Abstract

The management of village funds in empowering village residentsand to find out several factors that enable and hinder the management of villagefunds. This research uses sociological research methods. This activity was carriedout in Segati Village, LanggamDistrict, Pelalawan Regency, by conductinginterviews and observations to obtain data and information about interpretedvillage funds. Segati Village received a Village Fund budget of IDR2,571,968,300. In 2019, IDR. 2,809,007,000 in 2020, Rp. 2,442,927,000 in 2021and the Village Fund Allocation (ADD) budget in 2021 is Rp. 1,031,380,000. AndDistribution is carried out in 2 (two) stages, namely, the first stage 60% and thesecond stage 40%.The aim of this research is to determine the realization of VillageFund management in Segati Village, Langgam District, Pelalawan Regency. Thenumber of research informants was 5 people with the Village Head, VillageSecretary, Village Consultative Body, Management Activity ImplementationTeam, Subdistrict Head, as informants. data collection techniques usinginterviews and analysis.The research results show that the management of village fundscarried out by the village government has not been fully realized and needs to beimproved further. The suggestion in this research is that it is hoped that themanagement of Village Funds will put more emphasis on the provisions set so thatall sectors in the Village Fund Allocation management policy are implementedwell. As well as the Regional Government monitoring villages that do notimplement government policies regarding managing village funds properly, aswell as evaluating which villages use Village Fund Allocations but do not complywith the stipulated provisions so that they can be given warnings and sanctions sothat village fund management is realized properly.Keywords: Implementation, Management, Allocation of Village Funds

Abstract

In 2020 Indonesia was Constitutional Court Decision Number 91/PUU-XVIII/2020. Inthe decision the Job Creation Law was declared conditionally unconstitutional and gave 2years to complete the revision of the job creation law, but on December 30 2022 theGovernment postponed Government Regulation in Lieu of Law Number 2 of 2022 concerningJob Creation. Since the promulgation of this Perppu, there has been much debate in thecommunity, so there are pros and cons to the enactment of this Perppu. Therefore it isnecessary to know about the process of forming Perppu Number 2 of 2022 concerning JobCreation which is linked to the Constitutional Court Decision Number 91/PUU-XVIII/2020.The purpose of this research was to find out the background for the issuance of Perppu Number2 of 2022 concerning Job Creation by the President, as well as whether the establishment ofPerppu Number 2 of 2022 is in accordance with the Constitutional Court Decision Number91/PUU-XVIII/2020 and to find out how it should be Following up on the Constitutional CourtDecision Number 91/PUU-XVIII/2020 by the President.This research is a normative legal research. Normative legal research that examines andexamines literature or secondary data, by taking quotations from the literature that is relatedto the problem to be studied. As well as a statutory and conceptual approach, in this way thisstudy uses data sources consisting of primary, secondary and tertiary legal materials. Thisstudy also used qualitative data analysis and produced descriptive data.From the results of the discussion and research conducted, several conclusions wereobtained, namely: First, the background to the issuance of Perppu Number 2 of 2022 by thePresident is a matter of urgency that compels and as a continuation in implementing theConstitutional Court Decision 91/PUU-XVIII/2020, Second, the Establishment of PerppuNumber 2 of 2022 is not in accordance with the Constitutional Court Decision Number91/PUU-XVIII-2020. Because the subjectivity of the President which is the main reference forestablishing a Perppu is contained in the Constitutional Court Decision Number 138/PUU-VII/2009. Third, a decision of the constitutional court must be respected but must also beobeyed and maintained in its implementation. Abstract

