Abstract

ABSTRACT This research was aimed at revealing whether the mathematics conceptual understanding of the students taught by using Index Card Match active learning strategy was better than that of students taught by using conventional learning. This was an experimental research which used random toward the subject design. The population of the research was all of students in class VIII of SMPN 17 Padang registered in Academic Year 2013/2014. The data of the research was analyzed by using t-test. The result of t-test indicated that the value of tcalculated was bigger than ttable on the level of significance α=0,05. Based on the result of data analysis, H0 was rejected signifying that the mathematics conceptual understanding of the students taught by using Index Card Match active learning strategy was better than that of students taught by using conventional learning in class VIII of SMPN 17 Padang.

Abstract

Hukum pidana tidak hanya memiliki dimensi publik, tetapi juga dimensi privat. Keberadaan delik aduan menjadi salah satu buktinya. Delik aduan pada dasarnya merupakan tindak pidana yang bersifat privat dan penuntutan terhadap delik aduan harus berdasarkan pada pertimbangan dari pihak korban. Berbeda dengan delik biasa sebagai tindak pidana yang dianggap mengganggu kepentingan masyarakat umum sehingga negara menjadi pihak yang menentukan penuntutan terhadap pelaku. Perbedaan inilah yang membuat proses penyelesaian perkara delik biasa dan aduan seharusnya bisa berbeda. Delik biasa yang mengganggu kepentingan masyarakat umum diselesaikan dengan proses peradilan dan berakhir dengan sanksi pidana. Namun delik aduan, seharusnya bisa menggunakan pendekatan alternatif dalam penyelesaiannya yaitu dengan pendekatan restorative justice. Restorative Justice merupakan penyelesaian perkara pidana yang melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dan berfokus pada pemulihan kembali pada keadaan semula dan bukan pembalasan. Pendekatan restorative justice juga sesuai dengan nilai-nilai Pancasila dan praktek yang selama ini berlaku di dalam hukum adat dimana menyelesaikan segala permasalahan antar anggota masyarakat dengan musyawarah. Dengan pendekatan restorative justice, penyelesaian perkara delik aduan yang selama ini selalu menggunakan pendekatan retributive (pembalasan) bisa bergeser menjadi pendekatan restorative (pemulihan). Pendekatan restorative justice diharapkan bisa memenuhi rasa keadilan masyarakat, terutama di pihak korban.

Abstract

Penelitian ini bertujuan untuk mengetahui kesesuaian Kebijakan Larangan Penggunaan Alat Penangkapan Ikan Cantrang dengan prinsip negara hukum yang berorientasi kesejahteraan. Kebijakan tersebut tertuang dalam Peraturan Menteri Kelautan dan Perikanan Republik Indonesia Nomor 2/PERMEN-KP/2015 tentang Larangan Penggunaan Alat Penangkapan Ikan Pukat Hela (Trawls) dan Pukat Tarik (Seine Nets). Kebijakan tersebut memunculkan pro-kontra di kalangan nelayan. Bagi nelayan tradisional di sejumlah daerah yang selama ini menggunakan alat tangkap tradisional dan sejumlah lembaga yang concern pada pelestarian lingkungan mendukung kebijakan tersebut. Di sisi lain, nelayan pengguna alat tangkap cantrang justru menolak kebijakan larangan tersebut. Mereka menilai regulasi tersebut justru mematikan mata pencaharian nelayan dan akan mempengaruhi kesejahteraan mereka padahal pemerintah seharusnya memberikan perlindungan dan pemberdayaan kepada nelayan sesuai dengan amanat Undang-Undang Nomor 7 Tahun 2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudi Daya Ikan, dan Petambak Garam. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan perundang-undangan. Hasil penelitian menunjukkan kebijakan larangan penggunaan alat penangkapan ikan cantrang sudah sesuai dengan prinsip negara hukum yang berorientasi pada kesejahteraan. Selain melarang penggunaan alat penangkapan ikan cantrang yang selama ini diperbolehkan, pemerintah juga memberikan jangka waktu tertentu untuk memberikan kesempatan kepada semua nelayan cantrang untuk mengalihkan penggunaan alat penangkapan ikan mereka atas dasar pertimbangan keadilan dan kesejahteraan.

