Abstract

Introduction to The Problem: The rapid technological progress at this time has greatly influenced the development of the payment system in Indonesia. Innovations in electronic payment instruments have developed into more usable forms. Currently, like the other country, Indonesia is developing an electronic payment instrument known this day as e-money. Bank Rakyat Indonesia is one of the e-money issuer institutions, which issues Brizzi as an alternative non-cash payment instrument. The problem faced is that there are still many people who do not want to use e-money, especially Brizzi because they do not know the validity of using Brizzi e-money.Purpose/Objective Study: This research aims to study the importance of Brizzi E-Money as a means of payment.Design/Methodology/Approach: This research uses empirical juridical research methods to answer the validity of using Brizzi e-money as a payment method. This study uses primary data and secondary data. The primary data in this research are obtained from interviews at Bank Rakyat Indonesia, Merlung Branch. Other than that is secondary data collected through library research.Findings: This research shows that the existence of e-money continues to experience significant development from 2009 until 2019. The legality of using Brizzi e-money and other e-money in Indonesia has been recognized as a legal payment instrument as regulated in the PBI on Electronic Money.Paper Type: Research Article.

Abstract

The revocation of the Rural Bank (BPR) business license is inseparable from the function of the OJK in fostering and supervising the BPR. This study used an empirical legal research method, namely research was conducted at OJK Regional 3 Central Java and Yogyakarta Special Region. The results indicate that there are 2 legal protections provided by the government to depositors of funds, namely preventive and repressive legal protection. Preventive legal protection has the character of preventing problems, including the application of the principles of confidentiality and prudence. Meanwhile, the repressive legal protection that functions to resolve disputes that arise is the Deposit Insurance Corporation (LPS). Then the factors that cause the revocation of the BPR's business license are factors that come from internal BPRs that cannot manage the BPR properly. The revocation of the RB's business license was caused by 2 things, namely the revocation of the business license at the request of the shareholders and the revocation of the business license because the rescue efforts carried out did not bear fruit.

Abstract

Financial technology or fintech is a term or term to denote companies in the financial sector that provide modern technological innovations in banking payments. The number of financial technology is constantly increasing with various estimates and the number of more than ten thousand companies. The development of Financial Technology is inseparable from the risks, as some of the risks that arise are related to consumer protection which includes the protection of funds and user data. The purpose of this study is to find out how fintech regulation in Indonesia, to understand the existence of Fintech in the digital era and to know and understand the role of fintech in improving the welfare of society after the pandemic. The research method used is Normative Juridical and The approach method used is descriptive and qualitative research methods. The results showed that fintech is very popular and is an alternative to the use of financial technology and is a foundation for people who are far from the conventional financial business sector. OJK and BI as supervisors of the financial sector also issued several regulations related to the implementation of fintech in order to ensure a safe and comfortable financial business and not violate the principle of prudence. In its implementation, it is hoped that the public will not borrow and use fintech technology that has not been registered with the OJK or at BI. This requires the government to be more aggressive in socializing fintech that is legal and registered with the OJK or BI.

Abstract

Palm oil is one of the leading agricultural sectors which has an important role in Indonesia. In addition to being able to absorb new workers, the oil palm plantation business can also contribute to state revenues from crude palm oil (CPO) export levies, the demand for which is increasing every year. However, in recent years the level of productivity of oil palm plantations has decreased. This is due to the age of the plants that are getting older and not using superior and certified seeds at the start of planting. With this low level of productivity, it is necessary to carry out rejuvenation of oil palm plants. The target of this rejuvenation program is to be able to use both superior and certified seeds in order to increase plant productivity. This research uses normative juridical research methods, namely research conducted by researching and analyzing literature or secondary data only. The approach method is descriptive and qualitative research methods. The results showed that the government played an active role in implementing the oil palm rejuvenation program. This is evident from the many regulations made by the government or other stakeholders to support the smooth running of this program. In addition, as an effort to provide support in increasing palm oil productivity, especially in preparing funds for rejuvenation programs, the government has established the Oil Palm Plantation Fund (DPKS).

