Abstract

The growing number of alleged medical malpractice cases in Indonesia, particularly physicians’ misdiagnosis resulting in patient death, underscores the need for stronger legal certainty and accountability in healthcare services. Physicians are professionally obligated to conduct diagnosis and medical treatment in accordance with professional standards, service standards, and standard operating procedures; however, negligence may occur and lead to severe harm. This study aims to analyze the legal provisions governing physicians’ liability for misdiagnosis causing patient death and to examine the forms of legal responsibility that may be imposed. The research applies a normative juridical method using a case approach and literature review, relying on primary legal materials such as the Indonesian Civil Code, the Criminal Code, the Medical Practice Law, the Hospital Law, and Law Number 17 of 2023 on Health, supported by secondary and tertiary sources. The findings indicate that physicians may be held liable under civil, criminal, and administrative law if the essential elements of medical negligence are proven, namely duty of care, breach of duty, harm (including death), and a causal relationship between the misdiagnosis and the fatal outcome. Moreover, liability may extend to hospitals under the doctrines of vicarious liability, hospital liability, and strict liability. This study implies the importance of strengthening professional competence, reinforcing disciplinary mechanisms, and ensuring balanced legal protection for both patients and healthcare professionals within Indonesia’s health law framework.

Abstract

Kabupaten Sukoharjo sudah ada peraturan yang mengatur mengenai perangkat desa. Namun ketentuan dalam peraturan daerah ini sudah tidak sesuai dengan aturan yang baru sehingga menimbulkan kekosongan hukum. Permasalahan yang dihadapi mitra adalah Kurangnya integritas Panitia seleksi Kurang transparan dalam proses seleksi, Kurang memahami teknologi informasi untuk mendukung proses seleksi. Tujuan Pengabdian masyarakat ini adalah untuk mengatasi permasalahan yang terjadi di lapangan adalah dengan memberikan Pendampingan Seleksi Pengangkatan Perangkat Desa Cemani, Kecamatan, Grogol, Kabupaten Sukoharjo. Metode yang digunakan adalah Pendampingan dalam pelaksanaan ujian tertulis dan Pendampingan dalam pelaksanaan ujian praktek computer. Pendampingan yang dilakukan oleh Tim Pengabdian masyarakat Universitas Duta Bangsa yaitu dengan menerapkan 5 (lima) indikator yakni indikator terjaminnya akses sebagai informasi yang jelas dan tepat, indikator kebebasan bagi setiap orang untuk memperoleh informasi tentang penyelenggaraan pemerintahan, indicator informasi dan indikator hasil rekrutmen belum berjalan secara transparan.

Abstract

Consumer disputes between business actors and consumers continue to challenge the effectiveness of Indonesia’s consumer protection framework, particularly in the implementation of arbitration mechanisms. Law Number 8 of 1999 concerning Consumer Protection formally mandates the Consumer Dispute Resolution Agency to adjudicate disputes, yet regulatory and institutional limitations hinder the optimal execution of arbitration-based decisions. This study examines and analyzes the regulatory framework governing the execution of arbitration in consumer dispute resolution, identifies its normative and structural weaknesses, and formulates a justice-oriented reconstruction of the relevant provisions. The research applies a constructivist paradigm and adopts a sociological juridical approach. It integrates normative legal analysis with empirical field data to assess how arbitration functions in practice. The study systematically organizes and qualitatively analyzes both primary and secondary data to produce a comprehensive evaluation of the existing regulatory model. The findings demonstrate substantive inconsistencies between consumer arbitration procedures and the broader arbitration regime, structural weaknesses within the institutional framework of dispute resolution bodies, and limited consumer awareness regarding legal rights. These deficiencies reduce legal certainty and weaken the effectiveness of arbitration outcomes. The study concludes that lawmakers must reconstruct specific statutory provisions, particularly those governing the execution of arbitral decisions, in order to strengthen institutional coherence, enhance legal certainty, and ensure justice in consumer dispute resolution.

Abstract

Penelitian ini bertujuan untuk menganalisis peran kepolisian dalam pemberantasan tindak pidana judi online serta mengidentifikasi hambatan yang muncul beserta solusi penanganannya. Dengan menggunakan metode penelitian yuridis normatif dan pendekatan kasus, penelitian ini menelaah peraturan perundang-undangan, literatur hukum, putusan pengadilan, dan data resmi lembaga terkait. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap judi online dilakukan melalui penegakan formal meliputi penyelidikan, penyidikan, penuntutan, persidangan, hingga pemidanaan berdasarkan KUHP dan UU ITE, serta penegakan nonformal melalui pembinaan, pencegahan, dan rehabilitasi terutama bagi remaja. Hambatan utama dalam penanganan judi online meliputi keterbatasan SDM kepolisian di bidang IT, kesulitan memperoleh alat bukti, server situs judi yang berada di luar negeri, lemahnya koordinasi antar lembaga, dan rendahnya kesadaran masyarakat. Upaya kepolisian dilakukan melalui langkah preventif seperti sosialisasi dan edukasi publik, serta langkah represif berupa penindakan tegas terhadap pelaku. Penelitian menyimpulkan bahwa pemberantasan judi online memerlukan kolaborasi antara pemerintah, kepolisian, lembaga keuangan, penyedia internet, dan masyarakat, serta penguatan SDM dan regulasi agar penegakan hukum lebih efektif di era digital.

Abstract

This article discusses legal protection for healthcare workers as a fundamental aspect in ensuring the continuity and effectiveness of the healthcare system in Indonesia. This study aims to analyze the forms of legal protection provided to medical personnel and their impact on their welfare and performance using a legal economic analysis approach. The results of the study show that although there are a number of regulations governing the rights and obligations of healthcare workers, their implementation in the field is still not optimal. Legal uncertainty, unequal protection, and a lack of legal assistance have a direct impact on the psychological well-being and job stability of medical personnel. Additionally, weak legal protection also negatively affects productivity, loyalty, and the efficiency of healthcare services. Therefore, legal protection should be viewed as a strategic investment capable of enhancing the performance of medical personnel and strengthening the national healthcare system as a whole. This study recommends the need for a reformulation of legal policies and the strengthening of protective mechanisms that are more concrete and oriented toward justice and efficiency.

Abstract

Medical malpractice by non-physician health workers is a significant issue in Indonesia's healthcare system. Nurses and midwives, whether acting independently or under delegation from physicians, are at risk of exceeding their authority, which can result in legal consequences. This study aims to analyze the forms of malpractice committed by non-doctor health personnel, the legal regulations governing such acts, and the applicable legal liabilities. The research uses a normative juridical method with statutory, case, and conceptual approaches. Findings indicate regulatory weaknesses, overlapping institutional authority, and insufficient legal education among health workers, leading to ineffective handling of malpractice cases. Legal reform is needed through technical SOP formulation, strengthening of medical record systems, and continuous legal education for non-physician health personnel.
