Abstract

The contract is carried out consciously by a man and a woman, which is basically with the liking and willingness of both parties. Pleasure and willingness in a marriage is very necessary for the continuity of the household so that the marriage runs with mutual love and love with the aim of fostering a household that is sakinah, mawaddah and rahmah and with the willingness of both parties will also get ridha from Allah SWT. But there is a marriage that is very helpful and gives very good wisdom in marriage. Like the marriage of Pulang Balee, namely marrying his own brother-in-law, whether biological, step-by-step, still related by blood, or his own relatives. However, many of them do not want to and are forced to do it so that it has an impact on their domestic life. Thus, the researchers wanted to examine the problems related to how the practice of Pulang balee marriage in Darussalam District, Aceh Besar District, and how the factors and impacts of Pulang balee marriage in Darussalam District, Aceh Besar District. The research methodology that the author uses is using qualitative research in the form of interviews, observations and documentation. Based on the research that researchers found, the practice of balee return marriage in Darussalam sub-district is the same as usual marriage, starting from the proposal stage and the marriage stage and some of them hold walimah and some do not. The main factor of balee return marriage is thinking about the fate of their child, namely to ensure the care and needs of a child, because the child will be closer to the mother's family. And the impact of the balee return marriage is a positive impact, namely the maintenance of good relations between the two families, being able to look after and raise children together and obtain in-line offspring, as well as maintaining joint property. The negative impact of balee return marriage is a lot of talk from neighbors, feeling awkward at the beginning of marriage, easy to fight and divorce quickly.

Abstract

Inheritance is a science that studies the process or method of transferring the heirs' (deceased) property to their heirs and how much each heir gets. As is known, inheritance is an asset that is distributed after the owner dies. Inheritance is one of the problems that is very influential in everyday life; if the inheritance cannot be shared among families, there will be quarrels between families. The questions in this thesis are the reasons for the delay in the distribution of inheritance in the Jantho District, Aceh Besar District, the impact of the delay in the distribution of inheritance in the Jantho City District, Aceh Besar District, and a review of Islamic law delaying the distribution of inheritance in the Jantho District, Aceh Besar District. In this research, the author uses field research methods and library research methods using interview techniques. The results of the study The reasons behind the delay in the distribution of inheritance in the District of Jantho City, Aceh Besar Regency, are three, namely: the agreement of the heirs to delay the distribution of the inheritance; the heirs are still small or have not been able to manage the inheritance; and discussing the inheritance after the heir dies. Death is considered taboo by some people. The reasons behind the delay in the distribution of inheritance in the Kota Jantho sub-district, Aceh Besar district, are as follows: the breakdown of friendship between the heirs; the change in the status of the inheritance to private land; and the occurrence of disputes between families. In Islamic law, delaying the distribution of inheritance is not recommended; however, the postponement may be done for certain reasons or with syar'i udzur and with the approval of other heirs. However, if the delay in the distribution of inheritance is carried out for years, it will certainly cause problems in the future.

Abstract

Prophet Muhammad SAW is a source of information and guidance for people in carrying out the complete Islamic law. However, the understanding of this information does not always result in a unanimous agreement among the Muslim community, except in some aspects that are clearly defined in the Quran and authenticated Hadiths. In some cases, there may be opportunities for different practices based on the context of the situation. During the Prophet's lifetime, his companions could easily confirm the correctness of their actions by seeking his guidance. In certain cases, the Prophet's guidance was clear and unambiguous, and his companions were obliged to follow it. In other cases, the Prophet provided alternatives, allowing them to choose according to the situation they faced. In the context of religious moderation, which requires alternatives in some matters, there is a need for in-depth research into some Hadiths that contain messages on the importance of practicing religious moderation. This is necessary to avoid misunderstandings among the Muslim community and to create a harmonious religious social life, both within and outside the Muslim community.ABSTRAKNabi Muhammad Saw merupakan sumber informasi dan panutan bagi manusia dalam melaksanakan syariat Islam secara kaffah. Pemahaman terhadap berbagai informasi tersebut tidak secara tegas menghasilkan satu kata sepakat bagi umatnya, kecuali dalam beberapa aspek yang ditetapkan dengan ayat Alquran yang muhkam dan hadis-hadis mutawatir. Bahkan dalam beberapa kasus, dianggap memiliki peluang untuk dipraktikkan dengan beberapa alternatif, sesuai dengan konteks yang mengitari umat manusia.  Dalam praktiknya, para sahabat dengan mudah dapat mengkonfirmasi setiap amalan yang mereka lakukan karena masih hidupnya Nabi Saw.  Dalam kasus tertentu, para sahabat mendapati titah Nabi jelas dan tegas, sehingga tidak boleh bagi mereka mempraktikkan dengan cara yang tidak diizinkan oleh Nabi mereka. Sedangkan dalam beberapa aspek lainnya, Nabi memberikan alternatif kepada mereka untuk memilih sesuai dengan situasi dan kondisi yang dihadapi. Dalam konteks moderasi beragama, yang menuntut adanya alternatif-alternatif dalam suatu perkara, dibutuhkan penelitian secara mendalam terhadap beberapa hadis yang mengandung pesan-pesan terhadap pentingnya praktik moderasi beragama tersebut, sehingga tidak menimbulkan kesalahpahaman di kalangan umat Islam, dan juga dapat menciptakan kehidupan sosial keagamaan secara harmonis khusus di internal umat Islam itu sendiri, dan secara umum terkait pihak eksternal umat Islam.

