Abstract

Penelitian ini bertujuan untuk menganalisis penyelenggaraan administrasi kependudukan berdasarkan Peraturan Daerah Kabupaten Rokan Hilir Nomor 4 Tahun 2011 yang dilaksanakan oleh Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rokan Hilir. Penelitian ini juga mengeksplorasi hambatan dalam pelaksanaan administrasi kependudukan serta upaya yang dilakukan untuk meningkatkan efektivitas pelayanan publik. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif. Data dikumpulkan melalui wawancara, observasi, dan studi pustaka, serta dianalisis secara deskriptif. Hasil penelitian menunjukkan bahwa meskipun ada standar pelayanan yang ditetapkan, implementasi di lapangan sering mengalami kendala, seperti kurangnya infrastruktur teknologi, minimnya sumber daya manusia, dan praktik pungutan liar. Hal ini berdampak pada rendahnya kepuasan masyarakat terhadap pelayanan administrasi kependudukan. Upaya yang dilakukan Dinas Kependudukan dan Pencatatan Sipil Kabupaten Rokan Hilir mencakup peningkatan sosialisasi kepada masyarakat, penguatan infrastruktur teknologi, dan pembentukan Unit Pelaksana Teknis Daerah (UPTD) di wilayah terpencil. Penelitian ini memberikan kontribusi penting bagi pengembangan kebijakan publik, khususnya dalam meningkatkan efektivitas dan kualitas pelayanan administrasi kependudukan.

Abstract

Fuel oil (BBM) subsidy policy in Indonesia has been an important element in economic policy since the era of President Soeharto's administration. Initially, this subsidy was aimed at maintaining energy price stability and protecting people's purchasing power, especially low-income groups. However, over time, fuel subsidies have created various economic and environmental problems, including a large burden on the State Revenue and Expenditure Budget (APBN), economic distortions, and obstacles to the renewable energy transition. This research uses a normative legal approach to analyze fuel subsidy policies within the framework of the welfare state in Indonesia, with the aim of formulating more effective regulations. The data used is primary, secondary and tertiary legal materials which are analyzed descriptively-analytically. The research results show that the fuel subsidy policy has not been effective and efficient, with most of the benefits being enjoyed by the middle and upper income groups, while those who should benefit, namely the poor, are left behind. Therefore, it is necessary to reformulate fuel subsidy policies with the principles of social justice, economic sustainability, transparency and accountability. Formulating more targeted policies, developing renewable energy, and implementing the principles of good governance will strengthen the welfare state and support more equitable and sustainable development.

Abstract

Undang-undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) memberikan kewenangan tidak sedikit kepada Presiden. Salah satu kewenangannya adalah menetapkan “hal ihwal kegentingan yang memaksa”, karena negara itu tidak selamanya dalam kondisi normal/damai/stabil. Pada saat kondisi sebaliknya Presiden sebagai kepala negara diberi kewenangan secara konstitusional untuk menetapkan keadaan bahaya dalam bentuk Keputusan Presiden (Keppres). Penelitian ini dilakukan untuk mengetahui Keabsahan pembentukan Keputusan Presiden Republik Indonesia Nomor 12 Tahun 2020 tentang Penetapan Bencana Non Alam Penyebaran Corona Virus Disease 2019 sebagai Bencana Nasional dan Penetapan status bencana non alam penyebaran Corona Virus Disease 2019 sebagai bencana nasional. Jenis penelitian ini tergolong sebagai penelitian hukum normatif, Dalam penelitian hukum normatif, sumber datanya adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Pengumpulan data penelitian hukum normatif menggunakan teknik pengumpulan data secara studi kepustakaan. Data yang diperoleh melalui studi kepustakaan akan dianalisis secara kualitatif. Dalam menarik kesimpulan penulis menggunakan metode berfikir deduktif yaitu cara berfikir yang menarik kesimpulan dari suatu pernyataan atau dalil yang bersifat umum menjadi suatu pernyataan yang bersifat khusus. Berdasarkan hasil penelitian dapat dipahami bahwa syarat formil dan materil pembentukan Keputusan Presiden Keputusan Presiden Nomor 12 Tahun 2020 tentang Penetapan Bencana Non Alam Penyebaran COVID 19 sebagai Bencana Nasional dapat dinyatakan sah dan Penetapan penyebaran Covid 19 sebagai bencana tertuang dalam Keputusan Presiden (Keppres) No. 12 Tahun 2020 tentang Penetapan Bencana Non-Alam Penyebaran Corona Virus Disease 2019 (Covid-19) Sebagai Bencana Nasional sesuai Pasal 7 ayat (1) huruf c UU Penanggulangan Bencana, yang berwenang menetapkan status bencana nasional dan daerah adalah pemerintah. Normatifnya, penetapan status dan tingkat bencana harusnya ditetapkan berdasarkan indikator yang diamanatkan oleh UU No. 24 Tahun 2007 Pasal 7 Ayat (2) huruf c yang mana mengamanatkan dibentuknya Perpres yang memuat indikator dalam penentuan tingkatan bencana, tetapi sampai saat ini perpres yang diamantkan tersebut belum terbit. indikator yang meliputi jumlah korban, kerugian harta benda, kerusakan prasarana dan sarana, cakupan luas wilayah yang terkena bencana, dan dampak sosial ekonomi yang ditimbulkan.