Abstract

ABSTRACT?Indonesia has been deprived of its own true roots as a maritime country. This is the success of the colonial Dutch colonialists who do "devide at empera" in which eventually the nation in the archipelago of this archipelago sees the sea as a separator and inhibitor space.The purpose of this novice lecturer's research is to Know the concept of archipelagic state and maritime state in Indonesia and to prove its implementation in policy and development direction in Indonesia. Is the Government Homeland use in marine activities as a prime mover and a pledge to increase the economy, (2) is supported by a fleet of strong civilian and military, and (3) contribute as much as possible for the prosperity of the people.The research method used in writing this beginner lecturers are socio-juridical legal research methods is often called legal sociological research based school of sociological jurisprudence. Judging from the effectiveness of law or facts that exist in the field which is then compared with the rules of positive law. Abstract

Buhung Pitue Island has seagrass beds those which are spread almost evenly along its coast. Research using remote sensing technology in an effort to support seagrass conservation in Indonesia needs to be carried out. Spatial data is relatively easy to obtain because there are many types of images with various spatial resolutions. The image can be obtained on google earth. Analysis of the distribution of seagrass areas was obtained by digitizing on screen in ArcGIS software, namely in seagrass areas where the boundaries are known. Digitizing is conducted by enlarging the seagrass area in the downloaded image, performing radiometric and geometric corrections, and digitizing to create a shapefile (shp) storing the location, shape, and attributes of geographic features. The seagrass distribution area of Buhung Pitue Island was of 36.5 Ha in 2014 and was of 39.6 in 2021. The rate of change in area from 2014 to 2021 was of 0.085% (an increase of 3.1 ha). The distribution area of seagrass has increased due to natural factors and restrictions on human activities during the COVID-19 pandemic. In addition, another factor supporting the increase in seagrass distribution is the abundance of Enhalus acoroides seagrass species growing and spreading over long distances. The sea surface temperature was high, which was 30.37 °C, while the current speed was categorized as slow because it was around 0.01 m/s. Although the results are obtained from high-resolution imagery, an accuracy test still needs to be conducted.

Abstract

Artikel ini membahas masalah hukum terkait jurnalisme warga dalam era digital,yang diperkuat oleh perkembangan teknologi informasi dan media sosial. Isu utamayang diangkat adalah tantangan dalam mengatur dan mengawasi jurnalisme wargayang dilakukan oleh individu non-profesional, khususnya dalam hal keakurataninformasi, verifikasi, dan tanggung jawab hukum. Tujuan penulisan adalah untukmengeksplorasi bagaimana hukum dapat beradaptasi dengan perubahan sosial yangcepat dan memastikan perlindungan hak asasi manusia dalam konteks jurnalismewarga. Teori hukum yang digunakan termasuk teori Roscoe Pound yang melihathukum sebagai alat rekayasa sosial dan teori hukum progresif Satjipto Rahardjo yangmenekankan hukum harus melayani manusia. Hasil dan pembahasan menunjukkanbahwa meskipun jurnalisme warga memperkaya lanskap media, terdapat kebutuhanmendesak untuk regulasi yang jelas dan adil, serta peningkatan literasi digitalmasyarakat. Artikel ini menyarankan pengembangan regulasi yang berbasis hak asasimanusia, peningkatan literasi digital, dan kerjasama antara pemerintah, penyediaplatform, dan masyarakat sipil untuk menciptakan tata kelola media sosial yangefektif dan bertanggung jawab.Kata Kunci: Formulasi Pengaturan, Jurnalisme Warga, Hak Asasi Manusia, PerubahanSosial