The president is the head of government (chief of executive), but also the head of state (chief of state).The term of office of the president in various countries is different. The term of office of the president inIndonesia in one period of five years can be elected twice based on Article 7 of the 1945 Constitution, whilein the Philippines the term of office of the president can only be elected once in a year. one period for six yearsbased on the Philippine Constitution Chapter 7 Article 4. Therefore, this research aims to find out and comparethe two countries in terms of similarities/differences, advantages/disadvantages, and the urgency ofcomparison to strengthen regulations limiting the period of presidential office in Indonesia and thePhilippines.This type of research can be classified as a normative research type. The research focuses on examiningthe comparison of term limits for the presidents of Indonesia and the Philippines. The data sources used aresecondary data in the form of primary legal materials, namely the 1945 Constitution and the PhilippineConstitution, secondary legal materials, namely documents and journals, and tertiary legal materials, namelylegal dictionaries. The data collection technique in this research is the literature review method, usingDescriptive analysis describes, describes and compares the Indonesian and Philippine constitutions regardingpresidential term limits.Limiting the presidential term of office for Indonesia and the Philippines has similarities/differences,advantages/disadvantages, and the urgency of strengthening the implementation of presidential termregulations. The similarities/differences are that the countries have the same principle of Trias Politica(Division of power) while the differences in this case provide for re-nomination. The advantages guaranteethe creation of democratic politics, economic growth, lack of potential for corruption while the shortcomingsalso hinder the regeneration of new leaders from the executive branch. The urgency is to limit the presidentialperiod to prevent continued political instability. That in this case the researcher provides suggestions, it ishoped that policy makers will make legal politics related to the rules for limiting the term of office of thepresident by changing the provisions governing the term of office of the president as well as communityinvolvement, political style, and modernity by giving the term of office of the president to one term withprovisions as long as one period of six years.Keywords : Constitution - Period - Limitations

Abstract

Harmonization the draf regional regulation is an attempt to harmonize,adjusting, strengthening and rounding up the conception of a draf regionalregulatios, wheter higher, equal or more low, and other matters other than lawsand regulation, so that they are arranged systematically, not conflicting oroverlappig, regional regulations in Riau Province must of course be inaccordance with the principles of forming laws and regulations and providiondthat are in accordance with the philosophy o Pancasila and local wisdom.This research is a sociological legal research, this is based on fieldresearch which refers to interviews and observations statements as wellsupporting documents that have a corelation with the background of the problemto be studied. This study uses secondary date sources consisting of primary,secondary, and tertiary legal materials. This study uses qualitative date analysisby producing a deductive method of drawing conclusions, namely drawingconclusions from that are general to things that are specific.From the results of the discussion, it can be concluded that theharmonization, rounding and strengthening of the draft Provincial RegionalRegulations was carried out by vertical agencies, in this case the Regional Officeof the Ministry of Law and Human Rights, Riau Province. Obstacles in theprocess of harmonization of Riau Province Regional Regulations are caused byseveral factors, namely: the minimum number of human resources, the difficultyof adjusting time between agencies, and the limited budget resulting in norescheduling of the process. Efforts that need to be made so that theharmonization of the Riau Province Regional Regulation Draft can beimplemented is by providing an adequate number of human resources to carry outthe harmonization, the obligation of the relevant parties to be present whendiscussing harmonization, and the existence of an adequate budget to guaranteelegal products in the form of Regional Regulations.Keyword: Harmonization, Regional Regulation, Riau province.

Abstract

Government employees with a work agreement (PPPK) are Indonesian citizens whohave met the requirements and are appointed based on the work needs of government agencies.Government employees with a work agreement are appointed by civil service developmentofficials (PPK) with a work contract. If the maximum contract term limit is not strictlystipulated, it is feared that there will be potential politicization of the extension of the PPPKcontract by irresponsible individuals and then termination of PPPK employment may alsooccur. because there is a downsizing of the organization or government policy which results ina reduction in PPPK, what compensation will PPPK receive when that happens and what arethe legal remedies for termination of employment.The purpose of writing this thesis is: first, to find out the legal protection for governmentemployees with work agreements (PPPK) who are affected by termination of employment(PHK) by the government. Second, to find out the legal remedies that can be taken bygovernment employees with work agreements (PPPK) who are affected by termination ofemployment (PHK) by the government. The research method in this thesis uses a normativejuridical type of research, namely research that focuses on examining the application of therules of law. rules or norms in positive law. The nature of this thesis research isresearchdescriptivewhich systematically describes the facts and characteristics of the objectbeing studied accurately. Abstract

Article 5 Paragraph (1) explains that the President as one of theexecutives has the right to submit bills to the DPR as a legislative institution.Article 20 also regulates the formation of the bill. The joint agreement on thelegislative function in the Indonesian presidential system of government dividesauthority. The refusal made by one party opens the possibility of tension inrelations between the DPR and the President. Second, to find out the similaritiesand differences in presidential veto power on draft laws in Indonesia and theUnited States. Third, to find out the advantages and disadvantages of thepresident's veto power over draft laws in Indonesia and the United States.The research method in this thesis uses a type of normative juridicalresearch, which is research focused on examining the application of rules ornorms in positive law. The nature of this thesis research is descriptive researchthat describes systematically, the facts and characteristics of the object understudy precisely. The data sources used are primary, secondary and tertiary datasources, The data collection method used in this study is the first literature study,is a technique to obtain secondary data through documents related to theproblem, objectives and benefits of research, then after the data is collected thenanalyzed to draw conclusions.Based on the results of research, in Indonesia veto power is the right todeclare rejection of a draft law or to the material of a bill in the planning,drafting, and discussion stages. Abstract

