Abstract

The late Ibrahim Hosen, the former mufti of MUI (Indonesian Ulama Council), was on the opinion that ceating an islamic state is obligation for muslims. This opinion is not new, considering classic Muslim jurists such as Ibn Khaldun, al-Mawardi, al-Ghazali, and Ibn Taimiyyah also held similar view. Further, Hosen argued that the obligation is not a religious duty but also a rational conclusion. This obligation necessitates the obedience of citizens towards the government as long as the lattert follow islamic guidelines on policy making and regulating.  They are a) the policy is based on consultation, b) it is executable so that citizens will not be oppressed, c)the policy should be free from harmful consequence, d) it is aimed to implement prosperity, e) it upholds justice, and f) it is not contradictory to plain stipulations of sacred texts. On that basis, the government has the right to interpred the stipulations of sacred texts which their meanings are uncertain, including to regulate areas which the sacred texts are silent. Those areas are called a) mubah bi al-juz’i wa al-kulli, such as trade and registration and  b) mubah bi al-juz’i la al-kulli, such as regulations on marriage.

Abstract

National jurisprudence is actually a response to the discourse on the relationship between religion and the State. Some Islamic groups who have the view of Islamic religious and political unity (al-Islam din wa daulah) that the three concepts are a complete and inseparable unity. The others said that the unity of religion and the State had ended when finally of al-Khulafa 'al-Rashidun. This matter when contextualized in Indonesia also becomes a long debate about the shape of the Indonesian state. Some want Islam to be the basis of the state and others want a nation-state. This is where national jurisprudence emerges as a way of looking at the relationship between religion and the State. Nahdlatul Ulama (NU) as an Islamic organization since the beginning of the emergence of the State has very strong national fiqh nuances. NU's acceptance of the nation-state as a form of State is evidence of this. With this manhaj fiqh siyasah, NU introduced the building of national political arguments without leaving Islamic teachings. Indonesia as a plural country is certainly the choice of the nation-state is the most ideal choice because it can minimize the potential for discrimination.   Abstrak: Fikih kebangsaan merupakan respons atas wacana hubungan agama dan Negara. Sebagian kelompok memandang bahwa agama dan politik Islam (al-Islam din wa daulah) merupakan kesatuan yang utuh tak terpisahkan. Sebagian lain menyatakan bahwa kesatuan agama dan Negara itu sudah berakhir dengan selesainya al-Khulafa’ al-Rashidun. Dan ketika dikontekstualisasi di Indonesia menjadi perdebatan yang cukup panjang tentang bentuk Negara Indonesia. Sebagian menghendaki agar Islam menjadi dasar negara dan sebagian yang lain menghendaki nation-state. Di sinilah kemudian muncul fikih kebangsaan sebagai cara pandang dalam melihat hubungan agama dan Negara. Nahdlatul Ulama (NU) sebagai organisasi Islam sejak awal munculnya Negara sudah sangat kental nuansa fikih kebangsaannya. Penerimaan NU atas nation-state sebagai bentuk Negara menjadi bukti akan hal itu. Melalui manhaj fiqh siyasah ini, NU mengenalkan bangunan argumentasi politik kebangsaan tanpa meninggalkan ajaran Islam. Indonesia sebagai Negara yang plural tentu pilihan nation-state merupakan pilihan yang paling ideal karena dapat meminimalisasi potensi diskriminasi.

Abstract

Modernization to deliver the process in diversifying the socio-economic role of pesantren is undeniable things. Consequently, pesantren must take immediate action if they want to maintain their role and function. In this context, this article wants to describe the widespread mandate of a pesantren in Jember, namely Pesantren Nurul Qornain (PNQ), those takes part –not only empowerment in the field of education- but also play role in the development of economic enterprises. This is then reviewed in the perspective of maqashid al-shari’ah (the purpose of shari’a). Throughout qualitative study, this article explains that pesantren alumni and local society involved in the management of PNQ economic enterprises. Some of developed business unit in the area of agriculture, trading, animal farm, plantation, and mining. Furthermore, the main factor behind PNQ in managing economic enterprises is pesantren sovereignty. It is initiated by kiai (the leader of pesantren). According to him, pesantren can develop rapidly if they sovereign in all aspects. This sovereignty is interpreted as economic sovereignty. However, economic development is as determining factor in supporting the existence of pesantren. Additionally, the development of economic enterprises carries out by PNQ in line with the value of hifdhul maal (the maintenance of property). Hence, it is prospective benefits if it can be replicated by Islamic educational institution nowadays.

