Abstract

The issue of menstruation has attracted a lot of attention from fiqh scholars to discuss it, because the scholars have tried to eradicate and abolish the myths surrounding menstruation that have existed for a long time. But if we want to take a closer look at the stipulations, more or less there are still stereotypes in treating menstruating women, although there are still debates in it. The explanation in fiqh still causes ambiguity in the argument why menstruating women are prohibited from fasting, is there still a misogynistic assumption about menstruation in fiqh, so that menstruating women are not allowed to fast? From this point of view, it is necessary to re-examine why menstruating women are prohibited from fasting, because the scholars of fiqh do not provide sufficient studies on various implications arising from the existence of the menstrual cycle, except for a global explanation of all the prohibitions that must be avoided for women menstruating. In the book of fiqh it is explained that fasting is forbidden for menstruating women because fasting is pure worship. This study concludes that by looking at the physical conditions experienced by menstruating women in general, the prohibition of menstruating women from fasting can be understood as people who are sick who get relief to break their fast for the benefit of and maintain their health. So the prohibition of a menstruating woman from fasting is a relief (rukhsah) from God to maintain the stability of her body, and it does not mean a prohibition, considering that the condition of a menstruating woman's body is not the same.

Abstract

The issue of the position of women is a matter that invites much debate among feminists and observers of gender equality. Different perspectives and paradigms of thinking lead to differences of opinion in resolving these problems. This paper examines the position of women in the Islamic marriage system by reflecting it on the marriage system in the pre-Islamic era through a historical approach to understanding the position of women in the marriage environment. History shows that the position of women in marriage in pre-Islamic times has an unfavorable position. This is due to the division of roles according to their respective gender, where in the end it creates inequality in social life. In Arabian society, men are tasked with defending and maintaining all family members, responsible for meeting all the needs of family members. Consequently men monopolize leadership at all levels. Patriarchal culture dominates, so marriage becomes more synonymous with a contract of sale where women are considered to be nothing more than an object being sold. In addition, the killing of female infants is a custom in Arab society and women who are caught in war are usually made into concubines. Islam came by renewing the Arab community’s marriage system. Various innovations introduced by the Koran to improve the dignity of women at that time were only the initial stages, which were in accordance with the patrilineal context. Therefore, patrilineal at that time was a situation which had to be consolidated by Islam, and not institutionalized. An understanding of the pre-Islamic marriage system is important in order to be able to see clearly how the position of women in the Islamic marriage system is actually far more advanced than before.

Abstract

In the development of KLA in Indonesia, there has not been a single region in West Java Province that has won the title of child-friendly regency/city. Cirebon Regency itself has succeeded in achieving the title of Child-Friendly City (KLA) in the Primary category in 2015. This study aims to determine the prospects and challenges of the Cirebon Regency towards a Child-Friendly Regency with a better grade. The research approach used is a type of qualitative descriptive research with data collection methods in-depth interviews, data processed through SWOT analysis. The results of the study show a combination of strategies with the highest priority, namely Strength – Opportunity (SO), followed by Weakness – Opportunity (WO), then Strength – Threat (ST), and Weakness – Threat (WT). With an interpretation that the intended strategy is how to maximize strength and opportunities to support the running of child-friendly regional action plans in the Cirebon Regency.

Abstract

Bajapuik refers to a customary engagement (khiṭbah) of the Minangkabau Pariaman community, where the prospective bride’s family gives a certain amount of money (japuik) to the groom’s family prior to a marriage. Islamic law allows a person to give a certain amount of money or gifts in the process of engagement. However, when the engagement is revoked and the marriage fails, the status of the money given during the engagement has been much contested. This study aims to explore and understand the positive relationship between Islamic law in the bajapuik tradition and local traditions. This study focuses on the legal aspects of engagement in the bajapuik tradition viewed from Islamic law and gender analysis. A descriptive qualitative approach was adopted with the primary data obtained through interviews. Data analysis was carried out using a legal approach, a sociological approach, and a philosophical approach. This study concludes that the bajapuik tradition depicts women as having a higher position than men. For the Pariaman community in Cirebon, the annulment of an engagement (khiṭbah) is a disgrace to tradition. An engagement is considered as a legally binding contract. In other words, customary provisions have coercive power to bounded communities. If an engagement is revoked without a valid reason, the responsible person can be sued for breaking the contract with certain compensations. Morevover, when a dispute occurs over property or finances, Minangkabau customary law allows the aggrieved party to take action against the khiṭbah violators in the form of returning property or money.

