Abstract

Perundungan di sekolah merupakan masalah yang terus meningkat dan menimbulkan dampak serius terhadap perkembangan psikologis, sosial, maupun akademik peserta didik. Situasi ini mencerminkan bahwa nilai hukum dan moral belum tertanam secara kuat dalam diri siswa. Penelitian ini bertujuan untuk menelaah urgensi pendidikan hukum sejak dini sebagai upaya pencegahan perundungan di lingkungan pendidikan, sekaligus mengidentifikasi bentuk implementasi yang efektif dalam konteks Indonesia. Metode yang digunakan adalah studi kepustakaan dengan menelaah regulasi, laporan resmi lembaga Pemerintah, artikel ilmiah, serta literatur mengenai pendidikan karakter dan psikologi. Pendidikan hukum sejak dini berperan penting dalam menumbuhkan kesadaran akan hak dan kewajiban, mengembangkan empati, melatih kontrol diri, serta memberikan pemahaman mengenai konsekuensi hukum dari setiap tindakan. Implementasi yang optimal mencakup integrasi dalam kurikulum, penciptaan budaya sekolah yang aman, penguatan literasi digital, kerja sama lintas sektor, serta konsistensi pendidikan karakter. Dengan demikian, pendidikan hukum sejak dini tidak hanya berfungsi sebagai penyampaian pengetahuan normatif, tetapi juga sebagai strategi preventif yang menyeluruh untuk membangun lingkungan pendidikan yang bebas dari perundungan dan berlandaskan nilai kemanusiaan.

Abstract

Introduction: Embezzlement in office constitutes a form of crime arising from the abuse of trust within employment relationships, particularly in the automotive workshop sector, which is characterized by intensive asset management and high-frequency daily transactions. Modern car workshops operate through complex interactions involving cash handling, spare parts circulation, and technical service authority, creating structural vulnerabilities to occupational crime.Purposes of the Research: This article aims to analyze the practice of embezzlement in office within specialized car air conditioning and suspension workshops, with particular emphasis on the legal construction of employment relationships, the scope of employee authority, and the lawful possession of property that is subsequently abused.Methods of the Research: The research employs a statutory and conceptual approach, focusing primarily on the provisions of Article 488 of the New Indonesian Criminal Code. Doctrinal analysis is used to examine the elements of the offense, especially in relation to authority, trust, and asset control within the framework of employment.Findings of the Research: The analysis demonstrates that the operational characteristics of automotive workshops—such as cash management, spare parts administration, administrative record-keeping, and delegated technical service authority—generate heightened susceptibility to embezzlement aggravated by position. The article asserts that the elements of an “employment relationship” and “trust” constitute decisive factors in establishing embezzlement in office, thereby distinguishing it from ordinary embezzlement. This research underscores the necessity of a comprehensive understanding of employment relations and mechanisms of asset possession to ensure the accurate and proportional application of criminal law.

Abstract

The act of chemical castration is now one of the sanctions in Indonesia's positive law. However, it is still limited to child protection based on Law Number 17 of 2016, which can be imposed on perpetrators of sexual crimes against children if the victim is more than one person, is seriously injured, has mental disorders, suffers from infectious diseases, reproductive system disorders, and lose their life. This paper analyzes criminal policy and people's reactions to castration concerning the objectives of punishment. This research is doctrinal research as prescriptive research using a legal approach regarding legal categories regarding castration, the relationship between rules, difficulties that arise and predicting future developments on criminal policy regarding castration in positive law as one of the new sanctions in the criminal system. The results of the study is that the birth of chemical castration in criminal policy reform is based on a balance between the interests of child victims of sexual crimes and perpetrators of crime, but its existence in positive law does not necessarily make the whole community accept even though the pros and cons of castration are still balanced based on the purpose of punishment based on Pancasila. The recommendations put forward are the need for socialization of castration for all levels of society in a balance between the interests of child victims of sexual crimes and the interests of criminals, increasing non-penal efforts and the application of selective castration sanctions, and providing assistance for child victims of sexual crimes.
