Abstract

This article discusses scholars' views on the law of not exercising the right to vote in general elections from the perspective of Islamic political law, especially in the view of Ali Muhammad Sallabi. This study arises from the existence of different scholarly perspectives in assessing the position of elections and citizens' attitudes in exercising their voting rights. For this reason, three aspects are discussed: first, the view of Ali Muhammad Sallabi regarding the law of not exercising the right to vote in the election process; second, the perspective of Islamic political law on Sallabi's view; third, the relevance of Sallabi's view to the concept of modern law. The approach used is a conceptual approach, with the type of normative legal research. Data comes from library legal materials collected through book survey techniques. Data analysis is prescriptive-analytic. The research findings show that Ali Muhammad Sallabi argues that in the context of the state, exercising the right to vote in elections is obligatory. His argument refers to Quranic principles, the practice of the Companions regarding leadership regeneration, and the concept of public interest. Sallabi's opinion aligns with the principles of Islamic political law because there is no evidence explicitly prohibiting or commanding the use of voting rights in elections, while exercising the right to vote brings benefits. Furthermore, Sallabi's view is relevant to the concept of modern law, where leadership elections are carried out through voting processes, and citizens exercise their voting rights as part of realizing democratic principles.

Abstract

Al-hajatu tanzzilu manzilata al-dharurah (the need to occupy an emergency position) is a fiqh rule that is often misunderstood in its use in an effort to justify changes to a law. The reason for using this method is often based on an urgent need that seems to be the same as or at least approaching an emergency. On the basis of an emergency, a law or legal procedure can be "violated" temporarily. This study will focus on the Al-hajatu tanzzilu manzilata al-dharurah fiqh rules in order to understand the difference between the terms al-dharurah (emergency) and al-hajah (need), so that it can be ascertained which legal acts can change due to necessity and which cannot changed. After reviewing various ushul fiqh literature, it can be concluded that this rule can be developed in its application to various emergencies in life both in the fields of economics, energy, food, education, human rights, politics and worship.

Abstract

Abstract

The administration of government in a modern rule-of-law state often encounters challenges when public policies are considered legally valid in a formal sense but raise concerns regarding substantive justice, public welfare, proportionality of authority, protection of fundamental rights, and leadership accountability. This condition indicates the need for an analytical framework that goes beyond formal legal compliance and incorporates foundational values underlying state governance. This study aims to examine the relevance of the principles of siyāsah shar‘iyyah namely justice, public interest (maslaḥah), balance, protection of religion and life, and leadership trustworthiness within Indonesia’s legal system and governmental policies. This research employs a normative legal method using statutory and conceptual approaches by analyzing the Constitution, statutory regulations, and relevant government policies. The findings demonstrate that the principles of siyāsah shar‘iyyah have substantial relevance to Indonesia’s national legal framework, particularly the 1945 Constitution of the Republic of Indonesia and various sectoral regulations. These principles are reflected in guarantees of equality before the law, orientation toward public welfare, proportional limitations on state authority, protection of the right to life and freedom of religion, and the strengthening of governmental accountability. Therefore, siyāsah shar‘iyyah can serve as an analytical instrument for evaluating and formulating public policies that are just and accountable.

Abstract

In modern democratic practice, opposition is often perceived as a threat to political stability, especially in Muslim-majority countries. However, in the context of contemporary Islamic thought, opposition holds its own legitimacy. This study explores how Yūsuf al-Qaraḍhāwī conceptualizes mu‘āraḍhah (opposition) within a multi-party democratic system. The purpose of this research is to analyze al-Qaraḍhāwī’s perspective on political opposition as a means of controlling power in accordance with Islamic law. This study employs a library research method using a qualitative-descriptive approach by examining al-Qaraḍhāwī’s works and related literature. The findings reveal that, according to al-Qaraḍhāwī, mu‘āraḍhah is not a form of rebellion against the ruler, but rather a legitimate form of political participation that fulfills the Islamic obligation of enjoining good and forbidding evil (amr bi al-ma‘rūf wa nahy ‘an al-munkar), while preventing abuse of power. A multi-party system that accommodates peaceful opposition is compatible with Islamic values, provided it is constructive, avoids slander, and does not cause division among the Muslim community. Therefore, the concept of mu‘āraḍhah should be developed as a shar‘ī mechanism to balance authority and political morality in the framework of Islamic democracy.
