Abstract

The criminal disparity is inconsistent of different decisions toward crime with similar characteristics where its danger is comporable without obvious justification. Narcotics are substances or drugs from plants or others, wheter synthetic or semi synthetic, that can fatally affect the consciousness and lead to an addiction. This study aimed to analyze the factors influencing the disparity in judges decisions and the solutions or judges consideration in sentencing toward drug abuse cases. This normative research used a case approach referencing primary, secondary, and tertiary legal materials. Data collection techniques were carried out using literature studies. Based on the analysis, two factors influenced the judges decision legal and social. Besides, the verdict made by the judge has not fulfilled the sense of justice due to the irrelevancy.

Abstract

The aim of the research is to analyze the factors that cause criminal acts of traffic accidents committed by children and the responsibility of children related to traffic accidents committed by minors which cause death. The research method used in this research is an empirical method. The results of the research show that: 1. The factors causing the occurrence of criminal traffic accidents committed by children which cause death are. General factors include: Manuia, Weather/Nature, Road Conditions. Then external factors, including: Age, personal existence, lack of awareness of the safety of oneself and others, lack of awareness of traffic regulations. And internal factors, including: Lack of parental attention, social environment.2. Responsibility of children for criminal acts of traffic accidents by minors which cause death. The provisions for criminal fines for children whose negligence causes someone to lose their life in Article 310 paragraph (4) of Law Number 22 of 2009 concerning Road Traffic and Transportation can be imposed a fine that can be imposed on childrezn whose negligence causes someone to lose their life at most ½ (one half) of the maximum threat of imprisonment for adults. It can be concluded that for children whose negligence is proven to result in someone losing their life, the threat of imprisonment that can be imposed on them is ½ of the fine in Law Number 22 of 2009 concerning Road Traffic and Transportation. Because the criminal fine in Law Number 22 of 2009 concerning Road Traffic and Transportation is a maximum of IDR 12,000,000.00 (twelve million rupiah), then for a child whose negligence causes someone to lose their life a maximum of IDR 6,000,000, 00 (six million rupiah). Abstract

Disparity is the difference in deciding one case with another, this is often a question in a society about how this disparity can occur, which is when there is one case that is the same, but the way of giving sanctions is different, this also causes a Indonesian law is questioned whether the sanctions or punishments are appropriate or not and whether justice exists or not. This distinction will also stem from how a decision has been made by a judge, which basically judges give punishment based on several aspects, and where judges also have authority to decide a case. The purpose of this research is to find out what disparity is, and how considerations and legal aspects are used to decide a case. In this case, there is a disparity that will be discussed regarding the Disparity in Judges' Decisions Against the Crime of Defamation on Social Media (Analysis of Decisions Number 755/Pid.Sus/2020/Pn.Gtlo and 331/Pid.Sus/2019/Pn Gtlo). Where the method used is qualitative research with a statutory approach, conceptual approach, and a comparative approach and this type of research is normative juridical research.

Abstract

One of the crimes of physical violence was ever committed by a child until the victim died, as the child who committed physical violence resulted in the death of the victim. For the actions committed by the child as the perpetrator of the crime, the judge sentenced the child to 4 years in prison. The purpose of this research is to find out the factors that cause children to commit crimes of physical violence that result in death, criminal responsibility by children who commit physical violence that result in death, as well as the application of sanctions to children who commit crimes of physical violence that result in death. The type of research used is normative juridical research with a statutory approach and a case approach, which is supported by data obtained from library data including books, laws and regulations, and court decisions, and in this case the data is processed using qualitative analysis. Based on the results of the study, the factors that cause children to commit crimes of physical violence which result in death are due to several factors, both internal and external factors. Criminal liability by children who commit physical violence resulting in death can be seen from the provisions in Article 351 paragraph (3) of the Criminal Code, as the criminal responsibility is imposed on children when the child is proven to have fulfilled the criminal elements in the form of mistakes made by children, violence The physical violence that was done was done by the child, and the victims who were victims of physical violence were known to have died during or after the physical violence was carried out. The application of sanctions to children who commit acts of physical violence resulting in death, namely imposing prison sanctions on children, therefore, is sentenced to 4 years in prison.

