Abstract

This research focuses on the implementation of Village Funds in Jambi Luar Kota Subdistrict, Muaro Jambi Regency in the preservation of customary villages, where villages are autonomous regions with the passing of Law Number 6 of 2014 concerning Villages. The Village Law also provides a breath of fresh air regarding the escape of customary villages, where the previous regulations have not yet brought back the customary village clearly and firmly, but with the emergence of the Village Law it is sufficient to accommodate the Village to continue to maintain and maintain the values ​​of local wisdom. This study uses a descriptive approach, with interview data collection techniques. The Village Adat Institution must be able to cover all aspects, both in terms of customary Village management, supervision of traditional villages, customary Village government to customary Village Regulations, with the presence of Customary Institutions and having a significant role in maintaining and maintaining local cultural values ​​amidst diversity. in society, being able to implement its role without injuring the law, religious values, diversity and so on, but accelerating the realization of an Independent Village without having to erode the original culture of Jambi Luar Kota Subdistrict. The results of this research show that the implementation has been proven proven by ratifying it. The customary institutions in Jambi Luar Kota Subdistrict, it's just not optimal, because the Customary Institution is still focused on internal organizations, customary village regulations and the procurement of Sombolis infentary which is considered one of the local cultural treasures.

Abstract

Kematian seseorang memberikan akibat hukum kepada diri, keluarga, masyarakat, dan lingkungan sekitarnya. Kematian menimbulkan kewajiban orang lain bagi dirinya (si mayit) yang berkaitan dalam hal mengurus jenazahnya (fardhu kifayah). Akibat lain adalah hubungan hukum yang menyangkut hak para keluarganya (ahli waris) terhadap harta peninggalannya. Tujuan penelitian adalah untuk memperoleh pemahaman yang utuh dan mendalam mengenai Pelaksanaan pembagian waris menurut Hukum Waris Adat Melayu Jambi. Penelitian ini menggunakan tipe penelitian yuridis empiris, untuk melihat kenyataan dan fakta sosial sebagai budaya hidup Hasil Penelitian menunjukan pembagian waris belum bisa dilakukan pada saat pewaris meninggal, ttapi menunggu waktu yang tepat. Pelaksanaan pembagian waris menurut Hukum Waris Adat Melayu Jambi dilakukan dengan tiga cara, cara rukun dan damai, dibagi oleh penguasa adat dan melalui peradilan adat dalam dusun.

Abstract

Pernikahan seringkali dianggap sebagai perayaan dan juga sebagai tonggak sejarah dalam kehidupan manusia dewasa di seluruh dunia. Mengingat pernikahan sebagai tonggak sejarah dalam kehidupan manusia, pemerintah telah mengeluarkan usia dewasa pernikahan atau Marriage Age Maturity (MAM) pada tahun 2006. Undang- Undang (UU) Nomor 16 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 1 Tahun 2014 tentang Perkawinan menyebutkan, “pernikahan hanya diizinkan jika pihak pria dan wanita sudah mencapai umur 19 tahun”. Mengingat salah satu tugas perkembangan individu dewasa awal dengan rentang usia 19-25 tahun adalah menikah dan menjadi orangtua. Dampak yang timbul dari perkawinan dini yang berkaitan kesehatan dan kesejahteraan telah diakui secara luas. Tetapi pada kenyataannya, perkawinan dini tetap dilakukan dengan meminta dispensasi perkawinan dari pengadilan agama. Di Indonesia sendiri tercatat sebanyak 50.673 dispensasi perkawinan yang diputus pada 2022. Untuk mencegah peningkatan angka perkawinan dini ada lima (5) rekomendasi untuk menjamin percepatan pengurangan angka perkawinan dini.