Abstract

Abstract: This study aims to analyze the attitude of judges in dealing with litigants who are deaf and mute at the Surabaya Religious Court. This research is a type of qualitative research using a literature study as a reference. The approach used is a normative legal research methodology, with legal language in the laws and regulations related to testimony, doctrine, or other relevant theories. In court, the litigant who is deaf and mute at the Surabaya Religious Court is served face to face, where the judge must act like raising his voice, using body language and hand gestures, and writing a minor note for the litigant. The attitude taken by the judge was good and right, but it would be better if an expert in sign language were brought in to assist the proceedings of the trial so that the judge does not need to speak out loud or write down a minor note for the litigant.  Keywords: Divorced Divorce, Deaf, Speech, Disability, Judge. Abstrak: Penelitian ini bertujuan untuk menganalisis sikap Hakim dalam menghadapi pihak yang berperkara dalam keadaan tuna rungu dan tuna wicara di Pengadilan Agama Surabaya. Penelitian ini merupakan jenis penelitian kualitatif dengan menggunakan studi pustaka sebagai acuannya. Pendekatan yang digunakan yakni metodelogi penelitian hukum normatif, dengan bahasa hukum yang berada dalam peraturan perundang–undangan terkait dengan kesaksian, doktrin, atau teori lainnya yang relevan. Di pengadilan, pihak yang berperkara dalam keadaan tuna rungu dan tuna wicara di Pengadilan Agama Surabaya dilayani secara face to face, dimana hakim harus bersikap seperti melantangkan suara, menggunakan bahasa tubuh dan gerakan tangan, serta menuliskan sebuah cacatan kecil untuk pihak yang berperkara. Sikap yang diambil oleh hakim tersebut sudah baik dan tepat, tetapi alangkah lebih baik jika didatangkan seorang ahli dalam bahasa isyarat agar membantu proses jalannya persidangan. Sehingga hakim tidak perlu untuk berbicara dengan nada keras ataupun menuliskan sebuah cacatan kecil untuk pihak yang berperkara. Kata kunci: Cerai Talak, Tuna Rungu, Tuna Wicara, Disabilitas, Hakim.

Abstract

Islamic bankers assume that an Islamic bank is a bank that is free from riba. Furthermore, conventional banks as the bank alleges that does not comply with the principles of Islamic prisnip. This naturally raises the question, what is like that. Some scientists doubt munslim statement. In fact, there is a presumption of Islamic banks is just trickery to gain profit. Also some say Islamic banking and conventional banking is not just twins, but are conjoined twins. One contract that much attention is murabahah. Akad murabahah is a superior product in Islamic banks as a clear advantage and the risk of loss can be minimized. According to the study, 60-70% of the amount of financing extended by Islamic banks (both Islamic banks and BMT). Of course, this is reasonable since the establishment of Islamic banks, as conventional banks are profit-oriented. However, Islamic banks do not practice it much different from conventional banks, both do not want to lose. Because profit is determined by Islamic banks, where customers can not haggle Profit must be obtained. This ultimately hurt the principle of voluntarism and mutual fairness in the contract. If it is lost, then the contract does is batil and zalim.

Abstract

Sejak tanggal 1 Januari 2010 mulai diberlakukan Free Trade Agreement (FTA/Perjanjian Perdagangan Bebas) ASEAN-China.  Negara-begara ASEAN yang termasuk yaitu : Indonesia, malaysia, Singapura, Brunai, Vietnam, Filiphina, Kamboja, Laos, Thailand, dan Myanmar. Adapun hasil kesepakatannya yaitu bea masuk produk manufaktur China ke ASEAN, termasuk Indonesia, ditetapkan maksimal 5 persen, sedangkan di sektor pertanian 0 persen tanpa pajak sama sekali.  Hal ini tentunya berdampak pada persaingan yang tidak sehat di antara pelaku ekonomi bisnis di Indonesia, karena nyaris peran Negara tidak ada sama sekali. Di sinilah ekonomi Islam dapat menjadi solusi bagi para pelaku ekonomi bisnis demi terjaminnya keadilan. Kebebasan pasar dalam Islam dapat dibenarkan jika memenuhi prinsip-prinsip yang ditetapkan oleh syara, yaitu dilakukan dengan saling rida (suka sama suka), jujur, bersaing secara sehat, dan terbuka. Dengan prinsip ini, maka keadilan harga dalam pasar akan lebih terjamin, sehingga keuntungan dapat merata dan tidak menumpuk pada segelitir orang. Namun, jika kemudian terjadi penyimpangan dan tiadanya keadilan dalam pasar maka Negara berhak untuk melakukan intervensi demi terjaminnya keadilan harga. Dalam terminologi fiqh, lembaga yang secara khusus menangani seperti ini dikenal dengan al-hisbah.

