Abstract

Growth in society effect of globalization have influenced growth in tatanan punish national. In the end existing law norm have to can adapt to change that happened, but non meaning have to take off embraced values, like life view, Five Principles state s philosophy and ideology which have become the source of from all source of law. For that law remain to have to can alli arising out implication effect of current of globaliasi with elementary value which contained in Five Principles. becoming elementary question is how development of law in Indonesia arising out of globalization values with values in Five Principles payload as source of from all source of existing law. Pursuant to result of Five Principles study intactly have to be seen by as " guidelines national", as " Standard national, principles and norm" what at the same time load " responsibility human and rights human". Five Principles also can function as margin of of appreciation as appreciation margin or boundary to law which live in society which is pluralistic so that can be agreed in life of national law.

Abstract

Penelitian ini membahas tentang tradisi tetapol pada masyarakat Kabupaten Lampung Barat yaitu tradisi saling berkunjung antara kedua belah pihak keluarga si perempuan dan keluarga pihak laki-laki setelah prosesi akad nikah.. Metode yang digunakan adalah metode kualitatif yaitu metode menghasilkan data deskriptif. penelitian ini juga menggunakan pendekatan normatif dan sosiologi dengan metode deskriptif. Peneliti menggunakan pengumpulan data meliputi: observasi, wawancara, dan dokumentasi. Hasil penelitian ini adalah Tradisi tetapol ini adalah tradisi saling berkunjung dan dilakukan pada malam hari setelah 2 hari dari acara pernikahan. Tradisi tetapol pertama dilakukan oleh keluarga perempuan dengan diiringi oleh beberapa orang yang merupakan keluarga dan kerabat dekat. Tradisi tetapol ini ada suatu tangguhan yang berisi penyerahan pengantin dan mengenalkan keluarga masing-masing baik itu dari nama, tutogh, hingga tempat tinggal. Untuk melakukan tetapol ini diharuskan membawa benatok dan manjau pedom bagi keluarga pihak laki-laki atau perempuan. Tinjauan hukum Islam terhadap tradisi tetapol dalam perkawinan adat Lampung Saibatin di Kabupaten Lampung Barat tidak bertentangan dengan hukum Islam meskipun tidak diatur dalam Al-Qur’an maupun Hadis. Namun dalam hukum Islam, melalui sumber hukum yang lain memberikan kebolehan terhadap tradisi-tradisi yang tidak bertentangan dengan hukum Islam termasuk tradisi uang pelangkah. Hal ini dalam hukum Islam dikenal dalam Urf yang Shahih karena sudah memenuhi aturan yang berlaku. Dampak dari tradisi tetapol ini bisa mempererat tali silaturahmi dan juga dalam komunikasi bisa berjalan dengan baik karena ada proses saling mengenal keluarga satu sama lain dalam tetapol ini. Dampak lainnya yaitu dalam segi ekonomi kedua pasangan bisa dibantu oleh orang tua masing-masing jika ingin melakukan sesuatu seperti akan membuka usaha atau melakukan bisnis maka orang tua bisa membantu walaupun hanya sedikit.

Abstract

Digital banking services in Islamic banking continue to progress and improve. Digital banking services can ease Sariah Bank customers to transact by only using a mobile phone in 24-hour service. One of the digital banking services in Islamic banking is ZISWAF fundraising and fund management. ZISWAF is one of the products that will be the focus of the company in business development in the future because ZISWAF is a source of funds for Muslims who are expected to realize prosperity, social justice and reduce poverty. In order to increase the potential of zakat in Indonesia, the National Amil Zakat Agency has officially appointed the Zakat Management Unit (UPZ) of Bank Syar'ah Indonesia by utilizing digital banking. Therefore, this research was conducted to find out how the Sharia Economic Law Perspective towardThe Digital Banking  Based of ZISWAFfundraising and fund management at PT. BSI KCP Bandar Lampung TelukBetung. The results of the field research show that ZISWAF fundraising based on digital banking uses the BSI Mobile platform, BSI ATM, and the Jadiberkah.id platform. About fund management, ZISWAF funds are managed through charity programs and sustainable programs. If it is viewed from the perspective of Sharia Economic Law, The Digital Banking  Based of ZISWAF fundraising andfund managementis legal because it is included in providing convenience benefits, as explained in the surat Al-A̒lᾱ [87]: 8 The paragraphs explain that Allah SWT provides convenience for everyone. Muslims to get a way of convenience (in all matters) and have the value of benefit and be able to maintain the interests or objectives of Islamic law and are maṣlaḥah al-ḥᾱjjiyah, namely making it easier for BSI customers in paying ZISWAF and easing in worship.

