Abstract

Athletes are professional individuals trained to possess agility, strength, and speed for competitive performance. Football athletes, in particular, exhibit a high spirit of competitiveness to bring pride to their country, club, and region. This intense desire to win has led some athletes to resort to doping as a shortcut to enhance performance. This study aims to examine the legal framework governing the use of doping among football athletes in Indonesia, the enforcement of these laws, and the preventive efforts undertaken by the Bojonegoro Regency PSSI Association. Using a sociological juridical approach, data was collected through field studies and interviews with relevant stakeholders. The findings reveal that doping is strictly prohibited in football and is subject to legal sanctions, especially when involving narcotics-type substances. Law enforcement has been effectively implemented against offenders. Furthermore, the Bojonegoro PSSI Regency Association has taken active preventive measures by organizing awareness campaigns and educational sessions. These initiatives are conducted in collaboration with local hospitals and the National Narcotics Agency (BNN) of Tuban Regency. Such efforts aim to enhance athletes' understanding of the dangers and legal consequences of doping, thereby fostering a culture of fair play and clean competition in regional football.

Abstract

Termination of employment (PHK) must be carried out according to legal procedures, beginning with an official termination letter. However, issues may arise when such termination contradicts labor regulations. This research discusses the case of Bunari, a worker who received a termination letter during the trial process, which is suspected to conflict with Article 155 paragraph (2) of the Manpower Law. The main legal issue examined is the ambiguity of norms regarding the validity of termination during ongoing industrial relations disputes. The objective of this study is to analyze the legal validity of the termination letter issued to Bunari during the trial process, as reflected in Decision Number 1237 K/Pdt.Sus-PHI/2017, and to examine the rules surrounding process wages for workers under trial. This study applies a normative juridical method, analyzing legal events using statutory and regulatory frameworks. The findings reveal that the termination of Bunari is not legally valid due to the ongoing industrial dispute process at the time of termination, rendering the letter formally and legally flawed. Furthermore, Bunari is entitled to process wages as he fulfills the required legal elements. Based on Supreme Court Circular Letter (SEMA) No. 3 of 2015, the payment period for process wages is limited to six months. The study recommends reinforcing clarity in regulations regarding termination procedures during legal proceedings and urges employers to strictly adhere to legal mechanisms to prevent arbitrary dismissals and ensure workers' rights are protected.

Abstract

Criminal acts in Aceh are regulated in Qanun Number 6 of 2014 concerning Jinayat, which is a regional regulation at the provincial level based on Islamic law. In the case of indecent acts committed against children on the basis of mutual consent in Decision No. 6/JN/2019/MS. Aceh acquitted the defendant based on Article 1 number 27 of Qanun Number 6 of 2014 concerning Jinayat. The purpose of this study is to examine indecent acts against children in Qanun No. 6 of 2014 concerning Jianayat using the principle of preference lex superiori derogat legi inferiori and lex specialist derogat legi generali. This study is normative and uses a case and statutory approach as a research methodology. The results obtained from this study are that there was an error by the judge in acquitting the defendant, based on Law No. 35 of 2014 concerning Child Protection and the Criminal Code which is based on the principles of lex superiori derogat legi inferiori and lex specialist derogat legi generali states that a child's consent cannot be used as a reason to exempt a person from the crime of molestation of a child based on mutual consent.

Abstract

This study is expected to have significant implications for policymakers and stakeholders in Indonesia and other developing countries seeking to reform their labor laws. The study can validate the development of new policies and programs to protect the rights of the workers, promote decent work, and provide greater access to social protection. The discussion on comparing labor regulations before and after implementing the Job Creation Law (The Law Number 6 Year 2023) in Indonesia covers several key aspects, including wage arrangements, outsourcing, social protection, and fixed-term employment agreements (PKWT). The Job Creation Law reflects the trend to provide more flexibility to employers, allowing them to customize working conditions according to business needs. While a push exists to improve the investment climate and create jobs, these changes raise serious questions about workers’ rights and welfare, particularly concerning about social protection and job security. This comparison indicates significant changes in Indonesia’s labor regulations, providing a clearer picture of workers’ challenges and opportunities. Labor law reform in Indonesia has impacted workers’ perception and responses. While some perceive it as a positive step that strengthens legal protection against unfair termination of employment, many workers still experience inequalities in access to health insurance, pensions, and workplace accident insurance. The government and stakeholders should work to improve workers’ access to social security and strengthen law enforcement and oversight to minimize potential implementation failures that could harm the rights of the workers.