Abstract

The identification of transnational crimes is crucial not only because of the increasing cases of illegal fishing in Indonesia, which involve legal issues from other countries and call for effective law enforcement. concentrate on the welfare of catches produced by local Aru Islands fishermen. The descriptive analysis method is the research methodology used. By using a normative legal approach, data collection strategies use literature studies and documentary studies while the type of research used is qualitative research with primary and secondary data sources. The findings of this study are throughout 2017 until now the government has made efforts as much as possible on the fate of marine and local fishermen in the people of the Aru Islands district, seeing that all policies regarding the regulation of regional maritime boundaries no longer include the authority of the regional government but the duties and responsibilities of the Provincial Government.

Abstract

One effort to increase the productivity of oil palm plants is to carry out a replanting program. In implementing the oil palm plant rejuvenation program, most of the planters come from low-educated communities who lack knowledge regarding what and how partnership patterns are. It is the government's authority to regulate cooperative relations between plantation companies and farmers. This collaboration is carried out considering that planters may not be capable enough to work on rejuvenating their oil palm plantations, whereas if oil palm trees that are over 20-25 years old are not rejuvenated, they will no longer be productive and will produce little fruit. This collaboration is carried out by plantation companies as the core and plasma farmers/planters. In implementing this replanting program, there are several models of partnership patterns, one of which is the Intiplasm partnership pattern which is the most popular in implementing this program. The method used in this research is Normative Juridical with the research approach used is qualitative by examining statutory documents and comparing them with conditions in the field. The research results showed that the implementation of Minister of Agriculture Decree Number 940/KPTS/OT.210/10/97 concerning Guidelines for Agricultural Business Partnerships in the Implementation of Oil Palm Plant Rejuvenation has been carried out well, as evidenced by the existence of several regions in Indonesia that have successfully and completed following replanting using the intiplasma partnership pattern. This type of partnership pattern in implementing replanting is very important, because it can help people who do not have funds to continue participating in the replanting program. Then the form of legal protection obtained by farmers if a dispute occurs is through mediation and efforts to resolve disputes outside of court. Then, if no bright spot is found, the problem can then be resolved in court with all the consequences. Keywords: Palm Oil; Rejuvenation; Partnership Pattern.

Abstract

Palm oil or crude palm oil (CPO) is one of Indonesia's leading export commodities. The high level of exports is not accompanied by the provision of subsidized fertilizer for independent community farmers. Through the Ministry of Agriculture (Kementan) it has decided to remove subsidized fertilizer for oil palm plantations. With the elimination of fertilizer subsidies for oil palm farming, it makes it difficult for farmers to meet their fertilizer needs. The policy of eliminating subsidized fertilizer assistance has a direct impact on the productivity of oil palm farmers. The problems studied are limited to: What impact will there be after the ratification of the Minister of Agriculture Regulation No. 10 of 2022 concerning Procedures for Determining the Allocation and Highest Retail Prices for Subsidized Fertilizers in the Agricultural Sector related to the elimination of fertilizer subsidies for oil palm plantations? and How to overcome the problem of no subsidized fertilizer for oil palm farmers? The research method used is the Empirical Juridical method. The research results show that there are many impacts that can occur with the elimination of subsidized fertilizers by the government, especially for oil palm plants. Fluctuating CPO prices tend to make farmers unable to predict their income and set aside to purchase non-subsidized fertilizer which is unaffordable. Then the countermeasure initiated by the government is to use organic fertilizer, but it can take a long time to process organic fertilizer and the results can only be seen one year later. This is different from chemical fertilizers where the results can be seen immediately in a matter of months.

