Abstract

The aim of the activity to socialize the dangers of drug abuse at Wahidiyah Samarinda Junior High School (SMP) is so that participants can understand the impacts of drug use, both physical, psychological and socio-economic impacts, and what the P4GN Movement is. Socialization activities use participatory methods, lectures and questions and answers. The socialization activity was carried out on July 11 2023 with the number of participants taking part in the socialization activity consisting of 45 students and 2 teachers located in the Wahidiyah Samarinda Middle School hall. For this reason, through this socialization activity on the dangers of drug abuse, it is hoped that it will be able to increase the understanding of Wahidiyah Samarinda Middle School students regarding the types of narcotics that are usually used by teenagers, the impact of narcotics abuse from physical, psychological, educational, social and economic aspects, the P4GN program, as well as ways to prevent and control drug abuse among teenagers.

Abstract

The purpose of this study is to investigate the application of criminal law following the determination of changes to the omnibus law and the influence such changes have on legal certainty. The study method that is being utilized is known as normative legal research, and it involves approaching the topic from legislative perspectives, conceptual perspectives, and case perspectives. According to the findings of the study, the process of criminal law enforcement has slowed down significantly in several areas where the omnibus law has made changes. This is true not only for cases that have recently taken place, but also for cases that are still in the stages of investigation and prosecution, which has led to a number of criminal cases not being resolved in court. This is due to the fact that the Omnibus Law has removed several criminal provisions from the previous law, including changing criminal sanctions to administrative sanctions. Furthermore, the Constitutional Court's decision on the Omnibus Law has never provided clarity on its application, which has caused criminal law enforcement to become stagnant. The word "stagnation" is synonymous with "bottleneck," "congestion," and "deadlock." After the stipulation of revisions to the Omnibus Law, there was a lull in the activity of criminal law enforcement, which resulted in the absence of legal certainty.

Abstract

The discourse about combating corruption through restorative justice has produced positive and negative outcomes. The extraordinary crime of corruption features several distinguishing characteristics distinct from those of general crimes. Even though restorative justice is a method of modernizing the way law enforcement is practiced, the policy that is used to put it into effect needs to be extremely selective and cautious. This study will investigate the applicability of restorative justice to acts of corruption. The research comprises two research questions. 1) How is the concept of Restorative Justice regulated in Indonesia? 2) How is the analysis of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes on the resolution of corruption through restorative justice? The research employed a normative method that combined a statutory and conceptual approach to problem formulation, indicating that, first, the restorative justice concept is regulated in Indonesia through technical regulations developed by each law enforcement agency, with limited implementation. Second, restorative justice in the settlement of corruption contravenes Article 4 Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes and is a step back in efforts to eradicate corruption, as well as inconsistent with the state's obligation to support policies and effective practices in eradicating corruption as regulated by UNCAC.

Abstract

Penelitian ini akan mengaji tentang bagaimana peluang dan tantangan dalam penerapan delik obstruction of justice. Keberadaan obstruction of justice juga terdapat dalam penegakan hukum tindak pidana korupsi. Metode penelitian yang digunakan adalah metode peneltiian normatif melalui pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Hasil penelitian menemukan bahwa d memunculkan kerancuan dalam penerapannya dikarenakan ketidakjelasan rumusan unsur pasal. Khususnya dalam frasa sengaja mencegah, merintangi, atau menggagalkan secara langsung atau tidak langsung sehingga problematik dalam penerapannya. Sebagai jalan keluar dari problematik penerapannya, maka delik Obstruction of Justice perlu direvisi sehingga dapat dirumuskan dengan jelas dan memenuhi kaidah asas legalitas dimana dalam pengaturan hukum pidana harus memenuhi ketentuas lex certa dan lex stricta.

Abstract

This study aims to describe the implementation of Integrated Assessment and assess the effectiveness of the assessment of criminal acts of narcotics abuse. The research method used is normative research method, supported by field data and in-depth interviews with respondents and sources relevant to the research topic. The results showed that not all cases involving narcotics offenders were given assessment recommendations due to differences in perception among law enforcement, and the high cost of assessment. The implementation of the assessment of narcotics abusers has not been effective because its implementation has encountered various obstacles. This article recommends that a review of the legal basis for handling narcotics is needed to ensure legal certainty in the implementation of assessments and the need for the government to take a health approach in handling narcotics in Indonesia.

