Abstract

This article aims to describe the process of criminal acts solution for domestic violence by using penal mediation and knowing the constraints in its implementation. The research method used is the juridical sociology with the collection of data through observation, interview, and related research. Qualitative descriptive was used for data analysis. Penal mediation process begins with the agreement of the parties for discussion accompanied by investigator as a mediator so that final decision is reached according to both parties’ expectation. Unfortunately, in the implementation, the penal mediation faces some constraints such as no special institution for handling this matter, lack of public trust towards law enforcement, and time limitations. In a nutshell, penal mediation as an alternative dispute resolution in domestic violence is an effective way to support justice.Artikel ini bertujuan mendeskripsikan proses penyelesaian tindak pidana kekerasan dalam rumah tangga dengan menggunakan mediasi penal dan mengetahui kendala – kendala dalam pelaksanaannya. Metode penelitian yang  digunakan adalah yuridis sosiologis dengan pengumpulan data melalui observasi, wawancara, dan penelitian terkait kemudian dianalisa secara diskriptif kualitatif. Proses mediasi penal diawali dengan mempertemukan para pihak untuk bermusyawarah dengan didampingi oleh penyidik sebagai mediator sehingga tercapai penyelesaian perkara sesuai keinginan kedua belah pihak. namun dalam prakteknya mediasi penal mengalami kendala antara lain belum adanya lembaga khusus yang menanungi, kurangnya rasa kepercayaan masyarakat terhadap aparat penegak hukum, keterbatasan waktu. Dari penelitian ini dapat disimpulkan bahwa mediasi penal sebagai alternatif penyelesaian sengketa perkara kekerasan dalam rumah tangga lebih efektif daripada sekedar pemidanaan terhadap pelaku.

Abstract

In Law Number 2 Year 2014 regarding the Amendment of UUJN (UUJN-P) Juncto Law Number 30 of 2004 concerning Notary (UUJN) mentioned that was possible if there is a sign witness or an introducer witness. However, in Notary Law is not yet be regulated explicitly about legal protection for introducer witness who signed in a notarial deed. The purpose of this study was to know the legal protection for the introducer witness who signed in a notarial deed. The Type of research used in this research is normative, with statue approach and the results will be presented descriptively with deductive logic. The result of research shows that legal protection for introducer witness is can’t be sued because he is responsible the formal truth about people to notary only .The benefit of this research is bring information to public about legal protection for the instroducer witness.

Abstract

This paper aims to provide additional knowledge related to increased production and marketing for fish cracker craftsmen. The method used is the method of mentoring and workshops, with partners being fish cracker craftsmen in the sawohan area of ​​Sidoarjo. The result of this assistance is an increase in production and marketing from partners.

Abstract

This study aims to find out whether the judge's decision number 230/G/TF/2019/PTUN-JKT is in accordance with human rights regulations and also to find out whether internet access rights are part of human rights. The research method that the author uses is a normative juridical approach using a case approach or commonly known as the case approach. The conclusion of this study explains that internet access rights are part of Human Rights (HAM) because they both contain elements of freedom of expression and seek, convey and receive information without any restrictions. If there is a policy that limits internet access rights, then the policy is the same as limiting Human Rights and the policy can be said to be a violation of Human Rights. In decision number 230/G/TF/2019/PTUN-JKT, the Panel of Judges concluded that the actions of the defendants constituted a limitation on Human Rights (HAM) and that the action contained legal void so that the Panel of Judges decided that the action was against the law.

Abstract

BPJS health is a government program to guarantee the health of the people. In fact there are still health-care providers who do not perform their functions properly because they refuse patients participating BPJS health. This study aims to determine the legal protection for patients participating BJPS health and find out whether the hospital in bekasi violate. This research uses normative method with approach of regulation of law. Patient's legal protection of health BPJS that is rejected by the hospital ie the patient can sue through general court or special authorized institution. The rejection of the patient by the hospital home is the responsibility of BPJS Health and the hospital is responsible for the negligence of his medical personnel. This research is useful for writers and readers to increase knowledge about legal protection of BPJS participants' patients, for legal practitioner is expected to give input about solving problem of patient protection of patient health BPJS for hospital rejection to give health service.

