Abstract

This study seeks to examine and elucidate the significance of the principle of good faith within the national legal framework, as well as to develop norms pertaining to good faith in the context of operational cost recovery for production sharing contracts in Indonesia's oil and gas industry. This study utilizes a normative legal methodology alongside a legislative framework. The sources of data encompass essential legal materials, including legislation, journal articles, books, and pertinent research reports that contribute to the discourse. The analysis of the data is performed qualitatively through a juridical-philosophical lens, developing arguments rooted in legal philosophy, legal theory, and various legal principles. The findings reveal that the principle of good faith in the operational cost recovery of production sharing contracts in Indonesia is governed at each stage of the contract to safeguard the interests of disadvantaged parties. This regulation addresses the essential principle of good faith that all parties must adhere to in order to guarantee the equitable execution of rights and obligations. In the context of operational cost recovery for production sharing contracts in Indonesia, good faith is characterized by adherence to and compliance with audit results, reflecting a commitment to the proper execution of the business contract's terms. The operational cost recovery system is anticipated to serve as a reimbursement mechanism for expenses associated with oil and gas production.

Abstract

Salah satu kewajiban orangtua pasca terjadinya perkawinan adalah memelihara, melindungi, mendidik dan mengasuh anak hingga dewasa. Penentuan orang yang mengasuh anak pasca perceraian sangat ditentukan oleh putusan hakim. Adakalanya hak asuh anak diberikan kepada ibu dan ada pula hak asuh anak diberikan kepada ayah seperti putusan Nomor 55/Pdt.G/2012/Ms-Bna (kepada ibu dan ayah), Putusan Nomor 65/Pdt.G/2011/MS-Bna (kepada ayah), Putusan Nomor 66/Pdt.G/2012/MS-Bna (kepada ayah), Putusan Nomor 225/Pdt.G/2009/MS-BNA (kepada ibu), Putusan Nomor 261/Pdt.G/2010/MS-BNA (kepada ibu). Penelitian ini bertujuan untuk mengetahui dasar pertimbangan hakim menetapkan pengasuh anak, tinjauan yuridis dan konsekuensi hukum terhadap penetapan hak asuh anak pasca perceraian. Penelitian normatif ini menggunakan bahan hukum primer berupa UU No. 1 Tahun 1974, bahan hukum sekunder berupa putusan hakim dan bahan hukum tersier berupa kamus dan eksiklopedia hukum. Penyajian data dilakukan secara deskriptif dan metode analisis data secara kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan hakim menetapkan pengasuh anak pasca perceraian yaitu: adanya tuntutan dari penggugat/tergugat (pemohon/termohon), melalui putusan verstek, demi kepentingan terbaik bagi anak. Penetapan ibu atau ayah sebagai pengasuh anak tidak bertentangan dengan peraturan perundang-undangan yang berlaku selama menjamin kepentingan terbaik bagi anak dan baik ibu maupun ayah memiliki hak untuk mengasuh anak meskipun ibu orang yang lebih berhak mengasuhnya. Disarankan kepada hakim agar dalam memutuskan pengasuh anak tidak hanya memperhatikan jenis kelamin orangtua, akan tetapi harus menjamin kepentingan terbaik bagi anak. Disarankan kepada pengambil kebijakan agar menjadi kajian ini sebagai referensi dalam merumuskan kebijakan baru dan disarankan kepada orangtua agar tidak memperebutkan hak asuh anak jikalau tidak mampu mengasuhnya dengan baik.

Abstract

This study starts with the existence of social conflict and the importance of resolving social conflict between oil palm plantation companies through the empowerment of local workers. For the sustainability of the oil palm plantation business and improving people’s welfare. Article 74 paragraph (2) of Law Number 40 of 2007 concerning Limited Liability Companies (UUPT) and Article 2, paragraph (1) letter e of Law Number 19 of 2003 concerning State-Owned Enterprises. Although efforts to resolve the conflict between the community and oil palm plantation companies in West Aceh have been made, the conflict has not been resolved until now. This study aims to analyze the obstacles to resolving social conflict between the community and oil palm plantation companies in West Aceh. This study uses a sociological legal approach to look more deeply at the effectiveness of law in society. The study uses primary data and secondary data as well as field data in West Aceh. The results of the study indicate that the obstacles to resolving the conflict between the community and oil palm plantation companies in West Aceh are because many productive-age villagers are not working and the empowerment program is not running effectively. This study produces a model for empowering local workers through CSR budgets to provide job training to productive age people aged 18-35 years so that productive age people have skills that can encourage them to live independently and improve their quality of life.

Abstract

Cross-border insolvency is regulated by Law Number 37 of 2004 Concerning Bankruptcy and Suspension of Obligations for Payment of Debt (UUK-PKPU) in Indonesia. This law applies to situations where foreign parties are involved and the case extends beyond national and regional borders. The focus of this article is to examine the treatment of assets located abroad. Indonesia follows the territoriality principle, which means that the debtor's assets in foreign jurisdictions cannot be transferred to other countries unless bankruptcy decisions made by those countries are recognized. This study adopts a normative juridical research method to gather relevant materials such as concepts, theories, laws, and regulations pertaining to the subject matter. Due to the varying rules in each jurisdiction, it is challenging to determine the status of assets located in foreign countries. The key issue lies in whether domestic bankruptcy decisions are acknowledged and enforced in other jurisdictions, and vice versa. In conclusion, Indonesia should consider revising its cross-border bankruptcy laws and entering into international agreements or conventions to address these challenges effectively.

Abstract

This paper aims to find out the arrangements regarding the protection of foreign direct investment and the consistency between the arrangements contained in the rules against the fair and equitable treatment principle in Indonesia. This study used normative legal research, and found that the regulatory policy regarding the protection of foreign direct investment in Indonesia as stated in article 6 of law number 25 of 2007 concerning investment is not in accordance to fair and equitable treatment principle. The Indonesian government must pour out matters related to transparency and the absence of overlapping rules so as to create better protection by providing clear legal certainty to investors.

Abstract

The article 1 paragraph (2) the regulation No 11 of  2006 concerning the Aceh Government (UUPA), Aceh is a provincial region which is a special legal community unit and is given special authority to regulate and manage its own government affairs and the interests of the Acehnese people. Mukim is a form of government in Aceh which is recognized its existance based on the Regulation No 44 of 1999 concerning the Implementation of the Prefentiality Province of the Aceh Prefential Region and UUPA. The legal provision for customary forest management, the Mukim and Gampong have the right to control customary forests in their area for the benefit of their members or people outside the community. This research aims to identify the division of Mukim and Gampong areas in customary forest management.  The research method used is empirical juridical.  The data was obtained through the field research by means of observation, direct interviews with respondents, reviewing applicable legal provisions and what has happened in people's lives. The research result shows that Mukim and Gampong have their area boundaries themselves which strengthen the division of Mukim and Gampong positions to provide accuracy regarding the control and management of customary forests in their areas, one of them is fulfilling the customary forest management.  The division of Mukim area from the hereditary have been exists alrady, but there is still a discourse where the government does not have the same perception as the Mukim customary forests because they think there is a legal basis but it is still invalid or it has not accurate to state the mukim adat areas.
