Abstract

In the Indonesian constitutional system, the Prosecutor's Office of the Republic ofIndonesia is one of the institutions that contribute to law enforcement. To improve the qualityand capability of prosecutors and prosecutorial employees, it is necessary to have aninstitution that supervises, monitors, and assesses the performance of prosecutors andprosecutors in carrying out their obligations, as stated in Article 38 of the Law on theProsecutor's Office of the Republic of Indonesia. On the basis of this, the Attorney General'sCommission of the Republic of Indonesia was formed as an additional institution thatspecifically carries out this function. The research objectives of this thesis are first, toanalyze the existence of the Prosecutor's Commission as a state auxiliary agency based onapplicable laws and regulations. Second, to analyze the ideal arrangement of theProsecutor's Commission as a state auxiliary agency in order to realize good lawenforcement in the future.This type of research can be classified into normative legal research with thetype of legal systematics and legal principles. This research uses data sources in the form ofsecondary data with literature study-based data collection techniques.From the results of the problem research there are two main things that canbe concluded. First, the existence of the Prosecutor's Commission as State Auxiliary Agenciesbased on applicable laws and regulations, namely as an additional state institution that isnon-structural independent and is in the executive realm. Institutionally, the Prosecutor'sCommission is relatively weak starting from the position, legal basis, duties and authoritiesand financial rights that are not yet independent. Second, the ideal arrangement for theProsecutor's Commission as a state auxikiary agency in order to realize good lawenforcement in the future is to clarify the position of the Prosecutor's Commission as anindependent institution, increase the legal basis at the level of the Law, simplify the task andauthority procedures and the independent financial rights of the Prosecutor's Commission.The author's suggestions are First, the legislator should revise Article 38 of the Prosecutor'sOffice Law and strengthen the position of the Prosecutor's Office Commission as anindependent institution with a regulation at the level of law. Second, it is recommended thatthere be an expansion of the authority of the Prosecutor's Commission in the form ofexecutorial power. Third, the addition of authority for monitoring within a certain period oftime. Fourth, there is authority over financial rights by the Prosecutor's Commissionindependently. Thus it will strengthen the existence of the Prosecutor's Commission inrealizing good law enforcement in the future.Keywords: Existence, Prosecutorial Commission and Law Enforcement.

Abstract

KONI filed a lawsuit through the Constitutional Court to conduct a judicial review ofthe SKN Law with constitutional case register Number 19/PUU-XII/2014, one of the objectsof testing is Article 36 paragraphs (1) and (3) of the SKN Law related to the phrase "sportscommittee" where KONI believes that the emergence of these phrases makes KONI not havestrong legitimacy to carry out its authority as a partner institution of the Government insports management so far. Therefore, the purpose of this thesis research is first, to analyzethe considerations of the Constitutional Court judges in Decision Number 19/PUU-XII/2014on the interpretation of the phrase "sports committee" in Article 36 paragraphs (1) and (3) ofthe SKN Law. Second, knowing the legal implications of the interpretation of the phrase"sports committee" in Decision Number 19/PUU-XII/2014 on the position of the nationalsports committee.This type of research can be classified into the type of normative legal research. Thisstudy used secondary data consisting of primary legal materials, secondary legal materials,tertiary legal materials and data collection techniques were carried out using the librarystudy method.From the results of the research problem there are two main things that can beconcluded. First, in the legal considerations and judges' decisions in Decision Number19/PUU-XII/2014, the Constitutional Court used several approaches to constitutionalinterpretation that had fulfilled the principles of constitutional interpretation and gave averdict, namely the Constitutional Court interpreted that the phrase "sports committee" inArticle 36 paragraphs (1) and (3) of the SKN Law did not cause multiple interpretationsbecause the formation of the SKN Law was not intended to only form one national sportsorganization. Although so, the Constitutional Court is firm in accommodating pluralinstitutions in related decisions, it can also be seen that in its legal considerations, ifinterpreted more deeply, the Constitutional Court also leads to the concept of open legalpolicy. Second, the legal implication after the enactment of Decision Number 19/PUU-XII/2014 related to the interpretation of the phrase "sports committee" is the problem ofposition in the sports development of the two main national sports institutions in Indonesia,namely KONI and KOI. The author's suggestions: First, the Constitutional Court needs todevelop an approach related to the use of constitutional interpretation and provideconfirmation of when a policy falls into the constitutional / unconstitutional category andwhen a policy falls into the concept of open legal policy. Thus, it is clear about how toproperly implement the Constitutional Court's decision. Second, there needs to be aGovernment Regulation that regulates each national sports committee as a follow-up to theConstitutional Court Decision and as a form of coordination between existing institutions bypaying attention to proportionality goals that do not harm security and public interests,especially the issue of competing rights in the future.Keywords: Sports Commitee, Constitutional Interpretation, open legal policy.

