Abstract

This study explores how judges at the Malang District Court view “undue influence”(misbruik van omstandigheden) as a determinant of contractual incapacity in contract law and identifies the criteria they use. Employing an empirical approach with case analysis and sociological perspectives, primary data came from interviews, while secondary data, including court rulings and relevant materials, underwent descriptive and qualitative analysis. The research reveals that cases involving individuals who exploit situations from the beginning of an agreement with malicious intent, strategically using economic and psychological advantages to gain control, are central to the concept of undue influence. Surprisingly, the Malang District Court handles a limited number of such cases, as aggrieved parties often initiate criminal fraud proceedings before filing civil lawsuits citing undue influence. Some rulings categorized undue influence claims as unlawful acts or defaults. In deciding undue influence (misbruik van omstandigheden) cases, judges prioritize two key factors: the substantive content of the lawsuit, pivotal for the court's jurisdiction, and the level of due diligence exercised by parties, considering subject matter, witnesses, and relevant correspondence—all affecting the agreement's validity. Consistency in judicial decisions is recommended to provide legal certainty and predictability for parties involved. This research underscores the need for legal awareness, streamlined procedures, precautionary measures, and ongoing research in this area of contract law

Abstract

Green sukuk is a contemporary-era sharia investment revolution that accommodates environmental aspects. Integrating Sustainable Financing in green sukuk can be an alternative investment platform contributing to sustainable development. The concept paradigm is relevant for strengthening the proportional construction of green sukuk law in Indonesia. The study aimed to analyze the concept of sustainable financing as the legal basis for implementing green sukuk in supporting sustainable development programs in Indonesia. The study used normative legal research methods. This research approach used a conceptual approach through reasoning the concepts of sustainable financing, green sukuk, and other concepts relevant to the topic of study to strengthen the discussion argument. The study showed that there are 2 (two) components of the relevance of the Sustainable Financing paradigm as the basis for implementing green sukuk in Indonesia. First, the implementation of green sukuk in various countries has rules that accommodate sustainable financing in response to climate change problems. Second, the sustainable financing Paradigm is relevant as a source of green sukuk legal construction to strengthen the policy basis for implementing environmentally sound investment in Indonesia. The urgency of the regulation is to increase investment commitments that can increase environmental resilience, alleviation of social problems and business transparency in contributing to sustainable development in Indonesia.

Abstract

The lives of courier partners in the package delivery industry in Indonesia are full of safety-threatening challenges, especially when they use the "Cash On Delivery" (COD) payment system. Courier partners are often intimidated and mistreated by some customers, often buyers do not want to pay for COD packages because they feel the package is not suitable or the delivery is late, they must also be faced with the risk of traffic accidents. Courier partners are also considered informal workers who do not have clear attachments to service provider companies or government agencies, which causes companies to not have clear guidelines for risk management in this matter. This research was conducted to find out how legal responsibility for the work safety of courier partners in Indonesia and to find out the challenges and risks experienced by courier partners when carrying out their work. The research method used in this research is normative juridical using a statutory approach. Primary and secondary legal materials were obtained through literature studies and analyzed using descriptive methods. The results showed that the law enforcement used to protect the work safety of courier partners is Law No. 1 of 1970 concerning work safety.

Abstract

This study examines Indonesia’s policy of restricting nickel exports and its implications, focusing on the state’s approach to enhacing the value of nickel through downstream processes. It adopts a normative juridical research method with a legislative approach, utilizing primary, secondary, and tertiary legal materials. Legal sources are gathered through literature review and internet study, and analyzed using deductive and descriptive reasoning methods. Based on relevant analysis and discussions, the study concludes that Indonesia’s export restrictions primarily aim to improve nickel quality through downstream processing line with principles of prosperity and economic welfare. Despite concerns about potential limitations, such as the impact of smelter construction on local communities, Indonesia’s policy remins consistent with international trade principles to support domestic economic growth and job creation. Future research should comprehensively address these obstacles provide a deeper understanding of the socio-economic implications of nickel export restrictions and downstream development in Indonesia.Keywords: Nickel; Natural resources; Maslahah

