Abstract

Islamic inheritance law highlights diverse approaches to its interpretation and implementation in Muslim-majority countries such as Indonesia and Oman. These differences arise from a legal gap between the universal principles outlined in the Qur'an and their application within national legal frameworks. In Indonesia, Islamic inheritance law functions within a pluralistic legal system, whereas in Oman, Sharia principles serve as the primary and integral foundation of the judiciary. This article examines how the foundational philosophy of Islamic inheritance law is understood and applied in Indonesia and Oman, two countries with contrasting legal systems, to identify both normative and practical challenges, as well as the implications of these differences for future legal development. Employing a normative and comparative legal approach, the study reviews relevant legislation, fatwas, and court decisions in both countries, alongside an analysis of classical and contemporary Islamic jurisprudence. The findings indicate that Indonesia adopts a conciliatory approach, balancing religious norms with modern social needs, while Oman tends to adhere to a more literal and textual interpretation of inheritance law. These differences reflect the dynamic nature of Islamic inheritance law philosophy in responding to each country's unique social, cultural, and political contexts. This contributes to the ongoing discourse on developing an adaptive and context-sensitive understanding of Islamic inheritance law within various national legal systems.

Abstract

This research was compiled on the urgency of labor problems in the wage sector in Indonesia. The government based on the mandate of the law must realize the ideals of the nation, fulfill and protect the rights of its citizens, and strive to form a humane social sphere of society. This obligation is implemented through a set of rules that seek the values of Pancasila, especially human values and the 1945 NRI Constitution. The method used is a normative legal research method with a legal approach and a concept approach. This research is supported by secondary data that provides an overview of the discussion in the study. The formulation of the problem raised in this study is the concept of the ideal wage policy and how the humanitarian-based wage system. The result of this study is the concept of an ideal wage policy that is oriented toward fulfilling the welfare of workers and their families. However, the wage is still by the ability of entrepreneurs so that it remains balanced by considering the value of KHL. The humanitarian-based wage system emerged as a solution to labor law problems. This concept is one of the steps to construct legal norms of wage policy so that the content is based on human values as stated in the Second Precept of Pancasila. Abstract

Retention is a mechanism for withholding part of payments in construction contracts that is used to ensure the fulfillment of work maintenance obligations. In practice, retention often raises disputes, especially regarding late payments, detention without legitimate reasons, or unclear terms for release of retention. This study analyzes the legal position of retention, the legal basis that requires its payment, and the implications of default when retention is still withheld after the work is declared completed through the Final Hand Over (FHO). The research uses a literature study method on the Civil Code, the Construction Services Law, the FIDIC Red Book, procurement document standards, and contract law literature. The results of the study show that retention is a legal part of a contractual agreement that is subject to the principle of pacta sunt servanda based on Article 1338 of the Civil Code. Retention detention without a legal basis after the issuance of the FHO constitutes a default, which results in the obligation to pay retention along with compensation in accordance with Article 1243 of the Civil Code. The research concludes that the retention payment is an absolute obligation that must be fulfilled and its violation entitles the Contractor to demand performance and compensation.

Abstract

The globalization of cross-border construction projects increases the need for legal certainty and uniformity in the arrangement of international construction contracts. Differences in national legal systems, the complexity of long-term projects, and the dynamics of technical and economic risks often lead to contractual imbalances and potential disputes. In this context, UNCITRAL plays an important role through the development of soft law international legal instruments, especially the UNCITRAL Legal Guide on Drawing Up International Contracts for the Construction of Industrial Works, which provides a principled normative framework for the design of international construction contracts. This study aims to analyze the role of UNCITRAL in the standardization of international construction contracts and examine the implementation of these principles in construction contract practices in Indonesia, taking into account the development of national contract standards regulated in the Regulation of the Government Goods/Services Procurement Policy Institute Number 4 of 2024 and the Regulation of the Minister of Public Works and Public Housing Number 25 of 2020. The research method used is normative legal research with a legislative, conceptual, and analytical approach to UNCITRAL instruments and relevant national regulations. The results show that UNCITRAL functions as a normative framework that emphasizes procedural clarity, proportionate risk allocation, contract adaptation to changing circumstances, and a tiered dispute resolution mechanism.

Abstract

ABSTRACTThe implementation of the Electronic Mortgage System (HT-el) has introduced major changes to mortgage registration and the authority of PPAT, while creating regulatory, technical, and procedural challenges that remain misaligned with the Mortgage Law (UUHT). These conditions highlight the need for immediate adjustments in regulations and administrative policies. This study examines the application of HT-el in relation to PPAT authority and evaluates its effectiveness. Using a normative research method with descriptive qualitative data, the study finds that the implementation and effectiveness of HT-el are still limited due to regulatory gaps, technical barriers, and inadequate human resource readiness. Therefore, regulatory refinement, improved PPAT competencies, and strengthened systems are necessary to achieve effective services and ensure legal certainty. Keywords: Mortgage Rights; Electronic; PPATABSTRAKPenerapan Hak Tanggungan Elektronik (HT-el) menimbulkan perubahan mendasar dalam mekanisme pendaftaran dan kewenangan PPAT, sekaligus menghadirkan berbagai persoalan regulasi, teknis, dan prosedural yang belum sepenuhnya selaras dengan UUHT, sehingga menimbulkan kebutuhan mendesak akan penyesuaian hukum dan kebijakan. Tujuan penulisan ini yaitu untuk mengetahui penerapan hak tanggungan elektronik terhadap kewenangan Pejabat Pembuat Akta Tanah (PPAT) dan untuk mengetahui efektivitas terhadap adanya hak tanggungan elektronik. Jenis penelitian ini adalah normatif, dengan data yang digunakan adalah deskriptif kualitatif. Hasil penelitian ini disimpulkan bahwa Implementasi dan efektivitas Hak Tanggungan Elektronik terhadap kewenangan PPAT belum optimal karena kendala regulasi, teknis, dan kesiapan SDM, sehingga dibutuhkan penyempurnaan aturan, penguatan kapasitas PPAT, serta perbaikan sistem untuk mewujudkan layanan yang efektif dan menjamin kepastian hukum.Kata Kunci: Hak Tanggungan; Elektronik; PPAT

Abstract

This study aims to examine the settlement of investment disputes between the government and foreign investors through the ICSID institution and the mechanism for implementing its decisions in Indonesia. The research method used is normative legal research with a regulatory approach and a conceptual approach. ICSID (International Centre for Settlement of Investment Disputes) is based on an international agreement that establishes an autonomous and independent system for the settlement of foreign investment disputes. The ICSID's performance does not serve as a mediator that reconciles the parties; rather, it provides an institutional and procedural framework for independent conciliation commissions and arbitration tribunals set up specifically for each dispute case. In this case, ICSID only provides dispute resolution facilities based on two sets of procedural rules, namely the provisions of the ICSID Convention along with the ICSID Regulations/Rules, as well as the ICSID Additional Facilities Rules. Furthermore, the implementation of ICSID institutional decisions in Indonesia refers to Law No. 30 of 1999 which stipulates that the authority to recognize and implement international arbitral awards lies with the Central Jakarta District Court, with a procedure that must be preceded by an application from the party concerned.