Abstract

Fulfillment of mental health rights before the pandemic still had problems that had notbeen resolved by the government, until the emergence of the Covid-19 pandemic mental healthincreasingly did not receive the government's attention, causing significant problems. Laws andregulations that legitimize that mental health is health that must be considered like physicalhealth, have not been sufficiently implemented because the government has not made mentalhealth a top priority in handling a pandemic.This type of research can be classified as normative research, because in this study theauthor examines legal theories and principles and examines literature based on legalsystematics. Sources of data used, primary data, secondary data and tertiary data. Datacollection techniques in this research with literature studies found general concepts related toresearch problems.From the research results there are three main things that can be concluded. First, theright to get fulfillment of mental health during the Covid-19 pandemic is a guarantee that cannotbe released and is the responsibility of the state. Second, the mental health law is considered tostill have limited regulations regarding the fulfillment of mental health rights during the Covid-19 pandemic. Third, there needs to be a change in the rules because ideally a law and regulationalways experiences continuous development. Author's suggestion, First, the government needs tocarry out mental health management in a planned manner to thoroughly evaluate theimplementation of mental health rights during the Covid-19 pandemic. Abstract

Undang-undang Nomor 28 Tahun 2009 Tentang Pajak Daerah dan Retribusi Daerah (PDRD) saat ini telah dicabut melalui Undang-Undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Anatara Pemerintah Pusat dan Pemerintahan Daerah. Undang-undang Nomor 1 Tahun 2022 diberlakukan dalam rangka mengalokasikan sumber daya nasional secara lebih efisien. Pemerintah memberikan kewenangan kepada Daerah untuk memungut Pajak dan Retribusi dengan penguatan melalui restrukturisasi jenis Pajak, pemberian sumber-sumber perpajakan Daerah yang abru, penyederhanaan jenis Retribusi, dan Harmonisasi dengan Undang-Undang Nomor 1 Tahun 2022 Tentang Cipta Kerja.Jenis Penelitian yang digunakan adalah penelitian Yuridis Sosiologis, yaitu studi empiris untuk menemukan teori-teori mengenai proses terjadinya proses bekerjanya hukum dalam masyarakat. Adapun Teknik pengumpulan data meliputi: Wawancara, dan studi kepustakaan. Di dalam Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan antara Pemerintah Pusat dan Pemerintahan Daerah, diberlakukan dalam rangka mengalokasikan sumber daya nasional secara efisien, pemerintah memberikan kewenangan kepada daerah untuk memungut pajak dan retribusi  perpajakan daerah yang baru. Namun dalam penyederhanaan ini terdapat sumber retribusi yang dihilangkan dan mengakibatkan berkurangnya Pendapatan Asli Daerah.Dari hasil penelitian dapat disimpulkan bahwa, Presiden dan Dewan Perwakilan Rakyat Republik Indonesia harus melkukan evaluasi dan perubahan terhadap Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Antara Pemerintahan Pusat dan Pemerintahan Derah dalam semangan pemberian otonomi Daerah sesuai denga napa yang dibunyikan dalam Pasal 18 Ayat (5) Unddang-undang Dasar Tahun 1945 yang menyatakan “Pemerintah Daerah menjalankan Otonomi seluas-luasnya, kecuali urusan Pemerintahan yang oleh Unddang-undang ditentukan sebagai urusan Pemerintah Pusat”.

