Abstract

Indonesian Constitution states that all people of Indonesia are entitled to equal treatment before the law as stated in Article 28 D, paragraph 1 of the 1945 Constitution, but they are not always easily access it. The principle of justice is simple, fast and low cost can’t be reached by most people. Currently, there is also a change and dynamics of complex societies and regulations in some legislation. It also has implications on the public nature of the criminal law has shifted its relative entered the private sphere with known and practiced penal mediation. Issues raised in this paper is the concept of criminal law enforcement based on the existence of pluralistic and penal mediation as an alternative solution-in the practice of the criminal settlement. Of the studies that have been done that the concept of legal pluralism is no longer emphasizes the dichotomy between the legal system of the state on the one hand with the legal system of the people folk law and religious law on the other side. That law enforcement-based pluralistic more emphasis on interaction and co-existence of the workings of the various legal systems that affect the operation of norms, processes and institutions in masyarakat.Polarisasi law and penal mediation mechanisms can do, as long as it is earnestly desired by all parties ( suspects and victims), as well as to reach a wider interest, namely the maintenance of social harmony. In summary penal mediation would have positive implications philosophically that achieved justice done fast, simple and inexpensive because the parties involved are relatively small compared through the judicial process with the components of the Criminal Justice System

Abstract

AbstractThe object of this research is the implementation /action network Judicial Commission related to the han- dling of cases of corruption by judges in an area that has not been optimal. This is due to the problem of monitoring the process of setting standards in the area of   Corruption case management for KY’s networking and the existence of the unit in action KY networks area have become the un- ‘established’ unit and weren’t able to synergize with stakeholders. This study is an empirical law with the facts of observation methods in the study site and KY’s data / case as a basis of search results in the form of ‘action’ which refers to the legislation in force, so that the design and methods of a blend of legal research methods and sociological research methods. The findings in this study indicate that in action, yet coordinated network of KY, there is no standardization of the process of monitoring the behavior of judges in the handling of cases, and the lack of synergy between KY’s networking with stakeholders.Keywords : network, action, monitoring, unit complain, Judicial CommissionAbstrakObjek penelitian ini adalah pelaksanaan/aksi jejaring Komisi Yudisial terkait penanganan kasus tindak pidana korupsi oleh hakim di daerah yang selama ini belum optimal. Hal tersebut disebabkan adanya permasalahan mengenai pengaturan standarisasi proses pemantauan penanganan perkara Tipikor di daerah bagi jejaring KY dan mengenai keberadaan unit aksi jejaring KY di daerah belum menjadi unit yang ‘mapan’ dan mampu bersinergi dengan pihak-pihak pemangku kepentingan (stake holder). Penelitian ini merupakan penelitian hukum empiris dengan metode observasi pada fakta di lokasi penelitian dan data/perkara Tipikor yang dimiliki KY sebagai dasar pencarian hasil penelitian berupa ‘tindakan/aksi’ yang mengacu pada peraturan perundang-undangan yang berlaku, sehingga desain dan metodenya merupakan perpaduan antara metode penelitian hukum dan metode penelitian sosiologis. Temuan dalam penelitian ini menunjukkan bahwa dalam aksinya, jejaring KY belum terkoordinasi, belum ada standarisasi proses pemantauan perilaku Hakim dalam penanganan perkara, serta belum adanya sinergi antara jejaring KY dengan pemangku kepentinganKata kunci : jejaring , aksi, monitoring, unit complain, Komisi Yudisial

Abstract

In this pandemic situation, public awareness about the dangers of the COVID-19 pandemic is still low or lacking. The daily activities of the community, including in Kelurahan Sabiyan, are still running normally, they are still socializing and working normally, community activities that are crowd-nature are still often encountered and many even ignore health protocols. They feel safe and out of control because no one has become a victim of Covid yet. The activities carried out were indirect counseling on behavior in the new normal era, making and distributing masks as well as making and distributing traditional drinks made from spices. The method used in this service activity is indirect counseling and indirect training in the form of tutorials for making masks and making traditional spices. This activity is in synergy with the activities of the Trunojoyo University KKN students. The implementation was carried out during the KKN period, namely making traditional drinks made from spices and Madura batik masks, which were documented and disseminated through the YouTube media so that they could be accessed by the wider community. Achievements targeted with the target community are aware and obedient to following health protocols in activities outside the home to be protected from the threat of the dangers of the Covid 19 virus.

Abstract

Indonesia already has legal instruments related to storing and hoarding staple food: Law No.18 of 2012 on Food and Law No. 7 of 2014 on Trade. Repressive and preventive efforts havebeen carried out to combat this problem. However, it is far from what expected resulted inthe frequent occurrences of food hoarding to date. The condition raises questions on how tomake an effective law enforcement in preventing recurring food hoarding in Indonesia. Toknow the effectiveness of law enforcement as an effort to overcome the stockpiling of thebasic commodity, the theory of legal system is used. From the study conducted, it is proventhat the law enforcement of food hoarding is still ineffective. In addition, the Trade MinisterRegulation (Permendag), as mandated by Article 53 of Law No.18 of 2001., has yet to issuethe technical regulations which contribute to the failing in the substance of Food Law.Moreover, it is necessary to limit the prohibited number/quantity of staple food to store orhoard through government stipulation. From the structural side, there exists a sectoral egowithin institutions having authority on food security. Therefore, to establish a strong nationalfood institution which has a cross-sectoral authority is urgently required. The lack of controlfrom the society in the form of community participation in combating food hoarding crimehas more or less contributed to the ineffectiveness of law enforcement.

