Abstract

Abstract Reforms that rolls in 1998, has brought significant changes in the field of state administration of the Republic of Indonesia, especially after the 1945 Constitution changes. These changes have led to shifts in the way to fill the President and/or Vice President’s position and the mechanism of discharging the President and/or Vice President in their term of office. The ways to fill the position through general election have an implication to the strength of the President and Vice President’s position because they got legitimacy from citizens as the holder of sovereignty. It has the consequence that President and/or Vice President cannot be dismissed only for political reasons, but through a mechanism that is quite difficult. Keywords: the way of filling the vacancy, the dismissal of the President and/or Vice President in his tenure Abstrak Reformasi yang bergulir pada tahun 1998, telah membawa perubahan yang cukup signifikan di bidang ketatanegaraan RI, utamanya setelah adanya perubahan UUD 1945. Perubahan yang paling mendasar adalah dalam hal cara pengisian jabatan Presiden dan/atau Wakil Presiden serta mekanisme pemberhentian Presiden dan/atau wakil Presiden dalam masa jabatannya. Cara pengisian jabatan melalui pemilu secara langsung berimplikasi terhadap kuatnya kedudukan Presiden dan/atau wakil Presiden karena mendapat legitimasi langsung dari rakyat sebagai pemegang kedaulatan. Hal itu mengandung konsekuensi bahwa Presiden dan/atau wakil Presiden tidak dapat dapat diberhentikan dalam masa jabatannya hanya karena alasan politis semata, melainkan harus melalui mekanisme yang cukup sulit.   Kata kunci: cara pengisian jabatan, pemberhentian Presiden dan/ atau Wakil Presiden dalam masa jabatannya

Abstract

. Intellectual Property Rights (IPR) is born from an individual's recognition of his intellectual abilities, so that each of his works is directly attached to the creator. A work of art can be created by anyone, especially activists in the art world such as singers, writers, designers, photographers and so on. In its development, creators always find the latest variations and innovations for work. These innovations can be of various kinds and can result in good or bad, can harm other parties or not harm other parties. In one's profession a Graphic Designer always produces graphic design work that develops every year and follows market demand. The protection of graphic design products is also carried out by several owners, those who understand the Copyright Law must register their products with the Directorate General of Intellectual Property Rights by following the existing procedures. But on the other hand, there are also some copyright owners who do not register, but instead provide watermarks or watermarks in their works. This study aims to provide an understanding for those who carry out watermarking actions by using juridical and normative methods by prioritizing library-based legal research whose sources come from secondary data which is then applied to the core problem of this research, namely Watermarking in Graphic Design which focuses on the legal protection of the parties. Abstract

The attempt to purify Indonesia's multiparty presidential system was only reflected after the Third Amendment to the 1945 Constitution. However, it took work to implement it. In practice. Various measures have been taken, including party alliances and introducing voting barriers in parliamentary elections. Therefore, analysing the relationship between electoral thresholds and their ideal proportions in the form of legal-political reforms to strengthen the Indonesian presidential system is interesting. This is in line with the purpose of this study, which is to uncover and analyse the legal politics of electoral thresholds in an attempt to strengthen the presidential system of government in Indonesia. The approach adopted in this study is a theoretical approach with legal, conceptual, comparative and historical approaches. This study concludes that the legitimate political renewal of the electoral vote threshold is not closely related to efforts to strengthen Indonesia's system of multiparty presidential government. The ideal way to reform the legal, political threshold for electoral votes would be to set the parliamentary threshold at 2.5%, but at the same time tighten controls over the parties participating in the election, and the 2.5% threshold serves as President to maintain a balance between the parliamentary and presidential thresholds. In addition, it is also important to strengthen consensus (consensus democracy) among coalition political parties. There is still a desire to abolish the presidential threshold through the People's Representative Council (DPR) instead of the Constitutional Court (MK).