Abstract

Child abuse usually occurs due to negligence of parents or other caregivers. There are examples of cases that require action in child protection, namely child violence that occurs in orphanages. Based on these problems, the latest research is needed regarding the protection of child violence against orphanage children. This study uses empirical legal research methods. This research shows that children should get protection against violence or anything that can harm or hinder their growth and development in accordance with children's rights. Criminal sanctions for orphanage owners who commit violence against foster children can be given as an effort to protect the law from law enforcement officials against victims. Application of criminal sanctions against orphanage owners who commit violence against their foster children. That is, the perpetrator is subject to a penalty of 10 years in prison, the sentence is still not commensurate with the suffering experienced by the victim.

Abstract

This research aims to determine the application of Indonesian positive law to the crime of taking foreign citizens hostage in Indonesia. This research is classified as normative legal research with a statutory approach and a case approach. Legal materials are collected through literature study, then analyzed prescriptively. The research results show that the criminal act of taking foreign citizens hostage, in this case a pilot from New Zealand in Indonesia, is an unlawful act. The legal regulations that were violated by the crime of taking hostages were Article 6 of Law Number 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning the Establishment of Government Regulations in Lieu of Law Number 1 of 2002 concerning the Eradication of Criminal Acts. Terrorism Becomes Law and Article 451 of Law Number 1 of 2023 concerning the Criminal Code.

Abstract

Lahirnya undang-undang tentang pengelolaan sampah sejatinya memperkuat konstitusionalitas aspek lingkungan hidup di Indonesia. Perintah undang-undang untuk membentuk peraturan daerah (provinsi) tentang pengelolaan sampah regional tidak dipenuhi oleh seluruh daerah provinsi di Indonesia, kondisi ini menujukkan terjadinya legislative omision. Artikel ini menguraikan aspek konstitusionalitas lingkungan hidup yang di dalamnya termasuk pula aspek pengelolaan sampah, serta perbandingannya dengan beberapa negara lain, dan memotret kondisi legislative omision dalam pengaturan pengelolaan sampah di provinsi se Indonesia. pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan kasus, pendekatan konseptual, dimana bahan hukum yang diperoleh disajikan secara preskriptif. Penelitian ini menemukan 16 provinsi yang telah membentuk peraturan daerah tentang pengelolaan sampah sebagaimana perintah dari Undang-Undang tentang Pengelolaan Sampah, sementara 18 provinsi lainnya hingga saat ini belum membentuk peraturan daerah dimaksud. Obesitas peraturan perundang-undangan, pengaturan pengelolaan sampah yang diwujudkan dalam bentuk peraturan gubernur, masifnya pembentukan peraturan daerah kabupaten/kota tentang pengelolaan sampah, menjadi sebagian faktor yang memengaruhi  mayoritas provinsi yang tidak membentuk peraturan daerah provinsi tentang pengelolaan sampah.

Abstract

Criminal disparity refers to dissenting judgments regarding the same criminal act or one that possesses dangerous characteristics, both of which can be compared without clear justification. This research aims to understand and analyze whether the existence of disparities in prosecution can fulfill the legal perspectives’s objectives and to identify and analyze the factors causing disparities in prosecution in Cases Number: 176/Pid.B/2019/PN Gto and Cases Number: 163/Pid.B/2019/PN Gto by using a normative research method with a case approach. The technique employed involves a literature review supported by descriptive analysis a supplementary method. The research findings are as follows: firstly, in both verdicts, Number 176/Pid.B/2019.PN Gto and Number 163/Pid.B/2019/PN Gto, it is observed that they still do not fully meet the legal perspective’s objectives because there are legal objectives that remain unfulfilled. Secondly, both verdicts contain factors influencing the occurrence of disparities in prosecution, including the consequences caused, considerations from the prepator’s prespective, personal factors, aggravating and mitigating circumstances, and the extent of the losses incurred.

