Abstract

The development of science and technology today is not a reason to remove the provisions about ‘iddah that has been set in the Qur'an and Sunnah. 'Illat law and the purpose of enactment of ‘iddah which has been discussed needs to be reviewed. ‘iddah not only to know the empty uterus of the fetus, self-introspection, condition and period of mourning, but there is a higher purpose, that is belief in Allah and honor the noble covenant at the marriage ceremony. The noble agreement is realized in the ijâb and qabûl between men and women guardians. Consequently, if the marriage breaks up either because of death or divorce, both sides must respect the agreement. They must be equally restricted with the ‘iddah way until the time set by Syar'i, especially for women whose existence is more glorified and also the aim of the law' ‘iddah is for the common good.

Abstract

Children are the responsibility of parents, as long as they are not mature (adult) as their needs are the responsibility of parents, but when they grow up there are limits in both normative and positive laws that allow children to work, in reality many children are already working looking for income under the specified age. The problem is when can children work in both normative and positive law? This research is to be able to clearly describe a rule that applies, so that parents do not employ underage children. This research is a library research, namely a literature review of the views of the scholars and the laws and regulations in Indonesia with a philosophical-sociological approach. From a normative legal perspective, scholars agree that a child who has reached puberty can only carry out his religious obligations, including work, because he is considered an adult, while in Indonesian legislation, a child is said to be an adult when he is 21 years old, so that at that age, the child has an established mind, physically and psychologically.

Abstract

Tolerance plays a pivotal role in fostering positive impacts within society, particularly in Indonesia where Pesantren (Islamic Boarding School), as the oldest educational institutions, shape the character of Santri (students) and instills the essence of tolerance. This article aims to describe and analyze how exemplary leadership by the Kiai (Islamic kiais), the curriculum taught, and the daily activities of students in fostering religious tolerance in Khalaf and Salaf Islamic Boarding Schools. The study was conducted as field research using qualitative descriptive methods, delving into Al-Mujatama’ al-Islami (khalafiyyah), and Arroudhotul Wahidah (salafiyyah) Islamic Boarding Schools. Data were gathered through interviews, observations, and documentation from kiais and student teaching staff. The systematic data analysis involved collection, reduction, display, and conclusion drawing, validated through source triangulation. The research results demonstrate that the kiais at both Islamic Boarding Schools exhibit exceptional leadership by promoting inclusivity and understanding through interactions with students from diverse backgrounds. They value dialogue, respect diverse opinions, and uphold tolerance. Al-Mujatama’ al-Islami Islamic Boarding School prioritizes religious education and practical skills to foster religious tolerance, while Arroudhotul Wahidah Islamic Boarding School excels in teaching Islamic Heritage Books, fosters tolerance, respect for diverse views, social consciousness, and discourse. Those Islamic Boarding Schools use structured schedules, group activities, and an all-encompassing educational strategy to foster respect, unity, and holistic growth among students. They cultivate individuals with diverse competencies and compassionate values, emphasizing how religious teachings influence attitudes toward tolerance and respect for religious diversity.

Abstract

The title of the article is HeForShe's Role in Palembang Society. She invites men of all ages as equal partners in building a women's rights movement and implementing a shared vision of gender equality that benefits all humanity. The campaign sought to actively involve men and boys in a movement initially conceived as "women's struggle by women. The first issue raised was the role of HeForShe's campaign in protecting women in Palembang society. Second is a review of Islamic law on HeForShe's role in protecting women. This type of research is research this termasuk todalam descriptive research qualitative meetup will research yan g digunwill examine the condition of scientific objects, dimana researcher As a key instrument, data collection techniques are carried out in combination, inductive data analysis and qualitative research results emphasize meaning rather than generalization. From the results of this study, it can be concluded that the achievement of gender equality through the HeForShe Campaign is realized through the role of HeForShe in Indonesia to support and achieve gender equality in the form of training, socialization, and education aimed at the community, workers, and students. One of the activities is raising awareness among men and women about the Sriwijaya Smart Women's Movement (GPCS). Women's protection is included in the Adz-Dzaruriyah maslahat, which is an effort to protect women; women need this protection to carry out their rights and obligations properly. The policy of maslahah must be in accordance with the objectives of Islamic Law; that is, it must not contradict the Qur'an and the Sunnah and must be in accordance with the purpose of Islamic Law, namely al-maqāṣid al-Syari’ah, according to researchers, to be appropriate and appropriate.