Abstract

This article aims to examine the hadiths used by the majority of scholars from the perspective of the emergence of hadiths to be used as bayan of the Koran in the inheritance of kalalah by conducting a literature review of ushul fiqh works, interpretations and explanations of hadiths. This is based on the decisions of several religious courts in Indonesia which stipulate that the existence of daughters hinders siblings from obtaining inheritance. This ruling is different from fiqh which in no way makes having a daughter hinder siblings from obtaining an inheritance based on the hadith used in interpreting the Koran. The results of this study show that consideration of the time of appearance (wurud) of hadith has become the practice of Sunni scholars in legal istinbath, but is not applied to the function of bayan of the Koran. While the Prophet made legal decisions based on the verses of the Koran that had been revealed to him. On the other hand, it can be seen that the inheritance system built by the Qur'an is carried out gradually in four stages with the revelation of verses within a span of six years, each of which stipulates certain aspects of inheritance law. The use of these hadiths is seen as inappropriate because the hadiths have lost the spirit of renewal that the Qur'an has made. The context of the verses that were revealed later was different from the verses that were revealed earlier. The hadith is only appropriate to use as bayan verses 11 and 12 of sura al-Nisa' which explain their respective parts, not to explain the meaning of kalalah. Abstrak: Artikel ini bertujuan untuk menelaah hadis yang digunakan oleh jumhur ulama dari sisi pertimbangan waktu munculnya hadis untuk digunakan sebagai bayan Alquran dalam kewarisan kalalah dengan melakukan telaah literatur dari karya-karya ushul fiqh, tafsir dan syarah hadis. Hal ini didasari adanya putusan beberapa pengadilan agama di Indonesia yang menetapkan keberadaan anak perempuan menghalangi saudara dalam memperoleh warisan. Putusan ini berbeda dengan fikih yang sama sekali tidak menjadikan adanya anak perempuan menghambat saudara dalam memperoleh warisan berdasarkan hadis yang digunakan dalam menafsirkan Alquran. Hasil telaahan tersebut memperlihatkan bahwa pertimbangan waktu kemunculan (wurud) hadis telah menjadi praktik ulama Sunni dalam istinbath hukum, tetapi tidak diterapkan untuk fungsi bayan Alquran. Sementara Nabi membuat keputusan-keputusan hukum didasarkan atas ayat Alquran yang telah diturunkan kepada beliau. Di sisi lain, terlihat bahwa sistem kewarisan yang dibangun Alquran dilakukan secara gradual dalam empat tahap dengan turunnya ayat dalam rentang waktu enam tahun yang masing-masingnya menetapkan aspek-aspek tertentu hukum kewarisan. Penggunaan hadis-hadis tersebut oleh jumhur ulama dipandang tidak tepat karena hadis-hadis telah kehilangan semangat pembaruan yang telah dibuat Alquran. Konteks ayat yang turun kemudian telah berbeda dengan ayat yang turun terlebih dahulu. Hadis tersebut hanya tepat digunakan sebagai bayan ayat 11 dan 12 surat al-Nisa’ yang menjelaskan bagian masing-masing, tidak untuk menjelaskan makna kalalah.

