Abstract

The management of village funds in empowering village residentsand to find out several factors that enable and hinder the management of villagefunds. This research uses sociological research methods. This activity was carriedout in Segati Village, LanggamDistrict, Pelalawan Regency, by conductinginterviews and observations to obtain data and information about interpretedvillage funds. Segati Village received a Village Fund budget of IDR2,571,968,300. In 2019, IDR. 2,809,007,000 in 2020, Rp. 2,442,927,000 in 2021and the Village Fund Allocation (ADD) budget in 2021 is Rp. 1,031,380,000. AndDistribution is carried out in 2 (two) stages, namely, the first stage 60% and thesecond stage 40%.The aim of this research is to determine the realization of VillageFund management in Segati Village, Langgam District, Pelalawan Regency. Thenumber of research informants was 5 people with the Village Head, VillageSecretary, Village Consultative Body, Management Activity ImplementationTeam, Subdistrict Head, as informants. data collection techniques usinginterviews and analysis.The research results show that the management of village fundscarried out by the village government has not been fully realized and needs to beimproved further. The suggestion in this research is that it is hoped that themanagement of Village Funds will put more emphasis on the provisions set so thatall sectors in the Village Fund Allocation management policy are implementedwell. As well as the Regional Government monitoring villages that do notimplement government policies regarding managing village funds properly, aswell as evaluating which villages use Village Fund Allocations but do not complywith the stipulated provisions so that they can be given warnings and sanctions sothat village fund management is realized properly.Keywords: Implementation, Management, Allocation of Village Funds

Abstract

In 2020 Indonesia was Constitutional Court Decision Number 91/PUU-XVIII/2020. Inthe decision the Job Creation Law was declared conditionally unconstitutional and gave 2years to complete the revision of the job creation law, but on December 30 2022 theGovernment postponed Government Regulation in Lieu of Law Number 2 of 2022 concerningJob Creation. Since the promulgation of this Perppu, there has been much debate in thecommunity, so there are pros and cons to the enactment of this Perppu. Therefore it isnecessary to know about the process of forming Perppu Number 2 of 2022 concerning JobCreation which is linked to the Constitutional Court Decision Number 91/PUU-XVIII/2020.The purpose of this research was to find out the background for the issuance of Perppu Number2 of 2022 concerning Job Creation by the President, as well as whether the establishment ofPerppu Number 2 of 2022 is in accordance with the Constitutional Court Decision Number91/PUU-XVIII/2020 and to find out how it should be Following up on the Constitutional CourtDecision Number 91/PUU-XVIII/2020 by the President.This research is a normative legal research. Normative legal research that examines andexamines literature or secondary data, by taking quotations from the literature that is relatedto the problem to be studied. As well as a statutory and conceptual approach, in this way thisstudy uses data sources consisting of primary, secondary and tertiary legal materials. Thisstudy also used qualitative data analysis and produced descriptive data.From the results of the discussion and research conducted, several conclusions wereobtained, namely: First, the background to the issuance of Perppu Number 2 of 2022 by thePresident is a matter of urgency that compels and as a continuation in implementing theConstitutional Court Decision 91/PUU-XVIII/2020, Second, the Establishment of PerppuNumber 2 of 2022 is not in accordance with the Constitutional Court Decision Number91/PUU-XVIII-2020. Because the subjectivity of the President which is the main reference forestablishing a Perppu is contained in the Constitutional Court Decision Number 138/PUU-VII/2009. Third, a decision of the constitutional court must be respected but must also beobeyed and maintained in its implementation. Abstract

