Abstract

Sejumlah kasus kekerasan seksual terhadap anak di Bali telah mengejutkan masyarakat. Tulisan ini bertujuan untuk melakukan pengkajian dan mengkritisi secara mendalam faktor-faktor penyebab terjadinya kekerasan seksual terhadapanak dan untuk menganalisis bentuk perlindungan hukum yang diberikan terhadap anak sebagai korban kekerasan seksual di Provinsi Bali. Artikel ini merupakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan danpendekatan fakta. Tulisan ini menyimpulkan bahwa terdapat tiga faktor penyebab terjadinya kekerasan seksual terhadap anak apabila dilihat dari sisi pelaku dan empat faktor lainnya dari perspektif korban. Selain itu, tulisan ini juga menyimpulkanbahwa perlindungan hukum bagi anak yang menjadi korban kekerasan seksual di Provinsi Bali dilakukan oleh Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak.

Abstract

The enactment of Presidential Regulation Number 20 of 2018 concerning the Use of Foreign Workers and Job Creation Law has triggered pros and cons. On the one hand, these arrangements define as advanced approach to increase investment in Indonesia and assist transfer knowledge that can be obtained from equipped foreign workers with their skills and technologies. There are substantial arrangements to ease foreign workers access under growth investment idea, facilitating business licensing through deregulation, and scrutinize legal provisions for foreign workers to be able to work in Indonesia. This article was aimed to analyze, and finding analysis of policy dynamics regulating the use of Foreign Workers in Indonesia, as well as the gaps of the use of Foreign Workers arrangement in the Job Creation Law. This article was normative legal research using statutory approach, and conceptual approach. The study indicated that the dynamics of regulation in various legal policies on the use of Foreign Workers especially between Law on Employment and Law on Job Creation, even though there are fields and types of work that are also required to prioritize Indonesian Workers, along with the use of Foreign Workers to a certain time limit to adopt Foreign Workers skills. The prospective policy direction through this article is expected to be more selective policy in the context of utilization of foreign workers, state protection, and adequate improvement quality/standard of competence for Indonesian workers.

Abstract

Effectiveness of Industrial Design registration provision based on Act No. 31, 2000 concerning IndustrialDesign in Bali has not been fully enforced. It was caused by some factors such as: lack of understanding ofIndustrial Design in societies and some of them do not know the existence of this regulation which regulate thefirst file system, some societies who has not developed the need to have laws on Industrial Design as well as thepresence of communal cultures of the Indonesian people, which is completely different from the basic concept ofindividual right protection of IPR, which based on legal cultures of west countries have contributed to thedifficulties in fully implementing IPR. The other factors caused by lack of awareness Industrial Design protectionboth the substance and the existence of this provision among law enforcers and the inadequate infrastructurerequired to administer IPR.. The concept protection of Industrial Design protect designer / owner or recipient ofthe right who register their right based on first to file system. Through this system the designer would have anexclusive rights in the form of economic and moral right. The legal consequence of the inefficiency in enforcingarticle 10 jo article 12 of the Act No. 31 of 2000 concerning Industrial Design , which regulate first to file, mightresult in the failure of the designer to secure their right over their designs, whereas the legal protection shall be goto the person who registers and have evident in form of certificate registration.

Abstract

ABSTRACT The team lecturers from Faculty of Law socialized Business law, Nationality law, Criminal law and Adat law at the Legal Clinic Radio Polda “SUARA JANGER” on July 2007. This community services used interactive method by using telephone, SMS and e-mail. The all session of interactive legal consultation were well done and got positive response from the communities as proven by the receipt of 4 to 5 calls within a one hour interactive duration conducted once a week. Through this services community and legal consultation several legal issues such as industrial design, children’s protection who were born from mix marriage, good governance, money laundering, terrorism, and polygamy were discussed and the further legal solutions were advised by the team advisors refer to the Act No. 31 year 2000, the Act No. 12 year 2006, and the Act No.15 year 2003.