Abstract

Dalam perkembangan zaman, berbagai macam permasalahan semakin bertambah, tidak terkecali permasalahan dalam bidang hukum keluarga. Walaupun hukum perkawinan telah diatur oleh UU. Perkawinan dan juga Kompilasi Hukum Islam, namun masih saja terdapat praktik menyimpang yang terjadi pada masyarakat. Salah satunya adalah hubungan seksual sedarah (incest) yang terjadi di Kampung Kriyan Desa Pegambiran Kecamatan Lemahwungkuk Kota Cirebon. Hal ini sangat menarik untuk dikaji lebih dalam mengenai tinjuan hukum Islam dan hukum positif. Penelitian ini menggunakan metode penelitian kualitatif, data diperoleh melalui wawancara, observasi dan dokumentasi yang selanjutnya dianalisis dengan metode deskriptif analisis. Dari penelitian ini dapat disimpulkan bahwa dalam hukum Islam, incest dipandang sebagai perbuatan zina. Menurut hukum positif, incest dipandang sebagai pemerkosaan jika terdapat unsur paksaan atau ada salah satu pihak yang dirugikan. Faktor incest disebabkan oleh rendahnya pendidikan dan ekonomi, tempat tinggal yang terlalu sempit, kelainan psikologi dan juga pengangguran. Upaya penanggulangan yang dilakukan oleh masyarakat berupa tindak lanjut jalur hukum kepada pelaku incest dan juga penyuluhan dari Pemerintah Daerah (PEMDA) Kota Cirebon.  Kata kunci: Hubugan Sedarah, Hukum Islam dan Hukum Positif

Abstract

The purpose of this study is to describe the results of Yudian Wahyudi's thoughts on the renewal of Islamic law in Indonesia. This type of research is library research using a qualitative descriptive approach to describe the current phenomenon. This analysis seeks to see the socio-cultural background, the context of the readers and the text of books and articles about Yudian Wahyudi's thoughts related to the problems to be studied. The results of this study explain that Islamic law reform underwent a radical transformation with the emergence of several calls about Indonesian fiqh and Indonesian schools of thought by scholars such as Ash Shiddieqy and Hazairin who criticized puritans who often echoed Arabization of fiqh, both promoting the richness of Indonesian culture and traditions as a valid source. for the implementation of the law by trying to modernize the application of Islamic law with the help of modern knowledge and science. Yudian Wahyudi's thinking in the renewal of Islamic law offers an applicative methodological approach through the concept of returning to the Qur'an and Hadith, the concept of fiqh and maqashid sharia by trying to dialogue between sharia texts, and empirical 'urf, both of which complement each other. Different from the previous figure, the Islamic renewal proposed by Yudian Wahyudi is not only a theoretical offer but can also be implemented practically.

Abstract

Artikel ini hendak membahas gagasan dan upaya para pemikir Muslim dalam mereinterpretasi ajaran Islam dalam merespon isu-isu global seperti itu tentang HAM. Reinterpretasi itu penting guna memberikan solusi dan alternatif pemikiran dengan menawarkan berbagai model reinterpretasi terhadap syariah, sehingga syariah dapat merespon isu-isu tentang HAM. Isu Hak Asasi Manusia (HAM) merupakan hasil dari kemajuan peradaban manusia kontemporer untuk hidup dan bergaul antar sesamanya dengan semangat kesetaraan serta sikap saling menghargai dan menghormati, apapun suku, bangsa, agama dan warna kulitnya. Salah satu pemikir yang dibahas adalah Mahmoud Mohamed Taha. Metode untuk memahami pemikiran Taha menggunakan pendekatan normatif dan pendekatan filosofis. Dua pendekatan tersebut dapat secara luas menelusuri doktrin dan hasil interpretasi Mahmoud terhadap ayat-ayat Al-Qur`an yang menegaskan bahwa Islam sangat menjunjung dan menghormati prinsip-prinsip HAM.

