Abstract

The Problem arises related to hadith is how to search the ideal understanding so that the source of this religion remains relevant and its content can be practiced. History records that the typology of hadith understanding that dominates almost throughout history is textual understanding. In the modern era, this typology has crystallized more and more resulting in the standardization of Islamic religion (orthodoxy) which sometimes seems out of date. This condition is exacerbated by the widespread understanding of several groups of Islamic movements that support and practice fanaticism and radicalism, where in understanding hadith, they tend to be hard textual and it seems easy to brand heresy, even infidels towards other groups so that in the Indonesian context, it can threaten the disintegration of the nation. This is where Hasbi's contribution - as a reformer figure, offers an understanding of hadith by paying attention to the aspect of the spirit or soul of the Shari'a, especially for muamalah traditions. Hasbi's offer seems to be an 'alternative' understanding of hadith which is more moderate and in accordance with the Indonesian condition.

Abstract

Childless marriage, or an agreement between a husband and wife not to have children after marriage, is currently a trending topic on various social media platforms. Based on this issue, the formulation of this research is how childless marriages are seen from the hadith perspective and what solutions the hadiths offer to overcome this problem. The research method used is a literature study using the theory of hadith hermeneutics. This research was carried out by collecting and analyzing various written sources, such as books, journals and articles as well as Mu'tabar hadith books. The results of the study indicate that the hadiths regarding the permissibility of 'azal studied are of authentic quality and can be accepted as evidence in religion. Regarding understanding, thematic studies, especially from the historical aspects, show that the desire to perform 'azal expressed by a companion to the Prophet Muhammad was related to the condition of his wife who was breastfeeding, so the use of these hadiths as a basis for the permissibility of childfree needs to be reviewed. This shows a significant difference between childfree and the permissibility of 'azal. That the permissibility of 'azal does not mean an attitude or desire to not have children permanently, However, it is only conditional and temporary. This differs from childfree, which actually refuses to have children in a marriage. Meanwhile, a thematic analysis involving other "similar" hadiths shows that Islam places a strong emphasis on having children for its ideological and worshipful values. Therefore, the childfree attitude that is starting to become commonplace among Muslim couples is discouraged, even though having or not having children is the right of every couple. Moreover, if this childfree attitude becomes a "movement" and is campaigned extensively, then every Muslim should not make it a "principle" or primary choice in marriage.

Abstract

Abstract Buying and selling is a primary and inseparable activity in human life. Along with the development of the times and increasing needs, business transaction methods have also undergone changes, marked by the emergence of online markets or marketplaces as digital buying and selling platforms. The convenience offered by online buying and selling is indeed very appealing; however, in practice, negligence and deviations that have the potential to harm one party still frequently occur. Although return policies exist as a form of protection for consumer and seller rights, in reality, various irregularities are still found in their implementation. This research is a library study conducted to directly examine the practice of product returns in online buying and selling transactions on the Shopee platform, viewed from the perspective of hadith. The data collection method used documentation techniques. The primary sources for this research come from hadith literature, while supplementary data were obtained from secondary references such as books, scientific journals, theses, articles, and information from online media. The findings of this research indicate that product returns in online transactions on Shopee are clearly regulated, and from the perspective of hadith, it is permissible in Islam if the goods are not as described or are defective, provided that honesty, justice, and mutual consent between the seller and buyer are prioritized. Keywords: Market Place; Online Buying and Selling; Return of Goods.   Abstrak Jual beli merupakan aktivitas utama dalam kehidupan manusia yang tidak dapat dipisahkan. Seiring dengan perkembangan zaman dan meningkatnya kebutuhan, metode transaksi bisnis juga mengalami perubahan, yang ditandai dengan hadirnya pasar online atau marketplace sebagai sarana jual beli digital. Kemudahan yang ditawarkan oleh jual beli online memang sangat menarik, namun dalam praktiknya, masih sering terjadi kelalaian dan penyimpangan yang berpotensi merugikan salah satu pihak. Meskipun terdapat kebijakan retur sebagai perlindungan hak konsumen dan penjual, kenyataannya masih ditemukan berbagai penyimpangan dalam penerapannya. Penelitian ini merupakan studi kepustakaan (library research) yang dilakukan untuk mendalami secara langsung praktik pengembalian barang dalam transaksi jual beli daring di platform Shopee, ditinjau dari perspektif hadis. Metode pengumpulan data menggunakan teknik dokumentasi. Sumber utama dalam penelitian ini berasal dari literatur-literatur hadis, sementara data pelengkap diperoleh dari referensi sekunder seperti buku, jurnal ilmiah, skripsi, artikel, serta informasi dari media daring. Temuan dalam penelitian ini menunjukkan bahwa return barang dalam transaksi online  Shopee telah diatur secara jelas  dan dalam persfektif hadis diperbolehkan dalam ilam jika barang tidak sesuai atau mengalami kecacatan  dengan mengutamakan kejujuran, keadilan dan kerelaa kedua belah pihak antara penjual dan pembeli. Kata Kunci: Jual Beli Online; Marketplace; Pengembalian Barang.

Abstract

This article examines a number of prophetic traditions (hadiths) that are commonly categorized as misogynistic, namely those perceived as degrading women or reflecting gender bias. Through an analytical–critical approach combined with contextual and historical interpretation, this study demonstrates that misogynistic understandings do not originate from Islamic teachings, but rather from patriarchal cultural constructions, mythologies of female creation found in Judeo–Christian traditions, and religious interpretations that overlook the moral and social contexts of the hadiths. The analysis explores several key narrations, including the command for wives to obey their husbands, the creation of women from a rib, women as the majority inhabitants of Hell, and the issue of female leadership. Findings indicate that these hadiths contain ethical messages, relational values, and principles of mutual responsibility rather than serving as instruments of discrimination. Reception analysis further reveals that literal readings detached from context often give rise to gender bias. In essence, Islam elevates the dignity of women, granting them access to education, social participation, and self-actualization. This article emphasizes the importance of interpreting hadith comprehensively—integrating historical analysis, maqāṣid al-sharī‘ah, and gender hermeneutics—so that Islamic teachings on justice, equality, and human dignity can be understood proportionally.
