Abstract

The imposition of fines on financially capable customers who delay installment payments in Islamic financial institutions presents a complex issue that necessitates justification in accordance with Shariah principles. This study examines the application of principles such as justice, legal compliance, and responsibility within the fine policies directed at these customers. It further assesses the degree to which the imposition of fines is accepted across various Islamic financial institutions and explores how existing regulations can be clarified to ensure adherence to Shariah principles. The fatwa issued by the Indonesias National Sharia Council of the Indonesian Ulema Council (DSN-MUI) permits the imposition of fines solely on financially capable customers who intentionally delay their payments. However, a significant challenge persists: the lack of a standardized criterion for identifying capable customers who should justly incur fines, including the specific duration of delinquency required before a fine is applied. Islamic banks fundamentally operate on the profit-sharing principle and do not inherently recognize fines in the same manner as conventional banks. Nevertheless, to mitigate customer negligence and maintain a balance between justice and legal compliance, some Islamic banks incorporate fines into their financing contracts. This practice remains contentious, primarily due to concerns that such fines may resemble riba qardh or riba nasiah, both of which are explicitly prohibited in Islam. This article contributes to the development of standardized guidelines for Islamic banks, facilitating the objective identification of capable customers and the implementation of fines in a manner that aligns with Islamic values.

Abstract

Environmental crisis and limited religious knowledge in marginalized communities are significant challenges in creating sustainable development. This community service activity aims to strengthen understanding of Green Economy and Islamic values ​​through the Al-Islam and Muhammadiyah approaches at PKBM PRA 02 Bontaeng, Gowa. The method applied is a participatory qualitative approach, with stages of activity that include observation, program implementation (Green Economy workshop, training in crafts from used goods, and teaching the Koran), and evaluation. The results of this activity show an increase in participants' understanding of the Green Economy concept (from 80% who did not know to 78% who were able to explain), an increase in residents' ability to process waste into creative products, and the development of basic religious understanding in children. The practical da'wah approach has proven effective in meeting the socio-ecological needs of marginalized communities. This program reflects a holistic empowerment model and has the potential to be applied in areas with similar characteristics.

Abstract

This community service activity was carried out as part of the implementation of the Al-Islam and Kemuhammadiyahan (AIK) course at Universitas Muhammadiyah Makassar. The purpose of the activity is to enhance students’ social awareness through collaboration with LAZISMU in the One Day One Mustahik (ODOM) program. This program is designed to directly distribute assistance to mustahik groups such as street children, orphanage residents, becak drivers, parking attendants, and underprivileged communities in Makassar City. The method used is Participatory Action Research (PAR), which emphasizes the active involvement of students in all stages of the activity, from planning and implementation to evaluation. A total of 50 boxed meals and 20 basic food packages were directly distributed to several target points with full support from the LAZISMU team. The results of the activity show an increase in social awareness, communication skills, and the strengthening of students’ empathy towards social realities. On the other hand, the beneficiary communities felt tangible benefits both materially and morally. This collaboration has proven effective as a model of community service that integrates Islamic values, character education, and social action. The ODOM program is recommended as a model for service-based learning to be sustainably implemented within the Muhammadiyah campus environment.

Abstract

This study aims to examine how the use of digital technology can support the development of empathy and social awareness among children in orphanages. The research was conducted at Sejati Muhammadiyah Orphanage in Makassar using a descriptive qualitative approach. Data were collected through in-depth interviews, participatory observation, and document analysis. The findings indicate that digital media plays a significant role as a tool for social education, a means of expressing empathy, and a platform for children's virtual participation in humanitarian activities. The children demonstrated increased social awareness through the consumption of inspirational content and active involvement in digital-based social campaigns. Furthermore, empowerment through digital skills training and ethical media guidance helped strengthen empathy and social responsibility values. The study concludes that the wise and guided use of technology within the orphanage environment can be an effective strategy for fostering social character among youth in the digital era.

Abstract

This research aims to analyze home ownership credit (KPR) financing through murabahah contracts at sharia financial institutions. Murabahah contracts are one of the popular financing instruments in sharia banking because of their transparent and fair principles, and in accordance with Islamic sharia which avoids usury and gharar. Through qualitative descriptive methods, this research identifies the operational mechanisms of murabahah contracts in mortgage financing, examines the benefits offered, and evaluates the challenges faced by sharia financial institutions in their implementation. The research results show that murabahah contracts provide various benefits for customers, such as price certainty and fixed installments, which makes financial planning easier. In addition, transparency in the transaction process increases customer trust in Islamic financial institutions. However, this research also found several challenges, including quite high credit risk, the need for a better understanding of sharia products among the public, and compliance with strict regulations.Keywords: KPR financing; Murabahah Agreement; Sharia Financial Institutions; Credit Risk; Community Education