The parliamentary threshold is the minimum vote limit for political parties in generalelections to participate in determining the number of seats in the DPR. This parliamentarythreshold was created to stabilize the relationship between the Executive and the Legislature in ademocratic country. The aim of implementing the threshold provisions is to reduce the number ofpolitical parties in parliament in order to simplify the party system. Apart from that,parliamentary thresholds can also be used as an instrument to screen participants for the nextelection. In accordance with the mandate contained in the Constitutional Court's decisionNumber 52/PUU-X/2012, the parliamentary threshold only applies to calculating the valid votesobtained by political parties at the DPR level. Based on Law Number 7 of 2017, theparliamentary threshold for the 2019 election was again increased to a minimum of 4%.This legal research is normative legal research. Normative legal research is legalresearch carried out by examining library materials or secondary data and tertiary legalmaterials. This type of normative law is also called doctrinal legal research, also known aslibrary research or document study. It is called doctrinal legal research, because this research iscarried out or directed only at written regulations or other legal materials. Comparative legalresearch is research that finds and looks for differences in various legal systems.The conclusions that can be obtained from the research results are: First, the regulationregarding the parliamentary threshold in Indonesia continues to experience developmentstarting from the enactment of the 2009 Legislative Election at 2.5% Second, the parliamentarythreshold is a system that strengthens presidential government, because a multiparty system is aform of combination that is not compatible with a presidential government system. Abstract

Villages as the smallest government entity within the state framework were affirmed by theissuance of Law No. 6/2014 on Villages (Village Law). The issuance of the Village Law notonly provides regulatory changes but also provides a paradigm shift regarding the Village,which was originally seen as an extension of the regency or city into an autonomouscommunity unit that has the right and authority to regulate and manage its own territory.Therefore, Article 1 Point 3 of the Village Law mandates the existence of a Villagegovernment organizer, namely led by the Village Head and assisted by Village officialsThis research uses normative legal research. Normative legal research is library legalresearch, namely legal research conducted by making library materials as the main focus.From the results of the research it is concluded that, First, the election of the Village Headfrom the perspective of legal politics is a form of manifestation of democracy at the villagelevel by considering regional autonomy in technical related arrangements by involving thedistrict / city government. Second, the weaknesses of this regulation are quantitative-baseddemocracy or only the highest number of votes, the risk of money politics, the risk ofhorizontal conflict in the community, and conflict due to the determination of the winner ifthe results of the highest number of votes are more than one candidate. Abstract

Artikel ini bertujuan untuk menganalisis efektivitas kegiatan sosialisasi pendaftaran merek bagi pelaku usaha di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis. Pendaftaran merek merupakan langkah krusial dalam melindungi hak kekayaan intelektual dan menciptakan keunggulan kompetitif bagi pelaku usaha, terutama di tingkat lokal seperti desa. Namun, kesadaran dan pemahaman akan pentingnya pendaftaran merek seringkali masih kurang di kalangan pelaku usaha skala kecil di daerah pedesaan. Metode yang digunakan adalah metode diskusi dan praktek (learning by doing) dan hasil kegiatan menunjukkan bahwa sebagian besar pelaku usaha di Desa Semunai pada awal kegiatan belum memiliki pemahaman yang baik tentang pendaftaran merek dan manfaatnya, sehingga dengan dilaksanakannya kegiatan ini telah meningkatkan pemahaman dan kesadaran peserta terkait regulasi, urgensi, dan tatacara pendaftaran merek. Upaya sosialisasi yang lebih intensif dan berkelanjutan akan membantu melindungi hak kekayaan intelektual pelaku usaha, meningkatkan daya saing, dan mendorong pertumbuhan ekonomi di tingkat desa, khususnya di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis.

Abstract

Women are a group or group that is vulnerable to violence that occurs in society. To overcome various issues of violence that occur against women, special attention is needed from all groups, both community groups and government circles, consisting of the central government and regional governments. This certainly has an impact on the existence of women's groups in the social order amidst demands for achieving Sustainable Development Goals (SDG's). If we refer to the concept of "mainstreaming" itself, it can be interpreted as a process that is carried out to bring aspects that were previously considered unimportant or marginal into the decision-making and management of main institutional activities and work programs. This series of strategies was prepared based on insight, critical awareness and data obtained from gender analysis. Therefore, this study is considered important to look at gender representation in Siak Hijau policies.

