Abstract

This study aims to analyze and compare the institutional structure and basic principles of the Criminal Justice System (CJS) in Indonesia and South Korea. This study examines how the adaptation of Civil Law principles shapes the unique dynamics of the criminal justice process in both countries. Indonesia and South Korea are both rooted in the Civil Law tradition that upholds the principles of legality and codification. This study uses a normative legal method with a comparative approach through a literature review to analyze relevant legislation and literature. The results of the study show significant differences in implementation: Indonesia maintains an integrated criminal justice system model with a sectoral separation of the functions of investigators (the police) and prosecutors (the attorney general's office). In contrast, South Korea shows a more dynamic evolution through the centralization of the authority of prosecutors as leaders of investigations and the application of the limited principle of opportunity (Opportunitätsprinzip). This adaptation, including the participatory jury system as a foreign element, aims to improve efficiency, public accountability, and substantive justice-particularly in victim protection. In conclusion, South Korea’s strategy offers valuable insights for Indonesia to strengthen inter-agency integration, improve victim rights protection, and examine the potential flexibility in the principle of legality for the sake of a more equitable and effective CJS/SPP.

Abstract

Perundungan di sekolah merupakan masalah yang terus meningkat dan menimbulkan dampak serius terhadap perkembangan psikologis, sosial, maupun akademik peserta didik. Situasi ini mencerminkan bahwa nilai hukum dan moral belum tertanam secara kuat dalam diri siswa. Penelitian ini bertujuan untuk menelaah urgensi pendidikan hukum sejak dini sebagai upaya pencegahan perundungan di lingkungan pendidikan, sekaligus mengidentifikasi bentuk implementasi yang efektif dalam konteks Indonesia. Metode yang digunakan adalah studi kepustakaan dengan menelaah regulasi, laporan resmi lembaga Pemerintah, artikel ilmiah, serta literatur mengenai pendidikan karakter dan psikologi. Pendidikan hukum sejak dini berperan penting dalam menumbuhkan kesadaran akan hak dan kewajiban, mengembangkan empati, melatih kontrol diri, serta memberikan pemahaman mengenai konsekuensi hukum dari setiap tindakan. Implementasi yang optimal mencakup integrasi dalam kurikulum, penciptaan budaya sekolah yang aman, penguatan literasi digital, kerja sama lintas sektor, serta konsistensi pendidikan karakter. Dengan demikian, pendidikan hukum sejak dini tidak hanya berfungsi sebagai penyampaian pengetahuan normatif, tetapi juga sebagai strategi preventif yang menyeluruh untuk membangun lingkungan pendidikan yang bebas dari perundungan dan berlandaskan nilai kemanusiaan.

Abstract

The existence of factions in the House of Representatives is an important element in the institutional practice of parliament in Indonesia. Factions function as a means of political coordination for members of the House of Representatives who come from the same political party in carrying out legislative, oversight, and budgeting functions. This study aims to analyze the position of factions in the Indonesian constitutional system and assess the institutional legitimacy of factions from the perspective of the principle of people’s sovereignty. This research uses a normative legal research method with legislative, conceptual, and comparative approaches. The results of the study show that factions are not explicitly regulated in the 1945 Constitution of the Republic of Indonesia but constitute an institutional construction established through laws and regulations governing the organization of the House of Representatives. The dominance of factions in parliamentary institutional practice has the potential to shift the representative function of the House of Representatives from representation of the people to representation of political parties. Therefore, it is necessary to reconstruct the position of factions in the Indonesian constitutional system to ensure a balance between the role of political parties and the principle of people’s sovereignty. From a more progressive perspective, this research also opens discursive space regarding the possibility of a parliamentary model that provides greater room for the independence of legislative members, including the idea of a parliament without factions as a conceptual alternative within a representative democratic system.

Abstract

Perkembangan organisasi Advokat di Indonesia saat ini menunjukkan penerapan sistem multi organisasi (multi-bar), yang ditandai dengan keberadaan lebih dari satu organisasi Advokat yang masing-masing memiliki kebijakan internal tersendiri. Penelitian ini bertujuan untuk mengkaji dampak sistem multi organisasi terhadap profesionalisme Advokat dalam praktik peradilan pidana di Indonesia dengan menelaah hubungan antara struktur hukum profesi, tata kelola organisasi, serta hambatan birokrasi yang muncul dalam pelaksanaannya. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan perbandingan. Hasil penelitian menunjukkan bahwa terjadinya fragmentasi organisasi Advokat berimplikasi pada tidak seragamnya standar profesi, yang berdampak pada menurunnya kualitas kompetensi etika dan kemampuan teknis Advokat dalam proses persidangan pidana. Selain itu, kendala birokrasi dalam mekanisme pengawasan dan penegakan kode etik lintas organisasi turut menghambat terwujudnya integritas penegakan hukum yang berkesinambungan. Oleh karena itu, diperlukan pembaruan regulasi yang bersifat menyeluruh guna menyatukan standar profesi demi menjamin kepastian hukum, keadilan, serta perlindungan optimal bagi pencari keadilan dalam sistem peradilan pidana.