Abstract

This study analyzes the position of living law in the 2023 Criminal Code. Through normative research methods using a legislative approach and a conceptual approach, this article finds: First, the position of living law in the 2023 Criminal Code is narrowed down to only referring to customary law as regulated in the explanation of Article 2. Second, the regulation of customary law is a recognition of sanctions for fulfilling customary obligations that will be used by judges as guidelines for sentencing. Third, the living law sanction in the 2023 Criminal Code is a type of additional criminal sanction in the form of fulfilling local customary obligations. Violations of the provisions of living law are subject to principal criminal sanctions and additional criminal sanctions if the act has been regulated by the 2023 Criminal Code. The regulation of additional criminal sanctions in the form of customary obligations aims to accommodate the types of customary law sanctions. In addition, there is a substitution mechanism for perpetrators who cannot fulfill customary obligations, in the form of substitution of compensation whose value is equivalent to a category II fine to a supervision sentence or social work sentence.

Abstract

Pertanahan di Indonesia sering kali menjadi sumber konflik yang kompleks dan sulit diselesaikan. Salah satu daerah yang menghadapi tantangan ini adalah wilayah Samarinda, khususnya di RT 42 Kelurahan Lempake. Penelitian ini bertujuan untuk menganalisis strategi dalam pencegahan dan penanganan sengketa pertanahan sebagai upaya pencegahan konflik di wilayah tersebut. Hasil penelitian menunjukkan bahwa ada beberapa strategi yang dapat diterapkan dalam pencegahan dan penanganan sengketa pertanahan di RT 42 Kelurahan Lempake. Pertama, pendekatan komunitas melalui pembentukan forum dialog antara pihak-pihak terkait untuk membangun pemahaman bersama. Kedua, penguatan peran lembaga penyelesaian sengketa untuk memberikan alternatif penyelesaian yang cepat dan adil. Ketiga, peningkatan akses informasi dan edukasi kepada masyarakat mengenai hak-hak dan prosedur hukum terkait tanah. Selain itu, keberhasilan strategi ini juga bergantung pada kolaborasi yang baik antara pemerintah, masyarakat, dan sektor swasta dalam mengelola konflik pertanahan. Penelitian ini memberikan rekomendasi untuk meningkatkan implementasi strategi yang ada, termasuk pengembangan kebijakan yang lebih inklusif dan berkelanjutan serta perluasan jaringan kerjasama antarlembaga. Kesimpulannya, strategi dalam pencegahan dan penanganan sengketa pertanahan di RT 42 Kelurahan Lempake Samarinda dapat menjadi model untuk daerah lain yang menghadapi tantangan serupa. Implementasi strategi ini tidak hanya membantu mengurangi konflik tetapi juga mempromosikan keadilan sosial dan stabilitas sosial ekonomi di tingkat lokal. Studi ini diharapkan dapat memberikan kontribusi bagi kebijakan publik dan pengembangan teori dalam penanganan konflik pertanahan di Indonesia.   Abstract Strategy in the Prevention and Handling of Land Disputes in Lempake Village, Samarinda City.Land in Indonesia is often a source of complex and difficult to resolve conflicts. One of the areas facing this challenge is the Samarinda area, especially in RT 42, Lempake Village. This research aims to analyze strategies for preventing and handling land disputes as an effort to prevent conflict in the region. The research results show that there are several strategies that can be implemented in preventing and handling land disputes in RT 42, Lempake Village. First, a community approach through the formation of a dialogue forum between related parties to build mutual understanding. Second, strengthening the role of dispute resolution institutions to provide fast and fair alternative solutions. Third, increasing access to information and education for the public regarding rights and legal procedures related to land. Apart from that, the success of this strategy also depends on good collaboration between the government, society and the private sector in managing land conflicts. This research provides recommendations for improving the implementation of existing strategies, including developing more inclusive and sustainable policies and expanding inter-institutional collaboration networks. In conclusion, the strategy for preventing and handling land disputes in RT 42, Lempake Village, Samarinda, can be a model for other areas that face similar challenges. Implementation of this strategy not only helps reduce conflict but also promotes social justice and socio-economic stability at the local level. It is hoped that this study can contribute to public policy and theory development in handling land conflicts in Indonesia.

