Abstract

Pada tahun 2012, Indonesia menerbitkan sukuk negara pertama yang dikhususkan untuk membiayai pembangunan infrastruktur. Sukuk ini disebut dengan Project Based Sukuk (PBS). Kajian ini dilakukan untuk menyelidiki bagaimana pelaksanaan kontrak ijârah yang telah digunakan dalam produk ini. Data dikumpulkan dengan menggunakan metode wawancara dan metode perpustakaan. Sumber wawancara adalah para pihak yang berkepentingan di Direktorat Pembiayaan Syariah - Kementerian Keuangan dan Dewan Syariah Nasional - Majelis Ulama Indonesia (DSN-MUI). Secara umum, kajian ini memukan bahwa semua aturan dan peraturan kontrak al-ijârah dalam penerbitan produk sukuk PBS sesuai dengan syariah. Ditemukan juga bahwa akad Ijârah al-Maujûdât al-Mau‘ûd Bisti’jarihâ (IMMB) merupakan akad baru hasil ijtihâd DSN-MUI yang tidak bertentangan dengan aturan-aturan fiqih.

Abstract

Sukuk Ritel (SR) is one of the sovereign sukuk whose main purpose is to fund economic development, especially infrastructure development. To accelerate infrastructure development, the government issued Sukuk Ritel in 2009 as a funding source. This study was conducted to determine how the law of economic development funding in Indonesia sourced from Sukuk Ritel is viewed from the perspective of Islamic economic law. Data was collected through a literature review which was then analyzed using a normative approach. The results of this study indicate that borrowing or funding for infrastructure development through Sukuk Ritel is legally permissible (mubah), and Sukuk Ritel is better than borrowing directly. However, the government needs to continue taking precautionary steps when the state debt is approaching the normal threshold for borrowing funds.

Abstract

Islamic economic development is a task incumbent upon a good Muslim community. Indonesia has, in recent years, accelerated its economic development -especially in the area of infrastructure development- thereby requiring additional funding sources to aid this development. Thus, the government has issued Project Based Sukuk (PBS), which aims to finance the development of the country’s infrastructure. PBS is a shariah-based financing instrument that is an alternative for Muslim communities which are interested in building a country’s economy without elements of ribā. This instrument has a main contract in the form of ijārah and supporting contracts, one of which is al-wakalah. However, the application of these contracts can only be said to be valid from a Sharā‘ perspective if all rules and conditions are throughly fulfilled. Therefore, this study focuses on analyzing the application of the al-wakalah contract on PBS, whether the practice is in accordance with fiqh or not. The scope of discussion only focuses on the analysis of the implementation of the al-wakalah contract on PBS. It uses a data collection method by interview and review of literature, which was then analyzed inductively to draw conclusions from the specific to the general. The study found that the application of the al-wakalah contract to PBS is in line with the principles of Shariah, although there is still issue still to be rectified regarding the signing of documents as a symbol of offer (ijab) and acceptance (qabūl).

Abstract

This research discusses the application of musyarakah contracts as a sharia financing solution for Micro, Small and Medium Enterprises (MSMEs) in the midst of digital economic development. MSMEs have a crucial role in sustaining the Indonesian economy, but still experience difficulties in accessing fair and sustainable financing. The musyarakah agreement, with its partnership and profit-sharing principles, is considered to be in line with the character of MSMEs that prioritize cooperation and justice. Through a qualitative approach based on a literature study, this research explores the potential, regulatory challenges, and strategies to strengthen the implementation of digital musyarakah. The results of the analysis show that digitalization offers great opportunities in promoting Islamic financial inclusion, but is still constrained by low digital literacy, limited infrastructure, and weak supervision of sharia principles. Therefore, a strategy is needed that includes improving education, developing Islamic financial technology, and collaboration between regulators, financial service providers, and MSME players. This study concludes that the successful implementation of digital musyarakah requires an integrated approach so that MSMEs are able to access Islamic financing independently, fairly and sustainably.

Abstract

The existence of a contract is a very important matter in a transaction according to Islamic economic law. This contract is valid if all the pillars and conditions of the contract are fulfilled. Many Indonesian Muslims want to perform the hajj pilgrimage but do not have enough funds. Therefore, BPRS Harta Insan Karimah Bekasi introduced a hajj and umrah savings product with the mudarabah concept, namely that customers can only withdraw their savings if they have reached the minimum amount to perform the hajj pilgrimage. This study was conducted to determine how customers understand the contracts that have been used in this product. Data collection was carried out by interviewing BPRS HIK Bekasi and customers who save on the product. This study found that in general, customers do not fully understand the nature of the contracts used in hajj and umrah savings products. They are also not ready to bear the risk of loss from the management of their funds. In practice, BPRS HIK Bekasi provides voluntary security guarantees for mudarabah capital. Although in a mudarabah agreement, capital funds cannot be guaranteed against losses, there are opinions that allow this if done voluntarily.

