Abstract

The Indonesian government, regulators, and Muslim consumers increasingly recognize the halal industry as an essential sector for economic growth. This study aims to assess the understanding, acceptance, and implementation of halal among educated Muslim youth and analyse the urgency of halal in food, tourism, and banking. The research was conducted at four State Islamic Universities (PTKIN) in Central Java, Indonesia, involving 145 students as respondents. A descriptive quantitative approach was applied using structured questionnaires, analysed with frequency and percentage techniques, and interpreted through Islamic legal philosophy, particularly fiqh and maqāṣid al-sharī‘a. The study finds that the halal of food, tourism, economy, and banking has a strong epistemological basis in Islam; however, a segment of Muslim minority students demonstrates rejection or inconsistent implementation due to differences in interpretation, limited accessibility, and perceptions of government policies. Despite this, there is strong support for halal, with over 91% endorsing government initiatives and 92% acknowledging their contribution to economic growth. Based on these findings, the study recommends standardizing halal concepts across sectors, systematically evaluating program impacts, and continuously educating the public to optimise the implementation of Indonesia’s halal industry policy.

Abstract

The position of fatwa institutions in cases of blasphemy by cult groups is often seen as representing only the majority Muslims and blaming minority Muslims, as in Indonesia, or seen as a tool to suppress anti-government groups, as in Malaysia. This study aims to explain the position of the Indonesian Ulema Council (MUI) and Jawatankuasa Fatwa in handling heresy, including the reasons behind the differences in the positions and roles of the two institutions. Researchers use qualitative methods with a comparative legal approach. This study found that MUI's heretical fatwas had no legal force, the central MUI has the authority to enact heretical fatwas within MUI institutions, but not absolutely to respond to national laws, and not play a role in the criminal justice system. Meanwhile, Jawatankuasa Fatwa Kebangsaan (JFK) has the force of law with certain conditions, however, the federal state Jawatankuasa Fatwa has the authority to determine heretical fatwas to respond and strengthen state regulations (blasphemy laws). This research can be used as a reference for law enforcement in handling blasphemy cases by considering the views of MUI and Jawatankuasa Fatwa, which are regulated adequately by laws and regulations.

Abstract

Child marriage remains a serious problem in Indonesia, significantly affecting children's physical safety, psychological well-being, and legal protection. This article analyzes the practice of child marriage through an integrative approach between Islamic family law and Islamic criminal law, arguing that a family law approach alone is inadequate to address the vulnerabilities and risks faced by children as victims. This research employs qualitative methods, drawing on normative studies of Islamic legal literature, national regulations, and empirical findings related to the practice of marriage dispensation. The findings demonstrate that child marriage actually involves elements of coercion, violence, and violations of children’s rights, thereby placing it within a legal domain that also aligns criminal law consideration. Consequently, a more comprehensive framework of protection is required, achieved through the integration of the regulatory function of Islamic family law with the preventive and protective functions of Islamic criminal law. Normatively, the principle of ḥifẓ al-nafs (protection of life) is invoked to underscore the primacy of children’s safety and best interests. [Perkawinan anak masih menjadi persoalan serius di Indonesia dan secara signifikan berdampak pada keselamatan fisik, kesejahteraan psikologis, dan perlindungan hukum anak. Artikel ini melihat praktik perkawinan anak melalui pendekatan integratif antara hukum keluarga Islam dan hukum pidana Islam, dengan argumen bahwa pendekatan hukum keluarga semata tidak memadai untuk mengatasi kerentanan dan risiko yang dihadapi anak sebagai korban. Penelitian ini bertumpu pada kajian normatif terhadap literatur hukum Islam, peraturan perundang-undangan nasional, serta temuan empiris yang berkaitan dengan praktik dispensasi perkawinan. Hasil penelitian menunjukkan bahwa perkawinan anak kerap melibatkan unsur paksaan, kekerasan, dan pelanggaran terhadap hak-hak anak, sehingga menempatkannya dalam ranah hukum yang juga relevan untuk dikaji melalui perspektif hukum pidana. Oleh karena itu, diperlukan suatu kerangka perlindungan yang lebih komprehensif melalui integrasi fungsi regulatif hukum keluarga Islam dengan fungsi preventif dan protektif hukum pidana Islam. Secara normatif, prinsip ḥifẓ al-nafs (perlindungan jiwa) digunakan untuk menegaskan pentingnya keselamatan dan kepentingan terbaik bagi anak.]

Abstract

This study examines the concept of qatl al-gh?lah (murder by treachery) in Islamic criminal law and its relevance to the reform of Indonesia’s national criminal law. The phenomenon of qatl al-gh?lah is an essential issue in the study of Islamic criminal law because it has characteristics that differ from other types of murder. From the perspective of Islamic jurisprudence (fiqh jin?yah), this crime is classified as murder whose punishment can only be enforced through qi??? and ??cannot be removed even if the victim’s family forgives. The relevance of this issue becomes increasingly evident when linked to several cases in Indonesia, such as the murder of Affan Kurniawan by a police officer, the Ferdy Sambo case, the KM 50 incident, and various other cases that demonstrate the weak protection of public security. However, previous studies rarely connect the normative concept of qatl al-gh?lah with practical issues in Indonesian positive criminal law, resulting in a gap in understanding how treachery-based murder should be legally qualified. Using a qualitative, normative approach through a literature review and case analysis, this study finds that qatl al-gh?lah warrants urgent attention in inspiring national criminal law reform. Its primary contribution is to provide a conceptual foundation for discussing the special category of murder based on exceptions, thereby integrating Islamic values of justice into the Indonesian criminal law system.