The parliamentary threshold is the minimum vote limit for political parties in generalelections to participate in determining the number of seats in the DPR. This parliamentarythreshold was created to stabilize the relationship between the Executive and the Legislature in ademocratic country. The aim of implementing the threshold provisions is to reduce the number ofpolitical parties in parliament in order to simplify the party system. Apart from that,parliamentary thresholds can also be used as an instrument to screen participants for the nextelection. In accordance with the mandate contained in the Constitutional Court's decisionNumber 52/PUU-X/2012, the parliamentary threshold only applies to calculating the valid votesobtained by political parties at the DPR level. Based on Law Number 7 of 2017, theparliamentary threshold for the 2019 election was again increased to a minimum of 4%.This legal research is normative legal research. Normative legal research is legalresearch carried out by examining library materials or secondary data and tertiary legalmaterials. This type of normative law is also called doctrinal legal research, also known aslibrary research or document study. It is called doctrinal legal research, because this research iscarried out or directed only at written regulations or other legal materials. Abstract

Villages as the smallest government entity within the state framework were affirmed by theissuance of Law No. 6/2014 on Villages (Village Law). The issuance of the Village Law notonly provides regulatory changes but also provides a paradigm shift regarding the Village,which was originally seen as an extension of the regency or city into an autonomouscommunity unit that has the right and authority to regulate and manage its own territory.Therefore, Article 1 Point 3 of the Village Law mandates the existence of a Villagegovernment organizer, namely led by the Village Head and assisted by Village officialsThis research uses normative legal research. Normative legal research is library legalresearch, namely legal research conducted by making library materials as the main focus.From the results of the research it is concluded that, First, the election of the Village Headfrom the perspective of legal politics is a form of manifestation of democracy at the villagelevel by considering regional autonomy in technical related arrangements by involving thedistrict / city government. Second, the weaknesses of this regulation are quantitative-baseddemocracy or only the highest number of votes, the risk of money politics, the risk ofhorizontal conflict in the community, and conflict due to the determination of the winner ifthe results of the highest number of votes are more than one candidate. Abstract

The authority of the Constitutional Court in the 1945 Constitution of the Republic ofIndonesia (1945 Constitution of the Republic of Indonesia) after the issuance of MK DecisionNumber 138/PUU-VIII/2009. The Constitutional Court stated its authority to review GovernmentRegulations in Lieu of Law (Perppu) against the Constitution, relying on the interpretation thatPerppu is in a position parallel to the Law, in accordance with Law Number 12 of 2011concerning the Formation of Legislative Regulations . Abstract

Artikel ini bertujuan untuk menganalisis efektivitas kegiatan sosialisasi pendaftaran merek bagi pelaku usaha di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis. Pendaftaran merek merupakan langkah krusial dalam melindungi hak kekayaan intelektual dan menciptakan keunggulan kompetitif bagi pelaku usaha, terutama di tingkat lokal seperti desa. Namun, kesadaran dan pemahaman akan pentingnya pendaftaran merek seringkali masih kurang di kalangan pelaku usaha skala kecil di daerah pedesaan. Metode yang digunakan adalah metode diskusi dan praktek (learning by doing) dan hasil kegiatan menunjukkan bahwa sebagian besar pelaku usaha di Desa Semunai pada awal kegiatan belum memiliki pemahaman yang baik tentang pendaftaran merek dan manfaatnya, sehingga dengan dilaksanakannya kegiatan ini telah meningkatkan pemahaman dan kesadaran peserta terkait regulasi, urgensi, dan tatacara pendaftaran merek. Upaya sosialisasi yang lebih intensif dan berkelanjutan akan membantu melindungi hak kekayaan intelektual pelaku usaha, meningkatkan daya saing, dan mendorong pertumbuhan ekonomi di tingkat desa, khususnya di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis.