Abstract

Indonesia has undertaken numerous initiatives to protect human rights through ratified national and international legal frameworks. However, challenges remain as violations of fundamental human rights persist. This article examines Indonesia's efforts to protect human rights through sustainable development and compares them with Australia's approach to achieving sustainable development goals (SDGs) by upholding human rights. The study employs a normative legal research method, utilizing statutory and case approaches. Primary and secondary data sources, including relevant human rights legislation, were analyzed qualitatively to address the research objectives. The findings indicate that Indonesia is committed to the SDGs and identified national targets aligned with Goal 16, emphasizing peace, justice, and strong institutions. While Indonesia and Australia face similar challenges in achieving the SDGs, Indonesia can draw lessons from Australia’s experience, particularly in strengthening the localization of SDGs and adopting objective success measures. Implementing data-driven evaluations of progress, gaps, and opportunities will enable Indonesia to formulate relevant policies and improve SDG outcomes. Adopting such measures is crucial for Indonesia to advance its human rights agenda and sustainable development efforts more effectively.

Abstract

Background: The ever-evolving international legal framework prioritizes the enforcement and protection of human rights and global justice. States are encouraged to underline their obligations in preventing human rights violations, particularly in law enforcement practices. Indonesia, although it has ratified the UNCAC, has still not ratified the mechanism for the confiscation of assets resulting from corruption crimes without the need for a conviction or as well known as the Non-Conviction-based Asset Recovery (NCB). The relationship between the NCB and human rights is the source of the problem of law enforcement to eradicate corruption in Indonesia. Therefore, this article explains the protection of human rights, especially those concerning the third-party, in the asset forfeiture bill in Indonesia and compares it with the implementation of the NCB in Australia. Methodology: Using a legislative approach to examine the legal provisions applicable in both countries, namely Indonesia and Australia, this paper relies on the study of relevant legal sources, including anti-corruption law and human rights law. Objective: This study is expected to provide an overview of the human rights protection mechanism in the enforcement of the law on the confiscation of assets resulting from corruption without the need to go through the criminal process first in Indonesia. Findings: The study found that the draft asset forfeiture law in Indonesia does not offer balanced legal protection for third party human rights, specifically the right to own property acquired in good faith or without criminal involvement. Indonesia is advised to adopt a mechanism for asset forfeiture without criminal proceedings as implemented in Australia, which guarantees asset ownership rights for bona fide the third-party to reformulate human rights in the bill. Originality/Uniqueness: This research is relevant and necessary in the development of the concept of multinational asset recovery in Indonesia by prioritizing the balance of human rights protection, especially for the third-party.

Abstract

Penelitian ini menggunakan pendekatan doktrinal dengan dua fokus utama. Pertama, menganalisis bentuk kualifikasi serta perbandingan pengaturan hukum terhadap tindak pidana pemerasan dan pengancaman melalui transaksi elektronik. Kedua, mengkaji bentuk pertanggungjawaban dan sanksi pidana dalam Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) terkait pemerasan dan pengancaman yang bermotif prostitusi. Hasil penelitian menunjukkan bahwa tinjauan hukum pidana terhadap pemerasan dan pengancaman bermotif prostitusi online dapat diklasifikasikan berdasarkan modus operandi pelaku. Pada dasarnya, pemerasan yang dilakukan tanpa melibatkan media elektronik termasuk dalam lingkup KUHP. Namun, perkembangan kasus menunjukkan adanya pergeseran, di mana sebagian pelaku menggunakan kombinasi tindakan langsung dengan korban serta media elektronik, sementara sebagian lainnya melakukan aksinya sepenuhnya melalui media sosial tanpa kontak fisik. Oleh karena itu, pertanggungjawaban pidana pelaku dapat ditentukan berdasarkan kualifikasi hukum yang sesuai dengan modus dan motif operandi yang digunakan, baik dalam ketentuan KUHP maupun UU ITE. Temuan ini menegaskan pentingnya harmonisasi pengaturan hukum guna memberikan kepastian hukum terhadap fenomena pemerasan dan pengancaman berbasis prostitusi online.