Abstract

Based on the Qur'an and Hadith, this study investigates how Islamic teachings prohibit usury. Usury is an economic practice that damages the financial system. This study aims to provide an explanation of the meaning, legal status, and interpretation of the verses of the Qur'an and Hadith related to usury. This study analyzes the concept of usury and its types in contemporary financial transactions using a qualitative descriptive approach and literature study. The results of the study indicate that many communities, including Islamic communities, still do not understand the meaning of usury and its effects. Consequently, comprehensive education is essential to eliminate usury and support the development of a just and sustainable Islamic economic system.

Abstract

The Indonesian government needs funds to accelerate infrastructure development. Therefore, in 2012 Indonesia issued a PBS sukuk specifically to finance infrastructure development. This research was conducted to find out how the implementation of PBS sukuk in economic development in Indonesia is seen from the perspective of Islamic economics. Data was collected using interview and documentation methods from primary and secondary sources. The results of this study indicate that the issuance of PBS sukuk from time to time has shown significant growth. This is indicated by the PBS sukuk budget which is increasing from year to year in line with the increasing investor interest in the Shari'ah concept-used instrument. PBS's increasing budget in building national infrastructure also proves that Islamic instruments have grown in the capital market. So that it will gradually reduce the concept of usury circulating in the capital market. This phenomenon also shows that the Shari'ah economy has an important role in helping the government, especially in the field of infrastructure development.

Abstract

Indonesia, in recent years, has been trying to accelerate economic development, especially in the field of infrastructure development. This effort requires enormous funding, both from abroad and domestically. To expand funding sources from within the country, the government issued Project Based Sukuk (PBS) which aims to finance infrastructure development through sharia-based financing instruments. PBS is indeed an alternative for Muslim communities who are interested in building the country's economy without being overshadowed by the element of usury. This instrument has a main contract in the form of ijarah, supporting contracts and promises (wa'd). The application of these contracts can only be said to be valid from the point of view of the Shari'ah if all the rules and conditions are fully complied with. This study tries to analyze the application of the wa'd concept in PBS, to find out whether all the rules and conditions set by Syara' have been implemented properly. Data were collected through interviews and literature review which were then analyzed using a normative approach. This study concludes that the application of the al-wa'd concept to PBS is in line with sharia principles, although there are still two issues that still need to be fixed, namely first: the problem of investor ownership of PBS assets which is only for benefits, not accompanied by ownership of the goods; both mechanisms for reselling PBS assets at a price equivalent to the nominal value of PBS, even though according to AAOIFI and Majma' al-Fiqh al-Islāmī al-Duwali sukuk assets may not be resold at a price equivalent to the nominal value of the sukuk.

Abstract

This study aims to examine the Islamic legal maxim al-yaqīn lā yuzālu bi al-syakk (certainty is not removed by doubt), along with its foundations, branches, and applications in the context of Islamic economics. This maxim plays a crucial role in Islamic legal rulings as it provides guidance that something already established with certainty cannot be nullified merely by subsequent doubt. This research adopts a literature review method by analyzing the Qur’an, hadiths, and various recent academic references. The findings indicate that this legal maxim safeguards legal certainty, prevents decision-making based on mere speculation, and protects individual rights in transactions. Several derivative principles, such as al-ashlu baqā’ mā kāna ‘alā mā kāna, al-ashlu barā’atu al-dzimmah, and al-ashlu fil asy-ya’ al-ibāhah, reinforce the notion that the original legal status remains valid until proven otherwise by strong evidence. Its application in Islamic economics covers trade transactions, mudharabah contracts, asset ownership, and debt settlement, all of which require valid proof before altering an established legal status. This study concludes that implementing the maxim al-yaqīn lā yuzālu bi al-syakk remains highly relevant in the context of modern economic development, as it ensures fairness, minimizes disputes, and promotes secure and sharia-compliant transactions.

Abstract

The principle of "Al-Umuru Bi Maqasidiha," meaning "everything depends on its purpose," is one of the main principles of Islamic law that plays a crucial role in Islamic economic practices. This research aims to outline the meaning, legal basis, branches, and application of this principle in modern economic activities. The method used is a literature review, examining the Quran, Hadith, the opinions of scholars, and contemporary studies related to Islamic economics. The results of the study indicate that intention is a key factor in determining the validity or invalidity of an act, both in worship and transactions. This principle is relevant to addressing contemporary transaction developments, such as Islamic banking, fintech, and digital investment instruments, by emphasizing objectives aligned with the maqasid al-shariah (Islamic principles). The evolving branches of this principle emphasize the role of intention in distinguishing between custom and worship, establishing the validity of contracts, and transforming permissible activities into acts of worship. Its application in Islamic economics encompasses transaction contracts, asset management (mal), and Islamic banking practices, all of which are directed toward achieving benefits and preventing harm. In conclusion, the principle of Al-Umuru Bi Maqasidiha (The Principle of Proper Conduct and the Principle of Good Conduct) is highly urgent in building an Islamic economic system that is just, imbued with integrity, and oriented toward blessings.
