Abstract

ABSTRACT The current development of the highway is like a series of calculations while the growth of society is like a measuring series. Increased mobility on the highway can give birth to various traffic problems. Traffic problems are a very complicated thing. The increasingly congested state of the road with the increasing amount of vehicle traffic is one of the causes. For example, violations of traffic signs, congestion, accidents, air pollution, and so on. This study uses a socio-legal research approach by finding the reality of the law. Socio-legal research mainly examines primary data in addition to also collecting data sourced from secondary data. In terms of policies in suppressing traffic violations, there are 2 policies carried out by the South Kalimantan Regional Police. The first is Preventive Policy including Traffic Engineering, Traffic Guarding, and Socialization / Campaign. Second, repressive policies include the provision of tickets, confiscation of vehicles, and letters of reprimand or verbal reprimand. Factors that affect the peaceful settlement of criminal fines are as follows: a). The economic factor is affecting people's behavior in solving traffic problems, this is because taking the road peacefully does not require a lot of costs when compared to having to wait for the results of a court decision. b). Emotional closeness is a factor that until now is still difficult to avoid by police officers because the community and family kinship system are associated with law enforcement efforts. c). Cultural factors in solving the criminal problem of fines peacefully are influenced by cultural factors of society that are more likely to choose a peaceful solution. d). Institutional immunity factors to the law, this is due to the emergence of exceptions for a certain group in society that occupies a certain position, such as a large family of Police. Keywords : Violations, Traffic, Indonesian Republic Police.       ABSTRAK Saat ini perkembangan jalan raya bagaikan deret hitung sedangkan pertumbuhan masyarakat seperti deret ukur. Dengan bertambahnya mobilitas di jalan raya dapat melahirkan berbagai masalah lalu lintas. Masalah lalu lintas merupakan hal yang sangat rumit. Keadaan jalan yang semakin padat dengan jumlah lalu lintas kendaraan yang semakin meningkat tersebut, merupakan salah satu penyebabnya. Misalnya saja pelanggaran rambu-rambu lalu lintas, kemacetan, kecelakaan, polusi udara, dan lain sebagainya. Metode Pendekatan Pada penelitian ini menggunakan jenis penelitian Yuridis Sosiologis, Yuridis Sosiologis yaitu dengan menemukan kenyataan hukum yang dialami dilapangan atau suatu pendekatan yang berpangkal pada permasalahan mengenai hal yang bersifat yuridis serta kenyataan yang ada. Penelitian hukum yuridis sosiologis terutama meneliti data primer di samping juga mengumpulkan data yang bersumber dari data sekunder. Dalam hal kebijakan dalam menekan pelanggaran lalu lintas ada 2 kebijakan yang dilakukan oleh Polda Kalimantan Selatan. Yang pertama adalah Kebijakan Preventif diantaranya Rekayasa Lalu Lintas, Penjagaan Lalu Lintas, Sosialisasi/Kampanye. Kedua, kebijakan represif diantaranya Pemberian surat Tilang, penyitaan kendaraan dan Surat teguran atau Teguran Lisan. Faktor  yang mempengaruhi penyelesaian pidana denda secara damai sebagai berikut: a). Faktor ekonomi Faktor ekonomi memberikan pengaruh terhadap perilaku masyarakat dalam menyelesaikan permasalahan lalu lintas, hal ini disebabkan oleh karena dengan menempuh jalan damai tidak memerlukan biaya yang banyak jika dibandingkan dengan harus menunggu hasil keputusan pengadilan. b). Faktor kedekatan emosional, Kedekatan emosional ini merupakan suatu faktor yang sampai saat ini masih sulit untuk dihindari oleh pihak petugas kepolisian, karena sistem kekerabatan masyarakat maupun kekeluargaan dikaitkan dengan upaya penegakan hukum. c). Faktor kultur Dalam menyelesaikan permasalahan pidana denda secara damai, dipengaruhi oleh factor budaya masyarakat yang lebih cenderung untuk memilih penyelesaiannya secara damai. d). Faktor kekebalan institusional terhadap hukum, Hal ini disebabkan oleh timbulnya pengecualian bagi suatu golongan tertentu dalam masyarakat yang menduduki posisi tertentu, seperti keluarga besar Polri. Kata Kunci : Pelanggaran, Lalu Lintas, Polisi Republik Indonesia.