Abstract

Problem statement: Issues pertaining to women's protection rights have ignited social debate within the framework of the mak dijuk siang tradition. This tradition, upheld by the indigenous people of Lampung, forbids divorce and conveys the moral message that marriage is sacred, noble, and honourable, thus necessitating its preservation until death separates the couple. Objective: This study seeks to investigate the underlying reasons for the conflicting values associated with the mak dijuk siang tradition among the indigenous Lampung community, as well as to evaluate the relevance of this tradition in the heterogeneous social context of the indigenous Lampung populace. Methods: A qualitative approach was employed for this study. Primary data were collected through interviews with a diverse range of informants, including community leaders, traditional leaders, and community members from the sub-districts of Anak Tuha, Gunung Sugih, and Bumi Ratu Nuban in Central Lampung Regency. Theories of justice and gender served as the analytical framework for data analysis. Results: The findings indicate that the prevailing social reality, which prioritises the protection of women and human rights, has led to a debate between traditional and contemporary values concerning the mak dijuk siang tradition. The middle ground in this value debate advocates for a dialectic between the principles of justice and equality in gender relations, grounded in human rights. Conclusion: The fact that women are seeking divorce through the Religious Court in an area with strong traditional ties to this practice demonstrates that the tradition is no longer uniformly upheld. This study advocates for the local government to continue recognising and promoting local customs that possess positive values for family resilience.

Abstract

Sufism spiritual education faces challenges in combining traditional values with modern dynamics, especially in the context of multicultural Indonesia. This study aims to analyze the role, competence, and guidance strategies of mursyid teachers within the framework of maqāṣid al-syarī'ah to bridge the gap between the practice of Sufism and the goals of Islamic syarī’ah. This qualitative research uses a thematic analysis of transcripts from Indonesian scholars' lectures on YouTube, which were selected based on their credibility and relevance to the theme. The data were strengthened by triangulation of classical Sufism texts and consultation with experts. The analysis was carried out through thematic coding to identify patterns related to the role, competence, and guidance strategies of mursyid teachers, then contextualized with the framework of maqāṣid al-syarī'ah. The findings show that mursyid teachers play a crucial role in maintaining spiritual integrity (ḥifẓ al-nafs) and doctrinal adherence (ḥifẓ al-dīn). The core competencies include mastery of syarī’ah, taẓkiyah al-nafs skills, and legitimacy through ijāzah. Adaptive guidance strategies, such as a personal approach and dhikr discipline, have proven to be effective in aligning the practice of Sufism with maqāṣid al-syarī'ah. This study affirms the importance of integrating the framework of maqāṣid al-syarī’ah in the training of mursyid teachers to strengthen the pedagogical effectiveness and ethics of guidance. The implications include recommendations for the development of maqāṣid-based curriculum and capacity building for mursyid in the face of multicultural challenges. This research contributes to the revitalization of Sufism education that is relevant to the needs of the modern era.