Abstract

The purpose of this study is to find out the position of the Constitutional Court which later? an understanding of the politic of International agreement law adopted by the Republic of Indonesia. This can be reviewed from the legal considerations that underlying the Constitutional Court Decision. It is a legal research that examines the laws and regulation related to Constitutional Court through several stages: elaborate textual studies, completing textual studies, analyzing legal materials and determine conclusions. The study shows that International and legalized agreement that has not been ratified are placed as part of national law and are used as a reference to enrich the reasoning horizon in interpreting the constitution. Law on the ratification of the International Agreement containing norms which are attachments and an inseparable part of the law, which in its existence as a law constitutes the authority of the Constitutional Court to examine its constitutionality. In this context, the constitutional Court embraced the politic law of monism with the primate of national law and the Constitutional Court embraced the politic law of dualism when examining the constitutionality of the law concerning the ratification of the International Agreement-in terms of subject matter. Tujuan dari kajian ini adalah untuk mengetahui sikap Mahkamah Konstitusi yang nantinya akan memberikan pemahaman tentang politik hukum Perjanjian Internasional yang dianut Negara Republik Indonesia. Hal ini dapat ditinjau dari pertimbangan hukum yang mendasari amar Putusan Mahkamah Konstitusi. Artikel ini merupakan suatu penelitian hukum yang mengkaji Peraturan Perundang-undangan dan Putusan Mahkamah Konstitusi yang ada dengan langkah-langkah melakukan studi tekstual, melengkapi studi tekstual serta melakukan analisis terhadap bahan hukum yang terkumpul dan menarik kesimpulan. Hasil penelitian menunjukan bahwa Perjanjian Internasional yang telah disahkan maupun yang belum disahkan ditempatkan sebagai bagian dari hukum nasional dan dijadikan rujukan guna memperkaya cakrawala penalaran dalam menafsirkan Undang-Undang dasar. Undang-Undang tentang pengesahan Perjanjian internasional memuat norma yang merupakan lampiran dan bagian yang tidak terpisahkan dari Undang-Undang bersangkutan, yang dalam keberadaannya sebagai Undang-Undang merupakan kewenangan Mahkamah Konstitusi untuk menguji konstitusionalitasnya. Dalam konteks ini Mahkamah Konstitusi menganut politik hukum monisme dengan primat hukum nasional dan Mahkamah Konstitusi menganut politik hukum dualisme saat menguji konstitusionalitas Undang-Undang tentang pengesahan Perjanjian Internasional dalam hal menyangkut pokok perkaranya.

Abstract

The massive support to develop a new category of Indonesian Diaspora that is called as a “special friends of Indonesia’ (Indonesianist) seems would remain become a domain of academic and public debates. The existing Indonesian law and regulations, even though have been amended many times and during the debates on law creating process have tried to adopt the model of dual citizenship, do not affirm this new category. Despite this current legal situation, this article argues that this special friend can be cultivated from the international education section. This paper is academic research in the field of social sciences, especially international relations that analyzes statements, views, and opinion by government officers, diaspora, and Indonesianists as well as some law and regulations. The research suggests that the concept of Special Friends of Indonesia (Indonesianists) is too broad and poses a challenge for the conceptual and legal definition. Fully considering the high contribution of Indonesianist, nurturing of future Indonesianist - especially through student mobility programs - is best to take place in the situation allowing for exposure and socialization process to be built internally.

Abstract

The purpose of the service is to be able to compile awig-awig, the regulations used in the Subak organization that are the foundation of sustainable environmental development. It is important to be carried out in the context of spatial planning around Subak, therefore it is maintained and there is no easy change of land function that affects the existence of Subak. This service activity was carried out using lecture, discussion and question and answer methods when taking an inventory of the problems faced by Subak Pulagan Gianyar and then making awig-awig arrangements related to spatial planning around Subak. The target focus in the management of Subak is the apparatus of Subak officers and the members of Subak Pulagan Gianyar so that it is expected to have guidelines for the functional customary law community in Bali in determining the rules within the Subak organization. The realization of the service was carried out through reviewing the act of compiling the substance of awig-awig Subak, mainly in the palemahan (environment) section and was warmly welcomed by Subak Pulagan officers. This was responded well because it was realized by the local members of subak that preserving this world’s cultural heritage is the foundation for maintaining their natural environment in a sustainable manner.