Abstract

This article examines the influence and challenges of fiqh al-muwatanah in Indonesia. The discussion of this article focuses on a description of the pros and cons of the al-muwatinun concept offered by Nahdlatul Ulama (NU) and the challenges faced in implementing it. The method used is a literature study with a historical and comparative approach, then analyzed using content analysis. The research findings show that al-muwatinun as a socio-political concept is a new term that will not be found in the treasures of classical Islamic thought. Al-muwatinun is a product of NU ulama's ijtihad as a response to the strengthening of takfiri in Indonesia. Al-muwatinun contains values and teachings about equality, justice, and equality is a continuation of the mission brought by al-muwatinun to form a tolerant and peaceful society by eliminating the mention of infidels non-Muslims. All Indonesian people have the same status, whether Muslim or non-Muslim, and there is no majority or minority. Al-muwatinun is a form of fiqh typical of the archipelago. This idea has been started by previous Muslim thinkers who tried to contextualize Islamic law in Indonesia. On the other hand, the al-muwatinun concept shows NU's consistency in guarding the Unitary State of the Republic of Indonesia (NKRI).

Abstract

In the era of industry 4.0, it is so easy for students to take digital information instantly without any activity to ensure the validity of previous information. This study aims to analyze students' perceptions of digital literacy skills in fiqh learning at State Islamic University (UIN) Sunan Ampel Surabaya. This research is qualitative with phenomenological glasses. The informants in this study were 160 students. Brande filled out an online questionnaire through a google form containing statements related to the basic digital literacy skills that have been developed. Then we conducted a semi-structured interview on the informant's answer results directly. The results of the study revealed that students have a good perception of literacy skills. They are ready to use tools to search, dig, select and process information. However, students have not mastered the basic tools for learning fiqh, namely Arabic. Students experience problems when looking for fiqh information in Arabic. The recommendation in this study is that students will not be optimal in fiqh learning if they only have digital literacy skill but the fiqh learning base is not yet qualified. They need a fiqh website that is in Indonesian with credible and valid references.

Abstract

Marriage is a multidimensional event, not only containing legal dimensions, but also a religious, cultural, social and even political event. Marriage is legal because it is regulated by law, as is worship because someone will receive a reward, then it contains cultural aspects because the marriage process is carried out according to custom. This study aims to reveal the role of kyai in the tradition of remarriage during the 'iddah period in Wedoro Waru, Sidoarjo Regency, East Java. The tradition of remarriage during the 'iddah period is a tradition that has been passed down from generation to generation. That article uses an empirical legal method explained by the theory of maqāṣid al- syarī'ah, data collection techniques namely interviews and documentation studies. This study found that remarriage during the 'iddah period carried out by kyai includes al-maṣlaḥah al-taḥsīniyyah, namely doing something good according to tradition and avoiding bad behavior that is reprehensible according to correct reason, so that life becomes safe, peaceful and looks beautiful in the eyes of people. other. Remarriage during the 'iddah period is a form of al-tajammul (beautiful) and al-iḥtiyāt (prudence). From the perspective of maqāṣid al-usrah, remarriage is a form of maintaining family welfare and realizing maqāṣid al-sharī'ah. This remarriage process is carried out by a kyai for both partners, because the kyai is considered to know the most about religious knowledge. Likewise, it can be emphasized that the marriage integration of the couple carried out by the Kiyai is a form of obedience to Islamic law as a form of prudence and creates maqāṣid al-sharī'ah.

Abstract

This article examined the strengthening of Aswaja An-Nahdliyah’s understanding as an effort to anticipate radicalism for Islamic education teacher candidates at the Faculty of Tarbiyah, Sunan Ampel State Islamic University Surabaya. The type of this article was qualitative with a Participatory Action Research approach and the method of extracting initial condition data and coaching related to Aswaja An-Nahdliyah material as an effort to anticipate radicalism for Islamic education teacher candidates in the fifth semester of the Academic Year 2021-2022. The results demonstrated that strengthening Aswaja An-Nahdliyah provides an understanding of the map of radical groups and movements; Aswaja An-Nahdliyah teachings and attitudes teach religious moderation as a basis for anticipating and avoiding radicalism teachings and attitudes; Aswaja An-Nahdliyah’s teachings are full of religious tolerance, which helps to block radicalism. This issue is very important considering that even though Sunan Ampel State Islamic University Surabaya, as an Islamic university, is not free from radical infiltration, strengthening Aswaja is necessary to anticipate this, especially for Islamic education teacher candidates.
