Abstract

Pengangkatan penjabat (Pj) kepala daerah dalam proses pengisian kekosongan jabatan kepala daerah sampai dengan terpilihnya kepala daerah hasil Pilkada serentak nasional tahun 2024 terdapat di dalam Pasal 201 ayat (9) Undang-undang Nomor 10 Tahun 2016 tentang Perubahan Kedua Atas Undang-undang Nomor 1 Tahun 2015 tentang Penetapan Peraturan Pemerintah Pengganti Undang-undang Nomor 1 Tahun 2014 Tentang Pemilihan Gubernur Bupati dan Walikota Menjadi Undang-undang dan Peraturan Pemerintah Nomor 49 Tahun 2008 tentang Perubahan Ketiga Atas Peraturan Pemerintah Nomor 6 Tahun 2005 Tentang Pemilihan Pengesahan Pengangkatan Dan Pemberhentian Kepala Daerah Dan Wakil Kepala Daerah. Tujuan dalam penelitian ini ingin mengetahui ketentuan undang-undang Nomor 10 Tahun 2016 terkait pengangkatan penjabat kepala daerah, dan Kedua, dan tinjauan Siyasah Dusturiyah terhadap pengangkatan Penjabat kepala daerah. Penelitian ini menggunakan metode penelitian kualitatif dengan teknik pengumpulan data (library research). Hasil penelitian menunjukan, ketentuan pelaksana tersebut sangatlah kurang lengkap dan tidak lagi relevan karena masih mengalami tumpang tindih. Hal ini jelas menimbulkan kebingungan dan ketidakpastian hukum, karena undang-undang dan aturan pelaksananya memuat ketentuan yang berbeda dan berlawanan. Adanya pertentangan tersebut membuktikan bahwa regulasi dari pengangkatan penjabat kepala daerah masih cacat dan tidak lengkap. Dalam pandangan Fiqh Siyasah Dusturiyah terkait pengisian jabatan tertentu maka islam memandang penting atas terjadi kekosongan pimpinan dalam suatu daerah karna hal tersebut akan berdampak langsung dengan keberlangsungan pemerintahan suatu Negara dan juga terkait kemaslahatan ummat. Dalam konteks hukum tata negara Islam pejabat (Pj) kepala daerah dapat dikatakan sebagai gubernur umum yang pengangkatannya dengan akad atas dasar suka rela (gubernur mustakfi) yakni mempunyai tugas tertentu dan otoritas tertentu pula.

Abstract

This research examines the process of proving an ijārah 'ala al-'amāl contract and the effectiveness of sanctions applied by the Badan Kepegawaian Aceh. The method used is an empirical legal approach in which data is collected from primary sources such as interviews, observations, and focus group discussions. Secondary data is collected from secondary sources such as books, journals, and other resources related to this research. The findings show that the sanctions applied have not been fully effective in tackling arrears. This research is important because the sanction policy of Badan Kepegawaian Aceh needs to be evaluated in order to improve the supervision and enforcement of employee discipline, as well as to ensure that the application of ijārah 'ala al-'amāl is in accordance with applicable principles. The level and type of sanctions for default are listed in Government Regulation No. 94 of 2021 on the Discipline of Civil Servants. Meanwhile, defaulting employees are subject to a series of disciplinary enforcement procedures. The first step is a warning in the form of a summons to provide information about the absence. If the employee fails to comply with the summons, a follow-up summons will be issued. If the employee still refuses to comply, disciplinary action will be taken. The first disciplinary action will usually be a light sanction. This serves as a warning and encouragement to comply with attendance and work discipline rules. However, if the employee still repeats the offence or commits another offence, moderate or more severe sanctions will be imposed. These include sanctions such as deduction of TTP, demotion, delayed salary increases, or even dismissal, depending on the policy and the level of offence committed.