Abstract

This study aims to understand the perspective of Constitutional Court Decision No.65/PUU-XXI/2023 regarding the legality of using educational institutions ascampaign venues. The background of this research is the evolving political andregulatory context involving educational institutions in Indonesia. Prior to thisdecision, strict regulations prohibited the use of educational facilities for politicalcampaigns to preserve the neutrality and integrity of educational institutions asplaces for learning and intellectual development, free from political influence.This research is a normative legal study with a focus on the principle of legaljustice. It uses secondary data sources, including primary, secondary, and tertiarylegal materials. Data collection was performed through literature review, and dataanalysis employed a qualitative method.The findings reveal that the Constitutional Court's decision to permit the use ofeducational institutions for campaigns is based on balancing political expressionfreedom with educational neutrality. The Court concluded that as long aseducational institutions maintain their integrity and are not disrupted by campaignactivities, using these facilities for political purposes does not violate constitutionalprinciples. The implications include potential changes in the dynamics ofeducational institutions, which will need to establish procedures to ensure thatcampaign activities do not affect the learning process. Regulatory adjustments maybe necessary to define limits and mechanisms for campaign implementation ineducational settings.Keywords: Constitutional Court Decision, Educational Institutions, PoliticalCampaigns, Campaign Venues

Abstract

Perkembangan hukum acara peradilan tata usaha negara, Pasal 87 huruf (a)Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan merubahbanyak aspek termasuk kewenangan mengadili dari PTUN terhadap tindakan faktualsebagai salah satu perbuatan melanggar hukum (PMH) oleh pemerintah atauOnrechmatige Overheidsdaad (OOD). Meskipun telah ditegaskan tentang kewenanganPengadilan Tata Usaha Negara dalam mengadili gugatan OOD tindakan faktual, padapraktiknya seperti nomor 262/Pdt.G/2021/PN. Pbr, masyarakat maupun aparat penegakhukum masih mengajukan, menerima, bahkan mengadili Gugatan OOD tindakan faktual diPeradilan Umum karena belum ada peraturan perundang-undangan yang tegas menyatakankompensi absolut gugatan Citizen lawsuit terkhusus perkara non lingkungan hidup.Penelitian ini merupakan penelitian hukum normatif. Hal ini didasarkan pada penelitiankepustakaan yang mengambil kutipan dari buku bacaan, atau buku pendukung yangmemiliki kaitannya dengan permasalahan yang akan diteliti. Penelitian ini menggunakansumber data sekunder yang terdiri dari bahan buku primer, sekunder, dan tersier. Penelitianini juga menggunakan analisis data kualitatif dan menghasilkan data deskriptif.Dari hasil penelitian dan pembahasan yang dilakukan, terdapat beberapakesimpulan yang diperoleh yaitu: Pertama Perkembangan OOD sebagai objek sengketaberirisan dengan perluasan kewenangan PTUN melalui Pasal 85 dan 87 huruf a Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan dan diikuti SEMANomor 1 tahun 2016 atas tindakan faktual serta adanya PERMA Nomor 2 Tahun 2019yang mengalihkan kewenangan Peradilan Umum kepada PTUN atas OOD. timbulpersinggungan karena tindakan faktual meskipun tidak ditujukan untuk berakibat hukumnamun harus dilakukan secara tidak menimbulkan kerugian sehingga tidak