Abstract

Penelitian ini bertujuan untuk menyelidiki, merasionalisasi dan mengidentifikasi isu perlindungan hukum bagi pekerja informal yang masuk kategori kritikal. Oleh karena itu, artikel ini diberi judul Tantangan dan Peluang Dalam Perlindungan Hukum Bagi Pekerja Sektor Informal Dalam Pembangunan Ketenagakerjaan di Indonesia. Metode penelitian yang digunakan adalah pendekatan yuridis normative, studi dokumen, menggunakan metode kualitatif dalam menganalisis data dan menggunakan data sekunder sebagai sumbernya. Hasil penelitian ini menemukan bahwa Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang sama sekali tidak mengatur tentang pekerja informal sehingga terjadi kekosongan dalam hal perlindungan hukum bagi pekerja informal di Indonesia. Oleh karena itu, diperlukan peraturan perundang-undangan nasional tentang perlindungan hukum bagi pekerja informal yang pada intinya adalah memuat perjanjian kerja antara pengusaha dan pekerja/buruh informal. Dengan demikian, pemerintah bersama legislatif diharapkan dapat menetapkan peraturan dan perundang-undangan guna melindungi pekerja informal dan rentan di tengah-tengah meningkatnya informalisasi pasar kerja akibat dampak akselerasi kemajuan teknologi informasi dan komunikasi.

Abstract

This study highlights the central role of State-Owned Enterprises (SOEs) in managing strategic sectors as a realization of the mandate of Article 33 of the 1945 Constitution of the Republic of Indonesia. This paper questions the legitimacy, constitutional limitations, and oversight mechanisms for monopoly rights granted by the President to SOEs, as well as the challenges of policy implementation in the context of national economic governance reform. The methodology used is a normative legal approach with conceptual analysis, legislation, and comparative studies with other countries. The study was conducted on key regulations such as Law No. 5 of 1999, Law No. 1 of 2025, and KPPU documents, supported by a review of Constitutional Court decisions. The analysis was conducted using legal hermeneutics and qualitative methods to interpret the constitutional limits and effectiveness of SOE monopoly supervision. The results of the discussion found that the constitutional legitimacy of SOE monopolies is indeed sourced from Article 33 of the 1945 Constitution, but their implementation must meet the requirements of efficiency, justice, and legal certainty. It was found that granting monopolies without periodic supervision and evaluation risks causing abuse of authority, market distortion, and discriminatory practices against other business actors. The KPPU's role as an independent supervisory body has proven strategic in preventing violations and correcting monopolistic policies inconsistent with the principles of fair competition. Strengthening oversight mechanisms, transparency of audit results, public involvement, and regular independent audits are needed as a foundation for adaptive and accountable governance. Recommendations for regulatory reform, effective KPPU involvement, and public participation are proposed to balance state interests and protection of business competition. The conclusion emphasizes that monopoly by state-owned enterprises is not an end in itself, but rather an instrument for realizing public welfare if implemented with transparency, strict oversight, and high accountability in accordance with the principles of constitutional economic democracy.

Abstract

Purpose: This study aims to analyse the characteristics of horizontal conflict in Indonesia and evaluate the significance of a cultural approach based on Bhinneka Tunggal Ika (Unity in Diversity) for conflict resolution. This study also examines the contribution of a cultural approach to more effective, sustainable conflict resolution strategies, aligned with the Asta Gatra framework as a pillar of national resilience. Study Design/Methodology/Approach: This study uses an interpretivist-phenomenological philosophy with an empirical-inductive method and an archival study strategy to identify patterns of culture-based conflict resolution in various regions of Indonesia. The data were obtained through a literature review, document analysis, and stakeholder interviews and then analysed reductively to ensure links with the socio-cultural, ideological, and security dimensions of Asta Gatra. Findings: The research results indicate that a cultural approach based on Bhinneka Tunggal Ika (Unity in Diversity) has significant potential to reduce horizontal conflict and strengthen social cohesion. However, implementation limitations due to a lack of integration with policy, development, and the legal system require collaboration between the government, indigenous communities, and legal institutions as a key to national stability.

Abstract

This study aims to analyze the application of the maṣlaḥah principle in the dispute resolution mechanism of customary land among the Dayak Kenyah community in Pampang Village, Samarinda. This issue is significant because customary land functions not only as an economic asset but also as a source of identity, spirituality, and cultural sustainability. The maṣlaḥah approach in Islamic law offers an ethical framework that aligns with the communal justice and social harmony values upheld by indigenous communities. This research employs a qualitative method with a normative-empirical approach. Data were collected through the study of legislation, customary documents, interviews with traditional leaders, and direct observation of customary deliberation practices. The analysis connects the principles of maṣlaḥah mursalah and Islamic social justice theory with the indigenous dispute resolution practices that emphasize deliberation, consensus, and the balance of collective interests. The findings reveal that the Dayak Kenyah customary dispute resolution mechanism reflects maṣlaḥah values, particularly in maintaining collective welfare, preventing social division, and ensuring proportional justice distribution. However, its effectiveness remains limited due to the lack of formal recognition of customary decisions. This study recommends integrating the outcomes of customary deliberations into the national legal system to strengthen legal certainty and promote social justice based on maṣlaḥah values.

