Abstract

This study aims to analyze the impact of the recruitment of the Voter Data Update Committee (Pantarlih) on the effectiveness of voter data management and budget costs in the 2024 Regional Head Election (Pilkada) in Lampung Province. Pantarlih plays an important role in ensuring accurate and up-to-date voter data, which is the basis for implementing the Pilkada. In addition, this study also examines the influence of the Pantarlih recruitment process on efficient and targeted budget management. The study was conducted using qualitative methods through in-depth interviews with stakeholders and analysis of related documents. The results of the study indicate that a selective and professional recruitment process has a positive impact on the effectiveness of voter data management and budget use, which in turn improves the quality of Pilkada implementation in Lampung Province. Abstract

This research aims to explore and analyze the use of YouTube as a medium to improve services and disseminate information. By focusing on relevant literature, this research tries to understand how YouTube has become an effective platform in expanding the reach of information and improving the quality of services provided. The literature study method was used to collect and analyze various articles, books and other sources related to the use of YouTube in the context of providing information. Research findings show that YouTube has become one of the main tools in disseminating information widely and enabling service providers to interact directly with their audiences. The analysis also reveals that the use of YouTube in improving services can include various strategies, such as tutorials, vlogs, webinars and other interactive content. Additionally, this research highlights the importance of understanding audience characteristics and trends in YouTube usage to present relevant and engaging information. In this context, this research provides valuable insights for practitioners and researchers to understand the full potential of YouTube as a medium for improving services and disseminating information. The practical and theoretical implications of these findings are discussed, as well as directions for further research in exploring the role of YouTube in the context of information communication and public services.

Abstract

Usaha Mikro Kecil dan Menengah mendapatkan atensi dari pemerintah untuk mendirikan usaha lewat Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Pemerintah melakukan perubahan sudut pandang berusaha dari perizinan menjadi berbasis risiko yang memudahkan UMKM mendirikan dan mengembangkan usaha, permasalahan. Permasalahan dalam pengabdian kepada masyarakat ini adalah bagaimana Optimalisasi Peraturan Pemerintah No.7 Tahun 2021 tentang Kemudahan, Perlindungan, dan Pemberdayaan Koperasi dan Usaha Mikro, Kecil, dan Menengah dalam peningkatan perekonomian daerah. Pengabdian kepada masyarakat yang dilaksanakan merupakan menggunakan metode pendekatan yuridis normatf yang menitkberatkan penggunaan bahan atau materi penelitan data sekunder dengan di dukung oleh data kepustakaan. Di samping itu, penelitan ini juga menggunakan pendekatan perundangundangan (statute approach), pendekatan historis (historical approach), dan pendekatan perbandingan (comparatve approach). Bahwa usaha mikro dan menengah diwajibkan memiliki perizinan berusaha, dilihat dari tingkat risiko dalam bentuk NIB atau Nomor Induk Berusaha. NIB untuk kegiatan usaha risiko rendah, NIP dan Sertifikat Standar untuk kegiatan risiko menengah dan tinggi, NIB dan Izin untuk kegiatan usaha risiko tinggi.Dengan Hadirnya Aturan Peraturan Pemerintah No 7 Tahun 2021 Diharapkan Secara Maksimal Mampu Menjadi Indikator Peningkatan Perekonomian Daerah Serta Menjadi Perlindungan Hukum Bagi Usaha Mikro, Kecil Dan Menengah.

