Abstract

This study examines the characteristics of positive legal justice in Indonesia and the use of the concept of adab from the Islamic worldview as an offer to reconstruct legal justice in Indonesia. This research is doctrinal research using inductive-deductive logic using library materials. The data was then analyzed using qualitative methods. The results showed that First, the characteristics of legal justice in Indonesia, which are based on the paradigm of legal positivism, show that the essence of the source of justice comes from written legal norms, namely the law that separates law and morals. In the end, the separation itself is a manifestation of the law of partial justice. Many legal justice ideas have been developed by several legal experts in Indonesia by making efforts to reconstruct positivist legal thought into the context of Indonesian legal thought that reflects the values of justice based on state philosophy and guidelines for the Preamble of the 1945 Constitution, "For the sake of justice based on the Divine The Almighty. Second, Civilized legal justice based on Adab values is then used as an offer to reconstruct the existing positive legal justice so that the new legal justice will be able to reflect all the virtues that come from the highest standards these are wisdom, courage, temperance, and justice. Legal justice as the result of the implementation of the law will have the essence of high virtue values and the requirements for correct knowledge, if implemented, will lead to fair conditions as reflected by Adab.

Abstract

Olahraga masa kini tidak lagi sekadar soal gerak fisik, tetapi telah berubah menjadi industri besar yang penuh kepentingan, sehingga sengketa dalam pertandingan pun semakin sering muncul mulai dari protes hasil, masalah teknis, hingga konflik administratif dan pelanggaran etika. Penyelesaian melalui litigasi atau arbitrase memang memberikan kepastian hukum, tetapi sering kali lambat, mahal, dan kurang mencerminkan nilai pendidikan dalam olahraga. Di sinilah musyawarah mufakat menawarkan alternatif yang lebih manusiawi dan dialogis, sejalan dengan nilai Pancasila dan prinsip ADR yang mendorong keputusan cepat, efisien, dan menjaga hubungan baik. Penelitian ini menggunakan pendekatan empiris untuk melihat bagaimana musyawarah bekerja dalam praktik, khususnya pada Porprov Muba 2025 yang dijadikan contoh nyata penerapan penyelesaian sengketa berbasis kearifan lokal. Melalui observasi dan wawancara, ditemukan bahwa dari tiga sengketa yang terjadi, semuanya dapat diselesaikan melalui musyawarah tanpa harus naik ke jalur banding. Hasil ini menunjukkan bahwa musyawarah mufakat tidak hanya mampu meredam konflik dengan cepat, tetapi juga membantu menanamkan nilai fair play melalui dialog yang mendorong empati, kesadaran diri, dan integritas. Temuan tersebut menegaskan bahwa musyawarah mufakat memiliki peran penting dalam membangun ekosistem olahraga yang sehat, harmonis, dan berkarakter, sehingga layak diinstitusionalisasikan sebagai mekanisme penyelesaian sengketa utama dalam kompetisi olahraga di berbagai tingkatan.

Abstract

In Indonesian positive law, the prohibition of all forms of child abuse is not only present as a legal norm, but also as a moral commitment of the state to guarantee the dignity and safety of children. However, the reality on the ground shows that violence against children still often occurs in closed domestic spaces. Some of these acts are justified on the grounds of discipline, as if the use of physical violence were a legitimate tool in the parenting process. This study aims to identify and understand the precise limits of physical violence that is justified as child discipline under Indonesian positive law and to determine whether there are legal loopholes that allow parental violence in the context of discipline to go unpunished. This study uses normative legal research, an approach that centres legal texts and norms. Indonesian positive law, in principle, prohibits all forms of violence against children. However, the regulations do not provide a clear limit on which disciplinary actions remain justifiable. In other words, the legal boundaries exist normatively, but are not explicitly and operationally articulated so that they can be easily applied in practice. When these provisions are applied in practice, it is clear that there are still significant ambiguities and legal loopholes, namely, the absence of a definition or limitation of discipline in positive law. The existence of room for subjective interpretation by officials and judges. Socio-cultural constructs that still legitimise corporal punishment. The linking of violent offences to the element of injury, so that 'minor' violence often goes unpunished. The absence of explicit norms prohibiting physical violence as a form of child discipline. The lack of consistent law enforcement guidelines and jurisprudence. It is this law that opens up the possibility of impunity, namely, the suboptimal criminal accountability of perpetrators of violence who hide behind the excuse of discipline.