Abstract

Impeachment is a process of charges filed by the legislative branch of a government againsta civilian official. Legally the term impeachment is applied only to charges. In common usage, itincludes trials of defendants conducted by the higher branch of the legislature.This research will examine the main issues according to the scope and identification ofproblems through a normative juridical approach. Based on normative research methods, the datasources used in this research are secondary data sources which consist of 3 legal materials,namely: primary legal materials, secondary legal materials, and tertiary legal materials. Datacollected from literature studies.After the Amendment to the 1945 Constitution, the mechanism for dismissing the Presidentin Indonesia is far more complicated than before. Starting from the institutions involved and theprocess that must be passed is very different from before the 1945 Constitution was changed.Under normal circumstances, it is very difficult to remove or impeach the President and/or VicePresident. Whereas it is true that the procedure for dismissing the President and/or Vice Presidentduring their term of office has been provided for in the 1945 Constitution. It's just that to be able todo so requires a political and legal process that is quite long and tortuous. From the point of viewof the involvement of state organs and the regulation of the impeachment mechanism in the 1945Constitution, there is still room for struggle between politics and law. Abstract

Constitutional Court Decision No 91/PUU-XVIII/2020 states that the Job CreationLaw is conditionally unconstitutional and still valid with a 2-year deadline for improvement.The follow-up to the court's decision is aimed at the DPR and the President should makeimprovements to Law Number 11 of 2020 concerning Job Creation. However, the actiontaken by the DPR is to make changes to the Law on the Establishment of Laws andRegulations, which is the advice of the judge who dissented opimion. Meanwhile, IndonesianPresident Joko Widodo issued Perrpu Number 2 of 2022 concerning Job Creation, thisexplicitly aborted the conditional unconstitutional status of Law No. 11 of the Year 2020About Job Creation.This research is a normative legal research. It is based on literature research thattakes excerpts from reading books, or supporting books related to the problem understudy. This study used secondary data sources consisting of primary, secondary, andtertiary legal materials. This study also used qualitative data analysis and produceddescriptive data.From the results of the research and discussions carried out, it is necessary to havean ideal system to improve the application of the Constitutional Court decision inaccordance with the principle of erga omnes. The results showed that to optimize theprinciple, cooperation efforts between the Constitutional Court and other state institutionsor adressat decisions are needed in implementing it. One of them is by directly appointingthe competent state agency in the consideration of the decision to follow up. This can becombined with the application of judicial deferrals and the granting of a deadline for theenforcement of judgments imposed on the adressats as a determinant representation of legalboundaries and certainty.

Abstract

Very high unemployment rates can cause disruption to security stability.One of the government's actions to reduce unemployment is to open job opportunitiesthrough the procurement of the state civil apparatus. Another problem that arises inaddition to the high unemployment rate is the presence of honorary workers who aremushrooming in various government agencies. The attention of the government is eagerlyawaited and is expected to be able to change their status more clearly and definitely,namely being appointed as civil servants. Law No. 5 of 2014 may also be considered agovernment action aimed at breaking the deadlock on handling unemployment and a wayout for the appointment of honorary workers to be part of civil servants. The purpose ofwriting this thesis, namely; first to find out how legal politics in appointing honoraryworkers to become government employees with work agreements based on Law Number 5of 2014 concerning civil servants. Second to find out how the Regulations for theImplementation of the Appointment of Honorary Personnel to PPPK are conformidablebased on Legal Politics. This type of research can be classified as normative legalresearch, because in this study using literature materials as the main data to analyzecases, and the author did not conduct field research. Data sources used, primary data,secondary data, and tertiary data. The collection technique uses a literature study oflegal materials.From the results of the study there are two main things that can beconcluded. First, There is legal politics in the appointment of honorary workers to PPPKbased on Law No. 5 of 2014 to overcome unemployment problems and provide legalcertainty for honorary workers to be appointed as PPPK. The appointment of honorarystaff is carried out through the stages of planning, announcement of vacancies,applications, selection, announcement of selection results, and appointment to honorarystaff and honorary staff can be appointed as PPPK candidates if they have met therequirements specified in the law. With this mechanism, it is expected that the quality ofservices provided by employees working in government agencies will be better and moreprofessional. Second, The regulations for the appointment of honorary personnel toPPPK are not fully in accordance with the legal politics above. This can be seen from thedetermination of PPPK needs that are not in accordance with the number of honorarypersonnel and various selections made that have not been able to help provide legalcertainty for honorary personnel to become part of ASN. Abstract

