Abstract

ABSTRAK Pada dasarnya manusia memiliki kebutuhan yang beraneka ragam, sesuai dengan peningkatan kualitas kesejahteraan yang diinginkannya. Kebutuhan kebutuhan tersebut antara lain kebutuhan primer dan kebutuhan sekunder. Namun dalam hal tersebut masyarakat harus extra berhati-hati dalam memilih maupun mengkonsumsi suatu produk yang aman. Mengingat di zaman yang serba canggih seperti saat ini banyak produsen yang sering berlaku curang kepada konsumen demi memperoleh keuntungan yang sebanyak-banyaknya dan juga pelaku usaha sering kali mengenyampingkan hak-hak yang dimiliki oleh konsumen yang sudah diatur dalam peraturan perundang-undangan. Kurangnya wawasan konsumen atas hak-hak yang dimilikinya serta kurangnya edukasi yang diperoleh konsumen dari pemerintah dan instansi terkait membuat konsumen sering kali dirugikan dengan sikap pelaku usaha yang hanya mementingkan keuntungan semata tanpa memikirkan dampat dari pangan daging ayam yang tidak layak konsumsi yang dijualnya. Tujuan dari Penelitian ini yaitu untuk mengetahui bagaimana perlindungan hukum yang dimiliki oleh konsumen terkait dengan peredaran pangan daging ayam yang tidak layak konsumsi di Pasar Badung. Jenis dari penelitian ini menggunakan metode penelitian hukum empiris dengan pendekatan perundang-undangan (The Statue Approach) dan pendekatan fakta (The Fact Approach), artinya dalam meneliti masalah dengan menggunakan fakta-fakta yang terjadi terkait dengan penjualan pangan daging ayam yang tidak layak konsumsi di Pasar Badung, dengan kajian terhadap perundang-undangan yang dikaitkan dengan permasalahan yang ada. Hasil penelitian menunjukan Kurangnya pemahaman yang dimiliki konsumen serta tidak efektifnya penyampaian edukasi dan informasi dari pemerintah dibantu instansi terkait menyebabkan lemahnya kesadaran konsumen atas hak dan kewajiban yang dimilikinya, karena penyebab utama tindakan yang tidak baik dari produsen kepada konsumen adalah kurangnya kesadaran dan pengetahuan yang dimiliki oleh konsumen terhadap hak-hak serta kewajiban yang mereka miliki. sehingga pelaksanaan Undang-Undang nomor 8 tahun 1999 tentang Perlindungan Konsumen belum terlaksana dengan baik di Pasar Badung.

Abstract

This paper is titled “Responsibilities of Bussiness Actor as an Advertiser Toward the Advertisment that Incur Losses for the Consumer”. This paper uses analytical method and statute approach. Bussiness actor uses the advertisement to promote their goods and services to the consumer. The advertisement hold a big role in inreasing the number of selling. However, bussiness actor as the advertiser often ignoring the conditions about the procedures of making the advertisement that ncur losses for the consumer. Therefore, good bussiness actor are being responsible of a losses that experienced by the consumer.

Abstract

This writing shall be entitled as “Flight Aviation Liabilities towards Lost and Damaged Passengers’ Luggages “. This writing shall apply the normative analysis method combined with statutory approach. Indonesia as one of the country whose aviation business had emerged fast recently, indicated through the increasing quantity of airline services. Contrastingly, such phenomenon had been inflicted by the lack of response and seriousness of numerous aviation services in terms of claim during the lost or damaged luggages of passengers’ occured. Consequently, this condition had entered the court without any notification or understanding of the passenger concering the claim of luggage mechanism which is considered complicated and imbalance amount of compensation.

Abstract

This scientific study entitled Collateral In Islamic Banks Financing,motivated by a fact that many financing activities that do not run smoothlybecause the customer is unable to meet its obligations to the bank. To prevent this,Islamic banks are required to apply the precautionary principle, one of whichincludes collateral for customers who submit funding recipients. The purpose ofthis study was to find out the existence of collateral in the Islamic banks financingand to find out actions of Islamic banks in terms of customer facilities recipientwhich does not meet its obligations to the bank. This research was a legalresearch which used empirical legal research methods by conducting researchdirectly in Denpasar. As a conclusion, it was found that the collateral in financingof Islamic banks was essential thing that must exist, it became a virtue that bankshave certainty and guarantee the repayment obligations of the receiving facilitycustomers. In case of the customer could not meet its obligations to the bank,then the action taken Islamic banks were taking action in the form of rescuing thefinancial by rescheduling, reconditioning, and restructuring, and if such effortsstill can not resolve the problem then the next action bank will pursue financialtroubles by executing collateral.