Abstract

This study aims to analyse the regulation of termination of employment in Indonesia following the enactment of Law No. 6 of 2023 on Job Creation, compare it with the legal framework in South Korea, and propose a reconstructed model that ensures a more balanced and equitable employment termination system. Termination of employment (PHK) remains a central issue in labour law because it directly affects workers’ rights, the stability of industrial relations, and sustainable economic development. The enactment of Law No. 6 of 2023 on Job Creation has introduced significant changes to Indonesia’s employment termination framework, reflecting a shift toward greater labour market flexibility while raising concerns regarding legal certainty and the adequacy of worker protection. This study employs normative legal research using statutory and comparative law approaches through an analysis of legislation, judicial decisions, and relevant scholarly literature. The findings reveal that Indonesia’s current regulatory framework primarily focuses on post-termination compensation, while providing insufficient safeguards regarding substantive grounds for dismissal and preventive procedural protections. In contrast, South Korea adopts the principle of dismissal for just cause, supported by strict and participatory dismissal procedures, comprehensive unemployment insurance, and active labour market policies. Based on this comparative analysis, the article proposes a reconstructed model for Indonesia that incorporates clear limitations on dismissal based on valid and objective grounds, strengthens preventive and transparent dismissal procedures, and expands comprehensive post-termination social protection. The proposed model is expected to achieve a more balanced relationship between labour market flexibility and worker protection while enhancing legal certainty and fairness within Indonesia’s industrial relations system.

Abstract

Pengabdian kepada masyarakat ini bertujuan untuk menganalisis peran ahli hukum dalam penguatan kepatuhan jaminan sosial ketenagakerjaan pemerintah daerah di Provinsi Sumatera Selatan melalui mekanisme Penghargaan Paritrana. Jaminan sosial ketenagakerjaan merupakan instrumen perlindungan hukum tenaga kerja yang bersifat wajib, namun dalam praktiknya tingkat kepatuhan pemerintah daerah dan badan usaha masih menunjukkan variasi yang signifikan. Pengabdian ini menggunakan pendekatan kualitatif deskriptif dengan model pengabdian berbasis kebijakan publik. Kegiatan dilaksanakan pada bulan Juli 2025 melalui tahapan persiapan, sosialisasi, evaluasi dokumen, dan wawancara kandidat pemerintah daerah serta badan usaha peserta BPJS Ketenagakerjaan. Teknik pengumpulan data meliputi studi dokumen, observasi partisipatif, dan wawancara semi-terstruktur yang dianalisis secara deskriptif-analitis dengan perspektif hukum. Hasil pengabdian menunjukkan bahwa keterlibatan ahli hukum berkontribusi signifikan dalam meningkatkan pemahaman normatif mengenai kewajiban jaminan sosial, memperkuat argumentasi kepatuhan berbasis regulasi, serta mengidentifikasi kendala kelembagaan dan kebijakan di tingkat daerah. Selain itu, mekanisme Paritrana terbukti efektif sebagai instrumen evaluatif dan edukatif yang mendorong kesadaran hukum dan budaya kepatuhan terhadap jaminan sosial ketenagakerjaan. Pengabdian ini menegaskan bahwa peran ahli hukum penting dalam menjembatani norma hukum dan praktik kebijakan daerah guna memperkuat perlindungan hukum tenaga kerja secara berkelanjutan.