The preparation of the Local Government Budget based on Regulation of the Ministerof Home Affairs Regulation Number 84 of 2022 Concerning The Guidelines for CompilingThe Local Government Budget for Fiscal Year 2023. However, in its formation in KuantanSingingi Regency the delay in time. Therefore, the purpose of this thesis research is first,mechanism for establishing the draft Local Government Budget for the 2023 KuantanSingingi Regency based on the Minister of Home Affairs Regulation Number 84 of 2022.Second, obstacles encountered in the process. Third, efforts that must be made in overcomingobstacles in the process of forming.This type of research is sociological juridical research. With the research locationtaking place at the Regional People's Legislative Council of Kuantan Singingi Regency andthe Regional Financial and Asset Management Agency of Kuantan Singingi Regency.From the results of the research results it can be concluded. First, mechanism forforming of the draft Local Government Budget of Kuantan Singingi Regency in the 2023 isnot fully in accordance with the Regulation of the Minister of Home Affairs RegulationNumber 84 of 2022. Second, obstacle faced is the internet network and inadequate servers,lack of understanding and weak coordination between regional work units, limited humanresources, and the government's unpreparedness to prepare performance-based budgets.Third, efforts that must be made are making improvements to the Regional Government'sinternet network, increasing human resource development, determining priority scales,synergizing the executive with the legislature in drafting regional regulations on regionalbudgets.Keywords: Compliance, Local Government, Local House of Representative, The Formationof A Draft Local Government Budget

Abstract

The writing of this law is about a house located on the river border in SiakRegency. The formulation of the problem is whether the existence of a house on theSiak river border in Pekanbaru City is in accordance with Pekanbaru CityRegional Regulation No. 7 of 2020 concerning the Pekanbaru City DevelopmentPlan for 2020-2040 and what steps are being taken by the government to overcomethis problem. This legal research aims to identify, study, and analyze houseslocated in the riparian area of the river in Siak Regency. This Legal article is anempirical research. Based on the results of the study it can be concluded that thehouse which is located on the border of the Siak river in Pekanbaru City violatesPekanbaru City Regional Regulation No. 7 of 2020 concerning the Pekanbaru CityDevelopment Plan for 2020-2040 and until now there has been no governmenteffort to overcome this problem.Keywords: River border, Siak river, house located in the river border area.

Abstract

The relocation of the capital city dominates the country due to the country's regional development goals, mitigation of the risk of rebellion, decisions of the country's leaders, the problem of flooding in the capital, the country's former low, and infrastructure development. The discourse on moving the capital city has appeared several times during the presidential administration. Then during the administration of President Joko Widodo, discourse reappeared to move the national capital. President Joko Widodo decided to make parts of North Penajem Paser and Kutai Kartanegara in East Kalimantan the location for Indonesia's new capital. Law Number 3 of 2022 concerning the State Capital is a legal political form of moving the national capital. The urgency of relocating the capital as expressed by President Joko Widodo at the Annual Session of the People's Consultative Assembly, is based on the fact that economic activity is concentrated in Jakarta and Java, which has created an economic gap between Java and outside Java. This inequality causes a concentration of economic investment. The concentration of economic investment in Jakarta has resulted in a very low poverty rate in Jakarta compared to other regions. Therefore, it is necessary to examine how the legal politics of placing the Indonesian state capital in East Kalimantan are related to national economic development. The type of research used by the author is normative legal research. Normative legal research is carried out by examining library materials or secondary data. The data collection technique in this research is library research. This technique can be used to limit the use of document studies or library materials, namely secondary data. In writing this thesis, the author uses qualitative data analysis which produces descriptive data. With qualitative analysis, a researcher aims to understand or understand the symptoms he is studying. The results of this thesis research state that the placement of the Indonesian state capital from Jakarta to East Kalimantan is based on the philosophical, sociological, and juridical foundations of Law Number 3 of 2022 concerning the State Capital. Then the legal politics of placing the national capital in East Kalimantan is linked to national economic development so that in the future, the burden on the island of Java, especially Jakarta, can be reduced. In addition, the placement of the capital city in East Kalimantan is to balance the Indonesian economy, including to the eastern part. The government believes that this will bring a number of benefits in the economic field. However, moving the nation's capital should have been done when the country was ready.