Abstract

This research aims to determine the impeachment or dismissal of regional heads in Lampung Province from the perspective of Law and Islamic jurisprudence. This problem is interesting to research. Since this province was founded, at least five regional heads have been dishonorably dismissed for committing Corruption, namely the Regent of South Lampung, the Regent of North Lampung, the Regent of Tanggamus, the Regent of Mesuji and the Regent of Central Lampung. This research uses a library study method, is descriptive-analytical, and uses primary and secondary legal data sources, which are then analyzed using the comparative method. This research concluded that the impeachment of regional heads in Lampung Province was carried out because they violated their oath of office, namely committing Corruption as regulated in Law Number 9 of 2015 concerning Regional Government, which is the second amendment to Law Number 23 of 2014 concerning regional government. Corruption in Indonesia is an extraordinary crime because it has a significant and widespread impact. Instead, the budget for regional development and people's welfare is taken for their interests. In Fiqh Siyasah, this issue is included in siyasah qadhaiyah. Every community must obey the laws and regulations. So, if a regional head violates the Law, he can be dishonorably dismissed for acting wickedly and unjustly. The corrupt behavior of regional heads includes sinful acts and forms of cruelty by leaders toward their people.

Abstract

This study was made to analyze the implementation of the Decision of the Director General of Islamic Community Guidance Number DJ.II / 542 of 2013 concerning the Prenuptial Course at the Office of the Ministry of Religion in the City of Bandar Lampung and to determine the relevance of taking the Prenuptial Course to household harmony. This type of research uses Field Research, where researchers go directly to the field to obtain strong, objective and actual data. Researchers will go to the field to obtain authentic, accurate, detailed and in-depth data. The results of this study indicate that the implementation of the Decree of the Director General of Guidance for the Islamic Community Number DJ.II / 542 of 2013 concerning prenuptial courses is quite effective. couples to reduce disputes in the family, divorce and conflict, so that they become provisions for realizing a peaceful, prosperous, safe, peaceful family and truly creating a sakinah mawadah warahmah family. After fulfilling the existing procedures, the bride and groom get a foundation book for the sakinah family and a certificate. However, if viewed from the level of effectiveness there are still several weaknesses, including the lack of availability of funding to cover all training needs, the seriousness of the participants is not optimal, the lack of attendance and the level of activity of participants in taking pre-marital training courses, and the continuity of pre-marital course activities that have not been optimally scheduled.

Abstract

Artikel ini mengkaji perbedaan putusan antara hakim tingkat pertama/banding dengan hakim tingkat kasasi terkait pembagian harta bersama dalam kasus perceraian yang melibatkan anak di bawah umur. Hakim tingkat pertama memutuskan untuk membagi harta bersama berupa rumah setelah perceraian, sementara hakim kasasi menunda pembagian tersebut hingga anak mencapai usia dewasa. Penelitian ini bertujuan untuk menganalisis pertimbangan hakim dalam putusan mahkamah agung nomor: 159/k/Ag/2018 tentang pembagian harta bersama bagi pasangan suami istri yang mempunyai anak belum dewasa perspektif kemanfaatan hukum. Penelitian ini menggunakan teori maqāșid syariʻah, teori keadilan, dan teori kemanfaatan sebagai kerangka analisis untuk memahami dasar pertimbangan hakim dalam putusan tersebut. Metode yang digunakan adalah metode kualitatif dengan jenis penelitian library research. Sumber data utama adalah Putusan Mahkamah Agung Nomor 159/K/Ag/2018, yang dilengkapi dengan sumber data sekunder dari karya ilmiah yang relevan. Analisis data dilakukan secara kualitatif dengan fokus pada teori-teori yang telah disebutkan. Hasil penelitian menunjukkan bahwa hakim tingkat kasasi menunda pembagian harta bersama demi memastikan asas kemanfaatan bagi anak yang masih di bawah umur. Penundaan ini dilakukan untuk menjamin perlindungan dan kesejahteraan anak, yang sesuai dengan tujuan maqāșid syariʻah dalam menjaga agama, jiwa, akal sehat, keturunan, dan harta anak. Penundaan pembagian harta ini dinilai adil dan bermanfaat bagi semua pihak yang terlibat, termasuk anak yang belum dewasa. Penelitian ini berkontribusi pada pengembangan hukum di Indonesia dengan memberikan analisis mendalam terkait pertimbangan hakim dalam pembagian harta bersama, khususnya dalam kasus yang melibatkan anak di bawah umur. Hal ini penting untuk memahami bagaimana hukum dapat diimplementasikan dalam konteks perlindungan anak dalam perceraian. Kata Kunci: Pembagian, Harta Bersama, Hukum