bertentangandengan Pasal 1365 KUH Perdata bagi pihak lain yang mana pertimbangan akan timbulnyakerugian akibat tindakan faktual pemerintah menjadi salah satu unsur utama OOD. Kedua,pasca Pasal 87 huruf a UU AP dan PERMA Nomor 2 Tahun 2019 perkara non lingkunganhidup yang digugat dengan mekanisme Citizen Lawsuit idealnya menjadi kewenanganPTUN karena pada dasarnya gugatan dengan mekanisme Citizen Lawsuit baik terkaitperkara lingkungan hidup maupun non lingkungan hidup akan mempersoalkan tindakanfaktual pemerintah seperti kelalaian atau pengabaian yang karena tindakan pemerintahtersebut merugikan masyarakat.Kata Kunci: Citizen lawsuit, Kewenangan, PTUN

Abstract

This article explores the transformation of political thought among Muslim minority communities in the Asia-Pacific region since the early 2000s, particularly in relation to the interplay between religion (Sharia) and the state. Amid global currents of Islamophobia, exclusive nationalism, and accelerating globalization, Muslim minorities in countries such as India, the Philippines, Southern Thailand, Singapore, Australia, and New Zealand have demonstrated a shift in orientation—from pursuing Islamic statehood to embracing inclusive citizenship strategies. Employing a qualitative-descriptive approach with political discourse analysis and cross-national comparative methods, this study finds that Sharia is increasingly reinterpreted as a set of public ethical norms. Simultaneously, Muslim political engagement is directed more toward advocating civil rights, democratic participation, and collective identity recognition within secular state frameworks. The article argues that Muslim minorities are not merely objects of state policies but transformative agents who articulate an Islamic ethics of citizenship within pluralistic contexts. These findings enrich the field of Islamic political studies by offering perspectives from the margins that are contextually grounded, ethically nuanced, and relevant to the future of multicultural societies.

Abstract

The city of Pekanbaru, as the capital of Riau Province, continues to experience rapid development, supported by the improvement of facilities, including the growth in the number of restaurants, which contributes to the economy. Data from the Regional Revenue Agency (Badan Pendapatan Daerah) shows that revenue from restaurant taxes increased from 2021 to 2022, although it has not always reached the target, despite the fact that Pekanbaru serves as the center of all business activities, whether on a local, national, or international scale. This study uses an empirical juridical method, with clarification techniques that include interviews, questionnaires, and a literature review, aiming to identify the factors that hinder the enforcement of restaurant tax regulations in increasing Regional Original Revenue (Pendapatan Asli Daerah or PAD). The research findings indicate that law enforcement still requires a comprehensive approach through improvements in legal substance, structure, and culture. The obstacles faced include limited human resources, weak supervision, inefficient administrative systems, low taxpayer awareness, and inadequate sanctions. The success of law enforcement greatly depends on the synergy between the Regional Revenue Agency (Bapenda), the Civil Service Police Unit (Satpol PP), and the intensity of inspections to address restaurant tax violations.Keywords: Law Enforcement, Restaurant Tax, Local Original Income (PAD), Pekanbaru City