Abstract

ABSTRAK Study ini memiliki tujuan untuk meneliti dan menganalisis relevansi Pemilihan kepala daerah secara langsung dengan Pasal 22E Undang-Undang Dasar Tahun 1945 (UUD 1945) tentang pemilihan umum (pemilu), hal ini dirasa perlu karena masih banyak pro dan kontra mengenai pelaksanaan pilkada secara langsung, dikarenakan pilkada tidak termasuk bagian dari penjelasan pemilu sesuai amanat Pasal 22E. Penelitian ini menggunakan metode hukum yuridis normatif dan mempergunakan tiga pendekatan yaitu pendekatan perundang-undang, pendekekatan konseptual, dan pendekatan komparatif. Hasil dari studi ini menunjukan bahwasannya frasa “dipilih secara demokratis” mempunyai makna dapat dipilih langsung oleh rakyat ataupun bisa melalui perwakilan yang harus menyesuaikan dengan situasi dan kondisi masing-masing daerahny sehingga relevansi pilkada langsung dengan UUD 1945 ialah pilkada tidak termasuk kedalam rezim pemilu sebagai mana diatur dalam Pasal 22E UUD 1945, namun lebih mengarah pada penghormatan terhadap pengimplementasian Pasal 18 UUD 1945, yang dalam praktiknya bisa tidak sama dengan pemilu seperti yang diatur pada Pasal 22E UUD 1945. Kata kunci: Demokrasi, Kepala Daerah, Pemilihan Umum. ABSTRACT The prupose of this study is to examine and analyze the relevance of direct regional head elections to article 22E of UUD 1945 constitution regarding election, this is deemend necessary since there are still many pros and cons regarding the direct implementation of regional election, because the regional election are not included as part of the elction explanation as mandated by article 22E. The research methode that is used in this study is normative legal research using a statute approach, a conceptual approach, and a comparative approach. The result of this study shows that the phrase “democraticly elected” has the meaning of being directly elected by the people or through the representatives who must adapt to the situations and conditionsof each region. So that the relevance of direct regional head elections to UUD 1945 is that the direct regional head elections are not included in the general election regime as regulated in Article 22E of UUD 1945, but rather leads to respect for the implementation of Article 18 of UUD 1945, which in practice can be different from the general elections as stipulated in Article 22E UUD NRI 1945. Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui peraturan pengelolaan sampah berbasis sumber di Bali dan kesesuaiannya dengan Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah. Metode yang dipakai adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan komparatif. Tulisan ini menghasilkan bahwa Pergub Bali No. 47 Tahun 2019 belum memuat materi muatan rancangan perda tentang pengelolaan sampah secara komprehensif dan jika dibandingkan dengan perintah tegas pada UU No. 18 Tahun 2008 belum selaras. Pergub Bali No.47 Tahun 2019 sebagai peraturan daerah sejatinya harus selaras dengan Undang-Undang No.18 Tahun 2008 sesuai dengan asas hirarki dalam Undang-Undang No. 12 Tahun 2011 tentang pembentukan peraturan perundang-undangan. Kata Kunci: Harmonisasi, Peraturan Perundang-Undangan, Pengelolaan Sampah. ABSTRACT This study aims to determine the source-based waste management regulations in Bali and their compliance with Law Number 18 of 2008 concerning Waste Management. The method used is normative legal research with a statutory and comparative approach. This paper results that the Governor of Bali Regulation No. 47 of 2019 has not yet contained the material for the draft regional regulation on waste management comprehensively and when compared with the firm orders in Law no. 18 of 2008 has not been aligned. Bali Governor Regulation No. 47 of 2019 as a regional regulation should be in line with Law No. 18 of 2008 under the principle of hierarchy in Law no. 12 of 2011 concerning the formation of laws and regulations Key Words: Harmonization, Legislation, Waste Management.

Abstract

Decision of the Supreme Court Number 46 P/HUM/2018 regarding judicial review which invalidates the provisions of the Article 4 paragraph (3) of the General Election Commission Regulation Number 20 Year 2018 which states the prohibition of including candidates who are ex-convicts of drug cases, sexual crimes and corruption. However, the enactment of General Election Commission Regulation triggered pros and cons. On the one hand, the substance of the regulation regulates the prohibition and revoking the political rights of ex-convicted and contrary with the higher regulations, because it regulates the contrary substance with higher regulation. But on the other hand, this is a progressive step which is the hope for parties to shown the good image and free corruption legislative bodies. This paper raises 2 (two) problem formulations are (1) how is the regulation through the Election Commission Regulation related to political rights of convicted corruption cases and (2) how is the justification of the Human Rights dimension of the political rights of ex-corruption convicted. The purpose of this paper is to examine and find out how the General Election Commission Regulation Number 20 Year 2018 regulates the political rights of ex-corruption convicted as well as legal implications of the Supreme Court Decision Number 46 P/HUM/2018 towards General Election Commission Regulation Number 20 Year 2018. This study specifically uses normative legal method through library research and analyzed systematization into a descriptive analytical paper. The results showed that the enactment of the Election Commission Regulation that normalized the prohibition of passive political rights for ex-convicts contained several weaknesses and ultimately annulled by the Supreme Court’s Decision. Viewed from the perspective of Human Rights related to political-rights, in its application, there must be a limitation in the time of the revocation of rights.
