Abstract

This article examines the granting of amnesty to perpetrators of political crimes by the President of the Republic of Indonesia. This authority is regulated in the Basic Law of the Republic of Indonesia, 1945, Article 14 paragraph (2), and Emergency Law Number 11, 1954, Article 1 on Amnesty and Abolition. Both of these rules do not specifically describe the limitations or types of criminal acts that amnesty may be granted to. The amnesty granted by the President to Baiq Nuril, a victim of sexual harassment involved in cases of infringement of the Information and Electronic Transactions Act, was carried out on the basis of humanity and justice. This policy has influenced the historical changes in amnesty law aimed at non-political cases. The study aims to examine the authority of the President of Indonesia in granting amnesty, reviewed from a fiqh siyasah perspective. Data is obtained through library studies and analyzed using a normative or doctrinal approach. The results of the study show that the granting of amnesty by the president is a prerogative of the president, as stipulated in the Basic Law of the Republic of Indonesia 1945. But in fiqh siyasah, the essence of amnesty is forgiveness. Forgiveness is the prerogative of the head of state, aimed at creating greater crimes, and does not violate the provisions of the law that have been established. The President's policy of granting amnesty in non-political cases is in accordance with the provisions of the fiqh siyasah, because the concept of amnesty in the law and the notion of forgiveness in the fiqh siyasah are equally based on the interests of the state and the crime of the community. Historical facts show that the Prophet Muhammad and the caliphs after him gave forgiveness to rebels, war criminals, and non-political criminals.

Abstract

Konsep negara Islam (Dar Al-Islam) merupakan salah satu tema politik yang selalu hangat dibincangkan. Sebagian memandang Islam memiliki prinsip-prinsip dan norma politik dan pemerintahan yang dapat diterapkan dalam semua bentuk pemerintahan, sementara lain menganggap pemberlakuan formil sebagai sebuah keharusan. Pendapat lebih ektrem menyatakan tidak ada hubungan sama sekali antara ajaran Islam dengan negara. Data penelitian dianalisis dengan analisis-normatif/ Doktrinal. Hasil penelitian menunjukkan bahwa, menurut Yusuf Al-Qaradhawi konsep Dar Al-Islam atau daulah Islam bukanlah daulah diniyah atau teokrasi, bukan juga negara sekuler yang memisahkan agama dengan negara, dar Al-Islam adalah negara madani (daulah madaniyyah) atau negara sipil. Relevansi Dar Al-Islam dimasa moderen menurut pendapat Yusuf Al-Qaradhawi dapat dilihat dengan dua aspek. Pertama; bahwa konsep dar Islam mengimbangi konsep negara ideologi yang ada pada saat ini. Kedua; prinsip-prinsip hukum yang ditetapkan dalam Dar Al-Islam menurutnya sama negara bangsa (nation state), yang menerapkan sistem demokrasi, musyawarah (syura), dan sistem pemerintahan yang mementingkan hak-hak sipil. Konsep kesatuan politik, wilayah dan hukum yang dikemukakan Yusuf Al-Qaradhawi terkait Dar al-Islam tidak relevan dengan konteks realita negara bangsa saat ini. Keberadaan negara memang diakui dapat menguatkan agama dan dakwah Islam, namun bukan prioritas. Kebolehan menjalankan ibadah dengan bebas bagi umat Islam adalah batas minimal sebuah wilayah dikatakan dar al-Islam menurut para fuqaha.

Abstract

Islamic law and Indonesian legislation basically emphasize that marriage can only have one partner. In the Shafi'i school, Ash-Sharbini al-Khatib says, "A man, circumcision does not marry more than one wife without clear hajat. An-nash has pointed out that the principle of marriage is monogamy, not polygamy. The wife or a woman cannot marry more than one husband at the same time (polyandry) because of the impact caused. Polyandry is clearly forbidden as has been said by Allah Almighty. in QS. An-Nisa verse 24. In decision No. 383/Pdt.G/2020/MS. The bna polyandry is one of the reasons for divorce with the dropping of talaq one raj'i. The question in this thesis is how the right of talaq possessed by a husband how to analyze the Decision of the Judge of the Shar'iyah Court of Banda Aceh, and why the case of polyandry as a background for the breakup of marriage is broken with talaq raj'i. In this study, the author uses library research methods to analyze the judge's consideration and the Shafi'i school in terms of holding talaq rights on the grounds that they are caused by polyandry. There are several factors that make the existing legal provisions and procedures different, in the Shafi'i school in terms of privacy such as talaq is very guarded because it is considered bad if there are parties outside who know the domestic affairs, in contrast to the judge's consideration, the procedures of the Shar'iyah Court, the benefit of divorce is regulated to reduce illegal divorces that are not in accordance with the existing Shari'a. Therefore, it can be concluded that the difference that we can see between the judge's consideration and the Shafi'i school is the freedom of the husband to impose talaq anywhere and anytime, and the determination of the amount of talaq based on the husband's own intentions.

