Abstract

This article examines the management of Indonesia's natural resources based on Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) and the Basic Agrarian Law (UUPA), as well as its impact on indigenous land rights in the development of the Nusantara Capital City (IKN). The state has the authority to control natural resources for the welfare of the people, as regulated by the UUPA, particularly Article 4 Paragraph (1) on land control rights. The UUPA was formulated to eliminate the dualism between colonial agrarian law and customary law and to provide legal certainty regarding land rights. With the enactment of Law No. 3 of 2022 on IKN, new challenges have emerged in managing land in Kalimantan, particularly regarding indigenous territories, which encompass 476 mapped areas with vast customary forests. The main implication of this policy is the potential for conflicts between indigenous communities and the government concerning land control. The author employs a qualitative research method, using a legal and customary law approach, to explore the issue of how to protect indigenous rights and prevent their marginalization in large-scale development projects. On the other hand, opportunities arise to create more inclusive and sustainable policies by ensuring that local interests are considered in the development of IKN. This article highlights the importance of harmonizing the 1945 Constitution, UUPA, and IKN Law to balance the needs of national development and the protection of indigenous rights, thereby reducing the potential for regional conflicts and increasing legal certainty for investors.

Abstract

The preservation of marine fisheries resources within ASEAN nations’ Exclusive Economic Zone (EEZ) is an urgent and pressing challenge requiring collaborative efforts from all ASEAN nations. Challenges such as illegal fishing, climate change, and lack of coordination between ASEAN nations may cause damage to marine biota food chain, especially marine fisheries in Southeast Asia region. To solve this conundrum, collaboration between ASEAN nations pose as the key solution. The research method used in this study is normative juridical approach by analyzing primary legal materials such as International Agreements and other international laws & sources. Further analysis was also conducted from secondary law materials such as international journals and books. It should be noted that the preservation of marine fisheries within ASEAN region has always been a topic that needs to be continuously improved. The urgency to escalate the preservation efforts can be seen in various programs conducted through Ministerial Understanding on Fisheries Cooperation in 1983, as a form of understanding and cooperation between ASEAN nations for the development, management, and conservation of marine fisheries resources within ASEAN EEZ region. Moreover, ASEAN also carried out collaborative efforts for marine fisheries conservation through ASEAN Policy of the General Fisheries Policy Feasibility Study (AGFP). AGFP regulate the ASEAN marine fisheries sector and encompassed 15 focus areas, including marine fisheries resources management, countermeasures against Illegal, Unreported and Unregulated (IUU) Fishing, research on marine fisheries, food security, international trade, animal health, conservation of habitat, and management of marine debris and garbage. The policy was ultimately established by the ASEAN nations member as a Working Unit Forum named The ASEAN Sectoral Working Group on Fisheries (ASWGFi) to realize the vision and mission of AGFP. Efforts to overcome this challenge are laid out by committing to preserve marine fisheries resources in ASEAN nation’s regions, focusing on protecting marine biodiversity – especially marine fisheries resources, encouraging economic and social sustainability, while ensuring food availability and security for the future.

Abstract

This research aims to analyze the form of legal protection for consumer rights in the circulation of hazardous food products, using the case study of sodium dehydroacetate preservative use in Roti Okko products manufactured by PT Abadi Rasa Food. The entry of food products containing prohibited chemical substances has become a serious concern because it poses potential threats to public health and directly violates consumers’ rights to safety and security as stipulated in Article 4 of Law No. 8 of 1999 concerning Consumer Protection. This study employs a normative juridical method by examining relevant legislation, legal doctrines, literature, and official BPOM (Indonesian Food and Drug Authority) documents as primary data sources. The findings reveal that national regulations such as Law No. 18 of 2012 on Food, Law No. 36 of 2009 on Health, BPOM Regulation No. 22 of 2013, and Government Regulation No. 28 of 2004 provide a solid legal foundation for ensuring food safety, including the prohibition of hazardous food additives. However, recurring violations indicate weak enforcement and low compliance among business actors. The study also finds that BPOM holds the authority to withdraw products, revoke distribution licenses, and impose administrative sanctions. Therefore, the research concludes that the implementation of legal protection for consumers has not yet been optimal due to gaps in supervision mechanisms and the low awareness of business actors regarding food safety standards. The study recommends strengthening regulatory oversight, enhancing inter-agency coordination, and promoting continuous education for both business actors and consumers to achieve effective legal protection against the circulation of hazardous food products in Indonesia.

Abstract

Artikel ini membahas bentuk, konstruksi hukum, serta regulasi perjanjian kerjasama antara profesi dokter dengan perusahaan di sektor pelayanan kesehatan di Indonesia. Perjanjian kerjasama ini memiliki karakter khusus karena menggabungkan aspek hukum perdata dengan standar profesi dan etika kedokteran. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pengumpulan data melalui studi kepustakaan, mencakup peraturan perundang-undangan, doktrin hukum, serta literatur terkait. Hasil penelitian menunjukkan bahwa perjanjian kerjasama antara dokter dan perusahaan dapat berbentuk hubungan kerja atau hubungan kontraktual, yang masing-masing menimbulkan hak dan kewajiban tertentu. Meskipun mengikuti prinsip hukum perjanjian, seperti asas pacta sunt servanda dan syarat sahnya perjanjian, keberlakuannya harus sesuai dengan peraturan kesehatan, termasuk Undang-Undang Praktik Kedokteran, Undang-Undang Rumah Sakit, dan Kode Etik Kedokteran Indonesia. Selain itu, ketidakseimbangan posisi tawar antara dokter dan perusahaan dapat terjadi, sehingga pengaturan regulasi dan pengawasan oleh Konsil Kedokteran Indonesia, Ikatan Dokter Indonesia, dan Kementerian Kesehatan sangat diperlukan untuk menjaga independensi profesi dokter dan kualitas pelayanan medis. Kesimpulannya, perjanjian kerjasama yang efektif harus menjamin kepastian hukum, perlindungan profesi, dan pelayanan kesehatan bermutu bagi masyarakat.