Abstract

Qanun Aceh Nomor 11 Tahun 2018 Tentang Lembaga Keuangan Syariah merupakan peraturan perundang-undangan yang mengatur tentang kegiatan Lembaga keuangan dalam rangka untuk mewujudkan ekonomi masyarakat Aceh yang adil dan sejahtera dalam naungan bingkai syariat Islam. Qanun LKS ini telah diundangkan pada Tanggal 4 Januari 2019. Maksimal tiga tahun setelah diundangkan Qanun LKS tersebut, maka semua Lembaga Keuangan di Aceh harus beroperasi berdasarkan prinsip syariah. Hal ini menandakan bahwa pada Tanggal 4 Januari 2022, semua Lembaga Keuangan di Aceh sudah menjadi Lembaga Keuangan yang menjalankan kegiatan operasionalnya dengan prinsip syariah. Penelitian ini mengkaji tentang kondisi Lembaga Keuangan di Provinsi Aceh, peluang dan tantangan Lembaga Keuangan di Provinsi Aceh untuk menjalankan kegiatan operasionalnya sesuai dengan prinsip syariah, dan kesiapan Lembaga Keuangan di Aceh dalam menyongsong berlakunya Qanun Aceh Nomor 11 Tahun 2018 Tentang Lembaga Keuangan Syari’ah. hasil penelitian menunjukkan bahwa Lembaga Keuangan di Aceh memiliki peluang dan tantangan dalam menyiapkan diri untuk menyambut berlakunya Qanun LKS ini. Lembaga Keuangan di Aceh dapat disimpulkan telah bergerak dengan baik dan siap menyongsong berlakunya Qanun LKS. Hal ini ditandai dengan telah dikonversikannya beberapa bank konvensional yang berada di Provinsi Aceh, diantaranya adalah Bank Mandiri, Bank Rakyat Indonesia (BRI), Bank Negara Indonesia (BNI), dan Bank Central Asia (BCA).

Abstract

This article aims to examine the system of returning confiscated objects at the Banda Aceh city district court according to the perspective of Al-Milkiyah Rights in Muamalah Jurisprudence. The approach taken by the author is juridical-empirical research. The main data is obtained from interviews with the parties, and a number of applicable laws and regulations, while secondary data is obtained from the results of research related to this research. The results showed that the system for returning confiscated objects was carried out based on the provisions of the SOP. In the decision of the Banda Aceh District Court No.64/Pdt.G/2020/PN Bna, the decision of the Banda Aceh High Court No. 72/PDT/2021/PT BNA, the decision of the Supreme Court of the Republic of Indonesia No. 4173 K/Pdt/2022 regarding unlawful acts, namely the Defendant occupying and obstructing the plaintiff to take control of the disputed land that he had obtained from the winning auction No. 533/01/2020, and the execution of the execution No. 533/01/2020. 533/01/2020, and the execution respondent did not voluntarily vacate the land, then the granting of the request for execution will be executed by force with the execution agency. The judge ordered the Registrar of the Banda Aceh District Court and bailiffs accompanied by two witnesses to carry out execution against the land in order to ensure law enforcement by handing over the object of the land plot to the applicant for execution by order of the judge. From this decision, it was decided to carry out the execution of the land to fulfil the decision that has permanent legal force. The land object in dispute must be returned based on an inkrah court decision for certainty of law enforcement.

Abstract

ABSTRACThe potential of waqf in Indonesia is immense, yet its realization remains far from optimal. This study discusses the optimization of waqf innovation in the digital era to support sustainable development in Indonesia. Through a qualitative approach and literature review, this research examines the challenges in optimizing waqf innovation in the digital era, the development of waqf innovation, and what can be done to enhance its optimization. The findings reveal several challenges, such as low digital literacy, limited public trust, and the lack of regulations supporting digital waqf innovation. The study also explores digitalization opportunities, including the use of technologies such as crowdfunding, blockchain, and smart waqf applications, which can improve efficiency, transparency, and accessibility in waqf management. With collaboration among the government, waqf institutions, the private sector, academics, and society, these innovations are expected to maximize the socio-economic impact of waqf for sustainable development. The research provides strategic insights into leveraging digital technology to optimize waqf potential in Indonesia.

Abstract

On the island of Sumatra, several provinces have made palm oil a superior commodity, including Aceh Province. Therefore, many people in the Subulussalam region and various parties want to invest in the palm oil agribusiness sector, as a result, various unproductive lands have turned into palm oil lands. The function of the forest, which is the lungs of the earth, is disrupted due to the use of forest areas that are converted into economic land, which of course has a long-term effect on the destruction of the forest itself, which makes the condition of the forest soil will also deteriorate due to the use of fertiliser substances. This study aims to examine and analyse the problem with theoretical and practical approaches regarding the use of the Leuser Forest Area (KEL) as land for oil palm plantations. The research method used is a qualitative research method with a descriptive-analytical approach, data collection techniques are carried out by interview and documentation as well as literature review and regulations related to this research. The results showed that the process of forest encroachment that occurred in the Leuser forest area in Subulussalam City was an illegal activity, because the community cleared oil palm land without going through licensing procedures. Currently, there are approximately 20,000 hectares of illegal oil palm land cleared by residents that have been disciplined. The review of the concept of milk al-daulah on the issue of new palm oil land clearing by the community in the Leuser Forest Area (KEL) is contrary to the concept of milk al-daulah.