Abstract

Al-hajatu tanzzilu manzilata al-dharurah (the need to occupy an emergency position) is a fiqh rule that is often misunderstood in its use in an effort to justify changes to a law. The reason for using this method is often based on an urgent need that seems to be the same as or at least approaching an emergency. On the basis of an emergency, a law or legal procedure can be "violated" temporarily. This study will focus on the Al-hajatu tanzzilu manzilata al-dharurah fiqh rules in order to understand the difference between the terms al-dharurah (emergency) and al-hajah (need), so that it can be ascertained which legal acts can change due to necessity and which cannot changed. After reviewing various ushul fiqh literature, it can be concluded that this rule can be developed in its application to various emergencies in life both in the fields of economics, energy, food, education, human rights, politics and worship.

Abstract

The political conflict in Myanmar has resulted in a massive exodus of the Rohingya ethnic group from their country. The acceptance of Rohingya refugees in Aceh has sparked a societal dialectic due to the increasing number of refugees. The study focused on Islamic jurisprudence and local wisdom according to influential figures in Aceh in the protection of Rohingya immigrants. The empirical legal research method was deemed appropriate to analyze the conflict between the application of Islamic law in Aceh and the rejection of Rohingya refugees. The Islamic legal approach and local wisdom were important to analyze the context of Aceh's society, which is religious and highly values its customs. This study reveals that the handling of Rohingya refugees in Aceh, according to the views of ulama, academics, political leaders, and UNHCR Indonesia representatives, emphasizes Islamic values, Acehnese local traditions, and government policies. Ulama stresses the moral and religious obligation to assist refugees, following the Teurimong Jame tradition. Political leaders highlight the importance of government regulation to prevent negative social impacts, while UNHCR emphasizes the application of international refugee protection principles. Collaboration between society, the government, and International organizations is key to a humanitarian and structured approach to addressing the issue.

Abstract

This paper attempts to answer the issue of punishment for zina muḥṣān offenders in Aceh Qanun No. 6 of 2014 from the perspective of fiqh al-siyāsah and the ways the law is implemented in closed spaces such as prisons per the Governor Regulation No. 5 of the 2018. This study is a legal study with a Islamic politic approach (fiqh al-siyāsah) with a literature study data collection method. The polemic of the implementation of the Qanun Jinayah (criminal regional bylaws) in Aceh not only receives attention from outside such as human rights and non-governmental organization activists, but also from among Islamic academics or Acehnese ulemas. One of the most discussed topics is related to ‘uqūbah (punishment) for fornicators that does not distinguish between muḥṣān (married) and ghayr muḥṣān (unmarried) fornicators as is the case in classical fiqh (Islamic jurisprudence) literature. Qanun Jinayah does not at all separate between muḥṣān and ghayr muḥṣān fornicators, unlike the provisions of Islamic law which prescribe a hundred lashes for ghayr muḥṣān fornicators and stoning to death for muḥṣān fornicators. This indicates that those who commit zina in Aceh, whether married or unmarried, are punished with the same severity, which is 100 (one hundred) lashes. Further, the issue of changing the place of the flogging execution from public to prison in accordance with Aceh Governor Regulation No. 5 of 2018 concerning the implementation of the jināyah (criminal) procedural law is also worth to study from the point of view of fiqh al-siyāsah (Islamic politics) and legislation.

Abstract

The issue of food loss and waste (FLW) In North Sumatra, Indonesia brings significant threats that ultimately affect social, economic, and environmental conditions. The inefficiencies in food production, distribution, and consumption worsen the region's food insecurity, financial losses, and environmental degradation. This study examines the primary reasons and effects of FLW in North Sumatra, including cultural habits, inadequate waste management systems, and infrastructural shortcomings. The paper offers actionable recommendations based on thoroughly evaluating national regulations, local initiatives, and international best practices. Suggestions include investing in advanced processing and storage technologies, enhancing food recovery systems, adopting circular economy principles, and promoting public awareness campaigns. By addressing these challenges through collaborative efforts among stakeholders and innovative policy strategies, North Sumatra can significantly reduce FLW, improve food security, and contribute to Indonesia's broader sustainability goals—especially its commitment to UN Sustainable Development Goal 12.3. This study underscores the importance of integrating social, environmental, and economic considerations into strategies for mitigating FLW to ensure long-term regional development.

Abstract

Kajian ini dilatarbelakangi oleh adanya permasalahan yang timbul pada sudut pandang para pakar hukum mengenai isi dari UUPA dan UU IKN yang dianggap bertentangan. Dimana jangka waktu Hak Atas Tanah yang disebutkan dalam UU IKN berbeda dengan UUPA. Penelitian ini bertujuan untuk memberikan penjelasan mengenai pertentangan kedua Undang-Undang tersebut dengan mengkaji beberapa metode yang dapat dimanfaatkan dalam menjawab permasalahan ini. Pada kajian ini, penulis mengkaji dari sudut pandang asas lex specialis derogat legi generalis dan siyasah idariyah. Metode kajian ini ialah penelitian hukum normatif dengan objek kajian berupa norma hukum. Pendekatan yang dimanfaatkan pada kajian ini ialah pendekatan UU dengan menelaah semua regulasi yang berhubungan. Hasil kajian ini menunjukkan bahwa jika dibuat perbandingan antara metode nasakh dan asas lex specialis derogat legi generalis, keduanya punya konteks yang berbeda. menurut metode nasakh, UU IKN dapat mengesampingkan UUPA dikarenakan UU IKN yang datang kemudian setelah UUPA. Sedangkan dari perspektif asas lex specialis derogat legi generalis, UU IKN juga dapat mengesampingkan UUPA dikarenakan UUPA bersifat lebih umum dibanding UU IKN. Sesuai dengan prinsip Asas tersebut yakni hukum yang berperan khusus mengabaikan hukum yang bersifat umum.