Abstract

The tension between the ideal of unity and the reality of social diversity in multicultural societies through the perspective of Islamic law. In the Indonesian context, such tension is not merely conceptual but is manifested in identity-based conflicts, divergent religious interpretations, interreligious relations, and the politicization of religion in the public sphere. Employing a normative-sociological approach with a library-based research design, this study analyzes classical and contemporary Islamic legal sources alongside relevant socio-religious phenomena. The article explores fundamental principles of Islamic law such as tawhid (oneness), ukhuwwah (brotherhood), ta‘aruf (mutual recognition), ikhtilaf (legitimate difference), and al-‘adl (justice) as normative foundations for managing diversity. The aim of this study is to explain the role of Islamic legal principles in managing social tensions in multicultural societies in order to achieve social harmony and integrity. The findings indicate that an Islamic legal approach grounded in maslahah (public interest), wasathiyah (moderation), and tasamuh (tolerance) has significant potential to reduce identity-based conflicts and promote social harmony. When interpreted contextually and moderately, Islamic law functions not only as a religious normative system but also as a social institution capable of safeguarding cohesion in plural societies. These findings underscore the importance of strengthening a moderate paradigm of Islamic law as both an ethical and juridical reference for managing social diversity in plural states.

Abstract

Penelitian ini mengkaji pelaksanaan mediasi dalam penyelesaian sengketa bisnis syariah di Pengadilan Agama Makassar, dengan fokus pada kesesuaian prosedur, efektivitas, serta tantangan dalam praktik. Mediasi dipandang sebagai mekanisme alternatif penyelesaian sengketa yang mampu mengurangi beban litigasi sekaligus mencerminkan prinsip islah dalam hukum Islam. Namun, efektivitasnya dalam sengketa ekonomi syariah masih rendah. Jenis penelitian ini adalah penelitian lapangan dengan pendekatan kualitatif. Data dikumpulkan melalui observasi, wawancara dengan hakim dan mediator, serta dokumentasi perkara ekonomi syariah. Hasil penelitian menunjukkan bahwa secara prosedural mediasi telah sesuai dengan PERMA No. 1 Tahun 2016. Mayoritas sengketa berasal dari sektor perbankan syariah, khususnya akad murabahah. Walaupun mediasi menawarkan ruang dialog dan pemahaman perspektif, tingkat keberhasilan penyelesaiannya masih sangat rendah. Pada periode 2020–2024, dari 32 perkara hanya 2 yang berhasil diselesaikan melalui mediasi. Faktor penghambat efektivitas mediasi meliputi ketimpangan daya tawar, keterlambatan pelaksanaan, rigiditas akad syariah, serta keterbatasan pemahaman mediator terhadap substansi bisnis syariah. Temuan ini menegaskan perlunya reformasi mediasi yang lebih kontekstual dengan memperkuat kompetensi mediator di bidang ekonomi syariah, serta integrasi keadilan substantif berbasis syariah dalam mekanisme mediasi.

Abstract

Subsidized fertilizer is a form of government assistance aimed at reducing the burden on farmers and increasing agricultural productivity. However, in practice, the availability of fertilizer often becomes an issue, disrupting production processes and farmers’ income. This problem is mainly caused by untimely distribution and high prices due to limited supply.This study aims to analyze the effect of subsidized fertilizer availability on farmers’ welfare in Sengka Village, Bontonompo Selatan District, Gowa Regency. A quantitative approach was employed with two independent variables, namely fertilizer availability (X1) and fertilizer price (X2), and one dependent variable, farmers’ welfare (Y). Data were collected through questionnaires distributed to 80 respondents who were active farmers.The data were analyzed using multiple linear regression to examine the extent of the influence of X1 and X2 on Y. The results showed that both independent variables had a significant effect on farmers’ welfare, both simultaneously and partially. Untimely distribution and high fertilizer prices were found to negatively affect farmers’ income and quality of life. The study was analyzed using Ibn Khaldun’s economic theory, which emphasizes the importance of fair distribution and the state’s role in ensuring public welfare.

Abstract

This study examines why late-payment charges in Islamic banking remain contested, particularly at the boundary between legitimate cost recovery and prohibited time-based gain. It evaluates how taʿwīḍ (compensation) and gharāmah (penalty) are designed and whether they genuinely enhance consumer protection or risk operating as hidden pricing in Indonesian murābaḥah financing. A mixed normative–qualitative approach is employed by triangulating doctrinal analysis of Indonesian Sharia banking regulations and DSN–MUI fatwas, document review of contract templates and internal procedures, and semi-structured interviews with financing officers, Sharia Supervisory Board members, and affected customers. An Islamic law-and-economics framework is applied to assess incentive compatibility under information asymmetry and default risk. The study finds that taʿwīḍ is justifiable only when linked to verifiable incremental costs with clear evidentiary standards and ex ante disclosure. Gharāmah is effective as a deterrent only when revenue-neutral, transparently allocated, and properly governed. Key vulnerabilities include ambiguous contract clauses, weak disclosure mechanisms, and fragmented accountability structures. The study is limited to Indonesian murābaḥah practices and relies on qualitative data, which may affect generalizability across jurisdictions and contract types. This article offers a compliance-by-design framework separating taʿwīḍ and gharāmah in drafting and accounting, introducing cost-verification protocols, audit trails, and transparent dispute mechanisms to align Sharia compliance with modern consumer protection standards.