Abstract

The rapid expansion of e-commerce in ASEAN presents significant economic potential but also poses pressing challenges in integrating Sharia principles into regulatory frameworks. Regulatory fragmentation among member states, along with limited oversight, hampers the effective enforcement of core Sharia prohibitions such as riba (usury), gharar (uncertainty), and non-transparent transactions in digital commerce. This inconsistency risks undermining consumer trust and hindering the growth of Islamic digital markets across the region. This study explores the incorporation of Sharia principles into e-commerce regulations in Indonesia, Malaysia, Brunei, and Singapore through a qualitative comparative policy analysis, document review, and expert interviews. Findings indicate that Malaysia and Brunei have developed more mature regulatory frameworks that explicitly embed Sharia norms, whereas Indonesia and Singapore encounter structural and technical barriers to similar integration. Moreover, emerging technologies such as blockchain and smart contracts show promise in enhancing transparency and facilitating Sharia compliance. This article contributes to the discourse by recommending the establishment of an ASEAN-level coordinating body to harmonize Sharia-compliant e-commerce regulations and develop adaptable guidelines for member states. Such an institutional approach is vital for fostering regulatory coherence, enhancing market confidence, and supporting the sustainable development of Islamic digital finance. Future research should focus on leveraging advanced digital technologies to operationalize Sharia compliance across ASEAN’s digital economy. Perkembangan pesat e-commerce di ASEAN menawarkan potensi ekonomi yang besar namun juga menghadirkan tantangan mendesak dalam mengintegrasikan prinsip-prinsip Syariah ke dalam kerangka regulasi. Fragmentasi regulasi antarnegara anggota, disertai dengan pengawasan yang terbatas, menghambat penegakan efektif larangan-larangan utama Syariah seperti riba (bunga), gharar (ketidakpastian), dan transaksi yang tidak transparan dalam perdagangan digital. Ketidakkonsistenan regulasi ini berisiko merusak kepercayaan konsumen dan pertumbuhan pasar digital Islam di kawasan tersebut. Penelitian ini mengkaji sejauh mana prinsip Syariah telah diintegrasikan dalam regulasi e-commerce di Indonesia, Malaysia, Brunei, dan Singapura melalui analisis kebijakan komparatif kualitatif, tinjauan dokumen, dan wawancara ahli. Hasil menunjukkan bahwa Malaysia dan Brunei telah mengembangkan kerangka regulasi yang lebih matang dengan secara eksplisit memasukkan norma-norma Syariah, sementara Indonesia dan Singapura menghadapi hambatan struktural dan teknis dalam integrasi serupa. Selain itu, teknologi baru seperti blockchain dan smart contract menunjukkan potensi besar dalam meningkatkan transparansi dan memfasilitasi kepatuhan Syariah. Artikel ini memberikan kontribusi dengan merekomendasikan pembentukan lembaga koordinasi tingkat ASEAN untuk menyelaraskan regulasi e-commerce yang sesuai Syariah serta mengeluarkan pedoman yang dapat disesuaikan bagi negara anggota. Pendekatan kelembagaan ini sangat penting untuk mendorong konsistensi regulasi, meningkatkan kepercayaan pasar, dan mendukung pengembangan berkelanjutan keuangan digital Islam. Penelitian lanjutan disarankan fokus pada pemanfaatan teknologi digital maju untuk mengoperasionalkan kepatuhan Syariah di ekonomi digital ASEAN.

Abstract

The growing interest in constitutional reform has drawn attention to crowdsourcing as an innovative method for increasing public involvement. This approach, successfully implemented in Iceland, contrasts sharply with the traditionally elitist processes seen in many other countries, including Indonesia. This article investigates the potential of applying a crowdsourced model to Indonesia’s future constitutional amendment processes. Using a statutory and comparative legal method, the study analyzes the Icelandic experience to draw insights for the Indonesian context. The research finds that Indonesia's constitutional amendment process has historically marginalized public participation, lacking transparency and inclusivity. In contrast, Iceland's model demonstrates that structured digital engagement can produce a more democratic and representative outcome. This study offers two key contributions: first, it highlights the normative shift introduced by digital constitutionalism; second, it underscores the importance of designing hybrid models that blend conventional and digital mechanisms. While promising, the implementation of such a model in Indonesia faces significant obstacles, including digital inequality, manipulation risks from political buzzers, and the ethical challenges of AI-mediated discourse. These findings suggest that any future reform must be carefully tailored to local conditions, ensuring both accessibility and legitimacy