Abstract

Indonesia is a Republican State that has a variety of cultures, a maritime country with waters covering two-thirds of its land area, which makes it clear that Indonesia is a large country. The increasing number of poor people has resulted in an increasing number of people who prefer to work as street vendors because the work is in accordance with their expertise. The City Government has made efforts to reduce the difficulties caused by the presence of street vendors by passing Semarang City Regional Regulation Number 3 of 2018 concerning Arrangement and Empowerment of Street Vendors. The purpose of this research is to find out and examine the implementation of these regional regulations on Jalan Pandanaran 2 Semarang City, as well as the obstacles that hinder its implementation. The problems discussed in this study include how the Regional Regulation of the City of Semarang Number 3 of 2018 concerning Jalan Pandanaran II Semarang City is implemented, as well as the challenges faced. This research uses a juridical-empirical research type, the resources used consist of primary and secondary data. The research results obtained are (1) the implementation of this regional regulation can be said to have been going quite well even though it has not been implemented effectively. (2) there are still several obstacles encountered in the field such as lack of land availability, lack of human resources to support the effective implementation of regional regulations. (3) The solution that can be concluded from the results of interviews with several street vendors, the majority of them voiced a desire for the government to be more aggressive in providing socialization regarding a more orderly arrangement of street vendors, more accomodated collection of fees and clear coordination.

Abstract

The quality of regulatory and legislative measures, both within and outside the hierarchy in Indonesia, can be assessed using certain indicators. These indicators demonstrate a stagnation and a slight shift towards other legal issues. To improve the quality of regulatory and legislative measures, it is necessary to amend preventive and evaluative mechanisms. This condition provides a foundation for further analysis of all problems, with a focus on creating a positive system that prioritizes urgency and required improvements. This paper aims to analyze the preventive and evaluative mechanisms of legislation in Indonesia objectively. This article uses the doctrinal legal method, utilizing legal concepts, statutory laws, legal facts, and legal case approaches. It suggests amending the current mechanism and recommends reforms towards both preventive and evaluative mechanisms to improve regulatory and legislative quality in Indonesia. This study was concerned with formulating grounded principles and concepts, and providing proof of concept for preventive and evaluative mechanisms towards statutory laws, which would ensure the sustainability of Indonesia's legislative and regulatory reform.

Abstract

Since the instruction of the Minister of Home Affairs No. 14 of 1982 regarding the prohibition of giving absolute power of attorney in line with the transfer of land rights which took effect on March 6, 1982 and PP No. 24 of 1997 concerning land registration came into force on 4 July 1997, the use of absolute power of attorney is no longer permitted. However, in practice absolute power in land purchase agreements is still often used. The research to be carried out is a type of normative legal research through a review of literature and also legal materials, for example research on legal principles and rules and legal rules. The results of the study show that not any use of absolute power related to the sale and purchase of land is not permitted as long as it is not intended for the transfer of rights to land. The use of absolute power of attorney related to the Land Sale and Purchase Binding Agreement made before a notary is only aimed at protecting and guaranteeing legal certainty for the parties involved, especially the buyer that the sale and purchase process can later take place according to what was agreed when the terms of the sale and purchase have been fulfilled. regarding the use of absolute power of attorney in binding agreements for sale and purchase of land is legal and not a violation of laws and regulations. Another thing is that the legal impact arising from this use is absolute and is still recognized and continues to be enforced and binding for related parties.

Abstract

Terciptanya suatu keadilan pada hidup berbangsa dan bernegara wajib didukung dengan kebijakan yang tidak saling bertentangan dengan peraturan yang lainnya. Pemerintah Indonesia sudah mengeluarkan beberapa aturan dalam upaya penyelesaian Pandemi Covid-19, namun aturan yang dikeluarkan tersebut menimbulkan beberapa problematika hukum seperti hak imunitas untuk pejabat pelaksana penyelesaian pandemi. Tujuan penelitian ini adalah untuk mengkaji hak imunitas untuk pejabat pelaksana penyelesaian pandemic tersebut. Metode yang dimanfaatkan yakni yuridis normatif, dengan tipe riset deskriptif analitik, jenis data dengan data sekunder, analisis data dilaksanakan secara kualitatif. Hasil penelitian menyimpulkan bahwa imunitas pejabat negara merupakan perlindungan hukum bagi pejabat terkait, agar dalam pelaksanaan penanggulangan dampak Covid-19 pejabat tersebut tidak dapat diproses hukum akibat tindakan atau kebijakan yang dilakukan dalam penyelamatan perekonomian dan stabilitas keuangan nasional yang dibatasi oleh AUPB sebagai dasar itikad baik dan dilaksanakan berdasarkan peraruran perundangan yang berlaku. Apabila dalam penanganan dampak ekonomi Pandemi Covid-19 pejabat terkait melakukan penyimpangan dengan tidak ada itikad baik atau melakukan pelanggaran peraturan perundangan, maka pejabat tersebut tetap dapat diadili sesuai hukum yang berlaku.