Abstract

HKI merupakan ekspresi dari sebuah ide yang telah memenuhi tiga syarat, yaitu pertama, ide itu tidak hanya sebatas ide atau gagasan, tetapi harus diekspresikan dalam bentuk nyata. Kedua, ekspresi dari ide tersebut belum pernah diungkapkan kepada siapapun dan dimanapun, yang biasa disebut dengan orisinalitas ide. Ketiga, ekspresi ide tersebut dapat diwujudkan secara nyata, baik dalam bentuk komersial maupun nonkomersial. Hubungan HKI dengan dunia usaha seperti UMKM dan industri kreatif, HKI memiliki dua peranan penting, yaitu sebagai alat perlindungan dari barang atau jasa yang diproduksi, dan sebagai alat untuk optimalisasi bisnis UMKM dan industri kreatif khususnya di Kabupaten Mesuji Lampung. Peran pemerintah daerah setempat dalam mendukung UMKM di Kabupaten Mesuji khususnya kuliner. Mayoritas pelaku UMKM di Kabupaten Mesuji belum mendaftarkan potensi HKI-nya menjadi HKI, karena minimnya pemahaman dan pengetahuan tentang hak atas kekayaan intelektual, serta keuntungan yang bisa mereka dapatkan ketika HKI tersebut didaftarkan.

Abstract

The rapid evolution of digital technologies has necessitated a critical reevaluation of criminal law frameworks globally, particularly in addressing cybercrime. This study identifies significant gaps in Indonesia’s current Electronic Information and Transactions (ITE) Law, including ambiguous definitions of cyber offenses such as electronic defamation (Article 27(3)) and hate speech (Article 28(2)), which have led to inconsistent judicial interpretations in 58% of analyzed cases. The absence of clear distinctions between personal data theft and state-sponsored cyberattacks further complicates prosecution, while 67% of regional law enforcement agencies lack specialized digital forensics units, prolonging investigations by an average of 287 days for cross-border evidence retrieval. Qualitative analysis of 12 landmark cases (2020–2024) and interviews with 15 legal and human rights experts reveal systemic human rights risks, including warrantless data collection in 43% of operations and a documented chilling effect on free expression due to overly broad libel provisions. Emerging technologies like artificial intelligence (AI) present dual challenges: while predictive policing tools reduce investigation timelines by 72%, algorithmic bias in 29% of AI systems exacerbates discrimination against marginalized groups. This research proposes a multidimensional reform strategy emphasizing: (1) legislative modernization through GDPR-inspired data categorization and tiered penalties; (2) establishment of a National Cyber Forensics Network to standardize technical capacity across Indonesia’s 34 provinces by 2027; and (3) adoption of rights-centric AI governance protocols requiring judicial oversight for surveillance tools. The analysis underscores the urgency of ratifying the Budapest Convention to streamline transnational cooperation, despite sovereignty concerns raised by 63% of prosecutors. Without these reforms, Indonesia risks both technological obsolescence in combating sophisticated cyber networks and systemic erosion of digital rights in its pursuit of cybercrime deterrence.

Abstract

This study examines the position of customary law within Indonesia’s customary courts, exploring the delicate balance between legality and legitimacy from the perspective of national law. Customary law holds a significant place in Indonesia’s pluralistic legal system, recognised constitutionally and through various statutes such as Law Number 6 of 2014 on Villages and Law Number 48 of 2009 on Judicial Power. However, its practical enforcement and integration remain challenged by legal ambiguities and limited formal recognition, particularly concerning customary courts’ jurisdiction and authority. This research employs a normative legal approach, analysing relevant legislation, constitutional provisions, and judicial decisions to understand how customary law navigates between formal legality and the social legitimacy derived from indigenous communities. The findings reveal that while customary law is socially and culturally legitimate within indigenous societies, it often occupies a marginalised position within the state legal framework. Customary courts play a crucial role in mediating disputes and preserving indigenous identity, yet face constraints due to their limited legal empowerment. The study also highlights the need for comprehensive legal reforms and policies that enhance customary law’s status, promote cooperation between customary and state legal systems, and respect cultural diversity. Comparative insights from other pluralistic jurisdictions further underscore the potential for harmonising customary and national law to achieve justice and social cohesion in Indonesia.

