Abstract

Protection of the marine environment within the framework of international law is actually an accumulation of The Principle of National Sovereignity and The Freedom of High Sea. The International Maritime Organization (IMO) states that "a right on the part of an astat threatened with the environmental injury from sources beyond its territorial jurisdiction, at least where those sources are located on the high seas, to take reasonable action to prevent or abate that injury ". The general principle of good neighbor liness can be found in international customary law as well as in Article 74 of the UN Charter. This principle is reflected in several international treaties and is supported by the country's main practices in dangerous and emergency activities. Cooperation is contained in the 24th Principle of the Stockholm Declaration and the 27th Principle of the Rio Declaration which states that countries must cooperate in the principles of good faith and the spirit of partnership as efforts to protect the environment. Keywords: protection of the marine environment, principles of good faith, International Maritime Organization (IMO)

Abstract

This study aims to determine legal protection for workers who experience layoffs during the covid-19 pandemic. In this study, the type of research used is normative legal research using legal material collection techniques in the form of document studies or literature studies. The approach used in this research is a statutory approach and the sources of legal materials used are primary legal materials, secondary materials, and tertiary legal materials. The results of the study indicate that Termination of Employment has a negative impact on workers because they lose their jobs so that it also has an impact on increasing the poverty level of the Indonesian people. Due to the emergence of PSBB regulations from the government, of course, the space for work is getting narrower and layoffs are increasingly happening, therefore the regulation of Law no. 13 of 2003 concerning Manpower and also the role of the government is very important to overcome the occurrence of layoffs that are not in accordance with the laws and regulations.

Abstract

Pandemi Covid-19 telah menyebabkan perubahan signifikan dalam pola perilaku konsumen, khususnya dalam hal kebiasaan berbelanja. Sebelum pandemi, sebagian besar konsumen masih memilih berbelanja langsung di toko meskipun layanan daring telah tersedia. Namun, pembatasan sosial dan kebijakan pemerintah yang mengharuskan masyarakat untuk tetap di rumah mendorong pergeseran menuju transaksi online secara masif. Kondisi ini menuntut pelaku Usaha Mikro, Kecil, dan Menengah (UMKM) untuk segera beradaptasi dengan melakukan inovasi dalam produk maupun pelayanan agar tetap diminati konsumen. Penelitian ini bertujuan untuk menganalisis strategi adaptasi UMKM dalam menghadapi perubahan perilaku konsumen selama pandemi Covid-19. Metode yang digunakan adalah pendekatan kualitatif deskriptif dengan teknik pengumpulan data melalui studi literatur dan observasi terhadap pelaku UMKM di beberapa daerah. Hasil penelitian menunjukkan bahwa sebagian besar UMKM mengalami penurunan omset penjualan secara signifikan. Namun, UMKM yang mampu beradaptasi dengan mengembangkan platform digital, memperbaiki kualitas produk, serta meningkatkan pelayanan berbasis kebutuhan konsumen menunjukkan ketahanan usaha yang lebih baik di tengah krisis. keberhasilan UMKM bertahan di masa pandemi sangat bergantung pada kemampuan adaptasi terhadap perubahan pasar. Implikasinya, perlu dukungan kebijakan pemerintah dalam bentuk pelatihan digitalisasi dan akses pemasaran online bagi UMKM agar tetap kompetitif dalam situasi krisis.

Abstract

ABSTRACT The implementation of buying and selling online provides many benefits to streamline time so that everyone can make buying and selling transactions wherever and whenever. However, in practice it raises several problems, such as on the Shopee shopping site with a payment system using the Cash On Delivery (COD) feature, there are obstacles that are detrimental to the seller. This obstacle is caused by consumers who do not have good intentions by disappearing suddenly when the goods arrive at the buyer's address so that the goods are not paid for and are forced to be sent back to the seller. This is clearly detrimental to the seller both in terms of material and immaterial. The focus of research in this thesis is to analyze the concept of consumer protection for Shopee sellers who implement the COD payment system. This study uses empirical juridical research methods using primary data located in Purwokerto. Data analysis techniques using qualitative methods. The results of the study show that good faith as a form of business actor's obligation to the Shopee Marketplace has been fulfilled, but there is an imbalance in the position of unilaterally canceling so that the business actor does not get his rights in the form of payment for goods. So the seller must bear the risk and the goods must be returned, and for the safety of the seller must bear the cost of resend so that COD becomes more expensive. This is referred to as the risk borne by the seller.

Abstract

This article aims to analyze changes to the decision of the constitutional court in the 2024 general election contestation from the perspective of Indonesian constitutional law. This research uses a normative juridical research method with a type of approach, namely a statutory approach and a conceptual approach. The legal materials used are primary, secondary and tertiary legal materials, obtained by conducting literature studies. The research results show that factors that influence changes in the Constitutional Court's decisions will be taken into account, such as legal developments, social changes and political shifts that may occur over time. Through a review of constitutional law, this article will also consider the influence of constitutionalist thinking and human rights principles in the Constitutional Court's decisions regarding elections. This research pays attention to changes in the constitutional interpretation by the Constitutional Court and their impact on the electoral process.