Abstract

This study aims to explore the form of the absence of reciprocal or mutuality values that lead wives to file for a divorce, the factors causing the non-implementation of reciprocal values in financial support, and strategies for family strengthening. This research is a qualitative descriptive study based on the increasing trend of divorce cases filed by wives. Data was gathered from online news about the trend of divorce lawsuits triggered by either the wife's or husband's failure to apply reciprocal values.   Interviews were conducted with maslahah family counselors, heads of religious affairs office, female scholars, academics, and judges of religious courts about the reasons wives file for divorce and efforts to strengthen families. Analysis was done qualitatively using the theories of mublà and social adaptation. The findings indicate that the absence of reciprocal values is triggered by gender-biased understanding dominating classical scholars' mindsets, which rely on patriarchal ethics and greatly favour men. This gender bias is implemented in Indonesian marriage regulations and becomes ingrained in the subconscious of society. Consequently, the obligation of financial support is seen as an absolute duty of the husband, without considering specific circumstances such as illness, disability or imprisonment, which may prevent the husband from fulfilling his obligations. On the other hand, when a husband cannot provide financial support, he is also unwilling to share domestic responsibilities, causing the wife to bear a double burden. As a result, conflicts and violence often occur. Therefore, there is a need to reinterpret the concept of financial support by following the messages of the Quran and the dynamics of modern society, implementing reciprocal values, and adapting roles. Socialising reciprocal values to all elements of society through relevant institutions and social media is essential for realising family strengthening.

Abstract

Real Work Lecture (KKN) is a form of community service activity carried out by tertiary institutions. In the KKN activities carried out in Genggelang Village, Gangga District, North Lombok Regency, groups of students and lecturers at the University of Mataram carried out various activities with the main goal of developing the village's agricultural potential. The purpose of implementing this KKN activity is to answer various problems related to agriculture and help solve social issues. The problem that has been identified is the large amount of plantation waste that is not utilized which can cause environmental pollution. In an effort to overcome the problem of plantation waste that is not utilized optimally. The efforts made by the Mataram University Community Service students are to process the waste into organic fertilizer which can be reused by the farmers there as a support for holicultural plants in the residents' yards. So that the holicultural plants in the residents' yards can thrive in the presence of this organic fertilizer. With the activity of making fertilizer from plantation waste, the community can increase the selling value of community plantation products where, in addition to being able to sell the main plantation products, the community can sell waste that has been processed into fertilizer so that garden products can be utilized as much as possible.

Abstract

Sebagai hasil dari amandemen terhadap Pasal 18 adalah Pasal B ayat (2) UUD 1945  “negara mengakui dan menghormati kesatuan masyarakat hukum adat beserta hak-hak tradisionalnya.”Pengakuan terhadap masyarakat hukum adat, secara redaksional dimasukkan di dalam pasal yang terkait dengan pemerintahan daerah. Maka oleh karena itu, pengaturan tentang desa-pun  sejak reformasi include dalam UU yang mengatur tentang pemerintahan daerah.  Dilihat dari perspektif politik hukum ketatanegaraan, pengakuan terhadap kesatuan masyarakat hukum adat sudah ada sejak Pemerintahan Hindia Belanda, yaitu sebagaimana diatur dalam Regeringsreglement 1854 dan Pasal 128 ayat (3) Indische Staatsregeling (IS) tanggal 2 Septemer 1854, Stbld. Tahun 1854 No. 2.Kaidah yang terkandung dalam IS ini menunjukkan bahwa ada perintah  norma agar desa sebagai kesatuan masyarakat yang bertempat tinggal dalam suatu wilayah tertentu harus dibiarkan (gelaten) mengatur rumah tangganya sendiri (huishoiding gelaten) berdasarkan hukum adat.

Abstract

The Sebatin Lampung customary law community, seen from the lineage system including genealogical customary law community, draws on the patrilineal lineage. In the marriage system using an honest marriage system, where the wife is included in the husband's relatives. But for certain reasons, the Semanda marriage system was also used by the Sebatin Lampung customary law community. In the marriage system, the husband follows or is in the environment of his wife's relatives. In semanda marriage, which has more role in the inheritance dominated by the wife because the assets managed are indeed owned by the wife's family. If they get shared assets during the marriage, is there a husband's right to joint property in the distribution of inheritance. Based on the above background, the problem in this paper is how the distribution of inheritance in the Sebatin Lampung customary law community and how the husband's inheritance rights in Semanda marriage Sebatin Lampung Customary Law Community. The first research objective was to analyze the distribution of inheritance rights in Sebatin Lampung Customary Law Society. Second, to examine and analyze the husband's inheritance rights in the marriage of SemandaSebatin Lampung Customary Law Society. The method in this study, seen from its type, is qualitative research, even if seen from the nature of this research is library research. Data analysis using qualitative descriptive. The conclusion obtained in this study is First, For the Sebatin Lampung customary law community, inheritance system uses a system of major inheritance. This means that inheritance will fall on the oldest son. Assets inherited to the oldest sons are inheritance, customary titles, and parental property which is the result of the parents' efforts while still alive. Second, the distribution system of inheritance for husbands who carry out semi-marriages at the Sebatin Lampung customary law community, carried out in accordance with the conditions and conditions of each family. This division can be seen from two conditions. If in the family there are children born in semanda marriage, then the inheritance of the wife is given to the eldest son and the oldest child will take the policy to share or give part to his younger siblings.
