Abstract

The formation of hadith text is a response to the existence of past realities, both micro and macro, so that the language contained in the text follows the context at the time of the formation of the text. The development of language and dynamics of life is increasingly significant, of course the text is not able to reach comprehensively when only based on textualist and dogmatic understanding. Because, the events behind the formation of the text are different from the reality that occurs at this time. Therefore, it takes a method that can break the freeze of the text to gain comprehensive and contextual meaning to the demands of the times. In this study, using qualitative method to analyze in the form of verbal narrative based on data facts that are rationalizm. Muhammad Arkoun as a neo-modernist thinker tried to interpret the concept of hermeneutics as a solution in solving the freeze of the text. The hermeneutic mindset of Arkoun focuses on philosophy as a dynamic thinking tool that is not limited to space and time. According to him, hermeneutics are inseparable from applied Islamology, semiotics and historical socio- The study of a diachronic and synchronic language becomes the main state of studying a text, resulting in a comprehensive thinking with critical reason based on phenomenological analysis.

Abstract

Abstract: The role of marriage registration (recording) is important particularly in maintaining and protecting the rights of individuals to prove the marriage implementation. Registration of marriage, therefore, is governed by various related rules or regulation. Unfortunately, the registration of marriage is only as a normative one. Meanwhile, most Muslims do not obey the law of marriages arranged by the state because the law is ambiguous, having multi interpretations and difficult to implement. In fact, there are many negative effects emerging from marriage under the hands such as not getting the marriage certificate, and husband, wife and their children not being able to perform civil legal action against the genetic father who has left them. Therefore, marriage under the hand must be prevented with preventive, curative and anticipative measures. In order to produce a law that can respond to the changing demands of time, place, conditions and welfare of the spouses, the maqa>s}id al - shari>ah approach (the purpose of the law) is eligible to apply . Therefore, the government should change the law of registration of marriages that are not relevant to the state of society so that society will feel suitable with the legal registration of the marriage.

Abstract

One of the crucial issues in marriage is marriage without a guardian which is a problem of khilafiyyah ijtihadiyyah among the ulama' madhhab. One of the verses that is used as a foothold by each party is QS. Al-Baqarah: 232 with different interpretations. This paper attempts to conduct a critical study of the interpretation of the verse regarding the legality of marriage without a guardian. The results of the study conducted show that the difference in the scholars' interpretation of the verse is in the khit}a>b contained in the verse. According to the majority of scholars, the verse is intended for female guardians so that the verse indicates that marriage without a guardian is not valid. Meanwhile, according to the Hanafi school of thought, the verse is aimed at a husband who prevents his ex-wife from marrying someone else so that the verse shows a woman can marry herself without a guardian. Although this is a khilafiyyah problem, marriage without a guardian has the potential to cause a marriage based on consensual only which needs to be avoided.

Abstract

Islam merupakan agama yang menjunjung tinggi nilai-nilai keadilan yang penggambarannya banyak tercantum dalam ayat al-Qur’an dengan berbagai bentuk dan variasinya. Meskipun terdengar sepele, sikap adil sebenarnya merupakan hal yang tidak mudah dilakukan, terbukti dengan banyaknya pelanggaran terhadap hak diri sendiri maupun orang lain. Penelitian ini menggunakan metode maudhui yang mengumpulkan ayat-ayat yang terindikasi memuat nilai-nilai keadilan, yakni pada Q. S. Al-Nisa ayat 2,3, dan 11, dengan menggunakan pendekatan asbab al-nuzul ayat beserta relevansinya dengan penafsiran para ulama. Berdasarkan hal itu, maka penelitian ini menghasilkan suatu pemahaman yang erat kaitannya dengan sebab turun ayat tentang nilai-nilai keadilan yang tersirat pada ketiga ayat tersebut. Di antaranya yaitu berupa suatu keharusan bagi seseorang untuk bisa memenuhi hak-hak orang lain yang berada di bawah tanggungjawabnya. Ketiga ayat tersebut secara khusus menuntut sikap adil bagi orang-orang yang menjadi wali bagi anak yatim dan bagi mereka yang menikahi lebih dari seorang perempuan, sekaligus sebagai tuntutan untuk berlaku adil dalam menyikapi harta warisan. Beberapa hal tersebut dalam penelitian ini memiliki keterkaitan dengan masa-masa turunya ayat itu, terutama pada masa sebelum Islam datang. Hal ini membuktikan bahwa penafsiran suatu ayat sangat kental kaitannya dengan asbab al-nuzul ayat, yang sekaligus menjadi solusi atas kondisi yang terjadi pada saat itu.