Abstract

This study aims to determine how the implementing legal provisions and utilization of forest land conversion into plantations are oriented towards capitalism. This study uses a normative legal research method with the types of approaches, namely the legislative approach and the conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials, obtained by conducting a literature study. The results of the study indicate that Occupational Safety and Health (OHS) is an integral part of the protection of workers' rights, aims to create a safe and healthy work environment, and prevent work accidents and occupational diseases. In the Indonesian context, OHS is regulated through various legal instruments such as Law Number 1 of 1970 concerning Occupational Safety, Law Number 13 of 2003 concerning Manpower, and other derivative regulations that explain the standards and guidelines for the implementation of OHS. In addition, Indonesia has also ratified a number of international conventions from the International Labor Organization (ILO) which emphasize the importance of OHS protection for every worker. However, in its implementation, OHS regulations in Indonesia still face various challenges that lead to injustice in the protection of workers. Workers in the formal sector, especially those working in large companies, tend to get better OSH protection because the companies have sufficient resources to comply with existing regulations. In contrast, workers in the informal sector and small and medium enterprises (SMEs) often face more vulnerable situations, where OSH protection is minimal or even non-existent.

Abstract

Penelitian ini bertujuan untuk mengetahui, menganalisis, transaksi perbankan melalui internet banking di Indonesia. Penulisan artikel ini menggunakan metode penelitian bersifat yuridis normatif. Dalam pengumpulan data penelitian, dengan menggunakan bahan hukum sekunder berupa buku, jurnal, artikel, dan karya tulis lainnya, baik yang berasal dari media cetak maupun internet yang berhubungan dengan penelitian ini. Hasil penelitian menunjukan bahwa Internet banking merupakan salah satu pelayanan jasa bank yang memungkinkan nasabah untuk memperoleh informasi, melakukan komunikasi dan melakukan transaksi perbankan melalui jaringan internet. Transaksi perbankan melalui internet banking sampai saat ini belum diatur secara khusus dalam sistem perundang-undangan di Indonesia. Pengaturan mengenai transaksi perbankan melalui internet banking di Indonesia yang ada saat ini belum dapat menjamin kepastian hukum dan keadilan bagi para pihak, baik pihak bank maupun nasabah. Upaya perlindungan hukum telah dilakukan oleh pemerintah, namun substansi-substansi dari peraturan- peraturan yang ada belum menunjukkan adanya upaya perlindungan hukum yang optimal bagi para pihak.

Abstract

Eigendom, derived from Dutch, means "ownership" and refers to the right to control and manage both tangible and intangible assets. In Western legal systems, eigendom is regulated by civil law, granting absolute ownership. In Indonesia, the Civil Code recognizes eigendom as the highest form of ownership, giving owners full freedom to enjoy and manage their assets while adhering to regulations. A clear understanding of eigendom is crucial for legal certainty in property transactions and maintaining economic and social stability. This study employs a normative legal approach to analyze eigendom regulations in Indonesia and compare them with ownership concepts in other countries. An empirical approach is also used through literature studies and interviews with legal practitioners, notaries, and land officials. The data were analyzed using content analysis and presented in comparative tables and diagrams. The study found that eigendom rights in the Civil Code provide strong ownership guarantees but face challenges, particularly in verifying and validating ownership documents, influenced by colonial-era legacies. Comparisons with legal systems in other countries highlight interpretative differences, indicating the need for stricter verification to prevent misuse of rights and illegitimate claims. Although eigendom ensures strong legal protection for property ownership, the study concludes that regulatory improvements are necessary to promote fairness and transparency. The combination of normative and empirical approaches offers a comprehensive view of eigendom rights and emphasizes the urgency of legal reforms for justice in modern property law in Indonesia

Abstract

The research findings reveal a pluralistic understanding of dumping within the Indonesian Legal System, evident in various laws, including Law No. 17 of 1985 on the Ratification of UNCLOS, Law No. 32 of 2009 on Environmental Protection and Management, Government Regulation No. 29 of 2014 on the Prevention of Environmental Pollution, Ministerial Regulation No. 136 of 2015 on the Second Amendment to Ministerial Regulation No. 52 of 2011 on Dredging and Reclamation, and Ministerial Decree No. 4 of 2005 on the Prevention of Pollution from Ships. Dumping countermeasures are primarily perceived as acts related to dredging and reclamation, identified as contributors to the silting of shipping channels. Notably, Indonesia has not ratified the London Dumping Convention, and there is a lack of a definitive list specifying wastes requiring special arrangements and absolute prohibition within the coastal states' territories. Consequently, compensation has not been prioritized as a state-led measure for marine environmental protection. The state's responsibility, enforced through the State Attorney, necessitates procedural formalities, including a special power of attorney. Collaborative efforts with relevant institutions, particularly the Ministry of Environment and Forestry, are deemed essential. The current landscape in Indonesia reveals overlapping authorities among agencies, leading to conflicting interpretations of civil lawsuit issues related to environmental damages. The proposed model advocates for centralizing environmental priorities within the Ministry of Environment and Forestry, coordinated through the State Attorney, as a strategic step towards addressing these complex issues.

Abstract

This research aims to identify the elements of plagiarism, analyze the legal protection for alternative universe novel writers who are victims of plagiarism, and find out the legal consequences for the perpetrators and the application of the law in practice. The method used is normative and empirical juridical with doctrinal legal research specifications. Data is collected through literature studies and online platforms, then analyzed narratively. The results of the study show that plagiarism in AU novels can be seen from the similarity of plot, dialogue, characterization, and story structure. Legal protection is regulated in Article 1 of Law No. 28 of 2014 concerning Copyright, including moral rights and economic rights regulated by Article 5 and Article 9, and the term of copyright protection is regulated by Article 58. The author can file civil and criminal lawsuits in accordance with Article 113 of the UUHC. For digital plagiarism, Law No. 11 of 2008 concerning Electronic Information and Transactions (UUITE) also provides protection regulated in Article 35. In practice, dispute resolution is more often carried out through non-litigation channels such as mediation and negotiation on digital platforms.
