Abstract

AbstractThe National Criminal Code, which was recently passed, contains several new provisions that have not been regulated in the Criminal Code used to date, while the provisions in question are corporate criminal liability. The focus of this research is criminal liability imposed on management (executive/superior) in a corporation in terms of article 48 letters d and e. In order to analyze the laws and regulations which are used as the main basis of the research, the researcher uses a normative method by using several international and national sources in the form of theories and explanations that are relevant to the article which is the focus of the discussion of this research. Based on this research, it can be understood that one of the concepts of criminal responsibility in the corporate sector regulated in the National Criminal Code is the responsible corporate officer (RCO) doctrine. However, this model of criminal responsibility is not fully adhered to in the National Criminal Code. Even the RCO concept will look vague if you don't review articles 46 and 49 of the National Criminal Code. In addition, criminal liability based on (RCO) needs to consider AD/ART in corporations considering that this type of accountability model is closely related to sectors within corporations.Abstrak          KUHP Nasional yang belum lama ini disahkan memuat beberapa ketentuan baru yang belum diatur pada KUHP yang digunakan sampai saat ini. Adapun ketentuan yang dimaksud adalah pertanggungjawaban pidana korporasi. Adapun fokus pada penelitian ini adalah pertanggungjawaban pidana yang dibebankan pada pengurus (eksekutif/atasan) dalam korporasi yang ditinjau dari pasal 48 huruf d dan e. Guna menganalisis aturan perundang-undangan yang dijadikan landasan utama penelitian, peneliti menggunakan metode normatif dengan menggunakan beberapa sumber baik internasional maupun nasional berupa teori dan penjelasan yang relevan dengan pasal yang menjadi fokus pembahasan penelitian ini. Berdasarkan penelitian ini dapat dipahami  Salah satu konsep pertanggungjawaban pidana dalam sektor korporasi yang diatur pada KUHP Nasional adalah doktrin responsible corporate officer (RCO). Namun model pertanggungjawaban pidana tersebut tidak dianut sepenuhnya pada KUHP Nasional bahkan konsep RCO akan terlihat samar jika tidak meninjau pada pasal 46 dan 49 KUHP Nasional. Selain itu pertanggungjawaban pidana berdasarkan (RCO) perlu mempertimbangkan AD/ART dalam korporasi mengingat model pertanggungjawaban jenis ini erat kaitannya dengan sektoral dalam korporasi.

Abstract

The position of fatwa institutions in cases of blasphemy by cult groups is often seen as representing only the majority Muslims and blaming minority Muslims, as in Indonesia, or seen as a tool to suppress anti-government groups, as in Malaysia. This study aims to explain the position of the Indonesian Ulema Council (MUI) and Jawatankuasa Fatwa in handling heresy, including the reasons behind the differences in the positions and roles of the two institutions. Researchers use qualitative methods with a comparative legal approach. This study found that MUI's heretical fatwas had no legal force, the central MUI has the authority to enact heretical fatwas within MUI institutions, but not absolutely to respond to national laws, and not play a role in the criminal justice system. Meanwhile, Jawatankuasa Fatwa Kebangsaan (JFK) has the force of law with certain conditions, however, the federal state Jawatankuasa Fatwa has the authority to determine heretical fatwas to respond and strengthen state regulations (blasphemy laws). This research can be used as a reference for law enforcement in handling blasphemy cases by considering the views of MUI and Jawatankuasa Fatwa, which are regulated adequately by laws and regulations.

Abstract

Menurut data Komnas Perempuan tahun 2024, kekerasan seksual Indonesia masih tinggi, dengan 25.330 kasus dengan korban perempuan sejumlah 21.952 orang. Padahal pemerintah telah lama terapkan Undang-Undang Nomor 12 Tahun 2022 (UU TPKS) sebagai upaya penghapusan dan pencegahan Crime Against Humanity khususnya eksploitasi seksual perempuan Indonesia. Studi ini bertujuan untuk mengidentifikasi muatan aturannya, menemukan tantangan yang dihadapi, serta memformulasikan langkah pengoptimalan penerapannya. Hasil analisis menunjukkan bahwa sejatinya UU TPKS ini muatannya lengkap, melindungi kita dari segala bentuk kekerasan seksual, seperti pembentukan UPT PPA yang tersebar di 38 provinsi. Tantangan yang teridentifikasi yakni minimnya partisipasi masyarakat dalam upaya pencegahan TPKS karena kentalnya budaya patriarki. Maka langkah pengoptimalan UU TPKS yang disarankan adalah sosialisasi menyeluruh terkait pentingnya kerjasama antara pemerintah dan masyarakat dalam menjalankan program pemberantasan kekerasan seksual.

