Abstract

Dalam putusan hakim PN Simalungun No.475/Pid.Sus/2014/PN-Sim dengan hakim ketua Melinda Aritonang, S.H. dan hakim anggota masing-masing Renni Pitua Ambarita, S.H. dan Sinta Gabaria Pasaribu, S.H., M.H. menyatakan bahwa terdakwa ANDIY ARIYANTO ALS. ANDI tidak terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana sebagaimana yang didakwakan pada dakwaan kesatu maupun dakwaan kedua dan membebaskan terdakwa dari semua dakwaan penuntut umum. Hal tersebut diyakini bertolak belakang dengan fakta-fakta persidangan dimana terjadi upaya bujuk rayu terhadap anak saksi korban dengan berjanji untuk bertanggung jawab dan menikahi saksi korban. Putusan hakim ini dapat berdampak negatif terhadap korban dan keluarga serta dapat menimbulkan rasa ketidakpercayaan masyarakat terhadap penegakan hukum. Tujuan penelitian ini adalah untuk menganalisis putusan bebas hakim terhadap terdakwa dalam putusan hakim PN Simalungun No.475/Pid.Sus/2014/PN-Sim. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan melakukan penelitian aspek- aspek yang berkaitan dengan hukum baik hukum formil dan non-formil yang menjadi fungsi utama dalam upaya perlindungan terhadap korban tindak pidana perkosaan serta dengan pendekatan ditinjau dari peraturan-peraturan yang merupakan data sekunder. Hasil penelitian adalah pada Putusan PN Simalungun No.475/Pid.Sus/2014/PN-Sim, bahwasanya bentuk dakwaan alternatif yang dipergunakan kurang sesuai, karena dalam hal ini jaksa penuntut umum ragu-ragu dalam memberikan pasal yang didakwakan yaitu pasal 81 ayat (2), dan pasal 82 Undang-Undang Nomor 23 tahun 2002 tentang Perlindungan Anak dikarenakan tidak terpenuhinya unsur “Anak” berdasarkan keyakinan Hakim sehingga Hakim memberikan putusan bebas terhadap terdakwa. Kemudian dalam Pasal 293 ayat (1) KUHPidana berdasarkan fakta-fakta persidangan tidak terbukti adanya unsur “membujuk” dan berdasarkan keyakinan Hakim persetubuhan tersebut dilakukan atas dasar suka sama suka sehingga Hakim memberikan keputusan bebas terhadap terdakwa. Dasar pertimbangan hakim menjatuhkan putusan bebas tidak mencerminkan perlindungan hukum terhadap korban.

Abstract

The development and advancement of information technology, communication, and transportation in the era of globalization is very rapidly developing, while in line with the development of crime mode, one of the crimes of globalization is the crime of human trafficking against girls today. This study uses normative juridical approach methods, as well as secondary data collected from primary materials, in the form of legal provisions, and their implementation; while secondary legal material is done in the form of literature studies that are then processed and analyzed qualitatively, making it easier for authors to analyze. Often girls become victims of trafficking crimes because of the factors behind the occurrence of trafficking crimes. Therefore, special protection for girls is required, namely the Law of the Republic of Indonesia No. 21 of 2014 on Child Protection, as well as a special Law to protect against people trafficking crimes, namely the Law of the Republic of Indonesia Number 21 of 2007 on the Eradication of People Trafficking, and the Law of the Republic of Indonesia Number 39 of 1999 on Human Rights