Abstract

Artikel yang berjudul Positivisasi Hukum Islam di Indonesia Pada Masa Penjajahan Hingga Masa Orde Baru ini membahas perkembangan positivisasi hukum Islam di Indonesia dan menganalisis kesesuaiannya dengan pembangunan hukum nasional di Indonesia pada masa penjajahan Belanda dan Jepang hingga masa Orde Baru di bawah kepemimpinan Presiden Soeharto. Setelah dilakukan kajian, penulis berkesimpulan bahwa positivisasi hukum Islam di Indonesia pada masa-masa tersebut mengalami pasang surut sesuai dengan kebijakan politik dan hukum yang diterapkan. Pada masa penjajahan, hukum Islam diakui sebagai hukum positif dengan diterapkannya teori receptio in complexu yang kemudian ditentang dengan teori receptie. Pada masa Orde Lama, posisi hukum Islam suram. Kemudian posisi hukum Islam mulai membaik pada masa Orde Baru melalui lahirnya Undang-Undang tentang Perkawinan meskipun mengalami banyak tantangan karena kondisi pluralitas bangsa Indonesia.

Abstract

This article attempts to analyze the syarh al-hadith method of classical and contemporary scholars and the hermeneutic method of Islamic scholars in explaining (interpreting) the Prophet's hadith. Because most scholars who write about the interpretation of hadith with a hermeneutics approach, instead use references in classical hadith syarh. Therefore, the author wants to examine the relevance of hermeneutical methods or theories in the study of syarh al-hadith. Is hermeneutics appropriate to be applied as a single foundation in the interpretation of hadith or is it only a complement to the syarh al-hadith? This article concludes after trying to compare the interpretations of the hadith commanding to fight humans until they say there is no god but Allah using the two approaches or methods above, and it turns out that both can go hand in hand and complement each other. Moreover, the hermeneutics approach is more about the meaning of the context of the hadith at the beginning of its emergence to the present, which requires an understanding of the meaning of the hadith according to its originator at the time of the background of the hadith (asbab wurud) and the history of this can be known through the syarah hadith method, especially, syarah hadith with other narrations or through the words of friends who lived contemporaries with the Prophet (originator). Besides that, the study of the original language of the text is also used as a reference in this case, which is part of the syarah of hadith as well.   Artikel ini mencoba menganalisis metode syarah hadis ulama klasik dan kontemporer dan metode hermeneutika cendekiawan Islam dalam menjelaskan (menginterpretasi) hadis Nabi. Karena, kebanyakan cendekiawan yang menulis mengenai interpretasi hadis dengan pendekatan hermeneutika, justru menggunakan rujukan dalam syarah hadis klasik. Oleh karena itu, penulis ingin meneliti relevansi metode atau teori hermeneutika dalam kajian syarh al-hadits. Apakah hermeneutika layak diterapkan sebagai pondasi tunggal dalam interpretasi hadis ataukah hanya menjadi pelengkap syarh al-hadits? Artikel ini mengambil kesimpulan setelah mencoba membandingkan penafsiran terhadap hadis perintah memerangi manusia sampai mereka mengucapkan tiada Tuhan selain Allah dengan menggunakan dua pendekatan atau metode di atas.  Ternyata keduanya bisa berjalan beriringan dan saling melengkapi. Terlebih pendekatan hermeneutika lebih kepada pemaknaan konteks hadis di awal munculnya ke masa kini, yang mana hal itu memerlukan pemahaman akan makna hadis menurut pencetusnya di masa lahirnya hadis (asbab wurud) tersebut dan histori mengenai hal ini dapat diketahui melalui metode syarah hadis. Terutama syarah hadis dengan riwayat lainnya atau melalui perkataan Sahabat yang hidup sezaman dengan Nabi (pencetus). Di samping itu kajian bahasa asli teks juga dijadikan rujukan dalam hal ini, yang merupakan bagian dari syarah hadis juga.

Abstract

Hadith studies in Indonesia have lagged despite hadith being the second source of Islam. The question is how Muslim scholars and Islamic social organizations have contributed to developing hadith studies in Indonesia. To answer this, library research with an analytical approach was conducted to discover a description of their contributions. Data was gathered through a literature study, analyzing references written by Muslim scholars in Indonesia using inductive and content analysis. The result shows that the lag in hadith studies is due to the lack of attention from Muslim scholars and the limited resources of hadith. However, Hadith studies began to be experienced in the second half of the 19th Century, growing to the early 20th Century. This was, among others, driven by the purification of Islamic teachings and the critique of Orientalists who undermined hadith. In this context, Muslim scholars and Islamic social organizations in Indonesia have significantly contributed to the development of hadith studies, mainly through providing literature on hadith and its sciences. However, their approaches differ. Muslim scholars interpret hadith textually and contextually, while Islamic social organizations, except NU, primarily use a textual approach. NU, in contrast, applies both approaches in its deliberations.