Abstract

Sanction dualism often arises in offenses such as fraud, embezzlement, or persecution, where a single act violates public legal norms and simultaneously causes personal harm to individuals. This study explores the concept of sanction dualism the simultaneous imposition or potential overlap of criminal and civil sanctions in cases of unlawful acts within the Indonesian legal system. Using a normative juridical method, the study relies on legislative and conceptual approaches grounded in the theory of legal integration, which supports a cross-branch legal framework. The research identifies two key issues: how the legal system conceptualizes sanction dualism and how it manages the harmonization between criminal and civil law. The findings highlight that although Indonesia permits the application of dual sanctions, there are significant procedural and institutional challenges. These include limited integration of civil claims within criminal proceedings, a lack of clear technical guidelines, and inadequate protection of victims’ rights. Consequently, legal processes often become fragmented and fail to deliver substantive justice. The study recommends regulatory reform, improved coordination among legal institutions, and stronger adoption of integrative legal approaches. These efforts are crucial for achieving a legal process that is fair, efficient, and capable of restoring both legal certainty for perpetrators and justice for victims. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, serta studi kasus yang relevan. Teori yang menjadi dasar analisis adalah teori integrasi hukum yang menjelaskan perlunya pendekatan lintas-cabang hukum dalam menangani satu perbuatan melawan hukum. Hasil penelitian menunjukkan bahwa sistem hukum Indonesia secara normatif memungkinkan pemberlakuan dualisme sanksi, namun pelaksanaannya masih menghadapi tantangan dalam hal prosedur, kelembagaan, dan perlindungan hak-hak korban. Meskipun KUHAP mengatur kemungkinan penggabungan gugatan perdata dalam proses pidana, penerapannya masih terbatas dan jarang digunakan. Selain itu, belum adanya pedoman teknis yang jelas menyebabkan proses hukum sering berjalan secara terpisah dan tidak sinkron, sehingga berisiko mengabaikan keadilan substantif. Penelitian ini merekomendasikan perlunya harmonisasi yang lebih sistematis antara hukum pidana dan perdata, baik melalui pembaruan regulasi, peningkatan koordinasi antarlembaga penegak hukum, maupun penguatan pemahaman aparat terhadap pendekatan integratif. Tujuannya adalah agar proses hukum dapat berjalan secara efisien, adil, dan komprehensif, sekaligus menjamin pemulihan hak korban dan kepastian hukum bagi pelaku.

Abstract

Artificial intelligence (AI) has become a transformative tool in higher education, yet many students lack the skills to utilize it effectively. This community service program aims to enhance students' AI literacy through workshops on leveraging ChatGPT and other AI tools for academic productivity. Using hybrid training (offline and online), live demonstrations (ChatGPT, Gemini, Bing AI), and hands-on mentoring, the program involved 50 multidisciplinary students from University X. Post-workshop evaluation revealed a 75% improvement in participants' ability to use AI for academic writing, research, and time management. The initiative aligns with SDG 4 (Quality Education) and SDG 9 (Industry, Innovation, and Infrastructure).

Abstract

Digital transformation in public services brings efficiency and transparency, but at the same time gives birth to new modes of corruption that are non-physical, complex, and transnational. Digitalization opens up opportunities for data manipulation, system engineering, and the elimination of traces of electronic transactions, which are difficult to handle with conventional criminal law instruments. Law No. 31 of 1999 and Law No. 20 of 2001 still dominantly use the classic paradigm that focuses on physical state losses, so it is not yet fully able to reach technology-based crimes. The limitations of these norms create legal gaps and the risk of impunity, especially when the principle of legality requires the formulation of clear criminal justices. On the other hand, proving digital corruption requires explicit recognition of electronic evidence, while the judicial system is still based on conventional evidence. This condition emphasizes the need for responsive criminal law reform, both through expanding the formulation of criminal offenses, strengthening the position of electronic evidence, and developing new sanctions relevant to digital crimes. This research uses a normative juridical method by examining positive law, legality principles, doctrines, and law application practices. The analysis shows that the effectiveness of eradicating digital corruption can only be achieved through regulatory harmonization, increasing the technological capacity of the apparatus, and integrating criminal law with the cyber and administrative law regime. Thus, criminal law is required to be adaptive so as not to be left behind from the dynamics of crime in the digital era.