Abstract

The term of Fiduciary has known in Article 1 paragraph 2 of Act 42 of 1999 about Fiduciary which says that Fiduciary is a guarantee of the moving objects, both tangible and intangible, as defined in Law Nomer 4 of 1996 about The Right Dependents, who remain in control of fiduciary giver, as collateral for the repayment of certain debts which gives precedence to the receiver position against other creditors fiduciary. Fiduciary shall be registered through the official Fiduciary registration office, which is The Ministry of Law and Human Rights. So the creditors whom be the first to register the fiduciary is the recipient which considered by the creditor are parties to the agreement fiduciary.

Abstract

The exposure of free market towards Indonesia had ease the access of foreign investor in conducting investment in Indonesia. However, during its application, both foreign and national investor shall be liable in order to gain optimal results for both the investor and Indonesia. This paper shall be composed to discover the liability of foreign investor pursuant to Law No 25 of 2007 concerning Investment. By applying the method of normative legal research and statutory approach, this writing shall enunciate Article 16 of respective law as the legal instrument in conducting the capital investment in Indonesia explicitly.

Abstract

AYDA is one alternative to a takeover of problem loan taken by PT. BPR Tata Anjung Sari to decrease the number of problem loan. AYDA process has some drawbacks one of which is the presence of interested third parties who are not willing bank to taken their collateral. If this happens then the PT. BPR Tata Anjung Sari will take restructure loans. If restructuring was not successful then the bank will do the write-off of the loan. Key words : Bank, AYDA, Problem Loan, Collateral

Abstract

The Capital Market is one part of money market (financial Market) in general besides money market which has important role for the national development, particularly for the development of business as one of the alternative source external financing by a company. This paper uses analytical methods and approaches normative statutory. The purpose of this paper is to reveal the extent of the role and authority of the notary in The Capital Market. In conclusion that its function as a notary in the state officials in The Capital Market besides subject and obedient to the laws governing The Capital Market legislation.

Abstract

Journal entitled “Liability of PT. Lion Mentari Airlines as flight company toconsumers in flight delayed and cancelation of flight (Case Study: Denpasar’s DistrictCourt decision number: 641/PDT.G/2011/PN.DPS is based oftentimes consumersespecially flight consumers complaint the services was given if there is delayed orcancelation of flight in organizing air freight. So that, important to know how legalliability in practice of Lion Mentari Airlines Company in Denpasar as flight company to consumers about flight delayed and cancelation of flight based on law and throughDenpasar’s District Court decision number : 641/PDT.G/2011/PN.DPS.The writing method that used is the empirical laws. Based on researching result inNgurah Rai International Airport, Lion Mentari Airlines Company always givescompensation caused flight delayed or cancelation of flight to the consumers, but theenforcement of that liability obstructed by services factor. In accordance with theDenpasar’s District Court decision number : 641/PDT.G/2011/PN.DPS, Lion MentariAirlines Company only gives compensation like as drinks and snack and offers ticketrefund, but can’t help flight diversion (to another flight company).

Abstract

People who do not have enough funds to start the business activities and to acquire goods usually will try to borrow money through bank credit, both productive and consumer credit loans. Productive loans are loans given to businesses that producegoods and services, while consumer loans are loans given to the general public as individuals to make ends meet. The goal is to be able to describe the non-performing loans with mortgage guarantees, as well as to find out the resolution of problem loans in the loan agreement with a banking institution mortgage guarantees. Research carried out by the fact that there are in the field of settlement of non-performing loans in the loan  agreement with collateral mortgage. Settlement of bad loans tied to mortgage the bank before the bank doing the auction, the bank will make efforts to rescue the credit through credit prior to the completion of the restructuring of bad loans.