Abstract

Home Ownership Loans (KPR) in the community are not only in demand by those with middle income or target groups as regulated by the Minister of Public Works and Public Housing (PUPR) Number 242/KPTS/M/2020, but also those with high income. Such ownership is a common ownership, known by the developer and the bank appointed as the debtor by the government without any legal sanctions. In practice, existing motives such as profit-seeking, investment, and others are carried out in various ways. The problem is the legal aspect of the validity of mortgage ownership by non-target groups, which is further elaborated into 1) How is the mechanism of ownership of subsidised houses regulated in the Decree of the Minister of Public Works and Public Housing (PUPR) Number 242/KPTS/M/2020, and 2) how is the legal certainty of the ownership contract of subsidised houses according to the Ministerial Decree in the perspective of ghasab law—seeing the importance of knowing how Islamic law reviews the ownership of subsidised houses/mortgages by non-target groups. This research uses descriptive analysis. Data sources are divided into two types: legal sources, such as regulations and fiqh studies. Second, field data will be collected through interviews and observations at the locations of subsidised houses around Banda Aceh.

Abstract

This study aims to determine how the system of buying and selling imported used clothing in Banda Aceh is viewed from the perspective of fiqh muamalah and to examine it in terms of the elements of gharar and the fatwa of DSN-MUI No: 110/DSN-MUI/IX/2017 concerning the contract of sale. This study employs a qualitative method using a legal-empirical approach. The findings reveal that the system of buying and selling imported used clothing in Banda Aceh involves three parties in the transaction: the seller, the buyer, and the distributor. The seller orders and purchases clothing from the distributor in the form of bags without being allowed to inspect the contents. Upon arrival, the clothing is sorted according to quality, washed thoroughly, and then sold to the buyer. In general, the practice of buying and selling imported used clothing in Banda Aceh aligns with the principles and conditions of Islamic sales transactions. However, when examining the transactions between sellers and distributors of imported used clothing, there is an element of gharar, which involves uncertainty about the goods being purchased, as sellers are not permitted to inspect the goods in the bags before they are shipped. This falls under the category of gharar, which is not permitted in Islam.

Abstract

The process of legislation on the Qanun by the Aceh People's Representative Council (DPRA) is a unique legal mechanism in the Indonesian government system, because it is closely related to the implementation of Islamic sharia in Aceh. This study aims to see the relevance of the Qanun legislation process in Aceh from the perspective of the concept of Islamic politics put forward by Imam Al-Mawardi, a classical Islamic thinker who discusses a lot of Islamic government theory and law. This research uses a qualitative approach with descriptive analysis methods and literature studies on Al-Mawardi's thoughts in the book Al-Ahkam As-Sultaniyyah. The results of the study show that in the Qanun legislation process, the DPRA plays a role as a legislative body that has the authority to formulate regional regulations based on Islamic law. However, in practice, there are still challenges such as local political dynamics, the interests of various actors, and synchronization with national law. So, how does the DPRA use the concept of Islam in the Qanonic legislation process? And in the legislative process, the DPRA prioritizes certain political interests over the interests of the people? Al-Mawardi's perspective provides insight that good legislation must pay attention to the balance between Islamic law and the benefit of the ummah, and avoid political interests that can hinder the ideal implementation of sharia. Thus, this research contributes to the understanding of the Qanun legislation process from an Islamic political perspective and offers recommendations so that the DPRA can carry out its duties more optimally following the principles of ideal Islamic governance according to Al-Mawardi.

Abstract

This study discusses how risk management is implemented in Islamic banking in Indonesia, and how risk management in financing is applied in Islamic banking in Indonesia. This research is a type of library research that focuses on managing qualitative data using descriptive-analytical methods. The results of this study indicate that there are six stages in the implementation of risk management in Islamic banking in Indonesia: 1) Determining the risks associated with products and transactions within the bank. 2). Establishing risk assessment using measurement methods and information systems in risk management. 3). Setting limits or thresholds for risk tolerance. 4) Assigning ratings to the identified risks. 4). Developing a contingency plan in case the bank faces a critical situation. 6) Establishing internal control systems in every aspect of risk management decision-making. There are also six applications of financing risk management in Islamic banking in Indonesia: 1). Identifying risks in all financing, whether related to products or banking activities.2). Considering the financial condition of potential borrowers, including in-depth analysis of their ability to repay on time. 3). Categorizing risks into various defined criteria. 4). Ideally, each bank should have its own system for measuring the risks of financing provided or to be provided to borrowers. 5). Determining the financing period (maturity profile) linked to market conditions that may fluctuate.6). Assessing collateral aspects and the potential for default in repayments.