Abstract

Penelitian hukum ini membahas tentang Pelanggaran Berat HAM terhadap invasi Rusia ke Ukraina. Penelitian ini mengacu pada Deklarasi Universal HAM, ketentuan Hukum Internasional. Rusia disebut menembaki dan membom daerah-daerah berpenduduk, membunuh warga sipil serta menyerang berbagai infrastruktur sipil seperti rumah sakit dan sekolah tentu saja merupakan pelanggaran fundamental terhadap sejumlah aturan dan ketentuan dalam Hukum Internasional. Tujuan dari penelitian ini untuk mengetahui Pengaturan terhadap tindak invasi Rusia ke Ukraina serta bentuk pertanggung jawaban dan sanksi pelanggaran HAM bagi Rusia karena telah melakukan pelanggaran HAM saat melakukan invasi terhadap Ukraina. Metode yang digunakan dalam penelitian ini menggunakan metode yuridis normatif dengan cara meneliti bahan pustaka atau data sekunder. Penelitian ini bersumber dari pemantauan pelanggaran-pelanggaran oleh PBB dan tim di lapangan terhadap invasi Rusia ke Ukraina, kemudian menuntut Rusia menghentikan kekuatannya terhadap Ukraina segera dan sepenuhnya. Kasus ini adalah letak keterbatasan Hukum Internasional, kepatuhan negara-negara yang terlibat konflik untuk mematuhi aturan dan ketentuan Hukum Internasional tersebut. Seharusnya Rusia yang terlibat konflik ini sadar dan patuh akan aturan dan ketentuan Hukum Internasional adalah jalan satu-satunya saat ini untuk menyelesaikan perselisihan Rusia dengan Ukraina, dengan cara damai.

Abstract

In the era of digital economy innovation, people are trying to find new findings in the procurement of services for lending activities, which can be seen from the existence of money lending services on a digital basis which are considered to be able to build growth and the national economy. The type of observation used in this research is coherent research. Resolving disputes over payment of online loan debt and protecting consumer data is a complex problem in today's digital era. Consumers often become victims of the protection of their personal data by irresponsible online lenders. The sources of data used in this study are document laws, laws and regulations, and legal doctrines related to problem solving and consumer data protection. In using online loan services, consumers must provide a number of personal data, such as; name, address, telephone number, bank account number and other information. This can raise concerns for consumers regarding their security and privacy. To provide protection to consumers, data from the Indonesian fintech association (aftech), in 2019 there were around 15 million users of online loan services in Indonesia. In 2020 this number has increased by around 21 million users. In 2021 it is estimated that the number of users will increase again to 27 million. Abstract

Pseudo-legislation (pseudovetgeving) in the Dutch Legal Dictionary is defined as “regelstelling door een bettokken bestuursorgaan zonder dat dit op grond van een uitdrukkelijke wettelijke bepaling die bevoegdheid bezit”. Which can be understood as a regulation made by the competent Administrative Body but the policy does not have the power based on explicit statutory provisions. In writing this article, there are three main ideas related to the background of the problems raised, namely the use of the legal system by the Indonesian state which is more inclined to the common law system or civil law system, the ordering of laws and regulations in Indonesia, and the position of pseudo legislation (pseudowetgeving) or policy regulations (beleidsregels) against existing laws and regulations in Indonesia. To provide comprehensive results, in writing articles used research methods that are normative juridical. The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation. However, this is not explicitly regulated in Law Number 12 of 2011 Jo. Law Number 15 of 2019 concerning the Establishment of Legislation, but it is implied in the regulation of the National Archives of the Republic of Indonesia Number 5 of 2021 concerning General Guidelines for the Administration of Service Manuscripts, specifically in the section "regulation official documents and determination official documents". The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation. Abstract

The procurement of health personnel is carried out through higher education in the health sector which is directed at producing quality health personnel in accordance with professional service standards. The Field Learning Practice stage is also known as the clinical learning process which is fully implemented in the practical field, namely the hospital under the supervision of the clinical supervisor. In carrying out student clinical practice errors or omissions may occur. The purpose of this study is to determine the responsibility of nursing students who make mistakes that result in harm to patients and to find out legal protection for nursing students who make mistakes that cause harm to patients. The research described is normative research using primary, secondary and tertiary legal materials, analytical descriptive research characteristics, legal material collection is done by document study techniques, data are analyzed qualitatively. The results show that the management of nursing student responsibilities who make mistakes can be seen from the civil aspects of the criminal and administrative aspects while the legal protection is regulated in Law Number 36 of 2009 concerning Health, Law Number 44 of 2009 concerning Hospitals, Law RI Law No. 38 of 2014 concerning Nursing, Law No. 36 of 2014 concerning Health Workers, and Regulation of the Minister of Health No. 148 of 2010 concerning Licensing and Implementation of Nursing Practices while the Cooperation Agreement between Educational Institutions and Health Institutions already contains 4 elements, namely consent of the will, authority ), specific (achievement) objects and objectives of the agreement.