Abstract

Penelitian ini bertujuan untuk menjawab dan memberikan deskripsi tentang pandangan ulama Cirebon terhadap Inpres nomor 9 Tahun 2000 tentang Pengarusutamaan Gender (PUG), pandangan ulama Cirebon terhadap Rancangan Undang-Undang Keadilan dan Kesetaraan Gender (RUU KKG), dan pengaruh pandangan ulama Cirebon terhadap Inpres nomor 9 Tahun 2000 tentang Pengarusutamaan Gender (PUG) dan Rancangan Undang-Undang Keadilan dan Kesetaraan Gender (RUU KKG) terhadap pandangan ulama mengenai implementasi keadilan dan kesetaraan gender di Indonesia Penelitian ini menggunakan pendekatan kualitatif dan kuantitatif yang bersifat pengaruh berganda, yaitu untuk mengetahui adanya pengaruh dari dua variabel independen terhadap satu variabel dependen. Subjek dalam penelitian ini adalah para ulama, kyai dan pengurus ORMAS yang ada di wilayah Cirebon. Data kualitatif dalam penelitian ini dikumpulkan dengan menggunakan metode wawancara kebeberapa ulama, pengurus Pondok Pesantren, pengurus ORMAS Islam dan para tokoh ulama yang ada di wilayah Cirebon. Sedangkan data kuantitatif penelitian ini dengan menggunakan pengujian korelasional dan regresi, dengan menyebar angket kepada organisasi kemasyarakatan (Ormas) NU, Muhammdiyah, Persatuan Umat Islam, Fron Pembela Islam dan Al Irsyad degan mengambil sampel secara acak dari perwakilan masing-masing pengurus organisasi sebanyak 10 angket. Hasil penelitian ini menunjukkan bahwa: pertama, pandangan ulama yang menyetujui gender sebagai pembedaan peran dan tanggung jawab laki-laki dan perempuan, ulama yang belum tegas dalam menyatakan pandangannya, antara menolak dan menerima dan ulama yang menyatakan bahwa ide kesetaraan gender bertentangan dengan Islam. Kedua, pandangan ulama Cirebon terhadap Rancangan Undang-Undang Keadilan dan Kesetaraan Gender (RUU KKG) terbagi menjadi tiga kelompok Pertama, memandang bahwa RUU KKG harus segera disahkan. Kedua, ulama yang tidak terlihat antara menolak atau menerima RUU KKG. Ketiga, ulama yang dengan tegas menolak RUU KKG karena dipandang akan berdampak negatif bagi masyarakat Indonesia. Ketiga, pengaruh pandangan ulama Cirebon terhadap Inpres nomor 9 Tahun 2000 tentang Pengarusutamaan Gender (PUG) dan Rancangan Undang-Undang Keadilan dan Kesetaraan Gender (RUU KKG) secara kualitatif maupun secara kuantitatif juga menunjukkan bahwa pandangan Pengarusutamaangender (PUG) dan RUU KKG memiliki pengaruh terhadap pandangan mengenai implementasi Keadilan dan Kesetaraan Gender KKG. Hal ini menjukkan bahwa aturan yang tepat dan undang-undang yang jelas serta pandangan yang komprehensip mengenai gender dari ulama akan sangat efektif terhadap pemahaman kesadaran gender. Khusus mengenai persepsi ulama mengenai cara memandang gender memiliki kecenderungan yang tinggi dalam menkomunikasikan kesadaran gender pada masyarakat.

Abstract

During the COVID-19 pandemic, divorce in Praya, Central Lombok, increased. Based on this, this study aims to identify how high divorce cases occur during the pandemic in Praya, Central Lombok. Researchers use a qualitative approach. This research is field research; researchers go directly into the field to conduct interviews and collect documents, which research is carried out at the Praya Religious Court. The result of this study is the Praya Religious Court annual report for 2021. The biggest reasons for divorce are economical 59%, disputes 23%, domestic violence 10%, and 5% for infidelity cases. The Praya Religious Court's 2022 annual report shows that the biggest reasons for divorce are 60% and 40% economic disputes, 20% domestic violence, and 10% infidelity cases. In households, daily disputes occur that are caused by several factors. According to Mrs A, the Case Manager, it was explained that the increase in divorces from 2021 to 2022 touched 100,393 people, an increase of 50% compared to 2021 with 78,724 people.