Abstract

Based on information from Susenas 2017, there are about 13 million Indonesian Muslims who are already economically well-off for the hajj list, but do not register for the hajj. In response to this, MUI has issued a fatwa for people aged 60 to register immediately, worried about running out of fees and making up hajj and MUI stipulates that it is forbidden for them to delay. The research questions are: how is MUI's consideration in determining the obligation to immediately register for hajj for those who meet the criteria and how is MUI's consideration in determining the prohibition of delaying for those who meet the criteria. This research is classified as a type of qualitative research and is included in the normative study and the process of collecting data using the literature method is then analyzed with a descriptive analysis approach. The results found are that it is mandatory for people aged 60 years to register for Hajj immediately because of the hadith that states the average age of the Prophet Muhammad's people is 60-70 years, while the waiting period for departure is very long, for people who are worried about running out of money because it is analogous to the obligation to leave on Friday. at, and for qada hajj because there is a consensus of friends. As for the consideration of the prohibition of postponing the age of 60 because it is a sin to neglect worship, for people who are worried about running out of hajj fees because they violate the law from the results of analogies and for those who make up qada because they consider the consensus of friends.

Abstract

The Da'wah of the Salafi School aims to purify Islamic teachings by eradicating all kinds of deviations from Islamic practices that have mixed with non-Islamic cultures, giving rise to bid'ah. The salafi school invites them to return to the Al-Qur'an and hadith, where hadiths are only understood textually and in their sermons the salafi scholars openly attack Islamic boarding school scholars. ? How is the resistance carried out by Islamic boarding school scholars to salafi preaching, especially in understanding hadith? What is the influence that occurred on the implementation of Fiqh by the people in Aceh and North Sumatra Medan? This research is qualitative, namely a way of research and understanding that is based on how to investigate environmental conditions and community problems. The method of qualitative research is usually stated as a naturalistic research method because the research is carried out when the circumstances are as they are, also known as the ethnographic method. The approach used is an anthropological approach. To get the data, structural analysis, historical analysis, and ideological criticism were carried out. Based on the results of the research, it can be seen that the proselytizing of the Salafi sect which is carried out by attacking Islamic boarding school scholars openly, aims to really practice shari'ah which has the basis of Rasulullah SAW. Because they think that the Islamic boarding school scholars have left the Sunnh of Rasulullah SAW, so if it is not sunnah, don't do it because it will enter into bid'ah acts. However, the method adopted by the Salafi sect has actually departed from the provisions of the Koran itself, which wants da'wah to be carried out gently. Islamic boarding schools/dayah scholars should show their resistance to the salafi school (wahabi), because the salafi school is wrong in understanding hadith, because it only relies on textual understanding. Whereas hadith as the second source of Islamic law must be understood correctly, both textually and contextually, so that the messages of the Messenger of Allah through hadith, especially in interpreting the verses of the Koran which are still common, reach the community correctly. Salafi da'wah carried out both in Aceh and in North Sumatra has not had an impact on the community in practicing fiqh as expected by the salafi sect, because the community still commemorates Islamic holidays and understands hadith based on the Shafi'i school of thought. It is hoped that the salafi sect will carry out da'wah in ways that are gentle and willing to communicate in two directions, so that the messages to be conveyed can be accepted by the community. It is hoped that Islamic boarding schools/dayah scholars will maintain communication with the Salafi school, so that divisions can be avoided in an effort to maintain unity among fellow Muslims. It is hoped that the community will always maintain conditions so that they remain conducive even though they face ridicule and insults in practicing fiqh in everyday life.