Abstract

In Indonesia, the act of mistreatment has been done by a teacher to the students in the school has often happened. The form make physical contact or beating to the limbs of students. Appropriate sanctions are required so that the settlement of violent cases can be resolved thoroughly and fairly. This type of research uses juridical-normative approach with chase approach (case approach) and the source of law is from Court Decision Number 44 / Pid.Sus /2015/PN.Pbm. The results can be concluded, among others, the decision imposed by the court is not in accordance with those contained in the applicable legislation. The way the violent act cannot solve a problem but instead raises a problem for the teacher himself. For teachers who commit acts of violence against their students can not be excluded to be sanctioned.

Abstract

The principle of Good Governance contains Transparency, which is transparent and Accountability which explains that the procurement of goods and services in the Village needs to be regulated in a regulation that can guarantee legal certainty and produce goods and goods that are qualified. There were many different interpretations in each region which resulted in the vulnerability of misuse of rules, methods, to the determination of winners at a smaller level, one of them was in the Village Alert Operational Car Procurement in Rangkah Kidul Village, Sidoarjo. In the research, the procurement of Village Alert Operational Cars in Rangkah Kidul Sidoarjo Village used normative followed by case studies that looked at and observed the procurement. In fact the procurement is not based on the principle of openness and accountability. Besides that in nominal prices, accountability to the Rangkah Kidul village government in Sidoarjo is not worthy of being said as a good village government because it is not appropriate in the application of the General Principles of Good / Decent Governance.

Abstract

This study aims to analyze the legal considerations made by the judge to sentence the defendant in a criminal case of insulting idiots in Ahmaddhaniprast's Instagram vlog. This research is based on the judge's decision which does not pay attention to the juridical facts and only pays attention to the indictment and the demands of the Public Prosecutor. Methods This research uses a normative legal research type that examines primary legal materials and secondary legal materials using the following approaches: legislation approach; and case approach, as well as descriptive qualitative analysis of legal materials. The results of this study indicate that the legal considerations made by the Judge in Decision No. 275/Pid.Sus/2019/Pn.Sby., only paid attention to the Indictment and the demands of the Public Prosecutor and ignored the Defendant's Statements, Witness Statements, Expert Witness Statements and Evidence. in the trial, so that the judge's decision is not in accordance with the legal facts that occurred. The judge was not right in applying the rules in making a decision based on Article 27 paragraph (3) ITE by referring to Articles 310 and 311 of the Criminal Code regarding blasphemy and slandering someone who has committed a certain act, due to the fact that idiotic remarks were not directed or accused at someone. The judge should have enforced the provisions of Article 27 paragraph (3) of the ITE Law by referring to Article 315 of the Criminal Code, because the element of light humiliation (eenvoudige belediging) was fulfilled as stated by witnesses, expert witnesses and the statements of the Defendant.

Abstract

This study looks at efforts to identify and analyze the juridical selection of the courtroom Number 16PID.SUS/2019/PN.Drh regarding Criminal Sanctions for Teachers Who Do Violence Against Students. And to find out and analyze the correctional basis used by judges in formulating decisions and making choices of punishment in their choices. The form of this research includes juridical-normative research, with a case approach, primary prison substance regulations Number 35 of 2014 concerning Amendments to Regulation Number 23 of 2002 concerning Infant Safety, Regulation Number 14 of 2014 2005 concerning Teachers and Lecturers. And Court Decision Number 16/PID.SUS/2019/PN.Drh, Deductive Information Analysis. The results of this study indicate that the juridical analysis of the selection of case files Number 16/PID.SUS/2019/PN.Drh concerning Criminal Sanctions for Teachers Who Do Violence against Students is not in accordance with the applicable laws and regulations. and policies, the basis of imprisonment used by judges in preparing decisions and sentencing in optional decisions, including the law on honorary teachers and teachers 14 of 2015 article 2 paragraph (4) and (five), then article 39 of a government regulation. Law of the Republic of Indonesia Number 19 of 2017 concerning Teachers and the Purpose for Their Students to Become Great Babies is not a crime.

Abstract

The purpose of this study is to analyze law enforcement practices on the criminal acts of protected wildlife trade and analyze legal considerations by judges on Decision No. 3295/Pid.B/LH/2019/PN. Sby. The results show that law enforcement practices on the criminal act of trafficking protected animals is referring to Law No. 5 of 1990 on Conservation of Biological Natural Resources and Ecosystems. The results also showed that the legal consideration by the judge on The Verdict Number: 3295/Pid.B/LH/2019/PN. Sby has considered sociological, philosophical and juridical considerations so that the granting of imprisonment for 1 (one) year and a fine of Rp 25,000,000 (twenty-five million rupiah) provided that if the fine is not paid will be replaced with a fine of 1 (one) month in prison is considered appropriate and effective.