Abstract

Abstract. The regulation of premarital education in Indonesia has not succeeded in reducing the divorce rate in Indonesia. Weak regulations, unclear standardization, and the nature of the program that is recommended and only required in 2024 which tends to be formalistic are the main factors. This study aims to analyze the regulation of pre-marital education and its effect on divorce in Indonesia and Malaysia. The researcher used a qualitative method by reviewing various literatures and data obtained from journal articles, books, and news. The results show the need to reconstruct the law to tighten the provisions, centralize management at the Ministry of Religious Affairs through BP4, and make premarital education a mandatory requirement that is not just a formalistic implementation. Malaysia's experience, which has successfully reduced the divorce rate, can be emulated even though it is still constrained in its implementation, which needs to be addressed by conducting socialization related to the importance of the program, evaluating the duration of the program, and evaluating the resource persons or presenters. Thus, future Indonesian and Malaysian pre-marital education regulations are expected to be able to prepare couples to form a socially, emotionally and spiritually healthy family to prevent long-term social dysfunction, one of which is divorce. Abstrak. Regulasi pendidikan pranikah belum berhasil menekan angka perceraian di Indonesia. Lemahnya regulasi, ketidakjelasan standarisasi, serta program yang bersifat anjuran dan baru diwajibkan pada 2024 yang cenderung formalistik menjadi faktor utama. Penelitian ini bertujuan untuk melakukan analisis terhadap regulasi mengenai pendidikan pra nikah dan pengaruhnya terhadap perceraian di Indonesia dan Malaysia. Peneliti menggunakan metode kualitatif dengan wawancara dan mengkaji berbagai literatur serta data yang diperoleh dari artikel jurnal, buku, berita, dan data statistik. Hasil penelitian menunjukkan perlunya melakukan rekonstruksi ke tingkat undang-undang guna memperketat ketentuan, memusatkan pengelolaan pada Kementrian Agama Melalui BP4, serta menjadikan pendidikan pranikah sebagai syarat wajib yang tidak hanya sekedar pelaksanaan yang formalistik. Pengalaman Malaysia, yang sukses menekan angka perceraian dapat dicontoh meski masih terkendala dalam implementasinya yang perlu untuk dibenahi dengan melakukan sosialisasi terkait pentingnya program, evaluasi durasi program, serta evaluasi bagi para narasumber atau pemateri. Dengan demikian regulasi pendidikan pra nikah Indonesia dan Malaysia di masa mendatang diharapkan mampu menyiapkan pasangan yang sehat secara sosial, emosional, dan spiritual untuk mencegah disfungsi sosial jangka panjang yang salah satunya adalah perceraian.

Abstract

This research explains the relationship between politics and Islamic movements which influence each other with their respective roles in society. Political discussions include power, ideology, legitimacy, government, state, nation and others. The political consequences have had a huge impact on the orthodoxy and heterodoxy of the Islamic movement in Indonesia. This study focuses on the Rifa'iyah case in the 20th century AD. The Rifa'iyah group is heterodox because it is considered to deviate from Islamic teachings in general. This causes heterodox groups to experience discrimination and prohibitions from the Central Java Prosecutor's Decree. The uniqueness of Rifa'iyah's living pattern is in groups and in rural areas. This minority group received political asylum and blended into society until their struggle succeeded in revoking the prohibition decree. Especially the emergence of reform which has become the political aspirations of the Islamic community. This research is a qualitative type using a social-historical approach. The data collection method is library research, while the data analysis method is descriptive analysis. The research results show that politics has a role as accommodative, hegemonic and power. Rifa'iyah's strategy is to adjust its political role to regain its legality by collaborating with political parties, studying academically by holding seminars, and taking advantage of the reform period. The existence of politics can dissolve or maintain heterodox.