Abstract

Sebagaimana diatur dengan Undang-Undang Nomor 12 Tahun 1995, sistem pemasyarakatan di Indonesia telah mengubah konsep pemenjaraan pada era kolonial Belanda ke konsep pemasyarakatan. Perubahan konsep ini dimaksudkan untuk menerapkan program-program yang sifatnya menjerakan sekaligus merehabilitasi serta mereintegrasi narapidana secara sosial. Dengan demikian narapidana dapat kembali lagi menjadi warga masyarakat yang baik. Dalam praktiknya, tujuan ideal dari konsep pemasyarakatan ini tidak mudah terwujud. Persoalan-persoalan dalam pelaksanaan sistem pemasyarakatan ini sejatinya saling berkelindan, sehingga kebutuhan untuk mengubah Undang-Undang Nomor 12 Tahun 1995 menjadi penting. Dalam kaitan dengan rencana perubahan hukum itu maka penting pula mempelajari bagaimana sistem pemasyarakatan sesuai dengan nilai-nilai Pancasila dan bagaimana norma hukum baru yang akan dibentuk menguatkan nilai-nilai Pancasila. Dengan menggunakan metode penelitian doktrinal, penelitian ini menyimpulkan bahwa Undang-Undang Nomor 12 Tahun 1995 masih berisikan norma-norma yang belum lengkap atau tidak dirumuskan dengan jelas dan kuat terkait dengan beberapa sila Pancasila, seperti untuk meningkatkan rasa cinta tanah khususnya bagi narapidana terorisme dan separatisme. Pun studi ini menemukan bahwa nilai-nilai Pancasila dalam filsafat pemidanaan berkait dengan kemanusiaan, edukasi dan keadilan. Konsep keadilan bergeser dari keadilan retributif dan restitutif menjadi keadilan restoratif.

Abstract

Pendidikan hukum di Indonesia yang dikonstruksi dalam kerangka positivisme hukum secara struktural tidak mampu menjangkau masyarakat adat yang justru paling membutuhkan pengetahuan hukum untuk melindungi hak kolektif mereka dari ekspansi ekonomi ekstraktif. Penulisan ini bertujuan mengidentifikasi kebutuhan pendidikan hukum bagi masyarakat adat di Kalimantan, mengembangkan model pendidikan hukum kritis untuk paralegal adat, serta menganalisis dampaknya terhadap peningkatan kapasitas advokasi komunitas. Penulisan ini menggunakan metode kualitatif deskriptif-evaluatif dengan pendekatan mixed-method yang mengintegrasikan analisis doktrinal-normatif, empiris-sosiologis, dan etnografis di Desa Adat Pampang, Samarinda Utara, Kalimantan Timur. Hasil penulisan ini menunjukkan bahwa komunitas Dayak Kenyah mengalami kekerasan epistemis berupa delegitimasi pengetahuan hukum adat oleh persyaratan pembuktian formal negara. Model pendidikan hukum kritis yang dikembangkan berfondasi pada tiga pilar pluralisme hukum, conscientization, dan praxis terbukti mampu mentransformasi kesadaran magis menjadi kesadaran kritis serta memberdayakan paralegal adat sebagai subjek hukum aktif.

Abstract

Background: Indonesia’s forest governance continues to face challenges such as overlapping land claims, agrarian conflicts, and institutional fragmentation. Presidential Regulation No. 5 of 2025 establishes a cross-sectoral Forest Area Order and Enforcement Task Force (PKH Task Force) to accelerate forest recovery and improve legal certainty. However, concerns remain regarding data reliability and social justice in its implementation. Objective: This study examines the implementation of forest area regulation under Presidential Regulation No. 5 of 2025, focusing on governance effectiveness, socio-ecological impacts, and the relationship between enforcement mechanisms and environmental justice. Methods: A qualitative socio-legal approach was employed, combining normative juridical analysis, focus group discussions, field observations, and comparative policy review. Data were analyzed using thematic content analysis and cross-case comparison. Results: Findings show that the PKH Task Force recovered approximately 3.3 million hectares of forest land by September 2025. Despite this achievement, structural issues persist, including inconsistent spatial data, overlapping customary land claims (17.6–24.4 million hectares), and unequal enforcement between large-scale actors and smallholders. Limited community participation has contributed to ongoing socio-ecological tensions. In contrast, participatory schemes such as PPTPKH/TORA (3.04 million hectares) and social forestry programs (4.1 million hectares involving over 800,000 households) indicate more inclusive governance outcomes. Conclusion: Forest governance reform demonstrates strong administrative performance but limited social legitimacy. Effective implementation requires integrating distributive, procedural, and restorative justice principles supported by participatory and integrated data governance systems. Limitations: The study is based on secondary data and selected qualitative cases, which may not fully represent regional variations in Indonesia

Abstract

This study examines the implementation of the precautionary principle as a law enforcement instrument in immigration supervision of foreign workers at the Indonesia Morowali Industrial Park (IMIP) Airport in Morowali to safeguard national sovereignty. The rapid development of the Morowali industrial area has resulted in high mobility of foreign workers, especially from China, thus requiring a strict and professional immigration supervision system. This normative juridical research uses a legislative and conceptual approach to analyze the legal basis, implementation mechanisms, and effectiveness of the precautionary principle in the context of immigration supervision. The results show that the precautionary principle has a strong legal basis in Law No. 6 of 2011 concerning Immigration as amended by Law No. 63 of 2024 and is implemented through a comprehensive immigration and employment document verification mechanism, an early detection system for potential violations, and integrated coordination between relevant agencies. The implementation of this principle is effective in preventing immigration law violations, protecting the interests of local workers, and maintaining national sovereignty. However, significant challenges remain, including the high volume of foreign worker arrivals, lIMIPed human resources, the complexity of employment documentation, and technical constraints in information technology infrastructure. The study recommends increasing the number of immigration officers, developing an integrated information system, developing more specific standard operating procedures, and strengthening inter-agency coordination through the formation of an integrated task force to optimize the effectiveness of immigration oversight in protecting national sovereignty.