Abstract

Abstract: Social change today is caused by the development of technological advances that lead to modern life. Rural communities are no longer excluded from the modernization process. Modernization is a systematic effort to or produce values (such as physical, material, and social) that are universal, rational, functional, and of high quality. This essay aims to explain the process of social change and explore the extent to which law can anticipate social change as a result of technological advances and modernization. Keyword: social change, modernisation, technological advancement. Abstrak: Hal ini karena modernisasi melalui kemajuan teknologi juga mempunyai dampak yang besar terhadap masyarakat tradisional pedesaan. Masyarakat pedesaan tidak lagi tersingkir dari proses modernisasi. Modernisasi adalah upaya sistematis untuk mencapai atau menghasilkan nilai-nilai (seperti fisik, material, dan sosial) yang bersifat universal, rasional, fungsional, dan berkualitas tinggi. Biasanya, nilai-nilai tersebut dikontraskan dengan nilai-nilai tradisional. Abstract

This study examines the ambiguity of the phrase “degrading human dignity” in Article 5 of Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) in addressing sexist humor as a form of non-physical sexual violence. The research is motivated by the absence of objective legal parameters in interpreting verbal sexual harassment, causing law enforcement to remain heavily dependent on proving the perpetrator’s mens rea while neglecting the actual impact experienced by victims. This normative juridical research employs statutory, conceptual, case, and comparative approaches using qualitative legal analysis through grammatical, systematic, and teleological interpretation. The findings reveal that sexist humor may be categorized as non-physical sexual harassment when it contains sexual objectification, gender stereotypes, unequal power relations, and causes psychological or social harm to victims. The study identifies that the main weakness of Article 5 UU TPKS lies in the lack of objective standards for interpreting the element of “degrading human dignity,” resulting in inconsistent and subjective law enforcement practices. The novelty of this research lies in the formulation of a victim-impact standard consisting of five objective indicators, namely psychological harm, the reasonable person test, power relations, gender stereotypes, and social environment. This research contributes theoretically to the development of criminal law and victimology through a victim-oriented approach and practically provides interpretative guidance for law enforcement in handling non-physical sexual violence cases more consistently, adaptively, and protectively.   Penelitian ini mengkaji kekaburan frasa “merendahkan harkat dan martabat” dalam Pasal 5 Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) dalam mengklasifikasikan humor seksis sebagai bentuk kekerasan seksual nonfisik. Penelitian ini dilatarbelakangi oleh belum adanya parameter hukum yang objektif dalam menafsirkan pelecehan seksual verbal, sehingga penegakan hukum masih bertumpu pada pembuktian mens rea pelaku dan belum berorientasi pada dampak yang dialami korban. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan, konseptual, kasus, dan perbandingan dengan analisis kualitatif melalui interpretasi gramatikal, sistematis, dan teleologis. Hasil penelitian menunjukkan bahwa humor seksis dapat dikualifikasikan sebagai pelecehan seksual nonfisik apabila mengandung objektifikasi seksual, stereotip gender, relasi kuasa yang timpang, serta menimbulkan dampak psikologis maupun sosial terhadap korban. Penelitian ini menemukan bahwa kelemahan utama Pasal 5 UU TPKS terletak pada tidak adanya parameter objektif dalam menafsirkan unsur “merendahkan harkat dan martabat” sehingga penegakan hukum cenderung subjektif dan inkonsisten. Kebaruan penelitian ini terletak pada perumusan model victim-impact standard melalui lima indikator utama, yaitu dampak psikologis korban, reasonable person test, relasi kuasa, stereotip gender, dan lingkungan sosial sebagai parameter objektif penilaian hukum. Penelitian ini berkontribusi secara teoritis terhadap pengembangan hukum pidana dan viktimologi berbasis perlindungan korban serta secara praktis memberikan pedoman interpretatif bagi aparat penegak hukum dalam menangani kekerasan seksual nonfisik secara lebih konsisten, adaptif, dan responsif terhadap perlindungan martabat korban.

Abstract

The arrangement of the phrase "non-physical sexual act" in Article 5 of Law No. 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) creates legal ambiguity. The use of subjective and unmeasurable parameters such as "improper" in the elucidation section contradicts the principle of legal certainty. This study aims to analyze the phrase's conformity with the lex certa principle and formulate the appropriate normative wording to reflect legal certainty. This legal research utilizes a conceptual approach, statutory approach and a comparative approach, employing prescriptive analysis techniques. The results indicate that the current formulation of Article 5 fails to meet the lex certa standard because the specific behaviors of the criminal act are not contained in the main body of the law but are placed in the elucidation, and the measurement relies on standards that are highly subjective and culturally fluctuating. In conclusion, Article 5 of UU TPKS fails to provide clear boundaries of criminality (foreseeability) for citizens. It is recommended that legislators reconstruct Article 5 by stipulating the specific forms of actions (verbal, gestural, visual, and psychological) directly within the main body of the law and adopting the objective standard of the Reasonable Person Test.