Abstract

This article attempts to explain the pattern of interaction between history and dirayah in learning hadith. So far, hadith science tends to be classified into two types, namely riwayah hadith science and dirayah hadith science. In fact, in its development, these two types of hadith science interact with each other. Therefore, the focus of this study is to discuss how the interaction between the science of hadith history and the science of hadith is explored in learning hadith? The method used is qualitative by using data from the hadith books used by the scholars. The results of the study show that the science of riwayah hadith has a very close relationship with the science of hadith dirayah. Because the quality of riwayah hadith science is only known through research on the sanad of the hadith, while the sanad is the object of dirayah hadith science. In addition, the science of hadith riwayah only focuses on the narration as it is from the Prophet while the science of hadith dirayah discusses how to understand the material of the history. The science of hadith history is like the Koran, while the science of hadith is like interpretation of it, one cannot understand the Koran without knowing its meaning or interpretation. This is the interaction between these two fields of science that cannot be separated from one another. By integrating these two branches of knowledge, learning the science of hadith will be more useful as a second source of teachings in Islam. Artikel ini berusahan menjelaskan pola interaksi antara ilmu riwayah dan dirayah dalam pembelajaran hadis. Selama ini, ilmu hadis cenderung diklasifikasikan kepada dua jenis, yaitu ilmu hadis riwayah dan ilmu hadis dirayah. Padahal, dalam perkembangannya, kedua jenis ilmu hadis ini saling berintaeraksi satu sama lain. Oleh karena itu, fokus kajian ini membahas bagaimana interaksi antara ilmu hadis riwayah dan ilmu hadis dirayah dalam pembelajaran hadis? Adapun metode yang digunakan adalah kualitatif dengan menggunakan data dari kitab-kitab hadis yang digunakan oleh para ulama. Hasil penelitian menunjukkan bahwa ilmu hadis riwayah mempunyai hubungan yang sangat erat dengan ilmu hadis dirayah. Karena kualitas ilmu hadis riwayah hanya diketahui melalui penelitian terhadap sanad dari hadis tersebut, sementara sanad itu adalah objek dari ilmu hadis dirayah. Selain itu, ilmu hadis riwayah hanya fokus kepada periwayatan apa adanya dari Nabi sementara ilmu hadis dirayah membahas bagaimana memahami materi riwayat tersebut. Ilmu hadis riwayah ibarat al-Qur’an, sementara ilmu hadis dirayah ibarat penafsiran terhadapnya, tidak bisa memahami al-Qur’an tanpa mengetahui makna atau penafsirannya. Inilah interaksi antara dua bidang ilmu ini yang tidak bisa dipisahkan antara satu dan lainnya. Dengan memadukan kedua cabang ilmu ini maka pembelajaran ilmu hadis akan lebih berguna sebagai sumber ajaran yang kedua dalam Islam.

Abstract

This article focuses on exploring the depth of the teachings of Tawhid in the Hadiths of Prophet Muhammad SAW and their influence on individual Islamic practices. Through an analytical approach to related hadiths, this study aims to answer three critical questions: (1) What is the position of Tawhid teachings in the Hadiths of Prophet Muhammad SAW?; (2) What criteria for Islam protect an individual's soul and blood from the perspective of the hadiths?; and (3) How do the Hadiths of Prophet Muhammad SAW assess the religious status of a Muslim who commits sins? The findings of this study indicate that Tawhid plays a fundamental role in forming and understanding Islam, where the proclamation of the Shahada is emphasized as the main foundation. This research reveals that faith in Allah SWT is an absolute prerequisite for the acceptance of all other acts of worship. Furthermore, the study observes that while sinful actions do not erase one's Islamic status, the act of shirk (associating partners with Allah) can eliminate that religious status. However, the door of repentance is always open to every Muslim. These findings affirm the importance of the teachings of Tawhid as the core of religious practice.AbstrakArtikel ini berfokus pada eksplorasi kedalaman ajaran tauhid dalam hadis Nabi Muhammad SAW dan pengaruhnya terhadap praktik keislaman individu. Melalui pendekatan analitis terhadap hadis-hadis terkait, studi ini bertujuan menjawab tiga pertanyaan kritis: (1) Apa posisi ajaran tauhid dalam hadis Nabi Muhammad SAW?; (2) Bagaimana kriteria keislaman yang menjaga jiwa dan darah seseorang dalam pandangan hadis?; dan (3) Bagaimana hadis Nabi Muhammad SAW menilai status keberagamaan seorang muslim yang berbuat dosa? Hasil kajian ini menunjukkan bahwa tauhid berperan fundamental dalam pembentukan dan pemahaman keislaman, di mana pengucapan syahadat ditekankan sebagai fondasi utama. Penelitian ini mengungkap bahwa keimanan kepada Allah SWT adalah prasyarat mutlak untuk penerimaan seluruh amal ibadah lainnya. Lebih lanjut, studi ini melihat bahwa meskipun perbuatan dosa tidak menghapus status keislaman seseorang, perbuatan syirik dapat mengeliminasi status keberagamaan tersebut. Namun, pintu taubat selalu terbuka bagi setiap muslim. Temuan ini menegaskan pentingnya ajaran tauhid sebagai pusat dari praktik keagamaan.