Abstract

This study examines the impact of Narcissistic Personality Disorder (NPD) on achieving a harmonious family in marriage, and reviews the approach of Islamic family law and psychology in dealing with the problem. This study uses a library study method, This study describes how NPD characteristics, such as egoism and lack of empathy, can disrupt household harmony. In addition, this study also discusses the role of Islamic family law in providing protection for couples involved in marriages with individuals who have NPD characteristic disorders. The results of the study show that marriage with an NPD partner often creates emotional and psychological imbalances that hinder the achievement of a harmonious family, so it requires a multidisciplinary approach to resolve it

Abstract

This study aims to examine how interpersonal communication between husband and wife plays a role in decision-making regarding the number of children, viewed from the perspective of Mubādalah. This study uses a qualitative descriptive method with a library research approach, which examines various literature such as books, journal articles, and other relevant references. The results of the study indicate that effective interpersonal communication is characterized by openness, empathy, the ability to listen actively, honesty in expressing opinions, and emotional support has a major influence on the negotiation process and joint decision-making regarding the number of children. The Mubādalah perspective provides a theological and ethical framework in building equal partnerships, as well as correcting hierarchical relationship patterns that often place women's voices in a less prioritized position. By using the principle of Mubādalah, the decision on the number of children is not only understood as a technical issue, but also as a spiritual and moral discourse, where husband and wife have equal responsibility and authority in conveying their hopes, concerns, and limitations. This mutually respectful communication is the foundation for the formation of a harmonious and democratic family.]

Abstract

This study examines the contention around Islamic boarding school women's view of wives' rights in polygamous marriages. It aims to answer academic questions, specifically how and why there is contention among Islamic boarding school women over the rights of wives in polygamy. Furthermore, it also aims to answer what consequences this contestation has for the practice of polygamy, which is common in Islamic boarding schools. This paper is an empirical research that takes a sociological perspective. The analysis is based on Pierre Bourdieu's Cultural Sociology theory. Data were gathered through an interview study with research subjects from five traditional Islamic boarding schools in Lampung Province. The findings of this study show that the contestation of wives' rights in polygamy is influenced by the level of understanding of religious texts and norms, social and economic realities, and the strength of the patriarchal traditions and systems that surround it. Most women are denied the opportunity to fight for their bodily and spiritual rights, both before and after polygamous marriage occurs. Women in Islamic boarding schools recognize that men's supremacy influences the neglect of women's rights in polygamy because their understanding of religious texts is conservative. Women have no bargaining power when their husbands seek to practice polygamy. Conservatives believe that polygamy is a fate and consequence that women who want to marry a caregiver or an Islamic boarding school leader (Kyai) must accept. A moderate perspective necessitates that polygamy be practiced with proportional rights between husband and wife. The repercussions of this contestation have resulted in a better appreciation of the importance of men's and women's rights being proportionate, as well as mutual protection.

Abstract

Penelitian  ini  ditujukan dalam rangka menganalisis Pelaksanaan pasal 20  Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor  05 Tahun 2021 Tentang Penerbitan Dan Penandaan Surat Izin Mengemudi Persfektif Fiqh Siyasah Tanfidziyah dan Mengetahui pandangan Fiqh Siyasah Tanfidziyah tentang pelaksanaan Pasal 20 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 05 Tahun 2021 Tentang pelaksanaan Penerbitan  dan Penandaan Surat Izin Mengemudi. Penelitian dilaksanakan di Satlantas Polres    Metro. Metode pengumpulan datanya mempergunakan field research dengan cara  wawancara.  Dalam menganalisis datanya diterapkan metode  kualitatif yang tersaji melalui cara deskriptif. Temuan penelitian mengindikasikan, penerapan peraturan tersebut pada satlantas polres metro sudah sesuai pelaksanaannya dikarenakan beberapa  Prinsip  yaitu  Prinsip Legalitas, Prinsip Tranparansi, Prinsip Nondiskriminasi, dan Prinsip Efektif dan Efesien; dan   menurut pandangan Fiqh Siyasah Tanfidziyah tentang pelaksanaan Pasal 20 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 05 Tahun 2021 Tentang pelaksanaan Penerbitan dan Penandaan Surat Izin Mengemudi sudah sesuai dengan prinsip pelayanan dalam Islam yang tercantum melalui siyasah tanfidziyah.