Abstract

Later, there were reports about defamation allegations by various parties. The causes vary, ranging from writing on mailing lists, forwarding emails, reporting corruption, reporting events in the media, revealing research results, and a series of other actions. This study aims to describe the legal arrangements regarding defamation in Indonesian criminal law and criminal sanctions for perpetrators of criminal defamation through the internet media. The type of research used is normative legal research, that is, research that focuses on norms and this research requires legal materials as the main data. Meanwhile, the nature of the research that the author uses is research that is descriptive analytical in the sense that all legal materials that the author gets will be described and described and then analyzed. The results showed that: The regulation of defamation law as stipulated in the Criminal Code interprets that, the main element of the criminal act of defamation is the intention to attack a person's honor or good name so that the general public knows about it, as well as the absence of elements for the public interest and / or self-defense in it. This criminal act of defamation is also a complaint, where a person who defames another person cannot be prosecuted if there is no complaint from the person who has been defamed, as stipulated in Article 319 of the Criminal Code. As for the criminal liability for perpetrators of criminal defamation in the ITE Law, this is contained in article 51 paragraph (2) of Law Number 11 of 2008 concerning Electronic Information and Transactions in which a person who disseminates electronic information that contains insults and/or defamation and results in losses to others will be subject to a maximum prison penalty of 12 years and/or a maximum fine of 12 billion rupiah.

Abstract

The digital era has brought about a fundamental transformation in the communication patterns of Indonesian society through social media platforms, while at the same time giving rise to complex challenges in the field of criminal law. The Constitutional Court Decision No. 105/PUU-XXII/2024, issued on April 29, 2025, has shifted the legal paradigm of defamation by restricting the object of the offense solely to individual persons. This study analyzes the evolution of legal regulation of defamation in the digital era, the impact of the Constitutional Court’s decision on freedom of expression, and the challenges in implementing Law No. 1 of 2024 concerning the Second Amendment to the Electronic Information and Transactions Law (ITE Law) in law enforcement practices. Social media has become a virtual public sphere that can influence the reputation of both individuals and institutions with unlimited speed and reach, thereby requiring adaptive legal regulation (Rumondor et al., 2024). This research employs a normative juridical method with a statutory approach and judicial decision analysis. The analysis shows that although the Constitutional Court’s decision provides broader space for criticism of public institutions, technical challenges and legal harmonization still require regulatory strengthening and capacity-building for law enforcement officials. This study recommends the necessity of comprehensive dissemination to law enforcement authorities, the development of standardized operational procedures, and the enhancement of digital literacy among the public to prevent criminal defamation through social media.

Abstract

Health development in Indonesia continues to face major challenges, particularly in fulfilling community nutrition needs, as reflected in the high prevalence of stunting, wasting, and malnutrition. From a human rights perspective, the rights to health and food are interrelated and require integrated policy implementation. Through the Free Nutritious Meal Program (MBG), the government seeks to fulfill nutritional needs while carrying out its responsibility to guarantee the rights to health and food. This study aims to analyze the regulation of the rights to health and food within the Indonesian legal system and examine the integration of both rights into the Free Nutritious Meal Program as a human rights–based policy using normative legal research methods with statutory, conceptual, and human rights approaches. The findings show that the rights to health and food already have a strong normative basis in the 1945 Constitution and related legislation; however, existing regulations remain sectoral and lack an integrated framework. The study also identifies potential conflicts between fulfilling the rights to health and food and the right to education, particularly regarding state budget allocation, as the Free Nutritious Meal Program may create budgetary pressure on the education sector, thereby requiring regulatory harmonization to ensure balanced fulfillment of all human rights.