Abstract

Penerapan prinsip deklaratif dalam pendaftaran hak cipta mengalami kerancuan akibat pemberian wewenang kepada Sub Bidang Kekayaan Intelektual dalam pencatatan ciptaan, yang bertentangan dengan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan data primer dan sekunder melalui tahapan Editing, Classifying, Verifikasi, Analysis, dan Conclusion. Hasil penelitian menunjukkan bahwa pendaftaran hak cipta secara deklaratif hanya diperoleh setelah ciptaan berwujud nyata. Pencatatan hanya dianggap bukti bahwa karya sudah selesai. Proses dimulai dengan tracking setelah pelaporan pelanggaran hak cipta oleh pencipta. Setelah verifikasi, berkas dikirim ke Polda Jatim untuk penyidikan, lalu hasilnya disampaikan ke Sub-bidang Kekayaan Intelektual Kementerian Hukum dan HAM Jawa Timur. Meskipun demikian, penerapan prinsip deklaratif perlu disesuaikan untuk menghindari kerancuan dan memastikan kepatuhan terhadap undang-undang hak cipta yang berlaku. The implementation of declarative principles in copyright registration still faces confusion, as the government has granted authority to the Sub-Field of Intellectual Property in the service of recording creations. This contradicts the declarative principle and Law Number 28 of 2014 concerning Copyright. This study employs a socio-legal approach with primary and secondary data through stages of Editing, Classifying, Verification, Analysis, and Conclusion. The research findings indicate that declarative copyright registration is only obtained automatically after the creation is completed and takes on a tangible form. Registration serves as a legal assumption that the work is finished. The process begins with tracking following a report of copyright infringement by the creator. After verification, the file is sent to East Java Regional Police for investigation, and the results are relayed to the Sub-Field of Intellectual Property of the Ministry of Law and Human Rights in East Java. However, the implementation of declarative principles should be adjusted to avoid confusion and ensure compliance with applicable copyright laws.

Abstract

This article aims to revisit Islamic feminist thought on the reinterpretation of the Qur'an by analyzing the views of four major figures in the movement: Aminah Wadud, Fatima Mernissi, Asma Barlas, and Riffat Hassan. This study uses a critical text analysis approach to understand the arguments and interpretations they put forward in interpreting Qur'anic verses related to gender. Through an in-depth analysis of their work in articles, books, and papers of their views. In addition, the article explores the ways in which these Islamic feminists reconstruct an understanding of sacred texts, highlighting differences in approach and common themes in their interpretations. In addition, it evaluates the impact of their reinterpretations of the Qur'an on traditional views in Muslim societies and their implications in the context of social change and gender equality. When examining Islamic feminist views on the Qur'anic reinterpretation, it is important to thoroughly understand the cultural and linguistic context of Arabic. Misconceptions regarding the interpretations of classical Muslim intellectuals, which are often considered discriminatory against women, are often due to a lack of understanding of the cultural and linguistic context of Arabic. Therefore, it is important to pay attention to linguistic and cultural contexts when interpreting sacred texts. On the other hand, feminists should also note that interpretations of the Qur'an do not always result in interpretations that are in line with their principles of gender equality. The theoretical implication is that, in an effort to understand the verses of the Qur'an related to gender issues, it is important to consider the cultural context, language, and comprehensive interpretation. There is room for dialog and deeper understanding between feminist views and traditional interpretations, by taking an approach that combines an understanding of classical Arabic culture with the values of gender equality championed by feminists.

Abstract

The legal uncertainty regarding the categorization of the regarding whether or not the Covid-19 pandemic Covid-19 pandemic as a force majeure condition has led to inconsistent interpretations for those directly impacted by the situation. Therefore, considerations can be accepted as a reason for force majeure in agreements need further analysis, both in terms of written law and judicial practice. The objective of this research is to determine the legitimacy of the Covid-19 pandemic as force majeure condition and to describe the basis of the court’s reasoning in deciding whether the pandemic can be accepted as a valid reason for force majeure in contractual agreements. This research adopts a normative juridical methodology, utilizing a statue approach, case approach, and conceptual approach. The findings reveal that the Covid-19 pandemic may be considered as force majeure, provided that the debtor (in the contract) can demonstrate fulfillment of the force majeure criteria as stipulated in Article 1244-1245 of the Indonesian Civil Code, as well as the International Chamber of Commerce’s Force Majeure and Hardship Clauses. In practice, in determining whether the Covid-19 pandemic qualifies as force majeure, the court evaluates whether the following elements are satisfied, the event is unexpected (i.e., the Covid-19 pandemic), the event is beyond the debtor’s control, there is no element of negligence of intent, and there is good faith in the part of the debtor.