Abstract

Higher education institutions in realizing the implementation of education,research and community service, always uphold the values and norms in order to createa conducive academic climate. Guidance regarding academic integrity is an effort madeby higher education institutions in order to shape the character of academicians withintegrity, and maintain academic culture in higher education. Based on Article 5 ofPermendikbudristek Number 39 of 2021, it is stated that the guidance of academicintegrity values is carried out, one of which is through the establishment of regulationsregarding academic integrity in producing scientific works. The purpose of writing thisthesis is; First, to find out the Implementation of Permendikbudristek Number 39 of 2021concerning Academic Integrity in Producing Scientific Works at the University of Riau.Second, to find out the inhibiting factors and efforts to overcome obstacles to theImplementation of Permendikbudristek Number 39 of 2021 concerning AcademicIntegrity in Producing Scientific Works at the University of Riau.This type of research is empirical legal research, namely a research approach thatemphasizes legal aspects related to the main problem to be discussed, linked to the realityin the field. This research was conducted at the University of Riau. From the results ofthe problem research, there are two main things that can be concluded. First, theimplementation of Permendikbudristek Number 39 of 2021 at the University of Riau hasnot been optimally implemented. The implementation of academic integrity in producingscientific works at UNRI in the process of its implementation is still guided by the oldregulations and the new regulations are still in draft form which have not been stipulatedin the Chancellor's Regulation. Second, the technical regulations related to academicintegrity in producing scientific works with the Chancellor's Regulation have not beenstipulated due to the busyness of the UNRI apparatus and leadership. Abstract

Introduction: Administrator Officials are appointed and determined by the Staff Supervisory Officer. The implementation of the appointment and transfer of administrator officials within the Karimun Regency Government is considered not running optimally. There are administrator officials who sit in office but not in accordance with the requirements specified in PP No.11 of 2017 concerning Civil Servant Management. Purposes of the Research: The purpose of this study is to determine the implementation of the appointment and transfer of Administrator Officials by the Civil Service Supervisory Officials within the Karimun Regency Regional Government, to find out the obstacles and supporting factors in this implementation, and the efforts made by the government against this. Methods of the Research: The type of research conducted is sociological legal research conducted in the Regional Government of Karimun Regency. The data sources used are primary data and secondary data. The data collection techniques used are interviews, observation and literature review. The data is then analyzed which is qualitative in nature and then concluded using a deductive thinking method. Results of the Research: The result of this study is the implementation of the appointment and transfer of Administrator Officials is done through performance appraisal by TPK PNS is not done because it is not found what is called TPK PNS. This causes there are Administrator Officials who are not in accordance with the requirements determined by laws and regulations such as there are officials who are less qualified.

Abstract

Salah satu aspek yang harus diperhatikan dalam struktur BPD adalah keterwakilan perempuan dalam hal memilih dan dipilih sesuai instruksi Permendagri dan Perda bahwa keanggotaan BPD harus di isi oleh minimal satu orang perempuan dan proses pemilihannya yang harus dilakukan di forum perempuan pula yang memiliki hak suara. Masalah pokok dalam penelitian ini adalah apakah praktek mengenai keterwakilan perempuan dalam hal memilih dan dipilih telah sesuai dengan aturan yuridis, Penelitian ini di latar belakangi oleh kenyataan bahwa di Desa Suka Jadi Kecamatan Kuala Cenaku Kabupaten Indragiri Hulu dari pemilihan anggota Badan Permusyawaratan Desa (BPD) Keterwakilan Perempuan di Desa Suka Jadi tidak di lakukan di forum perempuan yang hanya di lakukan di forum laki-laki nampaknya memang sudah menjadi kebiasaan dari setiap periodesasi. Mengapa praktek tersebut terjadi, hal tersebutlah yang mendorong dilakukan penelitian ini. Penelitian ini tergolongan penelitian hukum sosiologis. yaitu penelitian yang hendak melihat korelasi antara hukum dan masyarakat dengan adanya kesenjangan antara dass sollen dan das sein. Sedangkan dilihat dari sifatnya, penelitian ini bersifat menggambarkan dari suatu kenyataan secara lengkap, rinci, dan jelas. Penelitian ini dilakukan di wilayah Desa Suka Jadi Kecamatan Kuala Cenaku Kabupaten Indragiri Hulu, sedangkan populasi dan sampel adalah Kepala Desa, Sekretaris Desa, Tokoh Masyarakat Perempuan, Ketua BPD, Ketua Panitia Pemilihan. Sumber data yang digunakan ialah dari data primer, data sekunder dan data tersier dengan teknik pengumpulan data dengan cara melalui wawancara dan kajian kepustakaan. Dari hasil penelitian, ada tiga hal pokok yang dapat yang dapat disimpulkan. Pertama, Mekanisme Pemilihan Anggota BPD Keterwakilan Perempuan Berdasarkan Perda Kabupaten Indragiri Hulu Nomor 3 Tahun 2019 Tentang Badan Permusyawaratan Desa memiliki tahapan yang pertama pemberitahuan berakhirnya masa keanggotaan BPD, pembentukan panitia pemilihan anggota BPD, penjaringan bakal calon anggota BPD Keterwakilan Perempuan, penyaringan dan penetapan calon anggota BPD keterwakilan perempuan. Kedua, Pemilihan BPD Keterwakilan Perempuan di Desa Suka Jadi tidak sesuai dengan Peraturan Daerah Kabupaten Indragiri Hulu Nomor 03 tahun 2019 tentang Badan Permusyawaratan Desa yang dalam teknisnya diatur dalam Perbup Nomor 89 tahun 2019, ketidaksesuaian tersebut terletak pada Tahapan Pemungutan Suara, pada kenyataannya di Desa Suka Jadi efektivitas hukum tidak ditaati yang mana dalam pada pemilihan BPD Keterwakilan perempuan tidak melibatkan forum-forum perempuan dalam pemilihan BPD keterwakilan perempuan. Ketiga, Kendala dalam mekanisme pemilihan anggota BPD keterwakilan perempuan di Desa Suka Jadi Tahun 2020 masih dijumpai adalah Pertama, Kurangnya Sosialisasi, Kebingungan dalam menentukan penetapan wilayah, Kurangnya partisipasi dari warga sekitar, Pendaftaran Bakal Calon Anggota BPD Keterwakilan Perempuan hampir semua bakal calon mendaftarkan diri di menit-menit terakhir.

