Abstract

When globalization has touched upon education, cultures, and economy, this means that there has been an expansion of western ideology and a brain washing of people in developing countries, such as Indonesia. Ironically, the government has legitimized the presence of foreign higher education in Indonesia. This creates a dilemma, because on one hand, this would make the quality of education of Indonesia more competitive and, on the other hand, could be used as a means of indoctrination of neo-liberalism. This article tries to discuss the fight against western ideology, developing in education, especially that related to the current issues.

Abstract

Following the Constitutional Court’s dismissal of the judicial review of Article 2, Paragraph 1 of the Marriage Law, the Jakarta Central District Court granted approval for the registration of inter-religious marriages. The issue of inter-religious marriage has once again become a hot topic of social discussion. Following the controversy, the Supreme Court issued a circular ordering the court not to grant marriage registration applications for interfaith couples. This study draws on normative legal research and empirical analysis of interfaith marriages to answer the question of how states (through courts) view and negotiate interfaith marriages from state, legal, and religious perspectives. The objective of this study is to examine the arguments presented by proponents and opponents of interfaith marriage in Indonesia, particularly focusing on the discourse surrounding human rights principles and the adherence to religious teachings within the realm of marital practices. The study concluded that Islamic law remains one of the most fundamental elements of contemporary Muslim family life practices in Indonesia. All religions, including government officials and judges, generally consider interfaith marriages illegal and prohibit them under the Marriage Act. The Constitutional Court's decision to deny judicial review of the provisions governing interfaith marriage reinforces the argument that, in terms of the relationship between religion and the state, Indonesia falls into the category of countries with religiously governed enclaves.

Abstract

Pancasila lahir dan tumbuh bersama dengan sejarah berdirinya bangsa Indonesia. Negara Indonesia lahir dengan latar belakang kultur sosial masyarakat yang sangat beragam. Hal ini membuat pengaktualisasian nilai Pancasila membutuhkan pemahaman yang mendalam terutama dalam konteks sosial masyarakat Indonesia di zaman modern seperti saat ini. Apabila salah dalam mengaktualisasikan  nilai Pancasila maka, dapat melemahkan negara hukum Indonesia. Dengan demikian bangsa Indonesia memerlukan pemahaman secara komprehensif terutama dikalangan masyarakat tentang pengimplementasian nilai pancasila yang sesuai dengan fungsi dan kedudukannya. Tulisan ini merupakan hasil pemikiran serta kajian terhadap pengaktualisasian nilai Pancasila di negara hukum Indonesia secara komprehensif. Pengaktualisasian nilai Pancasila perlu memperhatikan kedudukan dan fungsi Pancasila di negara hukum Indonesia mengingat Pancasila merupakan sumber tertib hukum. Kemudian melihat dari sudut pandang hukum Indonesia terhadap konsep penelitian hukum di Indonesia yang harus memperhatikan hukum dari segi sosiologis, tidak hanya segi normatif saja. Sehingga urgensi dari prespektif sosiologis dalam binkai masyarakat Pancasila akan memperkuat negara hukum Indonesia.Actualization of Pancasila Values in Strengthening Indonesia State of Law from Sociological Perspective. Pancasila was born and grew together with the history of the founding Indonesian nation. The State of Indonesia was born with a very diverse social cultural background. This makes the actualization of the value of Pancasila requires a deep understanding, especially in the social context of Indonesian society in modern times like today. If it is wrong in actualizing the value of Pancasila, it can weaken the rule of law of Indonesia. Thus the Indonesian people need a comprehensive understanding, especially among the people about the implementation of the value of Pancasila in accordance with their function and position. This paper is the result of thoughts and studies on the actualization of the value of Pancasila in the Indonesian law state comprehensively. Actualization of the value of Pancasila needs to pay attention to the position and function of Pancasila in the Indonesian law state, considering that Pancasila is a source of orderly law. Then looking at it from the point of view of Indonesian law on the concept of legal research in Indonesia which must pay attention to the law from a sociological perspective, not just the normative aspect. So that the urgency of the sociological perspective in the Pancasila community will strengthen the Indonesian rule of law

