Abstract

Sharia Financing Savings and Loans Cooperative (KSPPS) as a sharia microfinance institution has an important role in empowering the community's economy based on Islamic principles. One of the challenges faced is the risk of default due to the death of a member, which can have an impact on the sustainability of the institution and raise issues of justice. This study aims to determine the mechanism for handling cases of default due to death at KSPPS Guna Lestari Jaya Tegalsambi Branch, to analyze its compliance with sharia principles from an Islamic economic perspective, and the implications for institutional sustainability and member welfare. The research method used is qualitative descriptive with data collection techniques through interviews, observations, and documentation. The results of the study indicate that KSPPS Guna Lestari Jaya implements settlement through deliberation, tabarru' funds, and a sharia insurance scheme (ta'awun) according to previous agreements. This mechanism reflects the principles of mutual assistance, social responsibility, and justice, and avoids elements of usury and gharar. Thus, the handling of default due to death at this KSPPS is in accordance with Islamic economic principles.

Abstract

Cash waqf in Indonesia has great potential to improve community welfare. However, the realization is still not optimal. After previously OJK developed a cash waqf product integrated with sukuk (CWLS). Now OJK is reissuing a cash waqf product in collaboration with a deposit product or called cash waqf linked deposit (CWLD), as a deposit-based waqf innovation, offering a solution by integrating the social and commercial functions of sharia banking. However, there are no regulations governing cash waqf linked deposit (CWLD) itself, the implementation of CWLD can be different depending on the Islamic law adopted. In Islam there are four main schools of thought, each of which has a view on the concept of cash waqf and investment. Therefore, there is a need for studies related to CWLD analysis from an Islamic legal perspective. The research method used is library research. The source of data obtained is primary data sourced from books, journals, legal articles and other research results. The data collection technique in this research is by collecting literature that is relevant to this research. The results of the research obtained are that there is difference of opinion from four mazhab of thought regarding cash waqf linked deposit (CWLD). The Hanafi Mazhab and Maliki Mazhab allow it, while the Syafi’i Mazhab and Hanbali Mazhab do not allow cash waqf linked deposit (CWLD)

Abstract

Abstract

Basic food items such as rice, eggs, sugar, and milk play a crucial role in people's lives, especially during the month of Ramadan, when demand for these commodities increases significantly. This condition encourages the habit of storing food, which then gives birth to innovations in basic food savings products in Islamic financial institutions. This study aims to examine the application of the wadiah contract in basic food savings products at the Artha Yasmin Az Zahra Sharia Savings and Loans and Financing Cooperative (KSPPS), with reference to the fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) Number 02/DSN-MUI/IV/2000. The research method used is qualitative descriptive, with data collection techniques through interviews, observations, and documentation studies. The results of the study indicate that KSPPS Artha Yasmin Az Zahra applies the wadiah contract in the form of pure deposits, where the funds deposited by members are used to buy basic food items which will later be returned according to the agreed agreement. Although the implementation of the wadiah contract is in accordance with the provisions of the DSN-MUI fatwa, there are still obstacles, such as the lack of transparency in conveying information about the contract to members, which has the potential to affect their level of trust in this product. This study is expected to provide useful insights for KSPPS managers in improving the governance of basic food savings to be more in accordance with sharia principles and more transparent for its members.

Abstract

This study analyzes the implementation of contract restructuring (akad ulang) for Murabahah financing products at BMT Mitramu, Pasar Ratu Jepara Branch, based on the provisions of DSN-MUI Fatwa No. 48/DSN-MUI/II/2005 concerning the re-determination of the selling price in Murabahah contracts. Employing a descriptive qualitative approach, this research utilizes data triangulation through in-depth interviews, observations, and document analysis. The findings indicate that the contract restructuring process involves three main stages: preventive communication, deliberation and adjustment of the financing scheme, and formal re-contracting. The process is based on mutual agreement without increasing the principal debt or profit margin and only charges a real administrative fee. The new contract is legally formal and independently binding. This practice demonstrates compliance with sharia principles and institutional ethics, showing that contract restructuring serves as a legitimate, responsive, and fair contractual reconstruction within the framework of Islamic economic law.

Abstract

This community service program aims to enhance the economic independence of the Tengger Tribe through strengthening Islamic financial literacy and portable digital marketing skills. The program was conducted as an international collaboration between Indonesian universities that are members of APSKPS and Malaysian universities, namely Universiti Sains Islam Malaysia (USIM), Universiti Teknologi MARA (UiTM), and Universiti Kebangsaan Malaysia (UKM). The study employed a Participatory Action Research (PAR) approach, involving the community actively in each stage of the program, from planning to implementation and evaluation. The results indicate an increased understanding among participants regarding Islamic financial principles, including contracts such as mudharabah, musyarakah, and murabahah, as well as the application of simple financial record-keeping in small enterprises. Moreover, the portable marketing training encouraged local entrepreneurs to utilize digital platforms such as WhatsApp Business and Instagram to promote Tengger’s local products to a broader market. This program successfully fostered cross-country academic collaboration and demonstrated that the synergy between education, Islamic values, and digital technology can serve as an effective strategy in developing an equitable and competitive indigenous economy.

Abstract

Islamic banking, as an Islamic financial institution, is not solely profit-oriented but also holds a social responsibility to enhance societal welfare in accordance with the maqasid sharia principles. These principles align with the Sustainable Development Goals (SDGs). This study aims to assess the commitment of Islamic banking institutions to achieving the SDGs by employing a quantitative descriptive approach with time-series analysis. The analyzes data trends over a specified period using secondary data obtained from the sustainability reports of Bank Syariah Indonesia (BSI) and Bank Muamalat for the 2021–2024 period. Data collection involved identifying, downloading, and examining relevant sustainability reports containing information on programs, policies, and initiatives that support the attainment of the SDGs. The findings indicate that, overall, BSI demonstrates a stronger commitment to sustainability and environmentally oriented financing compared to Bank Muamalat, with a greater emphasis on funding for Micro, Small, and Medium Enterprises (MSMEs). In contrast, Bank Muamalat exhibited an increasing trend in financing the medium segment but experienced a significant decline in financing for the micro and small segments. This study reaffirms the contribution of Islamic banking-particularly BSI and Bank Muamalat in supporting the achievement of the SDGs through various strategic sector initiatives. The findings provide valuable insights into the role of Islamic banking in fostering inclusive and sustainable economic development.