Abstract

Indonesia dengan Venezuela merupakan dua negara yang memiliki sistem hukum yang berbeda (Indonesia menganut sistem hukum kontinental sedangkan Venezuela menganut sistem hukum sosial). Akan tetapi, Indonesia dan Venezuela memiliki kesamaan dalam sistem pemerintahan yaitu presidensial. Konstitusi Indonesia dalam hal periodesasi masa jabatan DPR tidak memberikan penjelasan berapa lama dan berapa kali DPR dapat menjabat kembali, begitu pun dengan peraturan perundang-undangan yang berkaitan dengan DPR lainnya, sedangkan negara Venezuela secara jelas mengatur hal tersebut dalam konstitusinya. Adapun tujuan dari penulisan skripsi ini adalah pertama, Untuk mengetahui bagaimana pengaturan hukum terkait masa jabatan DPR di Indonesia dan Venezuela. Kedua, Untuk mengetahui kelebihan dan kekurangan dari pengaturan hukum terhadap masa jabatan DPR di Indonesia. Ketiga, Untuk mengetahui kontribusi pengaturan hukum terkait pembatasan masa jabatan Majelis Nasional Venezuela dalam memperkuat pembatasan masa jabatan DPR di Indonesia. Penelitian ini merupakan penelitian hukum normatif. Hal ini didasarkan pada penelitian kepustakaan yang mengambil kutipan dari buku bacaan atau buku pendukung yang berkaitan dengan permasalahan yang diteliti. Penelitian ini menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Penelitian ini juga menggunakan analisis data kualitatif dan menghasilkan data deskriptif. Berdasarkan hasil penelitian, terdapat perbedaan dalam pembatasan periodesasi masa jabatan DPR Indonesia dengan Majelis Nasional Venezuela. Di Indonesia periodesasi DPR sama sekali tidak diatur dalam konstitusi UUD 1945 maupun undang-undang khususnya. Sedangkan di Venezuela periodesasi Majelis Nasional secara jelas tertulis dalam CRBV 1999 yang menyatakan bahwa Majelis Nasional hanya bertahan untuk dua periode saja. Pembatasan kekuasaan dalam hal waktu periodesasi ini menjadi penting karena dalam penerapan negara demokrasi terdapat prinsip-prinsip yang harus dipenuhi dengan dibatasinya periode masa jabatan DPR. Sehingga harapan peneliti kedepannya, para pemangku kebijakan membuat politik hukum terkait aturan pembatasan periodesasi anggota DPR dengan merubah ketentuan yang mengatur tentang masa jabatan anggota DPR