Abstract

One of the significant challenges in criminal law is the prevalence of narcotics offenses committed by recidivists—individuals who reoffend after having previously served a sentence. Recidivist status creates complex juridical dilemmas, as it serves as a statutory ground for sentence aggravation, often resulting in severe verdicts ranging from life imprisonment to the death penalty. This practice triggers a debate regarding the fundamental objectives of sentencing, where judges are compelled to strike a balance between retribution (retributive justice) to ensure deterrence, prevention (preventative justice), and rehabilitation (rehabilitative justice) aimed at social reintegration. This study aims to examine the legal framework governing narcotics offenses under Law Number 35 of 2009 concerning Narcotics and the specific sentencing mechanisms applied to repeat offenders. This research employs a normative legal methodology, utilizing secondary data through library research to analyze relevant statutes and legal literature. The findings demonstrate that the sentencing system under the Narcotics Law mandates aggravated penalties for offenders involved in organized networks, those involving minors, and those with recidivist status. Sentencing for narcotics recidivists emphasizes enhanced sanctions; while Articles 486 to 488 of the Criminal Code (KUHP) establish general provisions for recidivism, Article 144 of Law Number 35 of 2009 specifically stipulates that recidivists may be subject to an additional one-third of the maximum prescribed penalty.

Abstract

Negara Republik indonesia adalah negara hukum yang berdasarkan pancasila dan Undang-undang Dasar 1945, oleh karena itu bahwa semua aspek hukum yang berlaku di indonesia harus bernafaskan pancasilan dan Undang-undang Dasar 1945, yang mengakui adanya jaminan perlindungan hak asasi manusia, kesamaan kedudukan dalam hukum, dengan penekanan pada keseimbangan antara hak dan kewajiban, serta antara kepentingan individu dan masyarakat umum. Perlindungan ini perlu karena secara implisit sesuai dengan asas praduga takbersalah bagi setiap orang yang diadili karena diduga melakukan pelanggaran hukum, sehingga hak-hak tersebut dapat diwujudkan. Hak-hak tersangka dan terdakwa dalam proses persidangan sebagaimana yang diatur dalam Undang-undang Nomor 8 tahun 1981 tentang Kitab Undang-undang Hukum Acara Pidana. Tersangka memiliki hak-hak tersendiri baik proses penangkapan, proses penahanan dan proses penggeledahan. Begitujuga terdakwa memiliki hak-hak sebagaimana yang diatur dalam Kitab Undang-undang Hukum Acara Pidana.

Abstract

Restorative justice atau sering diterjemahkan sebagai keadilan restoratif, merupakan suatu model pendekatan yang muncul pada era tahun 1960-an dalam upaya penyelesaian perkara tindak pidana, yang berbeda dengan pendekatan yang dipakai dalam sistem peradilan pidana konvensional, pendekatan ini menitik beratkan pada adanya partisipasi langsung pelaku tindak pidana, korban dan masyarakat dalam proses penyelesaian perkara pidana. Secara umum tindak pidana terhadap tubuh pada KUHP disebut “penganiayaan”, mengenai arti dan makna kata penganiayaan tersebut banyak perbedaan diantara para ahli hukum dalam memahaminya. Penelitian ini bertujuan untuk mengetahui dan menganalisa terkait implementasi prinsip restorative justice pada perkara tindak pidana penganiayaan di Polresta Banjarmasin, serta untuk mengetahui dan menganalisa hambatan dan upaya Polresta Banjarmasin dalam melaksanakan restorative justice pada perkara penganiayaan. Adapun jenis penelitian yang digunakan adalah penelitian hukum empiris, dengan sifat penelitian deskriptif. Lokasi Penelitian ini dilaksanakan di Polresta Banjarmasin, adapun teknik yang digunakan dalam pengumpulan data ini yaitu dengan studi dokumen, observasi, dan wawancara. Teknik penentuan sampel yang digunakan adalah teknik Non Probability Sampling dan penentuan subjeknya menggunakan teknik Purposive Sampling sedangkan teknik pengolahan dan analisis data disusun secara kualitatif. Hasil penelitian menunjukan bahwa implementasi prinsip restorative justice pada perkara tindak pidana penganiayaan di Polresta Banjarmasin sudah berjalan sesuai dengan prosedural berdasarkan Peraturan Kepolisian RI Nomor 8 Tahun 2021 Tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif. Hambatan dan Upaya Polresta Banjarmasin dalam melaksanakan restorative justice pada perkara penganiayaan berasal dari masyarakat yang kurang paham mengenai adanya penyelesaian perkara dengan prinsip Restorative justice.