Abstract

Permasalahan yang dapat dikemukakan adalah: (1) Bagaimanakah bentuk-bentuk tindak pidana iklan yang menyesatkan dalam UU Perlindungan konsumen (2) Siapakah yang bertanggung jawab terhadap iklan yang menyesatkan dan (3) Apa yang menjadi hambatan-hambatan dalam penegakan hukumnya. Iklan yang menyesatkan telah diatur dalam UU No. 8 Th. 1999, tentang perilaku periklanan yang terkandung dalam pasal 9, 10, 12, 13,dan 17. Sedangkan tanggung jawab atas suatu iklan yang diproduksi terkandung dalam pasal 19 dan 20. Hambatan-hambatan dalam penegakan hukum terhadap iklan yang menyesatkan banyak ditentukan oleh faktor masyarakat itu sendiri sebagai konsumen suatu produk yang sering kali bersikap pasif.

Abstract

AbstractTanah Merah Dajah Village is not too far from the city of Bangkalan, it does not mean that the community has enough information about many things. Limited access and varying levels of education, economic conditions and a wrong understanding of religion, socially there are quite serious problems in society, namely about violence in the household. Among the community, including in thevillage community, it Tanah Merah Dajah has become a kind of tradition or habit to cover up acts of violence, especially domestic violence (KDRT) experienced by women and children. Until now, the problem of domestic violence is still considered a disgrace. Even if some of the victims asked for help from village officials, this was done secretly and the purpose of reporting to village officials was to make peace. In practice, the village apparatus conducts mediation to bridge these problems, so that the problems do not spread out. The settlement by the Village Head did not end the domestic violence, but it often repeated itself. The understanding residents of Tanah Merah Dajah Village, Tanah Merah Sub-district regarding domestic violence as a form of crime prior to the implementation of the legal socialization program is still low. This can be seen from the perception of society that views domestic violence as a personal matter which is a disgrace and must be kept tightly, even with family.Keywords: Legal Awareness, Domestic, Violent, Crimes

Abstract

AbstractThis empirical legal research aims to describe reality factors that caused not established BPSK (Consumer Disputes Resolution Board) in Madura area. Characteristics of Consumer Disputes in Madura  used as early Informed to mapping the factors inhibited BPSK in Madura. In-depth interviews and Focus Group Discussion (FGD) was conducted to mapping of  consumer cases characteristic that happened in Madura, furthermore, this research classified factors that caused not established BPSK in Madura. Results of this study mapping the structural and cultural problems is a major cause for the establishment of BPSK. AbstrakPenelitian hukum empiris ini bertujuan untuk menggambarkan realitas faktor-faktor yang menyebabkan tidak berdirinya  BPSK (Badan Penyelesaian Sengketa Konsumen) di wilayah Madura. Karakteristik sengketa konsumen di wilayah Madura dijadikan informasi awal untuk melakukan pemetaan terhadap faktor-faktor yang menghambat adanya BPSK di Madura. Interview mendalam dan Focus Group Discussion (FGD) digunakan untuk memetakan karakteristik kasus konsumen yang terjadi di Madura, selanjutnya akan di klasifikasikan faktor-faktor apa saja yang menghambat berdirinya BPSK di Madura. Hasil penelitian ini memetakan problem struktural dan budaya menjadi penyebab utama bagi pendirian BPSK.

Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui peran kejaksaan sebagai lembaga penegak hukum bidang penuntutan dan juga ingin mengetahui peran surat dakwaan jaksa penuntut umum dalam penegakan hukum kejahatan korupsi dalam sistem peradilan pidana Indonesia. Metode yang penulis gunakan dalam penulisan ini adalah metode penelitian hukum yuridis normatif dengan menggunakan data sekunder yang berasal dari bahan-bahan hukum yang relevan dengan masalah yang diteliti. Hasil penelitian menunjukkan bahwa peran jaksa sebagai lembaga penegak hukum bidang penuntutan yang diberi kewenangan membuat surat dakwaan khususnya dalam hal pemberantasan korupsi memiliki arti yang sangat penting  dalam mewujudkan tercapainya tujuan hukum. Hal ini dikarenakan jaksa merupakan bagian dari sub sistem peradilan pidana yang ada di Indonesia. Sebagai sub sistem jaksa memiliki kewenangan dalam hal pemberantasan korupsi dengan memberikan tuntutan pidana paling berat kepada pelaku korupsi melalui surat dakwaannya.”

The purpose of this research is to describe the factors that cause business actors to be disadvantaged due to the COD system and protection for business actors against unilateral cancellation in the COD payment system. This research is a type of normative legal research that is descriptive in nature with a qualitative approach. The type of data used is secondary data. Secondary data is obtained from library materials that are relevant to the problems studied.  The data sources used are secondary data sources obtained from primary, secondary and tertiary legal materials. The data collection technique used is the study of documents or library materials.

Abstract

Insulting the shape of the human Body, or what is familiarly known as body shaming, is an action by someone to criticize another individual's body shape, which originates from the imperfection of the body shape generally originates from; body shape is not ideal. Physique is not perfect, or there is a physical disability. The act of insulting the shape of the human Body or body shaming can be carried out verbally by carrying out direct insults aimed at insulting the individual, or an individual can criticize verbally and indirectly; in this case, the use of social media such as TikTok, Instagram, Facebook, Twitter. The research method used in this research is normative research. The results of the discussion obtained are that legally, the criminal act of insulting (body shaming) on social media can be subject to the provisions of the Law on ITE if the insult or body shaming is conveyed on social media and is expressed in the form of insults, ridicule, face, skin colour, and a person's body posture. So, this is included in the category of provisions of Article 27 paragraph (3) in conjunction with Article 45 paragraph (3) of Law No. 19 of 2016 concerning ITE. The legal protection provided to victims in criminal acts of insulting (body shaming) through social media is through LPSK, in the provisions of article 28 paragraph (1) of Law No. 31 of 2014 concerning the Protection of witnesses and victims.