Abstract

This research explains Fazlur Rahman’s innovative approach to delineating the distinction between Hadith and Sunnah and its implications for the reconstruction of Islamic science. Rahman identified historical ambiguities in the usage of Hadith and Sunnah within Islamic scholarship, advocating for a clearer differentiation between textual records (Hadith) and the practical applications (Sunnah) of Prophet Muhammad’s teachings. By employing qualitative analysis of primary texts authored by Rahman and supplemented by secondary literature, this study examines Rahman’s nuanced perspectives on these concepts. It critically assesses Rahman’s contributions, emphasizing his endeavor to harmonize traditional Islamic teachings with contemporary scientific paradigms. Rahman’s scholarly approach not only enriches the understanding of Islamic sciences but also underscores the vital integration of Islamic principles with modern knowledge frameworks. His intellectual legacy stands as a crucial link between traditional Islamic scholarship and contemporary critical inquiry, advocating for a nuanced approach that addresses the multifaceted challenges confronting Muslim societies today. Penelitian ini menjelaskan pendekatan inovatif Fazlur Rahman dalam menggambarkan perbedaan antara Hadis dan Sunnah serta implikasinya terhadap rekonstruksi ilmu pengetahuan Islam. Rahman mengidentifikasi ambiguitas historis dalam penggunaan Hadis dan Sunnah dalam kesarjanaan Islam, mengadvokasi pembedaan yang lebih jelas antara catatan tekstual (Hadis) dan aplikasi praktis (Sunnah) ajaran Nabi Muhammad. Dengan menggunakan analisis kualitatif terhadap teks-teks primer yang ditulis oleh Rahman dan dilengkapi dengan literatur sekunder, penelitian ini mengkaji perspektif Rahman yang bernuansa pada konsep-konsep ini. Studi ini secara kritis menilai kontribusi Rahman, menekankan upayanya untuk menyelaraskan ajaran-ajaran Islam tradisional dengan paradigma ilmiah kontemporer. Pendekatan ilmiah Rahman tidak hanya memperkaya pemahaman ilmu-ilmu keislaman, tetapi juga menggarisbawahi pentingnya integrasi prinsip-prinsip Islam dengan kerangka kerja pengetahuan modern. Warisan intelektualnya menjadi penghubung penting antara kesarjanaan Islam tradisional dan penyelidikan kritis kontemporer, mengadvokasi pendekatan bernuansa yang membahas berbagai tantangan yang dihadapi masyarakat Muslim saat ini.

Abstract

The transformation of higher education, particularly in Islamic studies, necessitates innovation in learning and research. This study explores the role of digital tools in Qur'anic and Tafsir research, analyzing their impact on efficiency, accuracy, and interdisciplinary collaboration. Using a qualitative case study approach, data were collected through observation, interviews, and documentation, involving rectors, faculty leaders, lecturers, students, and IT teams. Findings show that successful digital integration requires strong academic literacy and technology-based methodologies. Tools like corpus analysis software, AI-driven text comparison, and digital manuscripts enhance precision in analyzing Qur'anic texts, reducing processing time and enabling deeper cross-referencing. Compared to traditional methods, digital tools improve accuracy in identifying linguistic patterns and historical interpretations. Additionally, technology fosters interdisciplinary dialogue, connecting Qur'anic studies with linguistics, history, and artificial intelligence. This study underscores the importance of bridging tradition and technology, advocating for structured frameworks to optimize digital tools in Qur'an and Tafsir research. By embracing technological advancements, Islamic studies can remain relevant, innovative, and better equipped to address contemporary academic and societal challenges.

Abstract

Jacques Derrida’s hermeneutical thought offers an innovative a methodological framework for interpreting the hadith of the Prophet Muhammad. Through the lens of deconstruction, Derrida posits that the meaning of texts must always be questioned and revised, thus preventing texts from ever reaching stability or final truth. In the context of the Prophet’s hadith, a deconstructive approach is necessary to open up a more dynamic and contextual space for interpretation. One of its applications is to break the stagnation or rigidity in the interpretation of hadith texts, which are often understood only literally. This study will present Jacques Derrida’s hermeneutical thought and its application in interpreting the hadith of the Prophet Muhammad SAW. The article employs a descriptive-analytical library research study with a hermeneutic approach, examining how Derrida’s hermeneutical thought can be applied to understanding the hadith texts. This writing is expected to expand the dimensions and horizons of interpretation with a critical and contextual perspective. For example, the prophetic tradition regarding the origin of woman from man’s rib, often understood literally, can be deconstructed to reveal its deeper symbolic meaning.