Abstract

This study further highlights the relevancy between patent rights and human rights. The impact of the availability and accessibility of essential medicines necessary for Public Health is significant. This study primarily aims to analyze and examine the relationship of patent rights on medicines and pharmaceutical products with human rights and to criticize and evaluate whether the Indonesian government has a policy configuration in the field of essential drugs and the pharmaceutical industry following the principles that support human rights. This research employed qualitative and normative-juridical methods supported by conceptual, statutory, and legal political approaches. Using the theories of legal objectives, utility, and justice, this research focuses on understanding economic law and human rights.  Through in-depth analysis, this study highlights how the patent system for drugs and pharmaceutical products encourages innovation and faces criticism due to limited access for economically vulnerable groups. Hence, the right to health is hampered while the state is responsible for universal access to affordable health care.   The findings of the study indicate that the Patent Rights on drugs and pharmaceutical products are exclusive rights that intersect with human rights in the drug patent system. Several parameters can be used to examine the relationship between human rights and intellectual property. It is necessary to reform the drug patent system to protect the balance and human rights. The findings contribute to a complex understanding of the relevance of patents to human rights while providing a basis for inclusive and sustainable policy development in the global health domain.

Abstract

Fire is a disaster that is often caused by the negligence of building owners in meeting the required safety standards, threatening both property and human lives. This study aims to evaluate the legal responsibility of building owners within the civil law system, particularly regarding negligence that leads to physical and material losses. The research is conducted using a normative juridical method, focusing on the analysis of relevant regulations, such as Law No. 28 of 2002 on Building Construction, Law No. 24 of 2007 on Disaster Management, and provisions in the Civil Code (KUHPerdata), especially Article 1365.  The research findings indicate that, although existing regulations have outlined the obligations of building owners to prevent fires, the implementation faces various challenges. These challenges include insufficient supervision, suboptimal law enforcement, and lengthy legal processes for victims to obtain justice. The study identifies a gap between legal norms and field practices, resulting in the difficulty of enforcing building owners' responsibilities. Through this study, it is hoped that solutions can be found to strengthen the civil law system, ensuring that building owners are held more accountable and fire prevention efforts are effectively implemented, providing optimal protection for building occupants and users.

Abstract

Changes in the development of digital technology have an impact on every aspect of life, including law. In Indonesia, the demand for electronic notaries has emerged as a form of innovation that promises efficiency. However, various concerns and challenges have emerged. This article discusses the issues faced by law and society as users of notary services. This article also discusses the philosophical and ethical aspects of law regarding the paradigm shift. Legal issues will be answered through an analysis of existing regulations and the legal theories that underlie them, as well as considering community responses. This article concludes that there has been a shift in the notary world that affects the way notaries work and the way society interacts with the law. Regulatory adjustments are needed that are able to adapt to accommodate electronic signatures, digital authenticity, and digital data management to realize effective electronic notaries and consider legal values ​​and ethics. Professional ethics in realizing integrity, transparency, and responsibility must be maintained and translated into a digital context. To achieve legal comparability in electronic notaries, it is important to consider the balance between service accessibility and strict levels of supervision and control.

Abstract

Through the jurisprudential lens of Roscoe Pound, particularly his doctrines of legal realism and sociological jurisprudence, this article explores palm oil plantation management contracts. By situating contract law within the broader framework of social engineering, the study critiques the prevailing contractual practices in Indonesia's palm oil sector, which often privilege corporate profit at the expense of local communities and environmental sustainability. The analysis reveals a persistent asymmetry in power and legal capacity between plantation companies and rural populations, resulting in contracts that fail to deliver substantive justice. Drawing from Pound’s tripartite interest theory, individual, social, and public, the study argues that current contractual frameworks inadequately integrate ethical, ecological, and communal considerations. This research offers a normative proposal to redesign plantation management contracts as instruments of equitable governance. It advocates for a participatory and inclusive legal drafting process that recognizes local wisdom, ensures environmental accountability, and promotes distributive justice. By embedding Roscoe Pound’s vision of law as a dynamic, purposive institution, the article contributes to the evolving discourse on legal reform in natural resource management. Ultimately, it calls for a reconceptualization of contracts not merely as tools of economic transaction but as living legal instruments capable of reconciling corporate interests with the imperatives of social justice and environmental stewardship