Abstract

Prewedding comes from the English word which in Indonesian is a photo taken before the wedding. This means that all the processions that are carried out before the wedding and immortalised in a photo, then all these photos are prewedding photos. Prewedding photography is well known to many people. Prewedding photos are often used as mementos in the form of documentation, as is the case in walimah. Talking about walimah, of course we will talk about the accessories and makeup that adorn each room, one of which is a picture of a prewedding photo, where the bride and groom take a photo together, which is carried out before making ijab qabul or before the marriage contract. The background of this research is the existence of intimate scenes or poses that often violate Islamic norms, especially in the Aceh Besar area, and are contrary to Islamic law. This research aims to find out 1) the practice of prewedding photos in Aceh Besar; and 2) The perception of Aceh Besar scholars regarding prewedding photos. The research used in this paper uses Field Research (field research) and Library Research (literature). The results showed that the practice of prewedding photos in Aceh Besar begins with an introduction between the photographer and the prospective couple, and continues with an agreement on the cost of shooting. Then proceed to the shooting session. As for the perception of Aceh Besar scholars, it can be concluded that it is permissible as long as it does not violate Islamic law, and it can also be haram when prospective brides who are not yet legal as husband and wife do prewedding that involves khalwat (being alone without a legal bond), ikhtilat (mixing men with women), because it is close to adultery and violates Islamic norms.

Abstract

ABSTRACTThis study aims to examine the presence of the UUPA Guard Team which is generally intended to ensure that the articles in the UUPA run properly. This research uses a type of normative legal research, which is carried out by examining library materials that are focused on examining the application of the rules or norms in the UUPA. Data collection techniques were carried out through library research by reading previous studies and readings related to the development of Aceh's special autonomy, followed by observation, in-depth interviews with key informants and several informants who are closely related to this study. The results showed that the formation of the UUPA Guard Team was important because the work apparatus of the Aceh Government and the DPRA did not specifically have the competence and ability to understand the regulations in the UUPA. The formation of the UUPA Guard Team by both the Aceh Government and the DPRA was due to the demands of the article in the UUPA that every change to the UUPA must go through consultation and consideration of the DPRA and the Governor of Aceh, so that the UUPA Guard Team is expected to provide input to the two institutions when there is an attempt to change the provisions. in the UUPA. The presence of the UUPA Guard Team for the specificity of Aceh did not have a direct impact. This is due to the nature of the Guard Team being only limited to the Aceh government support team which was formed temporarily to provide input on the enactment of the UUPA so far. ABSTRAKPenelitian ini bertujuan menelaah kehadiran Tim Pengawal UUPA yang secara umum ditujukan untuk memastikan agar pasal-pasal dalam UUPA berjalan sebagaiamana mestinya. Penelitian menggunakan jenis penelitian hukum normatif, yang dilakukan dengan meneliti bahan-bahan pustaka yang difokuskan untuk mengkaji penerapan kaidah atau norma-norma dalam UUPA. Teknik pengumpulan data dilakukan melalui library research dengan membaca studi sebelumnya dan bacaan-bacaan yang berkaitan dengan perkembangan otonomi khusus Aceh, dilanjutkan dengan observasi, indepth interview dengan key-informan dan beberapa informan yang berhubungan erat dengan studi ini. Hasil penelitian menunjukkan bahwa pembentukan Tim Pengawal UUPA penting dilakukan disebabkan perangkat kerja Pemerintah Aceh dan DPRA yang ada tidak secara khusus memiliki kompetensi dan kemampuan memahami aturan dalam UUPA. Pembentukan Tim Pengawal UUPA baik oleh Pemerintah Aceh dan DPRA dikarenakan tuntutan pasal dalam UUPA bahwa setiap terdapat perubahan terhadap UUPA maka harus melalui konsultasi dan pertimbangan DPRA dan Gubernur Aceh, sehingga Tim Pengawal UUPA diharapkan dapat memberikan masukan terhadap kedua lembaga tersebut tatkala ada upaya untuk mengubah ketentuan dalam UUPA. Kehadiran Tim Pengawal UUPA terhadap kekhususan Aceh tidaklah berdampak secara langsung. Hal ini dikarenakan sifat Tim Pengawal hanya sebatas tim pembantu pemerintahan Aceh yang dibentuk secara temporer untuk memberi masukan terhadap keberlakuan UUPA selama ini.