Abstract

Peredaran skincare tanpa izin edar kini semakin mudah ditemukan, terutama di media sosial. Banyak konsumen yang tergiur oleh klaim hasil cepat dan harga murah tanpa menyadari risiko dibaliknya. Padahal hak konsumen untuk mendapatkan informasi yang jelas dan keamanan dari produk yang telah digunakan telah diatur dalam hukum indonesia. Penelitian ini bertujuan untuk menggali sejauh mana hak tersebut benarbenar terpenuhi dalam kasus penggunaan skincare ilegal. Hasil penelitian ini menunjukan kurangnya literasi konsumen, lemahnya pengawasan digital, dan serta maraknya pelaku usaha yang mengabaikan apa saja hak dan kewajiban pelaku usaha serta hak dan kewajiban konsumen.Kata kunci: Hak konsumen, Izin Edar, Keamanan Produk

Abstract

The background of this study is the widespread use of slimming products in Indonesia and reports of health risks from hazardous ingredients, highlighting gaps between legal norms and practical enforcement. The research problem focuses on business liability and the legal consequences of distributing Beauslim slimming products. This study employs normative juridical research with statute, case, and analytical approaches. Secondary data include primary legal materials such as Law No. 8 of 1999 on Consumer Protection, Law No. 36 of 2009 on Health, the Civil Code (KUHPerdata), and BPOM regulations, as well as secondary literature and media reports. Data were analyzed qualitatively to examine the alignment and gaps between normative obligations and business practices. The results indicate that while laws mandate accountability, transparency, and accurate labeling, enforcement remains weak. Many hazardous products continue circulating, showing a gap between law and practice. Stronger regulation, corporate compliance, and consumer awareness are essential to minimize risks and ensure accountability.

Abstract

The rapid growth of crypto-asset transactions in Indonesia has led to an increased reliance on electronic agreements containing standard clauses unilaterally drafted by digital platforms. However, the unilateral authority to block user accounts raises concerns regarding legal validity and potential violations of consumer rights. This study examines the legal framework governing standard clauses in electronic agreements on crypto-asset platforms and assesses the validity of account-blocking clauses under the Consumer Protection Law (UUPK) and the Indonesian Civil Code (KUH Perdata). Using a normative juridical method, the research analyzes statutory regulations, court decisions, and relevant literature. The findings indicate that although the standard clause satisfies the elements of a valid agreement under Article 1320 of the Civil Code, a unilateral account-blocking clause violates Article 18 of the UUPK because it grants disproportionate authority to business actors and may undermine consumer rights without a legitimate legal basis. The study concludes that account blocking is legally valid only when conducted pursuant to an order issued by a competent authority and in accordance with consumer protection principles.

Abstract

Advances in technology have accelerated the growth of the cosmetics industry; however, these developments are often exploited by businesses to distribute illegal products that fail to meet regulatory and safety standards. This study examines consumer protection mechanisms and the role of the Indonesian Food and Drug Monitoring Agency (BPOM) in responding to the circulation of illegal Tabita-brand cosmetics across digital media platforms. Using normative legal research with statutory and conceptual approaches, this study analyzes both primary and secondary legal materials. The findings indicate that consumer protection efforts are grounded in the Consumer Protection Law (UUPK), the Electronic Information and Transactions Law (UU ITE), BPOM regulations on cosmetics, and relevant e-commerce provisions. Preventive protection is carried out through the provision of accurate product information, while repressive protection consists of administrative, civil, and criminal sanctions. Nevertheless, law enforcement remains hindered by the anonymity of business actors in the digital environment. Although BPOM conducts both pre-market and post-market supervision, the ease of digital distribution continues to facilitate the circulation of illegal products, underscoring the urgent need to strengthen regulations and enhance cross-agency coordination.

Abstract

This study analyzes the implementation of the consent principle in the protection of personal data of healthcare workers in Indonesia, focusing on its implications and consequences in the context of digital healthcare services. As digital transformation accelerates in the healthcare sector, with the adoption of electronic medical records, telemedicine, and health applications, the personal data of healthcare workers, including doctors and nurses, is increasingly exposed and at risk of misuse. According to Law No. 27 of 2022 on Personal Data Protection (UU PDP), the consent principle is the primary basis for legitimate data processing. However, this research reveals a gap between existing regulations and their implementation, which could lead to legal, ethical, and professional consequences for healthcare workers. Findings indicate that, despite the normative regulation of consent in the UU PDP, its application in digital health policies remains weak and inconsistent. This study suggests the need for regulatory improvements and stronger enforcement of the consent principle to effectively protect the personal data of healthcare workers.

Abstract

Ideally, the principle of consent serves as the ethical and legal foundation for managing the personal data of medical personnel to ensure that every sensitive piece of information is processed transparently and securely. However, practical realities reveal weak compliance, limited awareness of data rights, and the rapid development of health technologies that are not yet balanced with adequate regulation. These conditions give rise to various legal issues, including data breaches and misuse of information that may harm medical personnel both personally and professionally. This study aims to analyze the position of the consent principle as one of the key pillars of personal data protection for medical personnel, while also outlining the implications and legal consequences of its implementation within the context of modern healthcare services. The methodology used in this study is categorized as qualitative library research, employing a normative legal approach explained through descriptive-analytical analysis. The findings indicate that the fulfillment of the consent principle has not been fully effective and still requires regulatory strengthening, enhanced data literacy, and consistent law enforcement to safeguard the integrity and security of medical personnel data.
