five-year democratic party, which will be held in 2024, is only months away. However, reflecting on aliases, they did not vote or participate, but because they did not understand voting technically, the ballots became invalid. On the other hand, there is something pragmatic. This community service activity aims to equip first-time voters in East Belitung who are currently in high school/vocational school with electoral technical skills and electoral insight to become smart voters and vote correctly. The activity was carried out with a voting simulation and a declaration as a smart voter by affixing a signature as a form of commitment. The activity was carried out at the East Belitung KPU on Tuesday, 30 May 2023, with 20 student representatives from SMA/SMK participating. The result can add electoral insight, vote correctly, and commit to being a smart beginner voter.

Abstract

Since ancient times, the Bangka Belitung Islands have been known as one of the world’s largest tin producers. Mining has taken place massively since tin is no longer a strategic commodity, marked by the issuance of several policies that grant permits to anyone to mine tin. Mining, which was originally mostly carried out on land, over time and needed in the economic aspect, has also been carried out at sea. As a result, mining, mostly carried out without permits, impacts environmental damage and other legal and social aspects. In fact, from a regulatory standpoint, the government has issued laws and regulations that serve as references in environmental management, including its relation to the mining sector. This study aims to determine awareness of environmental law in unconventional tin mining activities in the Bangka Belitung Islands. Judging from its type, this research is analytical descriptive research, describing an object through which the data obtained is processed and analyzed to conclude. The research was conducted in all regencies/municipalities in the Bangka Belitung Islands. From the research that has been done, the result is that even though they know, the fact is that most of the mining is carried out without permits, plus there has never been, and there has been no socialization regarding tin mining permits. In addition, most of them also know that their mining activities damage the environment and admit that mining activities damage the habitat of living things. This means that, based on the theories and concepts used, miners are more towards ecocentrism because they make nature an object, not ecocentrism, which pays attention to environmental sustainability.