Abstract

Sasak women grapple with a legal conundrum stemming from the coexistence of multiple marriage legal frameworks encompassing fiqh, adat, and state law. This intricate legal pluralism dynamically shapes the legal consciousness of Sasak women as they navigate the selection of legal avenues to secure legality and address their marital legal challenges. This study pursues two primary objectives: firstly, to examine the intricate interplay among fiqh, adat, and state marriage law concerning the provision of legal certainty and protection for Sasak women; secondly, to probe into the manifestations of legal consciousness arising from the plural marriage legal frameworks. Data were collected through document analysis, literature review, and in-depth interviews with selected Sasak women. The findings illuminate a dynamic interplay among fiqh, adat, and state marriage law across various marital facets, including prenuptial considerations, minimum marriage age, marriage prerequisites and pillars, marriage contracts, residency, polygamy, divorce, and reconciliation. Moreover, the study identifies three distinct forms of legal consciousness emerging among Sasak women: ‘before the law’ when confronting fiqh, ‘with the law’ when embracing formal legal mechanisms to address marital issues, and ‘against the law’ when eschewing formal legal provisions. In conclusion, state marriage laws are more progressive in providing legal certainty and protection for women but lacking criminal sanctions/fines weakens their position compared to religious law (fiqh) and customs (adat). Ultimately, this shapes the legal consciousness of Sasak women in diverse ways.

Abstract

Pasar Tiban di Jalan Lingkar Selatan (JLS) Salatiga adalah pasar yang berlokasi di jalan provinsi yang seharusnya steril dari gangguan dan hambatan akibat dari aktivitas warga yang bertransaksi jual beli. Faktanya, pasar ini tetap lestari hingga lebih dari satu dekade terakhir dan bahkan semakin banyak baik pedagang maupun pengunjungnya. Tujuan penelitian ini adalah untuk menjelaskan mengapa Pasar Tiban tersebut tetap eksis selama lebih dari satu dekade ini meski berlokasi di sepanjang jalan raya lintas provinsi. Untuk mengkajinya, penulis menggunakan teori fungsionalisme struktural AGIL Talcott Parons. Metode yang digunakan adalah kualitatif. Teknik pengumpulan data menggunakan observasi, wawancara dan dokumentasi. Analisis data dilakukan dengan melakukan reduksi data, display data, dan penarikan kesimpulan terhadap data yang didapatkan tersebut. Hasil riset menunjukkan bahwa Pasar Tiban JLS Salatiga dapat eksis lebih dari satu dasawarsa sampai saat ini karena Pasar Tiban tersebut sudah menjadi sistem sosial. Hal ini dapat dilihat dengan terpenuhinya fungsi AGIL (adaptation, goal attainment, integration, latency) dalam teori fungsionalisme struktural Parsons secara terstruktur dan terintegrasi. Fungsi adaptasi berupa komunikasi intensif dengan pihak-pihak berwenang untuk saling bernegosiasi, fungsi pencapaian tujuan berupa keuntungan ekonomi secara berlipat-lipat dalam waktu yang sangat singkat, fungsi integrasi berupa terbentuknya aturan yang mengatur cara jualan di Pasar Tiban dan fungsi latensi berupa memaksimalkan penegakan aturan main paguyuban, memperkuat kerjasama dan solidaritas pedagang serta mempersilahkan siapapun untuk ikut berjualan. Maksimalisasi keempat fungsi tersebut menjadi garansi keberlangsungan Pasar Tiban pada masa mendatang.

Abstract

Sexual violence was prevalent in many settings, including in religious educational institutions. This article analyzed cases of sexual violence at an Islamic higher education institution in West Java, Indonesia, using the maqasid al-shariah and Foucault's theory of sexuality as the theoretical frameworks. This mixed-method research used Google form's surveys, in-depth interviews, and observations as the data collection methods. The data were analyzed using a flow model, which comprised selection, display, analysis or discussion, and conclusion. This study showed that verbal and non-verbal sexual violence was rampant. It occurred between student and student, lecturer and staff, staff and staff, and lecturer and student. Four models of sexual violence were found based on the typology designed by Dzeich and Weiner, who categorized thirteen forms of sexual violence. The maqasid al-shariah analysis outlined that sexual violence was against the fundamental values and objectives of sharia and human rights. Additionally, Foucault's theory identified patriarchal and cultural hegemony aspects in sexual violence. This study's intriguing part was the findings that combined in-depth interviews, observations, and surveys, intended to understand the intensity of existing cases. On the other hand, the power of analysis was centered on normative fiqh and sociological aspects. According to the literature reviews, these two approaches had not been administered by previous researchers.