Abstract

Tindakan kekerasan dalam rumah tangga (KDRT) merupakan permasalahan serius yang sangat berdampak luas terhadap korban, khususnya perempuan. Minimnya pemahaman hukum di masyarakat menjadi salah satu faktor yang memperburuk kondisi korban KDRT. Kegiatan pengabdian ini bertujuan untuk meningkatkan pemahaman hukum kader PKK sebagai ujung tombak pencegahan KDRT di tingkat komunitas melalui sosialisasi Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga. Kegiatan dilaksanakan di Desa Pulau Busuk, Kabupaten Kuantan Singingi dengan melibatkan 20 kader PKK. Metode pelaksanaan menggunakan pendekatan partisipatif dan edukatif yang terdiri dari observasi awal, penyuluhan hukum, diskusi kelompok, serta evaluasi akhir. Hasil menunjukkan adanya peningkatan signifikan pemahaman peserta terhadap hak-hak korban dan prosedur pelaporan kekerasan dalam rumah tangga (KDRT), serta munculnya inisiatif pembentukan posko sahabat perempuan di desa. Pengabdian ini menegaskan bahwa dengan dukungan dan edukasi yang memadai, kader perempuan dapat berperan strategis dalam pencegahan kekerasan dalam rumah tangga (KDRT) di tingkat lokal.

The authority of the Constitutional Court in the 1945 Constitution of the Republic ofIndonesia (1945 Constitution of the Republic of Indonesia) after the issuance of MK DecisionNumber 138/PUU-VIII/2009. The Constitutional Court stated its authority to review GovernmentRegulations in Lieu of Law (Perppu) against the Constitution, relying on the interpretation thatPerppu is in a position parallel to the Law, in accordance with Law Number 12 of 2011concerning the Formation of Legislative Regulations . MethodThis research uses a type of normative legal research (normative law research) usingnormative case studies in the form of legal products produced, reviewing statutory regulations,books and journals related to this research, as well as analyzing Constitutional Court DecisionNumber 138/PUU- VIII/2009.The results of this research explain that the Constitutional Court has the authority toreview Perppu and regulations that are lower in level than the 1945 NRI Constitution whichpositions Perppu in the same position as the Law by using a slash (/), cannot change the contentsof the Constitution NRI of 1945, which clearly differentiates between Laws and PerppuKeywords: Authority, Constitutional Court, Testing

Article 222 No. 7 of 2017 concerning General Elections as an entry point forpolitical cartels, both the requirements for presidential candidates and vice presidentialcandidates and the procedures for presidential elections in the 1945 Constitution do notregulate the requirement sthreshold and the 1945 Constitution does not delegate laws toregulate condition shreshold and Article 222 does not provide legal certainty becauseneither new parties nor old parties that do not have 20% of the seats or 25% of the validnational vote can nominate presidential and vice presidential candidates.The purpose of writing this thesis is: first, to understand the political and legalregulations Presidential Threshold in the election of President and Vice President asregulated in Law Number 7 of 2017. Second, to find out about the arrangementsPresidential Trheshold In the General Election, it is in accordance with the Political andLegal Analysis of the 1945 Constitution. Third, to find out the Analysis of Legal PoliticalConformity Presidential Trheshold in Law Number 7 of 2017 Linked to the 1945Constitution. The research method in this thesis uses normative juridical research, namelyresearch that focuses on examining the application of rules or norms in positive law. Thedata source used is the data sourcefirst, seconds andtertiary, The data collection methodused in this research is firstly literature study, which is a technique for obtainingsecondary data through documents related to the problem, objectives and benefits of theresearch, then after the data is collected it is then analyzed to draw conclusions.Based on the research results, the first conclusion can be drawn that political legaldetermination Presidential Threshold in the election of the president and vice presidentregulated in law no. 7 of 2017 in the Law of the Republic of Indonesia of 1945 presentedas a form of strengthening the presidential system, and requiring a government thatisbalanced and mutually controlled Second Arrangement presidential threshold in theElection Law, this actually creates a contradiction or incongruity with the spirit of theconstitution, which has actually opened up the widest possible space for political partiesparticipating in the election to nominate presidential and vice presidential candidateswithout being limited by the threshold for obtaining votes or seats in parliament.Keywords: Election, presidential threshold, 1945 Constitution
