Abstract

The purpose of this study is to analyze law enforcement practices on the criminal acts of protected wildlife trade and analyze legal considerations by judges on Decision No. 3295/Pid.B/LH/2019/PN. Sby. The results show that law enforcement practices on the criminal act of trafficking protected animals is referring to Law No. 5 of 1990 on Conservation of Biological Natural Resources and Ecosystems. The results also showed that the legal consideration by the judge on The Verdict Number: 3295/Pid.B/LH/2019/PN. Sby has considered sociological, philosophical and juridical considerations so that the granting of imprisonment for 1 (one) year and a fine of Rp 25,000,000 (twenty-five million rupiah) provided that if the fine is not paid will be replaced with a fine of 1 (one) month in prison is considered appropriate and effective.

Abstract

This study aims to measure the effectiveness of the Social Security Agency Regulation No. 5 of 2020 and look for factors that hinder the implementation of this regulation in Sidoarjo. The research method used in this paper is sociological juridical using an empirical approach. The results of the study indicate that there is a different application from what has been regulated in the Regulation of the Social Security Agency Number 5 of 2020. This regulation is considered ineffective, because this regulation is fictitious and cannot be implemented properly. Factors that hinder the implementation of this regulation are communication factors, resource factors and also bureaucratic factors, making this regulation difficult to implement

Abstract

Tujuan dari penelitian ini untuk mengetahui dan menganalisa perlindungan hukum bagi perempuan korban pelecehan seksual di ruang publik. Metode yang digunakan dalam penelitian ini adalah menggunakan metode hukum normatif atau juga disebut penelitian doktrinal. Pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan perundang–undangan. Hasil penelitian menunjukkan pada kenyataannya perlindungan hukum bagi perempuan korban pelecehan seksual yang dilakukan diruang publik belum maksimal. Hal ini disebabkan peraturan perundangan yang ada yang tidak sepenuhnya mendukung terlindunginya korban. Dalam hukum pidana Indonesia pelecehan seksual belum diatur secara khusus sehingga pasal yang diterapkan masih tidak pasti.  Sementara itu peraturan perundang-undangan di Indonesia hanya mengatur permasalahan kekerasan seksual yang bersifat fisik saja. Sedangkan pelecehan seksual yang dilakukan di ruang publik yang dilakukan secara verbal hingga saat ini belum diatur dalam peraturan yang mengatur masalah ini.

Abstract

This study aimed to assess the compliance of the decision made by the Kepanjen District Court Number 1 /Pid.Sus-Child/2020/Pn Kpn with the provisions of criminal law book of article 49 paragraph 1 and paragraph 2, which govern forced defense as a means of self-defense. Using the normative method, the study examined legal literature to establish the truth of the matter. The study found that a forced defense must adhere to the principles of proportionality and subsidiarity to be considered legitimate. The conclusion drawn from this study is that the decision of the Kepanjen District Court must be evaluated based on these two requirements to establish the legal truth of the matter. Highlights: Proportional and subsidiarity requirements are essential for a forced defense to be considered legitimate. Excessive actions that go beyond the threat faced may not be considered a forced defense. The actions of the victim must be considered in evaluating the legitimacy of a forced defense.

Abstract

This data article presents a comprehensive analysis of scholarly works on the intersection of Cyber Law and fingerprints. Using the lens.org database, we employed specific filters, including the document type (Journal article) and subject (Law), to retrieve relevant articles. We examined nine key visualizations to explore the fields of study covered by active institutions, identify prolific authors, highlight leading countries in this domain, track scholarly works over time, visualize relationships within scholarly works, pinpoint top fields of study, unveil prominent institution names, reveal top journals by publishers, and spotlight influential publishers. Abstract

This data article presents an analysis of 100 journal articles on digital forensics and "organization & administration" within the realm of law, collected from Lens.org spanning 2012 to 2022. The study aimed to quantify the presence of articles related to these keywords, revealing the University of Edinburgh as the top institution and political science as the most active field. Eoghan Casey and Olivier Ribaux emerged as prolific authors, while the United Kingdom stood out as the most active country, and Elsevier as the primary publisher. Abstract

This research delves into the pervasive issue of cyber abuse within the realm of cyber law, employing data from Lens.org to unravel critical insights. By searching scholarly works using keywords "Cyberlaw OR Cyber Law AND Abuse" and filtering the results to focus on the legal category, a comprehensive dataset comprising 22,138 journal articles was curated. The study sheds light on the evolution of cyber abuse from 2015 to 2020, indicating a persistent concern despite slight declines in recent years. Psychology emerged as the primary field of study, with 6,971 journals dedicated to the topic, followed closely by Criminology and Sociology. The most active institutions in addressing abuse-related subjects include Deakin University, University of Nebraska, School of Law, and University of Washington. Noteworthy trends were observed in the geographical distribution of research efforts, emphasizing the global impact of cyber abuse. The data also uncovered a prolific scholarly output, with institutions and authors actively contributing to the discourse. This dataset serves as a crucial resource for legal scholars, policymakers, and law enforcement agencies, offering deep insights into the multifaceted challenges of cyber abuse and paving the way for informed legal reforms and social interventions. Active institutions encompassed various subjects. Key authors were Frank Ramsthaler and Guy Willems, each contributing two documents.
