Abstract

The obligation of living in the family or in the concept of fiqh that the obligation of living is borne by the husband, this is because the male leadership over women therefore the husband is charged with his wife's wages. But over time, the concept of living in fiqh now seems irrelevant. Not a few, it is the wife who plays a role in earning a living in the family. It is clear that the division of roles like this seems to cause inequality in the family. The obligation of living in the family according to KH Husein Muhammad is charged not to the husband, but who can afford him who is obliged. This means that it is not fixed on the husband. His thought that at that time, men were considered as public beings while the wives of domestic beings. In this position lasted for centuries. However, when in context, women are more capable, more productive and husbands make a living. So according to him there is no element of justice, while the husband is in a position of incapacity. This is what underlies his thinking regarding the obligation of living.

Abstract

Abstract One of the acts of domestic violence against people in the household sphere is neglect. Parental neglect is negligence of the child towards the biological mother's father who has a dependency in physical needs (negligence to provide adequate food, clothing, or hygiene), and emotional (negligence to provide care or affection). neglect of parents is included in the form of lawlessness to parents because parents have rights to their children. So that for each perpetrator of neglect parents must be subject to sanctions. This study aims to answer the questions that formulate the problem: "What is the view of Islamic law and positive law in Indonesia on neglect of parents" and "What are the sanctions for perpetrators of neglect of parents according to Islamic law and positive law in Indonesia". This study uses qualitative research, data collected by means of literature (library research) are then analyzed. As for the results of this study: 1) Neglect of parents in Islamic law and in positive law in Indonesia is prohibited, because in Islamic law people who do neglect are sinful, while in positive law in Indonesia neglect is included in violence. 2) Sanctions for perpetrators of neglect of parents in the perspective of Islamic law and positive law in Indonesia are criminal sanctions, but in Islamic law it is called jarimah ta'zir and the sanctions are not only that but there are other sanctions, namely big sins, all deeds are not accepted by Allah SWT, will not enter heaven, hated by Allah SWT. Abstract

Abstract: Discourse about women in the pesantren environment is an exclusive issue to be presented both internally in the pesantren and public. Women with various problems in the pesantren environment are a reflection of the "face" of Indonesian Muslim women. The debate between men and women in the study of feminism is often a sensitive topic so it does not rule out discrimination against women. In line with that, the researcher was moved to participate in exploring and driving the empowerment of women in the pesantren environment through research, namely feminism in the pesantren. More real, at one pesantren in Cirebon, the Buntet boarding school. Using a qualitative approach and using the structural-functional theory the results of the research found the fact that the role of women in the Buntet Cirebon boarding school is still limited to participatory in a functional structural framework. This role still limits the capacity of men and women in the pesantren environment. Whereas the development of feminism values in the Buntet Cirebon boarding school applies formally. In the sense that there has been a formal recognition that women have room to develop their roles and participation in the pesantren environment. While culturally, there are still remnants of the patriarchal culture that are not easily removed from pesantren even though there have been changes little by little. The influence of feminist values on the doctrines and traditions of the pesantren in the Cirebon Buntet Islamic boarding school is the emergence of a more egalitarian understanding of the existence of women. Likewise, with the pesantren tradition, there began to be a shift from traditions that prioritized the role of men from women to the tradition of egalitarianism in looking at women. In the next stage, women are no longer considered as subordinate men but become free and independent persons.Keywords: Women, Feminism, Gender, Pesantren, CirebonAbstrak: Diskursus mengenai perempuan di lingkungan pesantren menjadi persoalan yang eksklusif untuk disajikan baik pada internal pesantren maupun di muka publik. Perempuan dengan berbagai problematikanya dalam lingkungan pesantren merupakan sebuah cerminan “wajah” perempuan Islam Indonesia. Perdebatan antara laki-laki dan perempuan dalam kajian feminisme sering menjadi topik yang sensitif sehingga tidak menutup kemungkinan adanya diskriminasi terhadap perempuan. Sejalan dengan itu, peneliti tergerak untuk ikut mendalami dan menggerakkan pemberdayaan perempuan dalam lingkungan pesantren melalui penelitian yaitu feminisme dalam pesantren. Lebih riilnya, pada salah satu pesantren di Cirebon yaitu pondok pesantren Buntet. Dengan Pendekatan kualitatif dan menggunakan teori struktural-fungsional hasil penelitan menemukan fakta bahwa peranan perempuan di pondok pesantren Buntet Cirebon masih sebatas partisipatoris dalam kerangka struktural fungsional. Peran tersebut masih membatasi antara kapasitas laki-laki dan perempuan di lingkungan pesantren. Sedangkan Pengembangan nilai-nilai feminisme di pondok pesantren Buntet Cirebon berlaku secara formal. Dalam artian telah ada pengakuan secara formal bahwa perempuan mendapatkan ruang untuk mengembangkan peranan dan partisipasinya di lingkungan pesantren. Sedangkan secara kultural, masih terdapat sisa-sisa budaya patriarkhi yang tidak mudah dihilangkan dari pesantren meskipun telah ada perubahan sedikit demi sedikit. Adapun Pengaruh nilai-nilai feminisme terhadap doktrin dan tradisi pesantren di pondok pesantren Buntet Cirebon adalah munculnya pemahaman yang lebih egaliter terhadap eksistensi perempuan. Begitu pula dengan tradisi pesantren, mulai ada pergeseran dari tradisi yang lebih mengutamakan peran laki-laki dari pada perempuan menjadi tradisi egalitarianisme dalam memandang perempuan. Pada tahapan selanjutnya, perempuan tidak lagi dianggap sebagai subordinat laki-laki tetapi menjadi pribadi yang bebas dan mandiri.Kata Kunci: Perempuan, Feminisme, Gender, Pesantren, Cirebon

