Abstract

Sanction dualism often arises in offenses such as fraud, embezzlement, or persecution, where a single act violates public legal norms and simultaneously causes personal harm to individuals. This study explores the concept of sanction dualism the simultaneous imposition or potential overlap of criminal and civil sanctions in cases of unlawful acts within the Indonesian legal system. Using a normative juridical method, the study relies on legislative and conceptual approaches grounded in the theory of legal integration, which supports a cross-branch legal framework. The research identifies two key issues: how the legal system conceptualizes sanction dualism and how it manages the harmonization between criminal and civil law. The findings highlight that although Indonesia permits the application of dual sanctions, there are significant procedural and institutional challenges. These include limited integration of civil claims within criminal proceedings, a lack of clear technical guidelines, and inadequate protection of victims’ rights. Consequently, legal processes often become fragmented and fail to deliver substantive justice. The study recommends regulatory reform, improved coordination among legal institutions, and stronger adoption of integrative legal approaches. These efforts are crucial for achieving a legal process that is fair, efficient, and capable of restoring both legal certainty for perpetrators and justice for victims. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, serta studi kasus yang relevan. Teori yang menjadi dasar analisis adalah teori integrasi hukum yang menjelaskan perlunya pendekatan lintas-cabang hukum dalam menangani satu perbuatan melawan hukum. Hasil penelitian menunjukkan bahwa sistem hukum Indonesia secara normatif memungkinkan pemberlakuan dualisme sanksi, namun pelaksanaannya masih menghadapi tantangan dalam hal prosedur, kelembagaan, dan perlindungan hak-hak korban. Meskipun KUHAP mengatur kemungkinan penggabungan gugatan perdata dalam proses pidana, penerapannya masih terbatas dan jarang digunakan. Selain itu, belum adanya pedoman teknis yang jelas menyebabkan proses hukum sering berjalan secara terpisah dan tidak sinkron, sehingga berisiko mengabaikan keadilan substantif. Penelitian ini merekomendasikan perlunya harmonisasi yang lebih sistematis antara hukum pidana dan perdata, baik melalui pembaruan regulasi, peningkatan koordinasi antarlembaga penegak hukum, maupun penguatan pemahaman aparat terhadap pendekatan integratif. Tujuannya adalah agar proses hukum dapat berjalan secara efisien, adil, dan komprehensif, sekaligus menjamin pemulihan hak korban dan kepastian hukum bagi pelaku.

Abstract

Desa Taman Baru di Kecamatan Kalianda, Kabupaten Lampung Selatan, Provinsi Lampung, Indonesia, memiliki potensi wisata alam yang menjanjikan, dengan daya tarik utama berupa pantai dan air terjun, serta fasilitas rekreasi lainnya seperti Taman Wisata dan Taman Rekreasi. Salah satu destinasi utama, Way Tebing Ceppa, merupakan pemandian alami dengan sumber air dari Gunung Rajabasa yang terletak dekat dengan akses Jalan Lintas Sumatera dan Pelabuhan Bakauheni. Namun, seiring perkembangan teknologi informasi, masyarakat Desa Taman Baru menghadapi tantangan dalam pemahaman aspek hukum dan etika penggunaan teknologi digital. Minimnya literasi digital ini dapat menyebabkan berbagai masalah, seperti pelanggaran hak cipta dan keamanan digital. Untuk mendukung perkembangan pariwisata dan mengedukasi masyarakat, pelatihan mengenai keamanan digital, etika media sosial, hak cipta, dan pengelolaan informasi diadakan. Pelatihan ini diharapkan dapat meningkatkan keterampilan masyarakat dalam mengelola konten secara bertanggung jawab, serta meningkatkan daya tarik wisata melalui promosi digital yang lebih aman dan efektif.

Abstract

The Responsibility to Protect (R2P) is an international law principle that affirms the obligation of the international community to protect populations from genocide, crimes against humanity, and other mass atrocities. The Rohingya crisis in Myanmar highlights the persistent tension between R2P and state sovereignty. This article analyzes that tension by examining the challenges of implementing R2P in Myanmar, where the government has consistently rejected foreign intervention. Using a conceptual analysis and a case research of the Rohingya refugee crisis, the research explores how sovereignty claims and regional norms, particularly ASEAN’s principle of non-interference, constrain international responses. The findings show that although R2P provides a normative framework for addressing gross human rights violations, its implementation in Myanmar has been hindered by state resistance and regional political dynamics. This article contributes to debates on international justice and sovereignty by offering insights into the limitations and potential pathways for more effective R2P implementation within the ASEAN context.

Abstract

Purpose: This study aims to analyze the harmonization of modern criminal law and customary law to achieve fair criminal law enforcement through a case study of the settlement of minor criminal offenses using customary mechanisms in Lampung Province. Methodology: This study employs an empirical juridical method with a qualitative approach. Data were collected through a literature review, analysis of statutory regulations, judicial decisions, and documentation of criminal dispute resolution practices involving Lampung’s customary institutions. Results: The findings show that Lampung customary law remains effective in resolving minor criminal cases through restorative justice, integrating customary values with national criminal law while ensuring legal certainty and human rights protection. The study concludes that legal harmonization strengthens substantive justice, public trust, and social harmony. This study is limited to minor criminal disputes in Lampung Province. Conclusions: This study concludes that the harmonization of modern criminal law and customary law can strengthen substantive justice, improve public trust in law enforcement, and promote sustainable social harmony. Customary approaches can serve as complementary mechanisms within the national criminal justice system, particularly for minor offenses. Limitations: This study is limited to customary criminal dispute resolution practices in Lampung Province and primarily focuses on minor criminal offenses, which may restrict the generalizability of the findings to other regions and types of crimes. Contributions: This study contributes to the development of criminal law by providing an empirical model for integrating customary law into restorative justice policies and supporting future legal reforms in Indonesia.