Abstract

Direct regional head elections (Pilkada) provide opportunities for civilian circles to become candidates for regional heads, but this has created a new problem, namely the rampant phenomenon of dynasty politics. This condition is quite concerning, not only because incumbent families participate in the replacement, but also due to the negative effects of the desire for power. Therefore, it is necessary to analyze why the phenomenon of dynasty politics emerges and its influence on the implementation of Pilkada. Additionally, it is important to analyze how this phenomenon is viewed from the perspectives of human rights, law, and justice. This is in line with the research objective, which is to analyze the causes of the emergence of dynasty politics and its influence on Pilkada, as well as to analyze the phenomenon from various perspectives. The research method used is socio-legal. The conclusion drawn is that the emergence of dynasty politics is due to the recruitment function of political parties not being based on quality and the weakness of regulations. This has consequences for the implementation of Pilkada, resulting in candidates who are of lower quality and competence. From a human rights perspective, the regulations regarding dynasty politics may indeed violate human rights, but considering the widespread phenomenon of dynasty politics, it is not excessive to establish rules similar to those previously included in Law Number 8 of 2015. From a legal perspective, election laws and political parties should also be improved. All of these efforts are intended to prevent the further spread of dynasty politics, as it can result in injustice for other individuals who wish to run for office.

Abstract

Hak atas Merek adalah hak eksklusif yang diberikan oleh negara kepada pemilik merek yang terdaftar untuk jangka waktu tertentu dengan menggunakan sendiri merek tersebut atau memberikan izin kepada pihak lain untuk menggunakannya. Terdapat hak eksklusif pemilik Hak Kekayaan Intelektual dalam hal merek diantaranya menikmati secara eksklusif atas penggunaan, eksploitasi eksklusif atas keuntungan, serta memberi izin kepada orang lain untuk menggunakan. Pergerakan atas barang dan jasa sebagai pemenuhan kebutuhan tidak lepas dari isu hak kekayaan intelektual yakni impor paralel. Impor paralel yaitu impor produk yang tidak melalui jalur distribusi resmi terhadap produk yang telah dimasukkan ke pasar di suatu negara oleh pemegang lisensi yang sah. Tindakan impor paralel sejatinya adalah gejala alamiah dari free movement of goods, berdasar prinsip exhaustion right. Penelitian ini menggunakan metode penelitian hukum normatif, menggunakan pendekatan perundang-undangan. Impor paralel di Indonesia menurut Undang-Undang Tentang Merek, harus didaftarkan pencatatanannya pada Menteri dan dicatat oleh Menteri dan diumumkan dalam Berita Resmi Merek.

Abstract

ABSTRACTThe Complete Systematic Land Registration (PTSL) program aims to provide legal certainty for land ownership across Indonesia. This study evaluates the implementation of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of BPN Number 6 of 2018 and Presidential Instruction Number 2 of 2018 during the COVID-19 pandemic. Using a normative juridical approach with secondary data, the study reveals two key challenges. First, limited committee resources, including surveyors, hindered the achievement of targets. Second, data collection required door-to-door visits due to gathering restrictions, while PTSL mandates simultaneous implementation at the village/ward level. These issues delayed the program and prevented it from meeting its objectives as outlined in the presidential instruction.Keywords: Implementation; PTSL; COVID-19ABSTRAKPendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program pemerintah untuk memberikan jaminan kepastian hukum atas tanah di seluruh wilayah Indonesia. Tujuan penelitian untuk mengkaji implementasi Peraturan Menteri Agraria dan Tata Ruang/Kepala BPN Nomor 6 Tahun 2018 dan Instruksi Presiden Nomor 2 Tahun 2018 di masa pandemi COVID-19. Penelitian bertujuan mengevaluasi pelaksanaan PTSL agar sesuai target serta memberikan kepastian hukum. Metode yang digunakan adalah yuridis normatif dengan data sekunder. Hasil penelitian menunjukkan dua hambatan utama. Pertama, keterbatasan jumlah panitia, termasuk petugas pengukuran, menyebabkan target tidak tercapai. Kedua, pengambilan data dilakukan door-to-door karena larangan berkumpul, sedangkan PTSL memerlukan pelaksanaan serentak di desa/kelurahan. Kondisi ini menghambat pelaksanaan PTSL sesuai instruksi presiden.Kata Kunci: Implementasi; PTSL; COVID-19