Abstract

Cases of violence against children are still an increasing phenomenon, especially sexual violence. This is because most children who are victims of sexual violence are reluctant to report. As law enforcers and parents should be able to provide an understanding of sex for children so that children do not fall into the wrong hole. This study aims to find out how law enforcement is and the obstacles faced by law enforcers in cases of sexual violence against children. The method used in this study is a qualitative research by describing a description of the social phenomena associated. This type of research is normative law, legal research conducted by examining library materials or secondary data. The obstacle that is often found by the Cirebon City Police, West Java, is the lack of approach between the police and the community so that people are reluctant to report any events that occur to them or around them. Lack of understanding of the community in terms of the process of reporting every event due to lack of socialization. Parents are often silent and afraid to report because sexual harassment is a disgrace to their family.

Abstract

Dalam keluarga inti terdapat seorang suami sebagai kepala keluarga, seorang istri sebagai pengurus rumah tangga dan juga anak-anak. Namun, di beberapa keluarga hal ini tidak ditemukan apalagi jika peran suami sebagai kepala keluarga telah digantikan oleh istri yang biasanya bertugas mengurus rumah tangga. Peran istri yang menggantikan suami sebagai kepala keluarga merupakan fenomena yang semakin menjamur dewasa ini, sejalan dengan pemikiran kontekstual tentang konsep qiwamah, bahwa sesungguhnya tidak ada aib bagi istri yang menjalankan tugasnya sebagai kepala. Dari keluarga itu. Para pemikir kontemporer juga mengkritisi pemahaman klasik tentang qiwamah yang sering dimaknai sebagai superioritas laki-laki atas perempuan. Penelitian ini menggunakan metode kualitatif, sedangkan dalam hal pengumpulan data peneliti melakukan studi pustaka. Peneliti juga melakukan wawancara dengan beberapa informan perempuan kepala keluarga untuk kemudian dianalisa terhadap konsep qiwamah. Penelitian ini bertujuan untuk mengetahui konsep qiwamah terhadap amalan yang dilakukan oleh kepala keluarga di Desa Astapada Kecamatan Tengah Tani. Hasil penelitian ini menunjukkan bahwa pemahaman dan praktik kepemimpinan keluarga yang dilakukan oleh informan cukup moderat. Namun dalam beberapa kasus masih terdapat kontradiksi antara konsep qiwamah pada tataran ajaran agama dengan praktik di lapangan.

Abstract

Hijab has always been a controversial issue. Some Muslims consider it a mandatory command of God, while others consider it a cultural practice that can change so that the law is not the wearing of hijab itself. This paper examines the meaning of hijab in the Qur'an by using a mechanism commonly referred to as double investigations / double movement, i.e. by examining the context of the first time the hijab was revealed, to whom and how was the social construct of the hijab when the verses of hijab was firstly enforced. The next investigation is the semantic meaning contained in the hijab rhetoric and its sociological implications. In terms of the methodology for this study of hijab, the authors perform a falsification test to find out whether the hijab concept that has existed is still relevant to present reality or not, and to seek the truth that is adapted to the present reality. This paper concludes that the Qur'anic teaching on hijab can adapt to the context of a modern woman as smoothly as it adapted to the early Muslim community 14 centuries ago. This adaptation can be proven if the Qur'anic texts are interpreted by taking into account the social context of Muslim societies with their social changes.