Abstract

This research explores the legal perspective on intellectual property rights (IPR) cases in technology businesses with a focus on the provisions of Article 25 of the Information and Electronic Transactions Law (UU ITE). Article 25 of the ITE Law is the central point in regulating IPR protection in the digital business world in Indonesia. In this context, this research investigates the implementation and impact of Article 25 of the ITE Law on cases of intellectual property rights violations in the era of digital technology. This research uses qualitative descriptive research. This research methodology involves legislative analysis and case studies to identify challenges and opportunities faced by intellectual property rights holders and technology business actors. Using a normative and descriptive legal approach, this research analyzes whether Article 25 of the ITE Law provides adequate protection for intellectual property rights and the extent to which its implementation provides legal certainty for business actors. The research results show that Article 25 of the ITE Law provides a sufficient legal basis for protecting intellectual property rights in technology businesses. However, challenges related to the interpretation and enforcement of Article 25, especially in cases of IPR violations, remain an issue that requires serious attention from policy makers and legal practitioners. This research provides recommendations for improvements and clarifications in the implementation of Article 25 of the ITE Law, as well as the need to increase legal awareness among technology business players to ensure optimal protection of intellectual property rights in this digital era

Abstract

Perum Bulog belum dapat memenuhi kebijakan yang telah ditetapkan oleh pemerintah Indonesia yang seharusnya menjaga kestabilan harga komditi jagung dari petani dan dapat meningkatkan taraf hidup petani. Tujuan dari penelitian ini yaitu untuk mengetahui bagaimana kedudukan dan fungsi Perum Bulog dalam peraturan Perundang-undangan serta faktor-faktor apa saja yang menghambat stabilitas harga komoditi jagung dari petani di Kabupaten Bojonegoro. Berdasarkan permasalahan yang dibahas maka penulis menggunakan metode penelitian hukum normatif-empiris, khususnya penelitan terhadap asas-asas hukum dan gambaran umum obyek penelitian. Hal tersebut ditunjukkan agar mampu meninjau dan menganalisa masalah-masalah tersebut untuk memecahkan masalahnya. Terhadap permasalahan yang dibahas maka dapat disimpulkan dari permasalahan pertama mengenai kedudukan dan fungsi Perusahan Umum Badan Urusan Logistik atau Perum Bulog yang diatur dalam peraturan Perundang-undangan. Sedangkan dari pembahasan permasalahan kedua maka dapat ditarik kesimpulan bahwa sebagai lembaga yang ditugaskan pemerintah maka Perusahan Umum Badan Urusan Logistik memiliki peran dalam mejaga stabilisasi atau pengendalian harga komoditi jagung dari petani di kabupaten bojonegoro

Abstract

Penelitian ini membahas tentang prinsip keterbukaan dan akuntabilitas dalam mekanisme pengangkatan Penjabat (Pj) Kepala Daerah di Indonesia. Penjabat Kepala Daerah bertugas mengisi posisi kepala daerah sementara jika pejabat kepala daerah yang sebenarnya absen atau belum diangkat secara permanen. Mekanisme pengangkatannya diatur oleh Pasal 86 UU No 23 Tahun 2014 tentang Pemerintahan Daerah, di mana Presiden menunjuk penjabat gubernur berdasarkan usulan Menteri Dalam Negeri, sedangkan Menteri Dalam Negeri menunjuk penjabat bupati/wali kota berdasarkan usulan gubernur. Namun, hingga saat ini, peraturan pemerintah yang spesifik mengenai persyaratan, masa jabatan, evaluasi, dan monitoring terhadap kinerja penjabat kepala daerah belum ada, sesuai dengan yang diamanatkan oleh UU Pemerintahan Daerah. Hasil penelitian menunjukkan bahwa pengangkatan penjabat kepala daerah di Indonesia masih belum sepenuhnya mengedepankan prinsip keterbukaan dan akuntabilitas. Keterbatasan peraturan menyebabkan ketidaktransparanan dan kurangnya pertanggungjawaban dalam mekanisme pengangkatan. Prinsip keterbukaan yang menuntut proses pengangkatan dapat diakses dan dipahami oleh masyarakat belum terpenuhi sepenuhnya. Sementara itu, prinsip akuntabilitas yang membutuhkan pertanggungjawaban atas keputusan dan tindakan juga belum diimplementasikan dengan baik
