Abstract

The capital market forbids the practice of insider trading. The management of investment funds by PT Jouska Financial Indonesia resulted in a loss for the client in this instance. Allegations of insider trading by the directors of PT Jouska Financial Indonesia were the cause of the customer's loss. The issue is whether the PT Jouska Financial Indonesia directors' acts can be characterized as insider trading. The study methodology is normative and is supported by primary data collected through interviews and secondary data. In this study, interviews and literature reviews were used to obtain data. Qualitative data analysis was used, and deductive reasoning was used to get results. According to the letter of employment between PT Jouska Financial Indonesia and the customer, it is stated that the company can manage its customer's funds through investment into the capital market with the existence of an RDI opening clause. Furthermore, based on the derivation of Article 95 UUPM, the existence of insider trading can be seen from the relationship between Aakar Abyasa Fidzuno, as the main director and the issuer, the existence of material insider information which can be seen in the agreement between Aakar and the issuer on March 20 2019 and the existence of securities trading transactions in PT Jouska Financial Indonesia's customer portfolio.

Abstract

Indonesia’s competition law comprehends acquisition procedures in article 29 of Law No.5/1999 jo. Article 5 of Government Regulation No.57/2010 and KPPU guidelines about the acquisition, meanwhile Singapore has the same regulations through Article 54 of the SCA 2004 along with CCCS guidelines on M&A. Both countries apply different acquisition regulations as well as the application of notification concept, so that it’s become a problem to analyze KPPU Juridical Verdict No.30/KPPU-M/2020 and CCCS NID Case Number: 500/01/18 to know the similarities and differences. Therefore, this research used juridical normative method by examining secondary data and analyzing it qualitatively. The result of the research shows that there are differences in acquisition regulation such as differences in notification regime, threshold for notification, valuation method, and the use of public consultation in Singapore while the similarities include consideration of financial penalties and costs assessment. It can be concluded that both countries apply different notification regime, and Singapore not only use written law but also unwritten law, meanwhile Indonesia only use written law.

Abstract

Cosmetic products are currently increasingly demand, in the purchasing process there are many factors that make people buy using online buying and selling services. When buying online, sometimes buyers are less careful in buying products sold by business actors who ignore the terms of sale of cosmetics, so consumers are harmed. For example, HB Whitening lotion products that contain harmful ingredients but are still traded. The subject matter of this article is how is the legal protection of HB Whitening consumers that results in harm to consumers and find out how the efforts of the Food. The research method used is normative type, descriptive in nature, by sourcing secondary data which will be analyzed qualitatively and deductively drawn conclusions. Based on the results of the study, HB Whitening has provided insecurity for consumers because there is an element of harm in it, thus violating Article 4 of the GCPL and must be responsible for consumers based on Article 19 of the GCPL. BPOM has made preventive and persuasive efforts, but in tackling the circulation of HB Whitening products is still not in accordance with the applicable provisions.

Abstract

There is legal ineffectiveness related to the conditions of trademarks that cannot be registered and can be rejected as stated in the fourth chapter of Law Number 20 Year 2016 on Trademarks and Geographical Indications (MIG Law). This legal scientific work discusses whether the trademark “Sunan Drajat – Garam Sehat Berkhasiat” can be categorized as an unacceptable trademark under the MIG Law because it contains elements of a famous person's name and claims to have efficacious products. This research is normative legal research and is descriptive, using secondary data obtained through literature studies. The data is processed qualitatively and conclusions are drawn using deductive logic. Based on the results, there are discrepancies in the implementation of the MIG Law, especially Articles 20 and 21, in processing trademark applications in Indonesia. The trademark “Sunan Drajat – Healthy Salt Efficacious” uses the name of a famous person and should be refused registration. Additionally, it uses the word "Efficacious," which needs further examination because it can cause confusion if the description is not accurate. The conclusion is that the mark should not be registered at the Directorate of Trademarks and Geographical Indications under Article 20 letter d of the MIG Law.

Abstract

The human brain is a highly complex system whose dynamics cannot be fully understood through a single disciplinary perspective. This study aims to examine the synchronization of neural networks by combining theoretical physics, neuroscience, and computational methods. The research employed two main approaches: computer simulations based on the Kuramoto oscillator model and empirical analysis of electroencephalography (EEG) data. The simulation modeled neural activity using a graph-theoretical framework, while EEG analysis provided time-series data of brainwave patterns. Both results were compared to validate the accuracy of the model. Findings show that synchronization levels from simulations closely resemble EEG data, with only minor differences across various frequency conditions. Notably, both results revealed a tendency for stronger synchronization at higher frequencies, indicating a collective mechanism of neural coordination. These results demonstrate that physics-based models can effectively represent biological phenomena, while empirical data ensures that the findings remain grounded in real neural dynamics. The integration of theoretical and empirical approaches highlights the importance of interdisciplinary collaboration in studying brain complexity. This research not only contributes to a deeper scientific understanding but also opens potential applications in neuroscience, clinical diagnostics, and computational modeling. Overall, the study reinforces that interdisciplinary frameworks are essential for bridging abstract theories with biological realities.