Abstract

This article examines the practice of repeating marriage contracts (ṣiḥah marriage) among the Rifa'iyah Congregation in Wonocoyo Village, Wonoboyo, Temanggung, Central Java. This repetition was carried out by Rifa'iyah Kiyais as representatives of female marriage guardians to perfect the marriage contract which had been carried out previously in the presence of officers from the Office of Religious Affairs (KUA). This research is classified as qualitative field research using a sociological approach. The aim is to examine this social phenomenon from the perspective of Social Construction theory and the perspective of Islamic Law. This research found that the practice of ṣiḥah marriage among the Rifa'iyah congregation of Wonocoyo Village was formed through several stages, namely: the externalization stage, the stage of conveying the practice of ṣiḥah by Rifa'iyah Kiyais, the objectification stage, the stage of forming objective reality, and the internalization stage, the stage of absorption of the objective world into the individual consciousness of the Rifa'iyah Congregation. In the view of Islamic Marriage Law, the practice of ṣiḥah by the Rifa'iyah congregation is similar to tajdīdun nikāḥ  (renewal of the marriage contract) which, according to Jumhur ulama', is permissible simply because of ihtiyāth (caution).

Abstract

The diversity present in Nalen is a blessing, as it fosters cohesion in social, cultural, and religious ties, in contrast to the various conflicts that often arise from such differences. This cohesion resulted from the formation of a habitus of peace. This study aimed to answer the question of how the habitus of peace is cultivated in Nalen, a small village in Central Java. Data were systematically collected through in-depth interviews with prominent figures and community members in Nalen, complemented by observations. The subsequent analysis of the data employed Bourdieu’s theoretical framework, which delves into the intricacies of habitus development within the Nalen community. This analysis scrutinizes various forms of capital, with a particular emphasis on social and cultural capital, substantively contributing to the fortification of the habitus. This study finds that the habitus of interreligious harmony can manifest organically, devoid of external coercion, showcasing the community’s robust autonomy in the formative process. Additionally, the objective and subjective structures of society, alongside historical factors, emerge as foundational elements that influence the trajectory of habitus formation. Ultimately, habitus is cultivated within the collective consciousness of the community and is sustained by the diverse capital resources at their disposal.

Abstract

This study aims to analyze the efforts of traditionalist Islamic groups within Indonesian universities to counter the growing influence of transnational Islamic movements. Employing a qualitative research methodology, the study provides a comprehensive examination of the dynamics between transnational movements -such as Hizbut Tahrir Indonesia, Jamaah Tarbiyah, and Jamaah Salafi- and traditional Islamic organizations, notably Nahdlatul Ulama (NU) and the Indonesian Islamic Student Movement (PMII), within the context of the University of Yogyakarta. The findings reveal that transnational Islamic movements have strategically utilized existing campus infrastructure to expand their influence. The ideological contestation is accompanied by movement-based tensions, as traditionalist groups actively resist the growing presence of these transnational actors. The study concludes that universities play a critical role in mitigating radicalism by engaging constructively with the ideological frameworks of transnational Islamic movements.

Abstract

This study aims to determine the dynamics of life cycle liminality rituals in interfaith families in Salatiga City and their meanings. This study used a qualitative approach with socio-juridical (socio-legal) methods. This fieldwork was conducted on interfaith families in Salatiga City. The results of this study revealed that interfaith marriages in the Salatiga City people, from the perspective of symbolic interactions, involved the mind, self, and society. The actors were influenced by interactions with other individuals and tried to share meaning with society. The cognition construction of interfaith family actors paid attention to the dimensions of society that demand the legality of a marriage. In the ritual act of liminality in the life cycle, interfaith families in Salatiga City had a fairly large tolerance. It was marked by the freedom of family members to perform rituals, whether they came from tradition or religion. In the context of maqāshid sharia, the concepts of hifdzun nafs, hifdzud dīn, hifdzun nasbi wa nasl, hifdzul māl, and hifdzul aql could be maintained as long as there was no coercion from other parties. Thus, freedom of worship and carrying out religious rituals is absolutely necessary.