Abstract

Abstract. The public's understanding of the legal provisions regarding the minimum marriage age remains varied, with many still holding limited knowledge. Some communities continue to follow norms and traditions that allow marriage at a younger age, leading to conflicts with existing legal frameworks. This study aims to assess the public's knowledge of early marriage age limits and analyze the efforts made by religious and community leaders, along with government institutions, in preventing early marriages in the Thousand Islands. The research utilizes a qualitative method, drawing data from literature reviews and interviews with community figures and local government representatives. The results indicate that religious leaders play a crucial role by providing education through Friday sermons and lectures, while community leaders emphasize the importance of delaying marriage until a more mature age through socialization programs. On the government side, policies are implemented based on Law No. 16 of 2019, which raises the minimum marriage age. The findings underscore the significance of collaboration between community leaders and government institutions in overcoming cultural challenges and promoting legal awareness. The implications of this study suggest that a more integrated approach involving continuous public education and policy enforcement is essential to further reduce early marriage cases. Abstrak. Pemahaman masyarakat terkait ketentuan hukum mengenai usia minimum pernikahan masih bervariasi, dengan banyak yang masih memiliki pengetahuan terbatas. Beberapa komunitas masih mengikuti norma dan tradisi yang memperbolehkan pernikahan di usia yang lebih muda, sehingga menyebabkan konflik dengan kerangka hukum yang berlaku. Penelitian ini bertujuan untuk menilai pengetahuan masyarakat tentang batas usia pernikahan dini dan menganalisis upaya yang dilakukan oleh tokoh agama, tokoh masyarakat, serta lembaga pemerintah dalam mencegah pernikahan dini di Kepulauan Seribu. Penelitian ini menggunakan metode kualitatif dengan mengumpulkan data dari tinjauan literatur dan wawancara dengan tokoh masyarakat serta perwakilan pemerintah setempat. Hasil penelitian menunjukkan bahwa tokoh agama memainkan peran penting melalui edukasi dalam khutbah Jumat dan ceramah, sementara tokoh masyarakat menekankan pentingnya menunda pernikahan hingga usia yang lebih matang melalui program sosialisasi. Dari sisi pemerintah, kebijakan diterapkan berdasarkan Undang-Undang No. 16 Tahun 2019 yang menaikkan usia minimum untuk menikah. Temuan ini menekankan pentingnya kolaborasi antara tokoh masyarakat dan lembaga pemerintah dalam mengatasi tantangan budaya dan meningkatkan kesadaran hukum. Implikasi penelitian ini menyarankan pendekatan yang lebih terintegrasi dengan edukasi masyarakat yang berkelanjutan dan penegakan kebijakan yang lebih kuat untuk mengurangi kasus pernikahan dini.

Abstract

Penelitian ini membahas penyelesaian tindak pidana zina dalam masyarakat Suku Ocu di Kabupaten Kampar, Riau, dalam perspektif pluralisme hukum yang melibatkan hukum adat, hukum Islam, dan hukum positif negara. Dalam masyarakat Ocu yang menjunjung tinggi prinsip adat bersendi syara', syara' bersendi Kitabullah, penyelesaian perkara zina cenderung dilakukan secara kekeluargaan melalui struktur adat seperti Mamak Soko, Mamak Pisako, dan Mamak Nagari. Pendekatan ini berbeda dengan hukum Islam yang menganggap zina sebagai delik hudud yang tidak dapat diselesaikan di luar mekanisme syar'i, serta hukum positif (KUHP) yang membatasi definisi zina pada pasangan yang telah terikat pernikahan. Melalui studi kualitatif dan wawancara mendalam dengan tokoh adat, ditemukan bahwa bentuk pluralisme hukum di masyarakat Ocu bersifat kolaboratif, di mana hukum adat menjadi instrumen utama untuk menjaga kehormatan, keseimbangan sosial, dan nilai-nilai moral masyarakat, meskipun pada akhirnya hukum positif dapat mengambil alih jika tidak tercapai kesepakatan dalam mekanisme adat.