Abstract

Kedudukan Pancasila sebagai sumber dari segala sumber hukum berkonsekuensi bahwa setiap materi muatan peraturan perundang-undangan tidak boleh bertentangan dengan nilai-nilai yang terkandung dalam Pancasila. Begitu juga dengan kebijakan yang dibuat oleh pemerintah, sudah seharusnya selaras dengan nilai-nilai Pancasila. Di sisi lain, Pers sebagai pilar keempat demokrasi di samping legislatif, eksekutif, dan yudikatif memiliki fungsi kontrol atas setiap regulasi dan kebijakan yang dibuat. Berdasarkan diskusi awal dengan pengurus Persatuan Wartawan Indonesia (PWI) Kota Tarakan disimpulkan bahwa wartawan sebagai insan pers perlu mendapatkan pemahaman utuh mengenai realisasi dan operasionalisasi kedudukan Pancasila sebagai sumber dari segala sumber hukum. Oleh sebab itu, perlu dilakukan penyuluhan hukum kepada wartawan agar mereka mendapatkan pemahaman yang utuh mengenai realisasi dan operasionalisasi kedudukan Pancasila sebagai sumber dari segala sumber hukum. Kesimpulan yang dihasilkan dari penyuluhan hukum ini yakni PWI Kota Tarakan perlu merumuskan pedoman atau panduan evaluasi regulasi dan kebijakan yang berisi varibel dan indikator penilaian yang dirumuskan berdasarkan nilai-nilai Pancasila sehingga mereka dapat menjalankan peran kontrol sosialnya dalam mengawal perumusan kebijakan atau regulasi dengan menggunakan nilai-nilai Pancasila sebagai batu ujinya. The position of Pancasila as the source of all legal sources has the consequence that any material content of laws and regulations must not conflict with the values contained in Pancasila. Likewise, the policies made by the government should be in line with the values of Pancasila. On the other hand, the press as the fourth pillar of democracy in addition to the legislature, executive and judiciary has a control function over every regulation and policy that is made. Based on initial discussions with the management of the Indonesian Journalists Association (PWI) of Tarakan City, it was concluded that journalists as members of the press need to gain a complete understanding of the realization and operationalization of the position of Pancasila as the source of all legal sources. Therefore, it is necessary to conduct legal counseling to journalists so that they get a complete understanding of the realization and operationalization of the position of Pancasila as the source of all sources of law. The conclusion resulting from this legal counseling is that the PWI of Tarakan City needs to formulate guidelines or guidelines for evaluating regulations and policies that contain variables and assessment indicators that are formulated based on the values of Pancasila so that they can carry out their social control role in overseeing the formulation of policies or regulations using these values. the value of Pancasila as the touchstone.

Abstract

Amanademen UUD NRI Tahun 1945 yang dilakukan sebanyak 4 kali sejak tahun 1999 (19 Otober), amandemen kedua 2000 (18 Agustus), amandemen ketiga (10 Nopember 2001) dan amademen IV (10 Agustus) telah memberi dmpak besar bagi perubahan sistem ketatanegaraan Republik Indonesia guna mempertegas pemisahan kekuasaan (separation of power) atau pembagian kekuasaan (distribution of power) sebagai respon dari tuntutan reformasi konstitusi yang disuarakan oleh berbagai kalangan, baik kalangan akademisi, intelektual, mahasiswa dan professional guna menjamin tegaknya negara hukum demokratis serta perlindungan terhadap HAM. Amandemen UUD NRI tahun 1945 sekaligua upaya membatasi kekuasaan eksekutif dan memperkuat fungsi legislasi DPR agar terciptanya fungsi check and balances.

Abstract

Rewataya Village is situated on Tanakeke Island, within the Takalar Regency. Despite its significance, previous studies have not addressed the mapping of changes in mangrove land area within this locale. The present research aimed to fill this gap by assessing alterations in mangrove land area from 2013 to 2023, alongside examining density and canopy cover conditions. The method employed for mapping changes in land area entailed utilizing the unsupervised method with maximum likelihood classification. Additionally, the assessment of mangrove conditions involved employing plot line transects to determine species density and hemispherical photography methods to evaluate canopy cover. Notably, two types of mangroves, namely Rhizophora mucronata and Rhizophora apiculata, are prevalent in this village. The mangrove species density in Rewataya Village, Tanakeke Island, is categorized as good. In addition, the canopy cover in Rewataya Village falls within the classification of very dense according to mangrove damage criteria. However, there has been a notable reduction in the mangrove ecosystem area between 2013 and 2023, with a decrease of 42.28 hectares (from 367.13 hectares to 324.84 hectares).Keywords: MangroveLandsat 8Rewataya villageUnsupervised

Abstract

This research aims to determine the factors that influence the income level of fish traders at PPI Bonehalang, including age, length of business, level of education, and number of dependents. This research is a type of qualitative research using primary data, primary data was obtained from questions given to fish traders as many as 30 respondents using a questionnaire. The results of the research show that there is an influence of age, education, and number of dependents on the income level of fish traders at PPI Bonehalang.