Abstract

YouTube has become a non-physical, inheritable asset, as it carries economic value and can be transferred through inheritance. This study examines the division and management of royalties from monetized YouTube channels under Indonesian positive law for heirs. It also analyzes the technical distribution and management of royalties according to crowdfunding theory. This research adopts a normative juridical approach, drawing on legislative and conceptual frameworks. Primary legal materials include Law No. 28 of 2014 concerning Copyright and the Compilation of Islamic Law. The study's findings reveal that 1) under copyright law, royalty management for monetized YouTube channels containing musical content can be conducted through a collective management institution, while there is no specific institution managing video content royalties for heirs. The Compilation of Islamic Law suggests an amicable settlement as an alternative resolution if Articles 176-182 and 185 are not applicable; 2) Crowdfunding can be applied by consolidating the shares or portions of each heir within a single monetized YouTube channel, managed by one heir as the content creator. Royalties earned from the channel are then distributed to each heir based on the share percentages outlined in Articles 176-182 of the Compilation of Islamic Law.

Abstract

Many women work as men. From some BPR and KSP there is a ban on wearing the hijab in the workplace. The veils of worship are covered by the Law. Hijab can avoid bad deeds and avoid temptation. The veil contains maslahah as the goal of the maqashid of shariah. This study aims to identify the factors behind the ban on the use of headscarves by the leadership of BPR and KSP in Pasuruan Regency analyzed by labor law and maqashid syariah. Empirical legal research by using data search methods in the form of questionnaires, interviews and documentation. The results show that financial institutions that make company regulations contain elements of discrimination and violate article 5-6, article 111 paragraph (2) of the Manpower Act. Every Muslim has equal opportunity / Equal Employment Opportunity. Woman veiled in the subject Maqashid Khassah (specific maqashid). The right of women to veil a part of the protection of honor (hifz al'ird). Aurat for Muslim women become treasure and dignity to always be maintained and preserved its security. Wearing the hijab as a preventive measure (saddan lidz-dzari'ah) to preserve the honor of women. QS. Al-Ahzab: 59 wisdom and kausa (al-'illah) is good, that is to cover the genitalia. Closing of her Maqsid's aurat, ie avoiding slander against a woman. Maqashid shariah, which provides a sense of security for women to move. The prohibition of wearing the veil in the workplace is against the maqashid of shariah. Banyak perempuan berkarir sebagaimana laki-laki. Dari beberapa BPR dan KSP terdapat larangan pengenaan jilbab di tempat kerja. Berjilbab bagian ibadah yang dilindungi oleh UU. Berjilbab dapat menghindarkan diri dari perbuatan tidak baik dan menghindari godaan. Berjilbab mengandung maslahah seperti tujuan dari maqashid syariah. Penelitian ini bertujuan mengidentifikasi faktor yang melatarbelakangi larangan penggunaan jilbab oleh pimpinan BPR dan KSP di Kabupaten Pasuruan dianalisis dengan hukum ketenagakerjaan dan maqashid syariah. Penelitian hukum empiris dengan meggunakan metode pencarian data berupa kuesioner, wawancara dan dokumentasi. Hasil penelitian menujukkan bahwa Lembaga keuangan yang membuat peraturan perusahaan mengandung unsur diskriminasi dan melanggar pasal 5–6, pasal 111 ayat (2) UU Ketenagakerjaan. Setiap muslimah mempunyai kesempatan yang sama/ Equal Employment Opportunity. Perempuan berjilbab dalam bahasan Maqashid Khassah (specific maqashid). Hak perempuan untuk berjilbab bagian dari perlindungan kehormatan (hifz al’ird). Aurat bagi perempuan muslimah menjadi harta dan harkat martabat untuk selalu dijaga dan dilestarikan keamanannya. Mengenakan jilbab sebagai tindakan preventif (saddan lidz-dzari’ah) untuk menjaga kehormatan perempuan. QS. Al-Ahzab: 59 hikmah dan kausa (al-'illah) yang baik, yaitu untuk menutupi aurat. Menutup aurat maqsidnya, yaitu menghindarkan fitnah atas diri seorang perempuan. maqashid syariahnya, yaitu memberikan rasa aman bagi perempuan untuk beraktivitas. Larangan mengenakan jilbab ditempat kerja bertentangan dengan maqashid syariah.
