Abstract

Indonesia menghadapi permasalahan fragmentasi pengelolaan aset negara, rendahnya efisiensi investasi, serta persaingan global yang semakin meningkatkan kebutuhan akan lembaga pengelola investasi yang profesional. Untuk menjawab hal tersebut, pemerintah membentuk Badan Pengelola Investasi Daya Anagata Nusantara (Danantara). Penelitian ini bertujuan untuk menganalisis urgensi pembentukan Danantara dan mengidentifikasi problematika yang dihadapi dalam sistem investasi di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, historis, dan konseptual berdasarkan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa urgensi pembentukan Danantara didorong oleh ketidakefisienan pengelolaan aset BUMN, kebutuhan mempercepat pertumbuhan ekonomi nasional, serta upaya meningkatkan daya saing investasi internasional. Namun, Danantara juga menghadapi beberapa kendala, antara lain lemahnya mekanisme pengawasan, kekaburan norma hukum, keterbatasan transparansi, dan isu akuntabilitas terkait risiko kerugian investasi. Kondisi ini dapat menimbulkan ketidakpastian hukum dan moral hazard dalam pengelolaan aset negara. Kesimpulannya, diperlukan penguatan regulasi, transparansi, serta prinsip tata kelola yang baik agar Danantara dapat menjalankan perannya secara profesional dan akuntabel.

Abstract

Kegiatan pengabdian kepada masyarakat yang telah dilakukan dengan dasar atas rasa prihatin terhadap tingginya angka perceraian di Kabupaten Bojonegoro, karena perkawinan dibentuk bertujuan untuk mencapai kebahagiaan dunia sampai dengan akhirat. Ketidakmampuan mengolah setiap permasalahan yang dihadapi sangat besar kemungkinan memutuskan untuk mengakhiri bingkai rumah tangga yang dijalin dengan ikatan suci harus berakhir pada gerbang perceraian meskipun peristiwa tersebut dibenci oleh Tuhan Yang Maha Esa. Melihat kondisi sulitnya mempertahankan keutuhan dalam rumah tangga menjadi alasan tersendiri yang mendasari penulis untuk melakukan upaya pengabdian masyarakat dengan mewujudkan kesakinahan dalam rumah tangga. Dengan keadaan tersebut penulis bertujuan melakukan penyuluhan yang berkaitan dengan upaya mewujudkan keluarga sakinah yang diliputi dengan kasih dan sayang dalam rumah tangga. Selain itu, mengenalkan kriteria keluarga sakinah sebagaimana ketentuan dalam keputusan menteri agama republik Indonesia agar setiap keluarga berupaya memiliki keinginan untuk mewujudkan keluarga masing-masing ke arah sakinah I, sakinah II, sakinah III, dan sakinah III plus. Metode kegiatan ini dilaksanakan dengan cara penyuluhan, diskusi, dan tanya jawab terkait tema pembahasan, dan hasil kegiatan yang dicapai masyarakat memiliki pemahaman dan semangat untuk memperbaiki kualitas keluarga dengan standar yang diatur mengenai keluarga sakinah sebagaimana Keputusan Menteri Agama Republik Indonesia Nomor 3 Tahun 1999 tentang Pembinaan Gerakan Keluarga Sakinah.

Abstract

This study examines the integration of Samin cultural heritage within the development of the Bojonegoro Geopark, with particular attention to its representation in geopark planning, educational functions, and community participation. The research examines the integration of Samin cultural values, historical narratives, and social practices into the geopark framework. It also analyzes the forms and extent of Samin community participation in geopark-related initiatives and identifies the challenges of maintaining cultural identity within tourism-oriented development. The research employs a qualitative methodology that draws on empirical, historical, and conceptual approaches. Data were collected through in-depth interviews with Samin elders, community leaders, village officials, and members of Samin communities. Document analysis was used to examine policy documents, cultural records, and geopark planning materials. The data were analyzed using thematic analysis to identify recurring patterns, meanings, and relationships relevant to cultural representation and participation. The findings indicate that Samin's teachings emphasize honesty, non-violence, social responsibility, religious devotion, and harmony with nature. These values function as living traditions that support the educational, conservation, and community empowerment pillars of UNESCO Global Geoparks. The study also reveals active community participation in cultural preservation through rituals, traditional architecture, and cultural products. However, challenges emerge in balancing cultural authenticity with tourism-driven economic interests. The study concludes that inclusive governance and culturally sensitive geopark management are essential to ensure sustainable heritage preservation and community-centered development.