Abstract

Generally ‘iddah only applies to women (wives), with the ultimate goal of knowing the emptiness of wife’s womb. But if indeed the sole purpose of ‘iddah is to know the vacuum of the womb, then it is appropriate that ‘iddah is only for women, for only women have wombs. In this case, it means that ‘iddah only relates to sex (gender) and it is natural. However, the function of ‘iddah is not only to know the cleanliness of a wife’s womb, but from some other wisdom such as the prevention of infectious diseases, the period of reconciliation, upholding marital problems, and also serving a period of mourning when one’s partner dies. The wisdom and purpose of ‘iddah is actually an implementation of the concept of general benefits (al-kulliyat al-khams) namely hifẓ al-dīn (for religion), hifẓ al-nafs (for souls), hifẓ al-‘aql (for minds), hifẓ al-nasl aw al-‘ird (for esteems) dan hifẓ māl (for properties/wealth). By using the method of dalālah al-dalālah, and by taking into account the legal reasoning (‘illah al-ḥukm), it is very logically and legally acceptable that the implementation of ‘iddah is not only for women. The enactment of ‘iddah for women (wives) and men (husbands) is at least more upholding the human dignity and human rights ​​when marriage is concerned. This study uses a philosophical approach, with the aim of trying to find benefit values ​​in syariah law from the concept of ‘iddah, which is based on gender equality.

Abstract

There are a lot of divorces conducted outside the court that occurs in Cangkring Village, Indramayu Regency. Uniquely in this village Lebe (a marriage registrar officer) became a facilitator in matters of divorce including in terms of handling administratively the data of divorced couples without submitting to the Religious Courts. Through a socio-juridical study, it is understandable as a choice for the community in resolving conflicts in marriages. There are many reasons for choosing divorce by Lebe, the individual reasons, such as the geographical location of the village that far from the court, economic factors, early marriage, low human resources, or local socio-cultural conditions that affect a person to do divorce through the Lebe. Based on the theory of social action by Talcott Parsons, the actors who chose divorce through Lebe are considered easier to achieve its goal of divorce. Divorce by Lebe in Cangkring village is intended to curb peace and legal protection for the people who have a very high divorce rate. The community was given convenience because the rules in divorce are not as complicated as the divorce process in the Religious Court, even though it is considered illegal.

Abstract

The issue of menstruation has attracted a lot of attention from fiqh scholars to discuss it, because the scholars have tried to eradicate and abolish the myths surrounding menstruation that have existed for a long time. But if we want to take a closer look at the stipulations, more or less there are still stereotypes in treating menstruating women, although there are still debates in it. The explanation in fiqh still causes ambiguity in the argument why menstruating women are prohibited from fasting, is there still a misogynistic assumption about menstruation in fiqh, so that menstruating women are not allowed to fast? From this point of view, it is necessary to re-examine why menstruating women are prohibited from fasting, because the scholars of fiqh do not provide sufficient studies on various implications arising from the existence of the menstrual cycle, except for a global explanation of all the prohibitions that must be avoided for women menstruating. In the book of fiqh it is explained that fasting is forbidden for menstruating women because fasting is pure worship. This study concludes that by looking at the physical conditions experienced by menstruating women in general, the prohibition of menstruating women from fasting can be understood as people who are sick who get relief to break their fast for the benefit of and maintain their health. So the prohibition of a menstruating woman from fasting is a relief (rukhsah) from God to maintain the stability of her body, and it does not mean a prohibition, considering that the condition of a menstruating woman's body is not the same.

Abstract

The issue of the position of women is a matter that invites much debate among feminists and observers of gender equality. Different perspectives and paradigms of thinking lead to differences of opinion in resolving these problems. This paper examines the position of women in the Islamic marriage system by reflecting it on the marriage system in the pre-Islamic era through a historical approach to understanding the position of women in the marriage environment. History shows that the position of women in marriage in pre-Islamic times has an unfavorable position. This is due to the division of roles according to their respective gender, where in the end it creates inequality in social life. In Arabian society, men are tasked with defending and maintaining all family members, responsible for meeting all the needs of family members. Consequently men monopolize leadership at all levels. Patriarchal culture dominates, so marriage becomes more synonymous with a contract of sale where women are considered to be nothing more than an object being sold. In addition, the killing of female infants is a custom in Arab society and women who are caught in war are usually made into concubines. Islam came by renewing the Arab community’s marriage system. Various innovations introduced by the Koran to improve the dignity of women at that time were only the initial stages, which were in accordance with the patrilineal context. Therefore, patrilineal at that time was a situation which had to be consolidated by Islam, and not institutionalized. An understanding of the pre-Islamic marriage system is important in order to be able to see clearly how the position of women in the Islamic marriage system is actually far more advanced than before.