Abstract

Inheritance disputes involving adopted children are often a complex issue in legal practice in Indonesia, given the lack of comprehensive uniformity of arrangements between Western civil law, Islamic law, and customary law. This study aims to examine how Indonesia's positive law regulates the position of adopted children in terms of inheritance and dispute resolution mechanisms arising from claims of inheritance rights of adopted children. The normative juridical approach is used by examining various laws and regulations such as the Civil Code, the Child Protection Law, and the Compilation of Islamic Law (KHI), accompanied by case studies of court decisions. The results of the study show that in Western civil law, adopted children have an equal legal status with biological children in terms of inheritance, while in the perspective of KHI, adopted children do not automatically obtain inheritance rights, but can be given a mandatory will. Dispute resolution is carried out through litigation and non-litigation channels such as mediation, taking into account the principles of justice and protection of children. Therefore, legal harmonization and regulatory reform are needed to ensure legal certainty for adopted children in the context of inheritance

Abstract

The development of Artificial Intelligence technology has led to new forms of digital crime, one of which is deepfake pornography. This crime involves the manipulation of a person’s facial identity into pornographic content without consent, resulting in serious violations of privacy, dignity, reputation, and psychological well being. This study aims to analyze the legal construction of deepfake pornography within the Indonesian legal system and to examine the forms of legal protection available for victims. This research employs a normative legal method using statutory and conceptual approaches, supported by prescriptive and interpretative analysis of primary, secondary, and tertiary legal materials. The findings indicate that although several laws, such as the Pornography Law, the Information and Electronic Transactions Law, the Personal Data Protection Law, and the Law on Sexual Violence Crimes, may be applied to prosecute perpetrators, Indonesia still lacks a specific, comprehensive regulation that addresses the unique technical complexities of AI-generated content. This regulatory gap leads to inconsistencies in law enforcement and fails to address the rapid, borderless dissemination of deepfakes, leaving victim protection severely limited, particularly regarding long-term psychological recovery and the complex restoration of digital reputation. This study highlights the urgency of establishing a comprehensive, victim-centered legal framework that integrates criminal, civil, and administrative approaches within a global context, acknowledging that technologically driven harms constitute a pervasive and transnational challenge faced by legal systems worldwide.

Abstract

The implementation of electronic land certificates is a fundamental component of the digital transformation of land administration in Indonesia, aimed at increasing transparency, efficiency, and legal certainty. While previous studies often view electronic certificates as merely administrative tools, this study addresses a critical gap by analyzing their socio-legal implications and legal effectiveness in combating land mafia practices. Employing empirical legal research methods with a socio-legal approach, this study leverages in-depth interviews with the Bojonegoro Agrarian Office, law enforcement officers, and rural communities in East Java, as well as field observations. Empirical findings indicate that digitalization has resulted in significant improvements in administrative efficiency, reducing certificate issuance times by approximately 50% and measurably reducing document forgery disputes by 30% between 2022 and 2024. However, digitalization has proven only partially effective: rather than eliminating agrarian crimes, it has altered their modus operandi, creating new vulnerabilities to internal database manipulation and systemic bureaucratic collusion. Furthermore, a structural digital divide and persistent low public trust among rural and elderly demographics critically hinder the program's universal success. This manuscript contributes to the international scholarly discourse on digital land governance by demonstrating that, in developing countries, technological modernization must be strictly accompanied by institutional integrity, strict bureaucratic oversight, and socio-legal inclusiveness to achieve substantive legal certainty.
